해수면 상승이 유엔해양법협약 적용에 미치는 영향 분석 (Analysis on the Legal Impacts of Sea-Level Rise for the Application of the UN Convention on the Law of the Sea)

  • 기후변화로 인하여 해수면 상승이 발생하고 있고, 그로 인한 악영향에 대해 연안국을 비롯한 국제사회의 우려가 커지고 있다. 해수면 상승으로 해안선이 후퇴하고 섬등 해양지형물이 수몰되는 경우 그러한 해안선을 기점으로 설정된 연안국 관할해역 외측한계의 변경 가능성, 기존 해양경계획정조약의 개정 필요성, 섬 또는 암석이 암석 또는 수중암초로 변경됨에 따른 법적 지위의 변화 등 많은 국제해양법적 쟁점을 발생시키고 있다. 이 논문에서는 해수면 상승이 국제해양법에 미치는 효과에 한정하여, 쟁점별로 소도서개발도상국, 세계국제법학회, 유엔 국제법위원회의 주장을 검토하고 유엔해양법협약의 해석론적 측면에서 해결방안을 제시하였다.

미국의 승강기 인증·검사체계의 현황과 시사점 (A Current State and an Implication of an Elevator Certification and Inspection System in U.S.A.)

  • An undeniable reason for elevator accidents is relevant to diverse defects of elevator itself including a fatal flaw in its managing system. In order to prevent and control disastrous accidents, Korean government established brand new department, Ministry of Public Safety and Security(MPSS) in 2014. For the field of elevator accidents, MPSS, hoping to take the lead, tries to reform related law and statutes. At this time, it is worthwhile to review foreign country's precedent to find out its applicable lesson. This study specially focuses on introducing U.S. legal system dealing with elevator safety area from the viewpoint of stressing the identity of local governments such as state, county, city etc. This article mainly reviews these four points: i) a current state of safety code, guide, standard for elevator in U.S.A. ii) an elevator parts certification system under ASME A.17.1, iii) an elevator inspection system in New York City, iv) an implication of an elevator certification and inspection system in U.S.A. to us.

  • Recently as the rapid increasing of the elderly, silver housing has grown up. Though much fire evacuation and safety law, fire accident is most dangerous problem in our society. So this study is the purpose to analyze evacuation safety in urban silver housing of floor planning by corridor types using human behavior simulation. The methodology of this study is 'Literature Review' and 'Simulation'. This study has been carried out on silver housing's definition, types, fire safety theory and relation law. To proof evacuation safety, this study measured escaping time, longest distance, and bottleneck counting using human behavior simulation. This study use game engine simulation program to analyze 6 corridor types experimental model. As the result of simulation, this study compare between ASET and simulation result. The result come down to 3 part. First, double loaded corridor type is the most dangerous on urban silver housing. Second, Safe shelter's location and number cause increasing of escaping time. Lastly escaping time is influenced by behavior of agent, bottle neck strike frequency.

도심 고층건축물 고도제한규제의 합리성 모색에 관한 연구 (A study on the rationale of regulating the high elevation building)

  • 현행 군용항공기지법에 따라서 설정된 비행안전구역 밖에 위치한 건축물에는 동 법령이 적용될 수 없다. 또한 건축물의 허가제한조치는 특정 건축물을 대상으로 취해지는 조치가 아니라, 특정 지역이나 구역을 대상으로 계획행정의 차원에서 이루어지는 것이기 때문에, 특정 건축물에 대해서 허가제한조치를 발동하는 것은 여러 가지 차원에서 적절하지가 않다. 현행 법령의 규정만으로는 양 당사자간의 권리 충돌을 조정할 수가 없다고 보아야 하며, 건축하려고 하는 자가 적정한 대가를 지불하게 하는 방식 등을 통해서 비용과 편익의 비교가 가능하게 되는 방식을 모색하는 것이 바람직하다.

유해작업 사내도급 금지와 관련된 논란 및 개정방안에 관한 고찰 (A Review on Recent Debate on Proposals of Amendment of the Article of Prohibition of Inhouse-Contract for Harmful Work in the Industrial Safety and Health Act)

  • Objectives: The purpose of this study is to review the debate on the Article 28(Prohibition of Inhouse-Contract for Harmful Work) of the Industrial Safety and Health Law. Methods: Literatures and recent debate for prohibition and permission of inhouse-contract for harmful work were reviewed. Proposals of revision for the Article 28 of the Industrial Safety and Health Law were also reviewed. Results: It was not found reasonable to revise the Article 28 based on increased fatal accidents or diseases in the electroplating work and heavy metals handling works that are currently listed in the Presidential Decree under the law as the harmful works. Regulation types of prohibition or authorization for any harmful work shall have inherently poor coverage since the scope of application is extremely limited. Contractors for maintenance and repair of chemical facilities may not be included in the scope of application if the harmful works are defined as chemical handling works. If harmful works are prohibited, the contractor workers may loose their jobs. Therefore, it is necessary to consider balancing job security and occupational safety and health safety. Conclusions: Various limitations were found in the Article 28 and the proposals to revise it. Currently in-house subcontracting is widely spread in the workplace. Therefore, it may be inappropriate to set one or two Article such as the Article 28 and 29 to protect in-house subcontract workers from injury and illness. It is believed that it needs fundamental redirection and new approach with new paradigm to impose occupational safety and health duty to prime contractors.

제품안전을 위한 제조물책임(PL)에 관한 연구 (A Study on the Product Liability for Product Safety)

  • In July 2002, law of product liability will be established in Korea. Therefore, prevention for product liability(PL) will be immediately needed for many companies. So, in this paper, following topics will be discussed: 1) what are product liability and product safety, 2) why they are needed, 3) why important, 4) what's the difference between considering PL and not considering PL for companies, 5 ) what are risk management methods and risk evaluation system, 6) what is SASA(Systematic Approach to Accident Scenario Analysis) method for applying PL, 7) providing a final conclusion and discussion for future PL law.

건설현장 화재예방에 관한 연구 - 용접작업을 중심으로 - (A Study on the Fire Prevention of the Construction Sites)

  • Current fire safety in the construction sites has developed piecemeal over a considerable period of time. However, the law and regulation of fire safety is insufficient to protect fro in the construction sites. The frequency of fire in the construction sites is very rare but it brings longterm deterioration durability of building structure and large scale industrial calamity. There are many process of works and each work deals with many kind of flammable material, so it is very difficult to find a proper safety fire prevention. This study executed the questionnaire and fire experiment of the welding work to provide effective fire prevention counterplan.

항공안전을 강화하기 위한 소프트웨어 안전성 법제도 방안 (The Legal System Method of Software Safety to Strengthen Aviation Safety)

  • 지식 정보 기술력 중심의 지식기반 경제 원천인 소프트웨어로 인한 결함은 항공기의 운용에 핵심 역할을 수행하는 엔진에 영향을 준다. 따라서 소프트웨어의 안전성분석을 통해 항공안전을 강화하여 결함으로부터의 위험을 최소화해야 한다. 본 논문에서는 항공기 결함과 소프트웨어 안전성 법 제도를 살펴보고 항공안전을 강화하기 위한 법 제도 개선 및 제정 방안을 제안한다. 안전성분석과 관련된 용어 정립, 안전성이 포함된 품질인증 기준, 안전성분석서를 첨부해야 하는 품질인증 신청, 평가 및 인증기관 세부지침 개정 등의 항목으로 기존 법 제도를 개선해야 한다. 또한, 소프트웨어 평가 및 인증 의무화, 소프트웨어 생명주기에 다른 지속적 평가, 표준화된 개발방법론 도입 의무화, 고급인력 양성 제도 강화 등의 항목으로 신규 법 제도를 제정해야한다. 소프트웨어 안전성과 관련된 기존 법 제도를 개선하고 신규 법 제도를 제정하여 소프트웨어의 품질 향상과 강화된 항공안전을 기대할 수 있다.

Application of two different similarity laws for the RVACS design

  • The RVACS is a versatile and robust safety system driven by two natural circulations: in-vessel coolant and ex-vessel air. To observe interaction between the two natural circulations, SINCRO-IT facility was designed with two different similarity laws simultaneously. Bo' based similarity law was employed for the in-vessel, while Ishii's similarity law for the ex-vessel excluding the radiation. Compared to the prototype, the sodium and air system, SINCRO-IT was designed with Wood's metal and air, having 1:4 of the length reduction, and 1.68:1 of the time scale ratio. For the steady state, RV temperature limit was violated at 0.8% of the decay heat, while the sodium boiling was predicted at 1.3%. It showed good accordance with the system code, TRACE. For an arbitrary re-criticality scenario with RVACS solitary operation, sodium boiling was predicted at 25,100 s after power increase from 1.0 to 2.0%, while the system code showed 30,300. Maximum temperature discrepancy between the experiments and system code was 4.2%. The design and methodology were validated by the system code TRACE in terms of the convection, and simultaneously, the system code was validated against the simulating experiments SINCRO-IT. The validated RVACS model could be imported to further accident analysis.

The regulatory system for imported-cargo radiation monitoring in Korea and a proposal for its improvement

  • To protect people and the environment from environmental radiation, the Act on Protective Action Guidelines against Radiation in the Natural Environment was formulated in Korea in 2011. This law regulates matters related to radiation safety that can be encountered in life. In accordance with this law, radiation monitoring equipment is operated at major airports and ports across the country, ensuring radiation monitoring of imported cargo. Currently, six ministries conduct radiation monitoring of imported cargo: the Nuclear Safety and Security Commission; the Korea Customs Service; the Ministry of Food and Drug Safety; the Ministry of Environment; the Ministry of Agriculture, Food and Rural Affairs; and the Korea Forest Service. Each ministry designates the relevant cargo items for radiation monitoring. The objective of this study was to comprehensively review the Korean radiation monitoring system for imported cargo and identify the areas and scopes of improvement. This paper also proposes a new law and an integrated supervision plan, which involves establishing a dedicated department to enhance the efficiency and professionalism of the national radiation monitoring system for imported cargo. The review will contribute to the development of a more sophisticated national radiation monitoring system for imported cargo.
