자성분야의 특허출원동향과 특허 권리범위 작성 (The Trend of Patent Application in Magnetism Part and the Filing of Patent Claim)

  • 최근 특허의 권리는 각 나라의 경쟁력에 지대한 영향을 미치고 있다. 특히 첨단기술 분야에 원천기술을 갖고 있다면 그 나라의 기술경쟁력은 우위를 차지하고 있다고 말할 수 있다 앞으로 우리 나라의 연구소나 대학의 연구결과가 특허 출원과 연관되어야, 정부출연 연구비의 투자가 국가 기술력을 증진시킬 것이다 자기기록매체분야는 자성의 특성을 조절하기 위해 합금매체를 사용하게 되는데, 이와 같은 합금은 특허출원명세서 작성 시 주의해야한다. 특히 동일성을 회피하기 위한 청구범위의 작성에 유념해야 한다. 즉, 합금발명의 특허성은 (1)합금성분의 조성범위 및 필요에 따른 조직상태 (2) 그 합금만이 가지고 있는 고유한 성질 또는/및 용도의 각 사항에 의해서 판단하므로 합금발명의 성립 내지 완성은 기계·기구 등 타 분야에 비해 엄격한 기준이 적용되고 있음을 주의할 필요가 있다.

금려환(錦儷丸)의 현미감정 연구 (Microscopic Identification of the Chinese Patent Medicine 'Geum Ryeo Hwan')

  • Geum Ryeo Hwan(錦儷丸) is Chinese patent medicine which has been used for women's diseases and climacteric syndrome in Korea. It consists of 12 kinds of powdered crude drugs. In powdered crude drugs, it is hard to identify each component by chemical analysis or morphological examination. However, the method of identification of powdered crude drugs has not been clearly established. Therefore, it is of interest to establish the microscopic method for identification of powdered crude drugs of Chinese patent medicines. The effectiveness of microscopic method is exemplified by the identification of tissue and contents of crude drugs by comparison with standard drugs. Moreover, this method has advantage as a microscale analysis, since it requires only a small amount of specimens. In this study, it is demonstrated that the microscopic method is very effective for the identification of 12 crude drug ingredients in Geum Ryeo Hwan.

  • Ah Myeong Dan (兒明丹) is Chinese patent medicine which is used for congenital fever and congenital boils in Korea. It consists of 11 kinds of powdered crude drugs. In powdered crude drugs, it is hard to identify each component by chemical analysis or morphological examination.   • 국가나 기업이 보유한 정보통신 기술을 국제 표준에 반영하기 위한 표준화 활동은 국가의 산업 발전은 물론 기업의 생존이 걸린 중요한 문제라고 할 수 있다. 또한, 선진국은 자국의 기술을 국제표준에 반영하기 위하여 치열한 경쟁을 하고 있으며, 특히 정보통신 시장을 주도할 핵심 원천기술을 개발하고 이를 표준에 반영하는 표준특허 확보에 총력을 기울이고 있다. 이러한 환경에서 우리나라가 21세기 지식정보사회에서 지식정보강국으로 도약하고, 세계 정보통신 시장에서 주도적인 위치를 확보하기 위해서는 정보통신시장을 주도할 핵심기술에 대한 국제 표준화를 추진하는 정보통신 표준화 전략 수립 및 체계적인 추진이 필요하다. 따라서 본 논문에서는 그동안 단편적인 접근에서 벗어나 기술개발 기획에서 세계시장 선점까지의 표준특허 확보를 위한 종합적인 전략 수립에 대한 체계적이고 종합적인 접근방법을 제시하여, 국내 개발기술의 국제 표준화를 촉진하고 표준화 활동의 초석을 마련하는 것을 목적으로 한다.

특허풀에서의 공평한 로열티 분배를 위한 특허가치평가 (Patent Valuation for Fair Royalty Distribution in Patent Pool)

  • 본 논문에서는 특허풀 내에서 공평한 로열티 분배를 위한 특허가치평가 방안에 대하여 살펴보고자 한다. 지식기반경제에서는 지적재산, 즉 축적된 기술과 노하우가 기업의 경쟁력과 국가의 경제성장의 가장 중요한 원천으로 인식되고 있다. 특허제도는 특허권자에게 독점적인 권리를 부여함으로써 기술혁신, 즉 새로운 기술의 발명과 상업화를 촉진시켜 궁극적으로 삶의 수준을 향상시키는 것을 목표로 하고 있다. 하지만 특허권의 숫자가 증가하고 특허권의 소유가 분산되면서 나타나는 특허제도의 문제점들이 기술혁신 의욕을 저하시키고 있다. 이에 대한 유망한 해결책으로 특허풀이 제시되고 있으며, 1차 세계대전 당시 미국정부가 특허풀을 결성하여 항공기 관련특허를 모든 생산업체들에게 라이선스함으로써 항공기 산업을 활성화시킨 사례가 있다. 특허풀의 원활한 운영을 위해서는 특허풀에 참여하는 특허들의 기술적 기여도를 평가하여 특허권자들에게 공평하게 로열티 수입을 분배할 필요가 있다. 이러한 특허가치평가에는 Rating/Ranking 방법이 적절한 것으로 보인다. 본 논문에서는 여러 특허가치평가 기관들의 평가모형들을 살펴보고 Rating/Ranking 방법에 활용될 수 있는 주요한 평가항목들을 추출하였다.

The Fingerprinting of Huangjinju Powder for Injection on Chinese Patent Medicine by XRD Fourier

  • The purpose is to study the identification method of Huangjinju powder for injection and the medicinal materials by the fingerprint off-ray Diffraction Fourier (XRDF). We used the same method on both the studying of Huangjinju and the medicinal materials. Then we selected a few components alignment to compare. We analyzed the data by setting up the deviation $d({\AA})$ as ${\pm}0.05$ to calculate the rate of special mark on the sample (Px) and on the patent (P). The special XRDF of Huangjinju$[d({\AA})/(I/I_0)]$ have 5 peaks that have not expressed in medicinal materials. Therefore Px is 22.73%. Flos Trollii Chinensis has 3 special marks and Px is 17.65%. Flos Chrysanthemi Indici has 1 special mark and Px is 3.57%. Its coincided interplanar spacing with the patent is $2.907{\AA}$. Flos Lonicerae Japonicae has 6 special marks and Px is 23.08%. Its special mark in the patent are 4.95/14 and 4.50/15, respectively. The P is 9.09%. Its coincided interplanar spacing with the patent is $2.910{\AA}\;and\;3.05{\AA}$, respectively. The number of special XRDF mark peaks of baicalin is 9 and Px is 18.37%. Its coincided interplanar spacing with the patent is $2.910{\AA}$. It has visible mark and specificity adopting XRDF fingerprint to identify Huangjinju and medicinal materials. Establishing the quality standard is a synthetic index that depends both on special marks in the medicinal materials of the patent and on the coincidence peak data.

ICT 분야 국가 R&D 과제의 특허 성과 분석 (Analysis of Performance of Patent for National R&D Project of ICT)

  • 급변하게 산업이 발전하면서 ICT 산업에 대한 중요성이 강조되고 ICT에 대한 연구개발 투자에 대한 성과를 파악하고자 하는 요구가 증가되고 있다. 연구개발 투자에 대한 성과는 주로 사업화, 매출, 인력 채용, 지적재산권 등을 중심으로 분석한다. 본 논문에서는 ICT 분야의 정부 과제 중 과제 수행 후 결과로 얻어지는 특허에 대한 출원 시간을 중심으로 성과를 분석하는 기법을 제시한다. 본 논문은 국가연구개발과제 중 ICT 분야 35,551건을 대상으로 4개의 세부기술과 한국산업표준 17개 분류로 세분화하여 특허 성과 소요 기간을 산출하는 방법을 제시한다. 분석 결과 통신 분야가 1.2년으로 기술사업화 활동이 가장 활발한 것으로 확인하였다.

부상기술 예측을 위한 특허키워드정보분석에 관한 연구 - GHG 기술 중심으로 (Patent Keyword Analysis for Forecasting Emerging Technology : GHG Technology)

  • As the importance of technology forecasting while countries and companies manage the R&D project is growing bigger, the methodology of technology forecasting has been diversified. One of the forecasting method is patent analysis. This research proposes quick forecasting process of emerging technology based on keyword approach using text mining. The forecasting process is following: First, the term-document matrix is extracted from patent documents by using text mining. Second, emerging technology keyword are extracted by analyzing the importance of word from utilizing mean values and standard deviation values of the term and the emerging trend of word discovered from time series information of the term. Next, association between terms is measured by using cosine similarity. finally, the keyword of emerging technology is selected in consequence of the synthesized result and we forecast the emerging technology according to the results. The technology forecasting process described in this paper can be applied to developing computerized technology forecasting system integrated with various results of other patent analysis for decision maker of company and country.

소아의 간접 서혜부 탈장 (Indirect Inguinal Hernia in Pediatric Patients)

  • Herniorrhaphy of Indirect inguinal hernia (IIH) is one of the most frequently performed surgical procedures in children. The overall incidence of inguinal hernias in childhood ranges from 0.8 to 4.4 %. The incidence is up to 10 times higher in boys than girls, especially much higher in premature infants. IIHs in children are basically an arrest of embryologic development rather than an acquired weakness, which explains the increased incidence in premature infants. In normal development, the processus vaginalis closes, obliterating the peritoneal opening of the internal ring between 36th and 40th week of gestation. This process is often incomplete, leaving a small patent processus in many newborns. However, closure continues postnatally, and the rate of patency is inversely proportional to age of the child. The presence of a patent processus vaginalis is a necessary but not sufficient variable in developing a congenital IIH. In other words, all congenital IIHs are preceded by a patent processus vaginalis, but not all patent processus vaginalis go on to become IIHs. The overall incidence of IIH in population is approximately 1 to 2 % and the incidence of a processus vaginalis is approximately 12 to 14%, clinically appreciable IIH should develop in approximately 8 to 12 % of patients with a patent processus vaginalis. Although the classic open inguinal hernia repair remains the gold standard for most pediatric surgeons, laparoscopic repair is being performed in many centers. Like open technique, laparoscopic technique is fundamentally a high ligation of the indirect hernia sac with or without internal ring ligation. The advantages of laparoscopic approach include the ease of examining the contralateral internal ring, the avoidance of access damage to vas and vessels during mobilization of cord, decreased operative time, and an ability to identify unsuspected direct or femoral hernias. Almost all groin hernias in children are IIHs and occur as a result of incomplete closure of processus vaginalis. The treatment is repair by high ligation of hernia sac, which can be done by an open or laparoscopic technique. The contralateral side can be explored by laparoscopy or left alone, open exploration is no longer indicated due to potential risk of infertility.

Individualized ibuprofen treatment using serial B-type natriuretic peptide measurement for symptomatic patent ductus arteriosus in very preterm infants

  • Purpose: Plasma level of B-type natriuretic peptide (BNP), an emerging, sensitive, and specific biomarker of hemodynamically significant patent ductus arteriosus (PDA), rapidly decreases in infants receiving cyclooxygenase inhibitors for ductal closure. We investigated the usefulness of serial BNP measurement as a guide for individual identification of early constrictive responses to ibuprofen in preterm infants with symptomatic PDA (sPDA). Methods: Before March 2010, the standard course of pharmacological treatment was initiated with indomethacin (or ibuprofen) and routinely followed by 2 additional doses at intervals of 24 hours. After April 2010, individualized pharmacological treatment was used, starting with the first dose of ibuprofen and withholding additional ibuprofen doses if the BNP concentration was <600 pg/mL and clinical symptoms of PDA improved. Results: The BNP-guided group received significantly fewer doses of ibuprofen than the standard group did during the first course of treatment and the entire study period. The need for further doses of cyclooxygenase inhibitors and for surgical ligation was not significantly different between the 2 groups. No significant differences were seen in clinical outcomes and/or complications related to sPDA and/or pharmacological treatment. Conclusion: Individualized BNP-guided pharmacological treatment may be used clinically to avoid unnecessary doses of cyclooxygenase inhibitors without increasing the ductal closure failure and the short-term morbidity related to sPDA.
