우리나라의 해양경계 설정에 관한 연구 (A Study on the establishment of Korean maritime boundaries)

  • Since public awareness on the importance of sea is increasing, a number of states have ratified the United Nations Convention on the Law of the Sea. However several problems on marine boundary making are raising due to the ambiguity of law and importance of sea area. The purpose of this study is to find a logical principal through overall consideration on decision of baseline points which is a criteria of maritime boundary delimitation. Accordingly, this paper considers the current status, problems and measures for marine boundary making and then presents an alternative on it.

심해저 광물자원 개발과 해양환경보호를 위한 재정제도에 관한 연구 (A Study on the Financial System for Developing Mineral Resources and Protecting the Marine Environment in the Area)

  • For the commercial development of deep-sea mineral resources, the International Seabed Authority is engaged in wide ranging discussions to establish the Regulations on Exploitation. The core issue of the Regulations on Exploitation is how to protect the marine environment along with the royalty system that distributes the profits from such development. The United Nations Convention on the Law of the Sea stipulates the protection of the marine environment in Part 12 (Articles 192-237) for the preservation of the marine environment, and in the 1994 Implementation Agreement, the protection of the marine environment at the stage of application for approval of the plan of work together with the Regulations on Exploration for the protection of the marine environment. For this purpose, certain obligations are imposed on the applicants. In the Regulations on Exploitation, financial systems such as environmental performance guarantee, insurance, and environmental compensation funds, which were not found in the Regulations on Exploration, are added to further specify the measures for marine environment protection generally stipulated in the 1982 Law of the Convention or 1994 Implementation Agreement. Regarding the financial system for marine environment protection, the Marine Environmental Protection and Conservation Informal Working Group meeting is revising the purpose of the environmental compensation fund. Among these financial system elements, it is judged that there is a possibility that the environmental performance guarantee and insurance may overlap considerably, and it is also thought that the establishment of the environmental compensation fund can also provide a substantial sum of money that will meet the purpose of the compensation fund in terms of securing its financial resources. In this paper, the question is posed as to whether or not this can be accomplished. In this respect, this paper examines the environmental performance guarantee, insurance, and environmental compensation fund, which are necessary for the protection of the marine environment of the deep seabed, but which can impose appropriate obligations on contractors for the commercial development of deep seabed mineral resources. At the same time as figuring out how it is operated in relation to relevant domestic laws, I would like to propose a plan to reflect the implications derived from the domestic law operation process in the Regulations on Exploitation.

동북아 수역의 신 어업질서 성립과 향후 과제 (The Future Tasks for Reorganization of International Fisheries Order between Korea, China and Japan in Northeast Asian Seas)

  • This study aimed to review the reorganization of fisheries and the future tasks in accordance with the establishment of new fishery order in the Northeast Asian Seas. As the United Nations Convention on the Law of the Sea, which recognized the sovereign rights of Coastal States in a 200-nautical mile exclusive economic zone (EEZ), entered into force in 1994, the three countries of Korea, China and Japan ratified the United Nations Convention on the Law of the Sea in 1996 and started negotiations to establish a new fishery order consistent with the EEZ system. However, a conflict of interest occurred because of differences in fisheries between countries, negotiations many times have proceeded, resulting in the signing of fishery agreement between China and Japan in 1997, Korea and Japan in 1998, and Korea and China in 2000. Each fishery arrangement consists of a dual system of EEZ and provisional waters (middle waters, provisional waters). The two countries are engaged in mutual fishing based on coastal states in EEZ, and in the fishing operation under the principle of flag state in provisional waters. There are overlapping or ambiguous jurisdictions in the intermediate waters and provisional waters that are jointly available to both fisheries. The presence of these seas is a challenge to the establishment of a reasonable international fisheries management system for the entire Northeast Asian Seas. In this context, the challenges of the reorganization of the new fisheries order are as follows: 1) conversion to a fishery order for coexistence of fisheries, 2) expansion to an international fishery management system, and 3) establishment of a multilateral fishery cooperation system. Although the jurisdiction of their own waters has been expanded through the establishment of EEZ according to new fishery order, the need for mutual cooperation grows when considering the movement and migration of fishery resources, fishery management, fish consumption and trade. In addition to the fisheries cooperation between the governments, it is also necessary to revitalize the civil cooperation focused on fishermen who exploit fishing grounds together.

원양어업 옵서버 프로그램 운영현황과 개선방안 (Study on the status and improvement of national observer programs for Korean distant water fisheries)

  • After the United Nations Convention on the Law of the Sea (UNCLOS) and the United Nations Fish Stocks Agreement (UNFSA) came into effect, international cooperation through Regional Fisheries Management Organizations (RFMOs) was required, and each RFMO established and adopted the Conservation and Management Measure (CMM) for the regional Observer Programs to collect data on fishing activities and biological information and to monitor compliance with its CMMs. The observer coverage required by RFMO is set differently for each organization, ranging from 5% to 100%. In addition, tuna-RFMOs recommend increasing observer coverage in longline fisheries by at least 20% for reliable quantitative analysis of not only target species but also bycatch species and ecologically related species such as sharks, seabirds, sea turtles, and marine mammals. Therefore, in this study, we discussed ways to improve the national observer programs of Korean distant water fisheries that should be addressed in the future to respond to the RFMO trends.

국제법상 공해에서의 우리나라 해양경찰권에 관한 연구 (A Study on the Maritime Police Authority of Korea Coast Guard on the High Seas of International Law)

  • 우리나라의 해양경찰권이 미치는 해역은 크게 내수, 영해, 접속수역, 배타적 경제수역, 대륙붕(이하 "국내해역"이라 한다) 및 공해로 구분하고 있으며, 이 중 국내해역에서의 해양경찰권은 국제법인 "해양법에 관한 국제연합 협약"을 수용한 국내법을 따른다. 그 밖에 공해에서는 이 협약을 따르도록 하고 있다. 한편, 국내해역을 벗어난 공해에서는 자국 선박이외 외국선박에 있어서는 해적행위 등 이 협약에서 금지하고 있는 반인류적 범죄행위에 한해 제한적으로 관할권을 허용하고 있다. 하지만 공해상에서 연안국의 해양안보와 선박의 안전을 위협하는 외국선박의 불법행위는 반인류적 범죄 이외 여러 유형의 범죄(case)가 발생할 수 있고 명확한 명문규정 없이 이에 행사된 연안국의 관할권은 국가 간 분쟁을 가져올 수 있는 개연성이 높다 할 것이다. 따라서 본 논문에서는 공해상에서 국제 해양질서를 유지하고, 연안국의 해양경찰권을 안정적으로 확보하기 위한 제도적 개선방안에 대해 제시하고자 한다.

200해리 제도와 어업합작투자에 관한 소고 (A Study on the Overseas Investment of Fisheries under the 200 Nautical Miles System)

  • The international marine system was plunged into the age of divided occupation with the adoption of the United Nations Convention on Law of the Sea in April, 1982. The exclusive economic zone of 200 Nautical miles set up by the Convention confirms the assertions of many coastal states whose fishing industries are not well-developed. However, it is unfavorable to the countries whose fisheries are being carried on in deep-sea, because the coastal state has sovereign rights to conserve and manage living resources in it. Under the circumstances the Korean deep-sea fisheries had to find ways out of the difficulties. The ways may be divided into two ways, namely, licensed fishing and joint-venture fishing. The former type becomes unfavorable to foveign fisheries because of decreasing quarts, rising fees and remunerations. The latter type properly meets the wishes of countries concerned and has some merits. However, there is a possibility of bearing the risk in case of investment in developing countries. The insurance system is effective to make up for the loss from the risk, although not perfect. The deep-sea fisheries depressed now by accumulated difficulties need more financial support from the Goverment for the active promotion of overseas joint-venture.

국제법상 항공법과 우주법의 비교연구 (A Comparative Study of Air Law and Space Law in International Law)

  • 항공법과 우주법은 상호 관련성이 많으면서도 각자의 영역에서 꾸준하게 발전하여 왔다. 특히 국제법분야에서 두 분야의 발전은 괄목할 만하다. 항공법은 '항공공법'(public air law)과 '항공형법'(criminal air law) 그리고 '항공사법'(private air law)을 총칭하는 분야이다. 간혹 '항공운송법'(air transportation law)이라는 용어가 항공법을 대신하는 것처럼 사용되기도 하나 이것은 항공시점의 일부이다. 항공법 분야를 이해하기 위해서는 일반적인 법이론, 국내법, 유럽연합(EU)법, 학자들의 이론과 사례를 연구해야 하는 반면, 우주법의 경우는 우주조약을 비롯한 우주관련협약의 연구에만 제한되는 한계가 있다. 최근에 와서야 우주에 관한 국내법들이 제정되기 시작하였고, 우주법관련 사례들도 항공법에 비해 매우 적은 편이다. 본 연구는 이러한 두영역을 상호 비교하면서 차이점을 발견하고 21세기 항공법과 우주법의 발전과제들을 점검하고자 하는데 그 의의가 있다. 항공법과 우주법의 몇 가지 주제별 차이점에 관하여 다음과 같은 결론을 얻을 수 있다. 첫째, 항공분야에서는 공기구인 ICAO뿐만 아니라 사기구인 IATA도 제반 항공업무를 원활하게 하도록 하고 있는데 반해, 우주법은 COPUOS라고 하는 일종의 UN내의 위원회를 통하여 주로 법제정이 이루어지는 면에서 항공법보다는 매우 미흡한 단계에 있다. 우주활동이 활발해짐에 따라서 우주문제를 보편적으로 다룰 국제우주기구(International Space Organization)의 설립을 준비할 필요가 제기된다. 둘째, 항공법이 국가항공기 내지는 군용항공기를 제외하고 민간항공기에만 적용되고 있는 반면, 우주법은 모든 우주활동에 적용시키므로 민간우주선 뿐만 아니라 국가 우주선에 모두 적용되고 있다는 점에 큰 차이점이 발견된다. 이 문제도 우주활동이 점차 상업화함에 따라 민간우주선에만 적용되는 우주법제정이 필요한 시기가 도래할 것이다. 셋째, 국가주권면에서 볼 때 항공법에서는 영공주권이 매우 배타적으로 행사되고 있는 반면에 우주법에서는 국가들이 달과 모든 천체에 관한 우주활동에 관하여 자유를 가질 뿐만 아니라 천체를 전유할 수 없음을 천명하고 있고, 심지어는 1979년 달조약에서는 달과 다른 천체를 인류공동유산영역으로 선언하고 있다. 그러나 영공과 우주의 경계획정은 아직 확립되지 못한 상황은 서로 다른 법영역을 이해하는데 상당한 혼선을 빚고 있다. 마지막으로 책임문제에 관한 항공법과 우주법의 접근법은 항공법의 경우 항공운송이 활발해지고 발전됨에 따라 승객을 보호하는 법체제가 점차 발전되고 있고 지상손해에 관한 법규도 점차 발전되어 가고 있는 반면에 우주법에서는 우주운송법이 탄생되기에는 아직도 멀다고 할 수 있는데, 최근 러시아와 미국에서 우주관광객을 모집하여 우주산업을 마케팅화하고 현 시점에서 우주승객보호를 위한 국제법제정준비를 할 단계라고 생각한다. 우주활동에서의 책임문제는 항공법에서 절대책임원칙을 적용하는 지상손해에 대한 책임문제에 상당히 접근하고 있다.

동아시아 해양안보 : 해군력인가 해양법인가? (East Asian Maritime Security: Naval Power vs. Normative Power)

  • The security environment surrounding the East Asian seas is rapidly changing due to the naval arms race among coastal states. The arms race is likely to worsen the security dilemma of the countries involved, thus increasing the chances for armed conflicts. It is too early to tell how the contemporary naval arms race in the region will evolve. But, for sure, the level of uncertainty is increasingly becoming high and intense. At the same time, there is emerging a legal warfare or lawfare among the rival countries. In particular, the United States and China have been involved in a serious debate about the nature and scope of the right of innocent passage and freedom of navigation in other countries' maritime zones. In collaboration with its regional allies, the United States has also put normative pressures on China with its excessive claims in the South China Sea. The latest arbitral tribunal case between the Philippines and China illustrates the point. With both arms race and normative competition in play, the future of East Asian maritime security will remain very complex and uncertain.

갱생자원의 다자간 협력의 정치경제 :수산자원의 경우 (The Political Economy of Multilateral Cooperations in the Management of Renewable Resources : Fisheries Resources case)

  • This study raises the question about why do many international fisheries organizations or regional fisheries agreements come into existence, sustain, and develop prior to the internationally recognized institution such as United Nations Convention on the Law of the Sea(UNCLOS). In oder to solve the problem, I will investigate the characteristics of fisheries as renewable resources and propose the collusion model where it is based on the cost-benefit analysis. Especially, if once a fooall large number of fishing is implemented, they are immediately depleted. Consequently they are extinct and no longer exploitable. Thus each interest nations or participants will be better off if they are cooperative and will be worse off if they are competitive or noncooperative in a resource management. Therefore, many of the internationally recognized fisheries institutions and agreements have been made and developed in these days.

남중국해 중재판결 : 군사적 분쟁 고조인가 국제법적 해결의 증진인가? (PCA Ruling on SCS : Is it a Peaceful Solution or Cause of Military Tension?)

  • A unanimous Award has been issued on 12 July 2016 by the Arbitral Tribunal constituted under Annex VII to the United Nations Convention on the Law of the Sea in the arbitration instituted by the Republic of the Philippines against the People's Republic of China. The current security issues in the regional sea shall be carefully reflected to anticipate whether the Award could resolve the existing political conflict or rather will grow military tension in the region. The Award clearly directs the scope of delimiting maritime jurisdiction to coastal States in the Southern China sea, so it seems to help facilitating finding resolutions of regional disputes on maritime boundaries. On the other hand, there are several limitations in reality to implementation of the decisions included in the Award. USA could use the decisions to restrict military activities and exercise of unilateral maritime jurisdiction by China in the region, while China shall encounter guilt to illegitimacy of its activities as well as shaking the legal foundation of its policy in the region. Then the resolution of this dispute through application of international law would rather cause more political confusion. The intension of bringing the case to an international court were to resolve political difficulties. If, however, the political difficulties are not properly reflected in the legal decisions, such decision would possibly raise more political risks.
