Charter flight in international air law has, from very beginning, not precisely defined by the International Civil Aviation Organization (lCAO) since 1947 when it came into being. By practice, the operation of charter traffic is, in its very beginning, the subject to the regulations of national rules and bilateral charter agreements (charter annex clause) within the framework of normal bilateral agreement of international air services. Taiwan had signed a series of bilateral air service agreement under the name of the Government of the Republic of China when Taiwan was recognized by the United Nations and major members of international community as the sole legal government representing China before 1971, but that situation was changed since then. Taiwan has only maintained diplomatic relations with 25 States, but maintained semi-official relations with major powers of the world. The former agreements were signed within the framework of the Vienna Convention on the Law of Treaties of 1969 while the latter agreements were signed within the framework of administrative and civil law of two countries which were not in the form of bilateral treaty signed by two sovereign States in its proper sense of international law. The legal regime of charter flights between Taiwan and Mainland China is regulated by special arrangements negotiated by delegated airlines and airlines association or private law institutions.

Scientific and technical development, as well as the emergence of new types of contracts, which do not have their expression in current legislation, force us to explore the issues of contract law to adapt to change. In this context, the principle of freedom of contract is fundamental, which states that each person has the right to enter into a contractual relationship at his discretion. However, such freedom is not absolute, because the freedom of one person should not violate the freedom of another. Together with the conflict of private and public interests, these phenomena are a field for the study of topical issues of theory and application of the principle of freedom of contract in practice. Research methods are philosophical, general scientific, and special scientific methods, in particular, system-structural, formal-legal, hermeneutic; methods of analysis, synthesis, etc. As a result of the research, the main characteristics of the principle of freedom of contract, its role for private law regulation of contract law are given; approaches to understanding the restriction of contract freedom are analyzed; typical examples and means of such restrictions are identified; demonstrated how contract freedom is embodied in the use of IT tools, which types of contracts are most common in the digital environment.
There are lots of specialized graduate schools such as law school, medical school, business school. These specialized graduate schools has been designed to train the special experts practically from 1990s in Korea. For all that, there are no specialized graduate schools supported by the Small and Medium Business Administration(SMBA). So we will research the establishment plan of SME(Small and Medium Enterprise) specialized school for the development of SMEs. Recently, the SMBA supports the 2 types of graduate school such as the entrepreneurship graduate school and consulting graduate school. However, it is clear that these 2 types of schools are yet insufficient in terms of efficiency and redundancy. As the representative specialized graduate schools are law school and MOT(Management of Technology) in Korea, we do the comparative study with law school and MOT school. Through the comparative study, we can find some implication for SME specialized graduate school. As a result, the SME school has to need the training system such as the special master's and doctor's degree, over 3 year course work, daytime class, many practical professors, specialized programs with industry like the MOT school. In conclusion, we suggest that : First, the SME specialized graduate school has to be designed for potential SME consultants. Second, the entrepreneurship graduate school and the consulting graduate school can be integrated into the SME specialized school easily. Third, the SME specialized graduate school can have new educational models.
Price reduction under CISG Art. 50 is advantageous to a buyer because it is a self-help remedy to the buyer. It is the buyer that has the option and the power to reduce the price paid or to be paid to the seller. Price reduction is indispensable in such cases where the seller is relieved of liability. In such cases the remedy of price reduction is the only one giving the buyer monetary relief. Another special role of price reduction is to determine how much the buyer owes the seller for non-conforming goods when special circumstances relieve the seller of liability for damages. In any event, price reduction has been designed both as an alternative to damages and for cases where the non-performing party is excused from liability for damages. The price reduction remedy however leaves several issues for clarification and application in several respects.

This study examines the relationship between intrinsic motivation and individuals' performance in the Republic of Korea armed forces and explores whether job stress mediates the relationship between intrinsic motivation and individuals' performance. The research questions are: (1) Does intrinsic motivation influence individual performance in military organizations? (2) Does job stress impact individual performance? and (3) Does job stress mediate the relationship between intrinsic motivation and individual performance? The study utilizes data collected from a 350 soldiers survey in the Special Forces Brigade and Special Assault Commando Regiment of the Republic of Korea's Army. We use structural equation modeling (SEM) to explore the mediation role among intrinsic motivation, job stress, and individuals' performance. Research findings suggest that intrinsic motivation negatively impacts job stress. We also find that job stress has a positive effect on firearm skills. Moreover, the study reveals that the relationship between intrinsic motivation and firearm skills is partially mediated by job stress.
The purpose of this study is to investigate about security service history during the 1st and 2nd Republic. The 3rd Republic, one of the important periods, deserves special emphasis until now. But Compared with 1st and 2nd Republic, the 3rd Republic is inferior. Although security service history excluded the 1st and 2nd Republic. This research focused on the two points about the chief of the presidential security and the law of presidential security special order. Firstly, the chiefs of the presidential security in 1st Republic were Kim, Jang-Heung Seo, Jung-Hak Kim, Kuk-Jin Kwak, Young-Joo. Secondly, The law of presidential security special order be specified in Korean presidential security for the first time. Before the 1st Republic already recognized the importance of security services when they adopted the first security service regulations on December 29, 1949, which comprised 25 articles. But this law was only focused on presidential security and promulgated the law more than 10 years ago than law of the office of the Presidential Security in 1963. Deplorable in this law was declared by statute on July 7, 1953 from the 1st Republic, but repealed in 1960 after the 2nd Republic. Thirdly, 2nd Republic established the presidential security organization with the new government has been formed. In spite of this organization can not be kept for a long time, 2nd Republic attempted to professional forms of presidential security organization. The research of secret service history must continue to advance for academical learning.
In the process of industralization, Korea rural aged have played great role. By investing, educating, and supporting their brothers and children, rural aged transferred their economic surplus to non agricultural fields and urban areas. But they did not prepare for their old age. So in every agricultural policy implementation, special concern should be taken to rural aged. The rural home extension should be the major institution for the rural aged. This paper was carried out to find the direction and the policy task of rural guidance project for rural aged. This paper suggested the needs of support for the aged in family, economic status and income, and leisure. To support the aged in family, the rural home extension should teach them how to make good relationship between Mother-in-law and daughter in law and special support to families which composed of only rural aged(no children). The rural home extension program should provide special policy for job opportunity creation for the rural aged. The rural home extension should also make educational programs for useful utilization of leisure time of rural aged. The rural home extension should make major roles in rural aged related policy. So rural home extension workers are well trained in gerontology and more related information should be provided.
Objectives: The purpose of this study is to identify the causes of the retardation of administrative relief under the Special Act on Remedy for Damages Caused by Humidifier Disinfectant and to suggest the systematic refurbishment of this act for the quick and fair of relief of damages. Methods: This study was conducted through the application of the case study, literature review and systematic interpretation of law methods. Results: The disease subject to administrative relief under the Special Act is defined as health damage causally associated to a substantial degree with exposure to humidifier disinfectant. This definition is a strict requirement in light of the legislative purpose of prompt and fair relief of damages. Furthermore, the damage relief committee established under the Special Act judged causal relationships according to a rigorous standard in terms of medical certainty. This medical evidence-based judgment is a result of the committee's failure to understand the normative meaning and function of a causal relationship as an outcome of inference based on empirical rules and common sense. Conclusions: Humidifier disinfectant health damage should be defined as a health-related injury capable of occurring or deteriorating after exposure to humidifier disinfectant (HD). If the fact that a particular injury occurred or worsened after exposure to HD was found, then the damage can be presumed as being caused by HD. However, this might not be the case when the injury was considered to have occurred or been exacerbated entirely due to other factors.
This study aims to review legal problems of similar medical practice and suggest methods of improvement. Similar medical practice refers to all medical practices conducted in the state that human qualification is not fulfilled. It may cause serious damages on health and lives of national people. Currently, similar medical practices are recognized as unlicensed medical practices and prohibited based on the Medical law and additionally punished by then special law in Korea. However, the current Medical Law does not provide clear and accurate concept of medical practices so that it is difficult to regulate similar medical practices. The issue of complementary and alternative therapy related to similar medical practices is also in special state different from other countries. In addition, since similar medical practices lack of evidences in terms of safety, the dangerousness of accidents is high and it may affect badly on health of national people and health care policies. Methods of improvement in order to resolve problems regarding similar medical practices are: first, concept and scope of medical practice should be clear, accurate and concrete. Second, complementary and alternative therapies related to similar medical practices need to be strictly examined and the supervisory right should be given to doctors should be given even though a part of it is allowed. Third, research institutes specialized in the field should be established for scientific examination of complementary and alternative therapy and objective research results should be open to the public. Finally, since damage cases caused by similar medical practices by non-medical personnel, national management and supervision for similar medical practices should be reinforced.
Despite the longing for democracy of most people, Myanmar has missed opportunities for social and economic development by military dictatorship. However, since 2010, the civilian government has gained new opportunities for reform. After turning to economic reform, developed countries such as the US and EU lifted the economic sanctions that they had taken in the past. As a result, it is growing rapidly compared to neighboring countries due to attracting foreign capital, tariff benefits on export items, and expansion of industrial infrastructure. Despite the increased investment value due to economic growth and democratization, the complex and customary land system of Myanmar must be an uneasy factor in securing stable land rights when entering overseas markets. Therefore, this study sought the method of securing the land rights in the development project through the analysis of the foreign investment system in Myanmar and the investigation of joint development cases. The results of this study are as follows. First, the acquisition of land use rights at the early stage of development can be considered through the foreign investment system. Under the Foreign Investment Law and Myanmar Investment Law, the land can be used for up to 70 years, and Under the Special Economic Zone Law, the land can be used for up to 75 years. Second, in relation to land compensation, it is required to establish a detailed resettlement plan for the indigenous people as the difficulty of land acquisition is expected due to the recent democratization trend and strengthening the voice of residents. Third, land use at the operational stage can be achieved by leasing the land from developers, and this will be the most realistic plan at present. In other words, the developer can directly develop the land created under the Foreign Investment Law and the Special Economic Zone Law, or Sub-lease and transfer the land use right to a third party.
