A Study on the Properties of the DQI as a Participation Tool (DQI의 참여도구적 특성에 관한 연구)

  • This research suggests that the Design Quality Indicator for School(DQIfS) could be applied on the education facilities construction process not only as a building design assessment tool, but also as a participation tool. From the analyze of the background, the aims, the implementation processes and the case studies of the DQIfS, the results are: 1. DQI was formulated with the social requirement for the public participation in the public building design processes.; 2. DQI was articulated with the aim to involve the wide range of the stakeholders in the design processes, to hear the various opinions of the stakeholders, and to apply these opinions in the planning or the decision-making processes.; 3. In the implementation stage, it was found that the implementation methods of the DQIfS was devised to involve the wide range of the stakeholders. Moreover, the DQIfS has transformed its representation way to convey the results to the stakeholders and make a base for the discussion. 4. Through the case studies, it was found that the DQIfS was used with various participatory planning methods in the implementation process. Furthermore, the DQIfS was used as a main method to provide the basis of the discussion about the educational facility design. Thus, it could be concluded that DQIfS is a specialized participation tool for making participatory processes in the educational building design processes.

Customary Criteria on the Compliance Duty of Commercial Invoice in the Export Trade (수출거래(輸出去來)에서 상업송장(商業送狀)의 일치성의무(一致性義務)에 관한 관습적(慣習的) 해석기준(解釋基準))

  • Recently, the export claims related to the compliance of the commercial invoice are increasing. This paper aims to review the basic requirements of the invoice, and two theories on the document compliance, i.e., the strict compliance and the substantial compliance, and to analyse the substantial compliance of the invoice through some recent cases under the UCP 500, ICC's opinions and the International Standard Banking Practice (ISBP). As regards the compliance of the invoice, a majority of the cases has held that it must comply strictly with the credit terms ("strict compliance rule"). However, a minority of courts and credit industry standards such as the UCP and ISBP published by ICC take a different approach, infusing the credit law notions such as equity, "substantial compliance rule", etc. The extent of the substantial compliance of the invoice is particularly explained in the above-mentioned invoice paragraphs of the ISBP and supported by a large number of ICC's official opinions. Especially, the parties and descriptions in the invoice must correspond with those in the credit, being not inconsistent with the other documents. Other issues related to invoices such as a tolerance of the quantity, the amount, and the number of originals or copies, etc. must comply with the credit terms substantially.

  • To address threats to the natural environment, the government in Pakistan has banned the use of plastic bags for shopping. The concept of governmentality presented by Michel Foucault explores the techniques of governance and defines law not just as the manifestation of sovereign power but also as a technique of governance involving a range of organized practices designed to shape mentalities to achieve certain desired ends in subjects which claim to be for the welfare of the population. The present study explores the perceptions of the consumers regarding the rationality of the government behind the ban and also highlights the effectiveness of the use of law as a technique of governance. A qualitative approach was used by conducting fifteen interviews with young consumers selected through convenience sampling. The findings suggest that the rationality of the government behind the ban was received well by the consumers and the ban was viewed as a positive and pro-environmental step. The use of law as a technique of governance also proved to be effective in the said case because the people did not perceive the law as coercive despite the radical change it brought to their shopping practices. The present study contributes to the development of the theoretical understanding of governmentality and its sub-concept of the use of law as a technique of governance.

  • The dream is a well-known experience in the routine life. It is the image and thought being occurred during the sleep, and the complex reaction of our mental world to the event of everyday. In particular, there are so many opinions of the reason why people have a dream and this thesis is telling about the physical and pathological changes in the human as one of that various opinions. The aspects of this thesis are often founded in the diverse texts of oriental Medicine, including the Internal Classics(내경), and there were some cases that regarded the dream as diagnostic object and put to clinical uses. These attempts were not only tried out by particular orient thoght, also the ancient Greeks thought that the dream would represent important informations about the health. But, these ideas have been treated lightly by the impacts of the western medicine since the modern age. Straightforwardly, before the psycho-analytics was not development, most of the doctors and scientists regarded the dream as things like dregs of mind. The central operating bodies of the dream are the Spirit(신) and Hon and Beak(혼백), and the Spirit(신) is more essential part between the two.

A Study on Improvement of the School Space through Socio-Spatial Network Analysis (사회-공간 네트워크 분석을 활용한 초등학교 공간계획방향에 관한 연구)

  • The purpose of this study is to present the direction of the new space plan by reflecting the opinions of the user (student) in the existing standardized elementary school space planning. The purpose of this study is to investigate the activities of elementary school students by using socio - spatial network analysis method and to propose the direction of new elementary school space planning through the results. We analyzed the results of each centrality by using the analysis of closeness analysis, betweeness analysis, girvan-newman clustering, and concor analysis. The results of this study are as follows. First, it should be planned to use the classroom and the special room as one area by utilizing the corridor. Second, it should be planned that the outdoor space and the indoor space are closely related to each other by utilizing the hall, the lobby and the classroom. Third, the school should create a small space where physical activity is possible in an indoor space of the school. In order to improve the standardized elementary school space, this study proposes a method to reflect the opinions of the users in the school planning stage.

Sociocultural meanings of flapper look - Analyzed from The New York Times articles - (플래퍼 룩의 사회 문화적 의미 고찰 - The New York Times 기사를 중심으로 -)

  • The purpose of this study is to examine the sociocultural meanings of flapper look in American society during the 1920s. Using the ProQuest database, I searched articles from The New York Times published between 1920 and 1929 for opinions and discussions on the flapper look. Keywords included "clothing," "dress," "fashion," and "flapper," and advertisements and articles on menswear, leisurewear, and bathing suits were excluded. In the resulting articles, I extracted the following sociocultural meanings: autonomy, activeness, practicality, attractiveness, and extravagance. Meanings were analyzed from the opinions and discussions focusing on skirt length, dresses that directly and indirectly exposed the body, heavy make-up, non-constricting underwear, the H-line dress, bobbed hair, hygiene, comfort, and consumption. In sum, the 1920s flapper look represented progressive characteristics such as autonomous and active womanhood and practicality, which matched the technological development of the time. However, the flapper look was commercialized and exploited to make women look attractive and extravagant. Even though American women had access to higher education, more economic power, and suffrage in the 1920s, they were limited in their ability to overcome social conventions and the power of consumerism. Understanding the double-sidedness of flapper look within the social context of the time would enhance the comprehension of the relationship between women's lifestyles and changing fashion.

A Comparative Legal Study on the Battle of Forms (서식전쟁에 관한 비교법적 연구)

  • International sales contract, in general, is concluded through the exchange of written forms which contain each of their own business terms and conditions among the contractual parties. To illustrate, A sends the other an offer on A's general terms and conditions of business and B accepts the offer subject to the use of B's own general terms and conditions. Where the two sets of terms and conditions do not coincide, the question may arise whether the parties(A and B) have contracted and, if so, whose general terms and conditions apply. This situation is referred to as "the battle of forms". This article would try to make, in terms of the battle of forms, a comparison between the classical perspectives and opinions which are based on the principle of the English Common Law and the modernistic perspectives and opinions which are applied to the provisions in the UCC, CISG, and PICC. Therefore, the aim of this article is to provide the increase self-consciousness with respect to the battle of forms between the contractual parties that may frequently happen in the international business transactions and will pave the way for further research in the future.

Case Study on the Discrepancies of Bill of Lading under UCP 600 (UCP 600 이후 선화증권 하자관련 분쟁사례)

  • Bill of lading means the transport document ("marine", "ocean" or "port-to-port" or similar), however named, covering sea shipment only. Data in a bill of lading, when read in context with the credit, the document itself and international standard banking practice, need not be identical to, but must not conflict with, data in that document, any other stipulated document or the credit, according to UCP 600 and ISBP. This article has provided the general guideline of the discrepancies on the basis of UCP 600, ISBP 681 and the ICC Banking Commission Opinions, for the solution of the unpaid problems of the credit transactions. I have studied especially the ICC Banking Commission Opinions and the DOCDEX Decisions on the bill of lading after UCP 600, the international standard banking practice (ISBP 681), and the recent Korean cases. As such, this article would fill a need gap in the market between the general principles in the UCP provisions and the daily job of the practitioner. The credit practitioners are suggested to this resulting guidance whenever doubts arise as to how to check the credit documents in daily practice.

The Dwellers Opinions about their Preferred Element of Designs for Housing in order to Enhance the Level of Housing Environment (주거환경 계획을 위한 거주자 요구 조사 -김해시를 중심으로-)

  • This study was designed to know the dwellers opinions about their preferred element of for housing in order to enhance the level of environment through better housing plan. The main tasks of investigation were to: (1) determine the preferred elements of design for housing. (2) determine the usage of outdoor space dwellers prefer, (3) ascertain what kinds of management program and public facilities dwellers need. The sample, of 450 dwellers, was selected from the apartments in Kimhae. In complete questionnaires were not used in the analysis of data, thus, the total research sample consisted of 400 dwellers. The questionnare was developed by the researcher for this study. Data were collected during June 1996. Respones from 400 dwellers were processed by SAS package program using frequency counts, percentages and x2 to analyze the data. The major findings were: (1) that size of house, number of bed room, number of bath room, housing type that they want were significantly different according to the characteristic of the dwellers, (2) they preferred in individual heating system to the centralized heating system of the compound, and the preferrence differed significantly in accordance with what system they are using now, (3) they wanted to have more green zone than enlarging childrens' play ground or parking lot, (4) about the management program and public facilities they wanted, there was no significant difference according to the characteristic of the dwellers.

A Survey of the Behaviors on Fast Food Restaurants (편의식품 이용 실태에 관한 연구)

  • This study understands the actual conditions and problems for making traditional Korean food into the fast food. 1. Convenience to eat and nice atmosphere with friends (25%) are the best motive of visiting fast food restaurant. 2. The frequency of eating fast food is one to three times a month and the result of analysis on interrelation of human being in social anthropology represents that the fast food represents negative (-) interrelation by increasing of the age. The opinion about the fast food's nutrition is that the fast food lacks the nutrition (23.3%) and has excessive fat (40%). 3. The consumers were satisfied with the atmosphere of the fast food restaurant and unsatisfied with it's high prices. 4. The consumers' opinion on making the traditional food into a fast food was 66.4%. The consumers' opinions on traditional food to be improved are the sanitation (37.9%), the cookery (25%), the taste (11.7%), the nutrition (10.7%) and the opinions about inheritance of the traditional food is that 87.5% of people gave positive responses.
