컨테이너의 해상운송(海上運送)과 위험관리(危險管理)에 관한 연구(硏究) (A Study on the Risk Management of Container Transport at Sea)

  • 해상운송에 있어서 컨테이너화의 급진전한 발전으로 이전에 예상치 못했던 새로운 위험에 직면하게 되었다. 즉, 컨테이너 도난과 같은 모랄 리스크(moral risk), 컨테이너 멸실위험, 냉동컨테이너의 해동손해 등과 같은 위험이 있다. 이것은 컨테이너 운송인의 기업운영을 어렵게 하고 있다. 따라서 컨테이너의 해상운송시 발생할 수 있는 위험에 대해서 위험관리를 할 필요가 있다. 이에 본 논문에서는 위험관리 이론을 컨테이너의 해상운송위험에 적용하였으며, 위험분석방법으로서 하인리히의 도미노 이론을 도입하여 손해사례를 토대로 위험관리 기법의 선태문제에 대해서 고찰하였다. 이를 위해서 손해검정보고서를 이용하여 8개의 사례를 선별하였고, 각 사례별로 사고발생요인을 분서하여 하나의 요인을 제거함으로써 손실노출에 대비하였다. 그 결과 대부분의 사례에서 위험관리 기법 중 사후적 통제방안인 보험으로 전가가 이용되었음을 알 수 있었다.

  • Attempts were made to increase an efficiency of soil contamination investigation systems (SCISs) including Soil Network and Special Soil Contamination Management Facility Sites in Korea. In order to increase low efficiencies resulting from inappropriate SCISs, possible policy suggestions are driven based on the results from problem findings of Korean policy and comparisons of policies on industrialized countries including United States, United Kingdom, Germany, the Netherlands and Japan. First, functions of Soil Environment Conservation Act (SECA) on liability should be updated and reinforced to initiate a soil contamination investigation process for stakeholders including an owner(s) or a responsible party(ies) of the potentially soil contamination sites positively. Second, appropriate SCISs should be emerged for implementing the Soil Network and Special Soil Contamination Management Facility Sites properly. Stakeholders for the potentially contaminated sites should easily access and raise the soil contamination issues, and soil contamination investigation implemented by liable and profit environment (consulting) companies should be encouraged. Third, the soil contamination reporting system of SECA needs to change legally responsible. Further more, public announcement system showing soil quality of a site which exceeds a certain scale would be considerable. Fourth, liable environment (consulting) companies should legally execute Soil Environment Assessment of SECA.

CISG상 권리부적합에 대한 매수인의 구제권에 관한 연구 (A Study on the Buyer's Remedies in respect of Defects in Title under CISG)

  • This study describes the buyer's remedies regarding defects in title under CISG. Although CISG stipulates the seller's liability for the delivery of conforming goods physically at Art. 35 and legally at Art. 41 and Art. 42 respectively, the buyer's remedies are not distinguished between non-conformity governed by Art. 35 and defects in title governed by Art. 41 and Art. 42. If the seller does not fulfill his obligation under Art. 41 and Art. 42 to deliver goods which are free from third party claims, the buyer should pay attention to which remedies are available under CISG. Under CISG, for defects in title in the delivered goods, the buyer is entitled to require performance in Art. 46 (1) unless he has resorted to a remedy which is inconsistent with this requirement, to declare the contract avoided by strictly limiting the situation in which the failure by the seller to perform his obligation amounts to a fundamental breach of contract in Art. 49, to claim damages in Art. 74, and to suspend the performance of his obligation where it becomes apparent that the seller will not perform a substantial part of his obligation in Art. 71 (1). Unlike Art. 35 non-conformity, the buyer may not require delivery of substitute goods under Art. 46 (2), claim repair under Art. 46 (3), and declare price reduction for title defects under Art. 50.

외국의 우주보험 관련법 연구 (A Study on Space Insurance of Foreign nation's Law)

  • 최근에는 상업적 우주활동의 증가와 우주파편의 증가로 인해 그 위험성이 더욱 증대되고 있다. 우리나라에서도 지난 2009년과 2010년 두 번에 걸쳐 인공위성 발사하였으나, 모두 실패로 끝났다. 이에 따라 국내외적으로 위성 발사 실패에 따른 책임 규명에 대해 보상 논의가 활발하게 이루어졌다. 이러한 점에 비추어 볼 때 우주개발과 관련한 리스크 관리 장치로서의 우주보험에 대한 정확한 개념규정과 법적인 논의가 이루어져야 할 것이다. 우주보험과 관련하여 통상적으로 두 가지 형태가 가능하다. 첫째는 발사와 궤도진입과 관련한 보험이며, 두 번째는 제3자 손해에 대한 보험이다. 전자는 피해를 입은 위성의 소유자나 운영자를 보호하는 것이고, 후자는 사고로 인한 소유자나 운영자의 책임을 담보하거나 배상하는 것이다. 우주보험과 관련하여 국제조약이나 국제적 규범은 없지만, 미국을 비롯한 영국, 프랑스, 러시아, 한국 등 각국은 국내법을 통해 우주보험의 인수를 강제하고 있다. 특히, 미국은 1984년 상업우주개발법과 관련 법률에서 발사체를 운영하는 자격을 가진 사람에게 제3자 손해에 대한 보험을 인수하도록 하고 있다. 상업적 우주산업의 관행과 미국의 상업적 우주발사법에서는 위성의 고객과 발사제공자는 발사로 인한 재산적 손해, 신체적 부상이나 사망 위험에 대한 가정과 상호 책임면제에 합의해야 한다고 규정하고 있다. 이는 위성의 발사 실패나, 위성체를 손실하였을 때, 위성의 고객은 비록 발사제공자가 과실이 있다고 하더라도 발사제공자에세 배상을 요구할 수 없다는 의미일 것이다. 그리고 미국과 기타 우주발사국들은 부보된 보험액을 초과하는 경우 제3자 손해에 정부의 배상을 제공한다. 그러나 유인우주선에 대해서는 유인 우주선에서 포기조항이 요구되지 않으며, 동의를 통보해야만 한다. 위성고객이 발사 제공자에세 소송을 제기하는 것을 제한하는 미국법상 포기조항은 유인우주선에는 적용되지 않는다. 이같이 미국법에서는 우주활동과 관련된 보험문제에 대해서 비교적 상세하게 규정하게 있으나, 다른 국가에서는 다수가 보험을 인수하도록 요구하고 있으나 상세한 규정은 두지 않고 있다. 우리나라도 예외가 아니다. 그러나 향후 우주활동이 활발하게 이루어지 상업적 우주관광 등이 이루어짐에 따라 우주보험문제에 대해서도 심도 있게 논의가 이루어져야 할 것이다.

KSLV발사에 따른 제작 및 제3자피해 책임에 대한 우주법적 소고 (Legal Study for the KSLV launching - Products & Third Party Liability -)

  • 2007년 고흥 우주센타에서 우리가 만든 KSLV(Korea Small Launching Vehicle)이 발사될 예정이며, 우리나라의 우주개발을 체계적으로 진흥하고 우주물체를 효율적으로 이용관리하기 위하여'우주개발진흥법'이 제정되었고 효력을 발휘하고 있다. '우주개발진흥법'제3조 (1)항에서"정부는 다른 국가 및 국제기구와 대한민국이 맺은 우주 관련 조약을 지키며 우주공간의 평화적 이용을 도모한다."라고 규정하고 있는바, 대표적으로 우주조약(1967)과 책임협약(1972)등이 그 대표적인 국제협약들이다. 우주물체로 야기된 손해에 대한 책임협약 제2조에서 발사국은 자국의 우주물체에 대하여"지상(on the surface of the earth) 또는 비행중인 항공기(aircraft in flight)에서 발생된 손해에 대하여 절대적(absolutely liable)으로 배상할 책임이 있다고 규정하고 있다. 우주개발진흥법 제14조 (우주사고에 따른 손해배상책임)에는"우주물체를 발사한 자는 그 우주물체로 인한 우주사고에 따른 손해배상책임을 부담하여야 한다."는 규정은 발사허가의 문제를 넘어, 우주발사자에게 명백하게 책임을 부담하고 있는 것이다. 또한 우주책임협약(1972) 제2조에는 발사국(A launching State)이 배상책임의 주체가 되어 있다. 따라서, 현재 다른 나라의 사례에서 보면, 우주발사자는 제3자 피해 등에 대한 책임보험까지만 배상을 하고 그 보다 많은 배상액이 요구될 때에는 국가가 손해배상을 부담하는 체재로 수행하고 있다. 여기서, 우주발사자에게 제조물책임법을 적용시킬 수 있느냐의 문제가 제기된다. 우리나라는 2002년 7월 1일부터 시행하고 있다. KSLV개발에 있어서 KARl와 러시아제작사간 계약은 공동개발인지 기술이전개발 인지에 대한 명확한 이해가 부족하다. 특히, 러시아 회사들에 대한 책임면책에 대한 규정들이 없는 것으로 알고 있는데, 우주개발의 통념상 상호면책을 한다는 인식만으로 러시아 회사들의 제작 및 개발책임들을 면책할 수 있는 방안은 없다고 판단된다. 따라서, 명백한 책임면책 조항이 없다면, 러시아 회사들에 대하여, 한국의 제조물책임법이 적용될 수 있다고 판단된다. 가장 중요한 법적논점은 KARl와 주요부품업체간에 제조물책임법을 적용할 수 있는가에 대한 문제이다. KARl는 모 주요부품업체간의 물품구매계약특수조건에 대한 합의서 제17조에 제조물책임법에 대한 규정을 하고 있다. 참고로, Appalachian Insurance co. v. McDonnell Douglas 사례를 검토할 필요가 있는데, 본 사건은 Western Union Telegraph사 소유의 원거리 전기통신위성이 본 궤도 진입에 실패한 사례이다. Western Union의 보험회사는 완전한 손실로 간주하여 그 위성에 대해 Western Union 사에 1억 5백만 달러의 보험금을 지급하였다. 5개의 보험회사- Appalachian 보험 회사, Commonwealth 보험회사, Industrial Indemnity, Mutual Marine Office, Northbrook Excess & Surplus 보험회사 - 는 McDonnell Douglas와 Morton Thiokol 그리고 Hitco사를 상대로 과실과 제품에 대한 엄격한 책임을 물어 고소를 했다. Appalachian Insurance co. v. McDonnell Douglas사례를 참고로, KARl는 주요 제작업체의 제조물책임을 면책시켜주는 계약을 맺어야 한다. 주요제작업체가 제조물 책임을 면하기 위하여, 자비로 보험을 들게 되면 곧 KSLV 제작비만 증가하게 되기 때문이다. 따라서, Government Contractor Defense(정부계약자 항변)'의 법적개념을 적용시킬 수 있는지 여부에 대한 연구가 필요하다.

제3자의 행위에 의한 개인정보침해사고로 발생한 손해배상책임의 합리적 배분 (Rational Allocation of Liability for Damages in Personal Information Infringement by Third Party)

  • 해커와 같은 정보침해행위자에 의한 개인정보침해사고가 발생하여 손해가 생긴 경우, 정보주체는 통상적으로 가해자인 정보침해행위자보다는 정보처리자에게 손해배상을 청구할 것이고 정보처리자는 다시 자신이 정보보호업무를 위탁한 정보보호기업에게 구상청구를 할 것이다. 본 연구는 정보주체, 정보처리자, 정보보호기업간에 진행될 것으로 예상되는 손해배상청구의 연쇄가 결국 침해행위로 인한 피해자들 간에 책임의 전가를 위한 다툼에 불과하다는 점에서 정보주체의 손해에 대한 전보라는 일면적인 접근보다 정보보호산업 생태계를 구성하는 주체들간에 손해를 합리적으로 분배하기 위하여 손해배상문제를 다면적 관점에서 고찰해 본다. 또한 개인정보침해사고의 특성상 대량의 개인정보 침해가 발생한 경우 배상금액이 기업의 존폐에까지 영향을 미칠 정도로 커질 수 있기 때문에 손해에 대한 배상책임을 전적으로 피해자들에게만 부담시키는 것보다 사회도 일정부분 손해를 분담하기 위한 구체적이고 현실적인 방안이 필요함을 주장한다. 향후 본 연구에서 제기한 손해배상책임의 합리적 배분 방안에 대하여 충분한 사회적인 합의를 거쳐 구체적이고 객관적인 책임배분기준을 마련하고 이를 제도적 또는 법적으로 반영함으로써 손해배상책임의 예측가능성과 법적안정성을 확보하여야 한다.

Research on John School as a policy to prevent recidivism of online sex trafficking

  • Recently, President Donald Trump signed FOSTA (Fight Online Sex Trafficking Act) in April 11, 2018, which makes online service no more immune from civil liability for the action of third party facilitating sex trafficking content. Although it is also important to enhance security regulations and cognition on law, but it will be economically more effective to put more energy on preventing recidivism. For John School in Korea, it should increase implementation rate by putting core manpower and budget for preventing needs of sex purchase and then, check operation method and efficacy to improve the actual program. One way is first, empirical analysis and data is required on efficacy of John School program. Second, should have clear definition in Special Sex Trade Law. Third, more strick regulation for selecting participant is required. Fourth, more manpower and budget is required. Fifth, charging the participant for educational fee shall be reviewed. Sixth, educational program should be reviewed. The most important point of education is to make those criminals feel guilty about financially purchasing the sex, basically making them to recognize that it is ethically wrong. However, the current education system contains no clear explanation about the ethical issue of such problem but focusing more on other factors such as sexual disease and structural problem of sexual business. Therefore, this failed to deliver the right psychological training to those criminals without any ethical control. Knowing why women feel hurt when having unwanted sexual relationship by being paid is required part in terms of education for preventing sex trafficking.

미국 자동차보험에 있어서 무과실보험의 중재에 관한 고찰 - 미국 뉴욕주를 중심으로 - (A Study on No-Fault Arbitration in U.S.'s Automobile Insurance - Focus on the Case of New York State -)

  • No-fault automobile insurance system is a statutory scheme to provide automobile accident victims with compensation for certain expenses arising from personal injuries occurring in car accidents. New York State has enacted No-Fault Law to ensure that the injured in automobile accidents be paid rapidly by their own insurance company for medical expenses, lost earnings regardless of fault, replacing common law system of reparation for personal injuries under tort law. Its primary purpose is to facilitate compensation without the need to exhaust time-consuming litigation over establishing the existence of fault and the extent of damages. No-Fault Law allows arbitration as a method for settling the no-fault insurance disputes. No-fault arbitration, however, differs in a significant way from general arbitration system. First, No-Fault Law provides the parties with the option to submit any dispute involving no-fault automobile insurance to arbitration. Second, no-fault arbitration attempts to speed its procedure incorporating various methods. Third, the parties are required to seek review of arbitral awards by master arbitrator prior to seeking court's review. Fourth, the parties have right to bring de novo action in court if master arbitrator's award exceeds $5,000. Given the current state of law in Korea, it may not be easy to introduce no-fault arbitration system into Korea in the context of automobile insurance disputes settlement as its law has a long-established reparation system based on tort liability and no-fault arbitration system has its own features that differ from general arbitration system. Nonetheless, it could be suggested that no-fault arbitration be introduced in other fields which require speedy dispute resolution and a third party's decision to settle the disputes. The optional right of submitting disputes to arbitration as provided by No-Fault Law of New York State may offer a ground to supprot the effectiveness of an optional arbitration agreement.

2011년 주요 의료 판결 분석 (Review of 2011 Major Medical Decisions)

  • According to the review and analysis of medical cases that are assigned to the Supreme Court and all local High Court in 2011 and that are presented in the media, it was found that the following categories were taken seriously, medical and pharmaceutical product liability, the third principle of trust between medical institutions, negligence and causation estimation, responsibility limit, the meaning of medical records and related judgment of disturbed substantiation, Oriental doctors' duties to explain the procedures, IMS events, whether one can claim for each medical care operated by non-physician health care institutions to the nonmedical domain in the National Health Insurance Corporation, and the basis of norms for each claim. In the cases related to medical pharmaceutical product liability, Supreme Court alleviated burden of proof for accidents with medical and pharmaceutical products prior to the practice of Product Liability Law and onset the point of negative prescription as the time of damage strikes to condition feasibility of the specific situation. In the cases related to the 3rd principle of trust between medical institutions, the Supreme Court refused to sentence the doctor who has trusted the judgment of the same third-party doctors the violations of the care duty. With respect to proof of a causal relationship and damages in a medical negligence case, the Supreme Court decided that it is unjust to deny negligence by the materials of causal relationship rejecting the original verdict and clarified that the causal relationship shall not deny the reasons to limit doctors' responsibilities. In order not put burden on patients with disadvantages in which medical records and the description of the practice or the most fundamental and important evidence to prove negligence and causation are being neglected, the Supreme Court admitted in the hospital's responsibility for the case of the neonate death of suffocation without properly listed fetal heart rate and uterine contraction monitor. On the other hand, the Seoul Western District Court has admitted alimony for altering and forging medical records. With respect to doctors' obligations to description, the Supreme Court decided that it is necessary to explain the foreseen risks by the combination of oriental and western medicines emphasizing the right of patient's self-determination. However, questions have arisen whether it is realistically feasible or not. In a case of an unlicensed doctor performing intramuscular stimulation treatment (IMS), the Supreme Court put off its decision if it was an unlicensed medical practice as to put limitation of eastern and western medical practices, but it declared that IMS practice was an acupuncture treatment therefore the plaintiff's conduct being an illegal act. In the future, clear judgment on this matter should be made. With respect to the claim of bills from non-physical health care institutions, the Supreme Court decided to void it for the implementation of the arrangement is contrary to the commitments made in the medical law and therefore, it is invalid to claim. In addition, contrast to the private healthcare professionals, who are subject to redemption according to the National Healthcare Insurance Law, the Seoul High Court explicitly confirmed that the non-professionals who receive the tort operating profit must return the unjust enrichment and have the liability for damages. As mentioned above, a relatively wide range of topics were discussed in medical field of 2011. In Korea's health care environment undergoing complex changes day by day, it is expected to see more diverse and in-depth discussions striding out to the development in the field of health care.

항공화물운송상(航空貨物運送狀)의 성질(性質)과 유통성(流通性) (The Character and Negotiability of Air Waybill)

  • The air waybill is supposed to be made out by the consignor. If the carrier makes it out, he is deemed, subject to proof to the contrary, to have done so on behalf of the consignor. The air waybill shall be made out in three original parts. The first part shall be marked "for the carrier", and shall be signed by the consignor. The second part shall be marked "for the consignee", it shall be signed by the consignor and by the carrier and shall accompany the goods. The third part shall be signed by the carrier and handed by him to the consignor, after the goods have been accepted. According to the original Warsow Convention article 8, the air waybill must contain 17 particulars or items. However, the Hague Protocol reduced to three the number of particulars required to appear on the air waybill. Only one item is obligatory, namely, the notice that the carriage is subject to the rules of the Warsaw Convention. The absence of the air waybill entails unlimited liability of the carrier because it deprives him of the right to avail himself of the provisions of the Warsaw Convention which exclude or limit his liability. The consignor shall be liable for all damages suffered by the carrier or any other person by reason of the irregularity, incorrectness or incompleteness of the particulars and statements in the air waybill. Although the contract of the carriage of goods by air is not a formal contract, the document of carriage is issued. The issue of air wayhill is not essential for the existence or validity of the contract, but serves merely as a means of proof. The Hague Protocol has lessened the consequences of the carrier's neglect to faithfully accomplish the required formalities. Henceforth, these formalities no longer constitute legal obligations. The air waybill is the consignment note used for the carriage of goods by air. It is often called an air consignment note and is not a document of title or transferable/negotiable instrument. It is basically a receipt for the goods for despatch and is prima facie evidence of the conditions of carriage. Each of the original parts of the air waybill has evidential value and possession of his part is a condition for the exercise by the consignor or cosignee of his rights under the contract of carriage. Oveall, it is an usage that under a documentary letter of credit, the consignee on the air waybill is the opening bank of the letter of credit, and the notify party is the importer who applied for the letter of credit. In Korea there is an usage as to process of cargo delivery in air transportation as follows: The carrier carries the cargo into the bonded area of the airport and gives both the notice of arrival of the cargo and the consignee's air waybill to the notify party who is the importer. Then the notify party obtains the Letter of Guarantee from the opening bank in exchange for reimbursing the amount of the letter of credit or tendering the security therefor to the opening bank. The notify party then presents this document to the customs authorities for the process of customs clearance. The opening bank becomes a consignee only to ensure repayment of the funds it has expended, and the only interest of the opening bank as consignee is the reimbursement of the money paid to the exporter under the documentary letter of credit. Just as the bill of lading in maritime law, the air waybill has always been considered negotiable although the Warsaw Convention does not emphasize this aspect of negotiability. However, the Hague Protocol article 4 corrected the situation by stating that "nothing in this Convention prevents the issue of a negotiable air waybill." This provision officially recognizes that the air waybill must meet the needs of the present day business circles by being a negotiable instrument. Meanwhile, Montreal Additional Protocol no. 4 has brought important changes. Registration by computer is acceptable and the parties to the contract of carriage are allowed to replace the air waybill with a receipt for the goods. In conclusion, as the Warsaw Convention has not details of provisions relating to the issuing of the negotiable air waybill, it is hoped that there should be supplement to the Warsaw Convention and establishment of international commercial usage with regard to the negotiable air waybill.
