A Study on Suggestions for Activating Smart Contract - Focusing on Software Export Business (스마트계약의 활성화 방안에 관한 연구 - 소프트웨어 수출사업을 중심으로)

  • The purpose of this study is to examine the extent to which smart contracts can be applied to the software export business and to find out the legislative issues to activate smart contracts. A smart contract is a computer program that automatically executes a contract when conditions are fulfilled. Smart contracts can play a pivotal role in the field that requires immediate execution of contract or in a highly standardized field with multiple parties involved. In the software export business, it is desirable to apply the smart contract partially rather than applying the smart contract to the entire process because various parties are involved and the process is very complicated. The business model of exporting packaged software, a completed software that is mainly licensed for use, rather than the business model of exporting customized software is suitable for using smart contracts because the project for implementing customized software is mainly focused in the development stage. When smart contracts are used in processes such as contract signing, payment, and project management, work efficiency can be increased. In addition, smart contracts can be used when conditions can be quantified, such as error penalties, in areas that previously required contracts with third parties such as banks, guarantors. In order for smart contracts to be actively used in practice, legal reviews on various issues are necessary including the legality of a smart contract and the validity as an electronic document of NFT (non-fungible token) certificate. Also, for the system stability preventing hacking, etc, the periodic verification or inspection by a third party is essential. To activate smart contracts in international transactions the international treaty regarding smart contracts is also necessary.

  • The purpose of this paper is to explore the scope of realization of multiple perspectives so that the implementation of the right to be forgotten is more realistic than the ideal information deletion concept. We examined domestic and foreign legal system and technology/service trends, and reflected the classification realization level of service realization, processing type and information characteristics of personal information processor, and legislative/technical factors for multi-level scope analysis. As a result, we have presented a matrix of the range of realization of the right to be forgotten and the scope of diversified regulation by the subject of protection. This study will be extended to the convergence of law and engineering, and will contribute to the prediction of social costs and expansion of the market by identifying the scope of 'deletion rights'.

A Legal & Institutional Supporting on Local Broadcast Development - Syntactic Approach about Special Act on the Development of Local Broadcasting (지역방송발전을 위한 법적·제도적 지원방안 -지역방송 발전지원 특별법의 성과와 한계를 중심으로)

  • According to the change in media environment, a support plan for local broadcast has been required. In terms of legal and institutional support for the development of local broadcast, the enactment of special Act for local broadcast has become a breakthrough. In this point of view, we analyzed the performance and the limitation of the special Act. As a literature research, analyzing the literature and related-ordinances, we have sought legal and institutional support plans for the local broadcast. As a result, with the Local Broadcast Development Council being in charge of legislative right and responsibility, a plan to empower them to have legal and institutional authority should be drawn; another plan to secure independence in operating a fund and to promote the capability to produce local broadcast programs and the distribution system should be drawn; the other elaborate plan for the locality index that assesses the locality is required. Local broadcast should be on a way to secure not only public interest and concern but locality and diversity; legal and institutional plans should be sought.

S. Korea's Approach Strategy through Policy Analysis of Major Countries to Promote the Use of Forest Biomass as Renewable Energy (재생에너지로서 산림바이오매스 활용 촉진을 위한 주요국의 정책분석을 통한 한국의 접근전략)

  • Forest biomass energy is based on scientific evidence in response to carbon neutrality and the climate crisis, international consensus, and environmental-geographic characteristics of each nation. In this study, the authors aimed to analyze macroscopic forest biomass energy policies for ten major countries. They categorized them into six detailed categories (Sustainable utilization, Cascading Uutilization, Replacement of fossil fuel/Carbon intensive products, Utilization of forest by-products/residues as the source of energy, Contribution to carbon-neutral/climate change, and Biomass combined with CCS/CCUS ). In addition, the surveyed nations have developed a policy consensus on the active use of forest biomass with sustainable forest management except for the cascading utilization category. Furthermore, the authors evaluated the mid to long-term plans of the Korean government for improvements in the policy and legal aspects. As a result, the authors derived four major directions that South Korea should approach strategically in the future (1) secure financial resources for sustainable forest management and stimulating investment in the timber industry, (2) promote unified policies to establish a bio-economy, (3) enhancement of the forest biomass energy system, and (4) reorganization and promotion of strategy centered on the opinions of field experts in internal and external instability.

Self-Directed Learning in the Workplace and Labor Education in South Korea: Implications for Legislation on Trade Union Education (일터 내 자기주도학습과 한국의 노동교육: 노동조합교육 법제화에 대한 함의)

  • The purpose of this study is to explore self-directed learning (SDL) in the workplace and to examine labor education in South Korea in order to draw the critical implications for legislation on trade union education (TUE). First, labor education in South Korea and its legal system were reviewed in a detailed way. Second, SDL in the workplace was closely analyzed from the perspectives of not only human resource development (HRD) but also adult education and lifelong learning. Third, based on the results of the comprehensive review, the implications of SDL in the workplace for worker-initiated labor education were discussed in terms of legislation on TUE in South Korea. Since legislation at the national level can promote workers' participation in TUE in the context of SDL for industrial democracy, TUE in South Korea should be provided with appropriate legislative, financial, and administrative support.

  • During the recent decades in democratic and industrialized countries, government policies for governing technological innovation and risks to environment and human health have undergone significant changes. The shift from a top-down legislative approach to a more inclusive and deliberative atmosphere is, putatively the most prominent change. Such a move is often described as a move from government to governance. In the governance of technology and risk, public engagement has been a major strategy in technology decision-making process. This article aims to look into the changes in the procedural modes of technology decision-making process. It discusses the main viewpoints that have been placed on the basis of such a move. Also, it further relates the changes in local decision-making process to science and technology decision-making at global level. It argues that the democratic and reflexive trends in local science and technology decision-making will be the basis upon which to shape and respond to global governance system: while international decision-making process would require accountability in integrating different values and rationalities, such accountability may be sustained and reinforced depending on the robustness of the local decisions and social choices.

A Study on the Construction of an Ideal Internet Fashion Cyber Mall Focused on Web Design, Merchandising and Management

  • The purpose of this study is to pinpoint currently arising issues concerning cyber fashion mall by analysing present status and contents of its web design, management and planning within the limits o business to customer (B2C) commerce, and to suggest a direction for building an ideal fashion mall on the internet. As for the study method, conceptual definitions were given based on previous studies. And a positive study was implemented, in which the cases of 23 chosen cyber fashion malls among 60 or so domestic and foreign malls selling fashion products were found by internet search engines and analysed. Results of the case analysis of cyber fashion malls are as follows : 1) cybermall must provide customers with an integrated service as well as e-commerce. 2) various products assortment and price differentiation must be developed, 3) the techniques of graphics, coloring and texturing, and layout design must be adopted to process and express product information, 4) the legislative system is needed to deal with the security, and 5) design and management of customer oriented interface are needed to process and express product information matter of electronic payment and customer protection. Considering the issues in internet fashion cybermalls, are suggested the important factors that are necessary or web design, planning and management to build an ideal cyber fashion mall. These results will contribute to the development of fashion e-commerce.

  • This study is focused on concepts and types of drilling investigating the scope of activity and problems the application of marine environment and safety acts related to deep-sea drilling for the development of the continental shelf in Korea. For the systemic development of subsea mineral resources, this study suggest a legislative proposal for the establishment of a separate law based on the UK Offshore Installation (Safety Case) regulation and improvement of the marine environment management act, maritime safety act and oil & mining safety regulation. Specially, this study emphasized on the necessity of establishing education, training and evaluation system according to the international certification training for the domestic work force based on accident cases related to overseas offshore plants.

  • As the importance of technology protection is emphasized day by day, various protection measures are being carried out to protect technology. But attempts to leak technology are continuing. As an alternative to this, stronger punishment is socially required for technology leakage crimes. In response to these social demands, the standard for punishment has been steadily raised. Legislative bills containing additional reinforcement are still pending in the National Assembly. However, in order to substantially enhance the deterrence against crime, it is not enough to strengthen the punishment standards. The effect can only be fully exercised when the certainty of punishment increases. Therefore, this paper focused on seeking ways to increase the certainty of punishment under the current system rather than the reinforcement of the punishment itself. The purpose of this study was to derive the reason why the innocence rate in technology leakage criminal cases is higher than that of general criminal cases by analyzing cases and causes of innocent cases in technology leakage criminal cases. Based on this, I discussed improvement considerations to reduce unfair acquittal cases.

Evaluation and Tasks of FTA Domestic Supplementary Measures in the Area of Agriculture and Livestock Industry (FTA 국내보완대책의 평가와 과제: 농·축산업분야를 중심으로)

  • This study closely examines domestic supplementary measures implemented for Free Trade Agreements (FTA) concerning the agriculture and livestock industry and finds out their problems and put forward improvement measures in terms of their system and contents. The systematic problems with previously established supplementary measures are as follows. First, the existing short and long term measures does not comply with each FTA's special and unique economical, political and legislative purpose. Secondly, they focus on improvements for individual FTAs. They must be holistic and integrative considering all FTAs, thus producing synergy to reach better policy overall. Lastly, FTA policies and the measures must reflect the expanding size and scope of regional economic integration. Problems or concerns in existing supplementary measures include first, flexible financing. The government hands out loans to players in the industry based on assets but these loans must be flexible to market interest changes and must include reduced mortgage rate options. Secondly, rigid standards that trigger direct loss prevention, establishing maximum and minimum loan limits, and developing a comprehensive standard for identifying crops to support are all problems that need to be addressed. Thirdly, education of next and future agricultural generation is paramount in building a competitive workforce. Fourthly, the government must identify industries lacking in performance or short in supply to cease or reducing funding. Last but not least, the government should actively search for new markets for export and produce long term road maps for export growth.
