중국의 선원교육제도의 개요와 선원송출조직에 관한 조사연구 (A Survey Study on the Outline of Chinese Seafarers' Education System and the Mechanism of Chinese Overseas Seafarers' Employment)

  • Chinese seafarers have begun to be employed by foreign shipowners since 14979. Recognizing the benefits of overseas seafarers employment , Chinese goverment has implemented policy for seafarers' education and supply. Over the past two decades, the goverment has expanded and improved seafarer training facilities. As a result a number of seafarers have been educated, who are now available for employment on Chinese and foreign flag vessels. In 1995, about 20,000 Chinese seafarers served on foregin shipowner's vessels and the total foreign currency they earned was approximately US $300 million. This paper aims to describe the education system for Chinese seafarers and the mechanism of Chinese overseas seafarers employment and to highlight main problems occurred in the mechanism of their overseas employment. It takes the fact-finding research method with literature survey and interview.

  • Transverse vibrations of ship's aft end and deckhouse among the various modes of hull structures are induced mainly by transverse exciting forces and moments of main engine such as ${\times}$ and h-moment. Avoidance of resonance should be made in a intial design stage in case there is a prediction for resonance between main engine and transverse modes of deckhouse. This study shows a case of change in type of main engine from 12 cylinders to 10 without modification of hull structures in engine room requested by a shipowner of 8,600 TEU class container carrier and proposes a guide to the effective ways of structural arrangement for avoiding resonance between transverse exciting force and surrounding structures of main engine in engine room through case studies.

  • Recently, the fuel charge is accounted for very high in the navigation cost. Therefore Shipowner is tried to find method for reducing oil consumption. ERCS(Energy Reduced Cooling System) is one of the method. The ERCS algorithm operates to decrease a power consumption of main sea water cooling pump through inverter control. We have developed ERCS controller with algorithm. The ERCS controller consists of CPU board, Digital I/O board, A/D board, D/A board and LCD/SW board. We tested with dummy signal to confirm the algorithm working correctly and achieved the good results. Before soon we will test under real condition in the ship and expect to get the result as forecasted.

  • As the noise of ship engine room is too loud, the engineer who works in a ship engine-room has the trouble of hearing. In this paper deals the investigation of the noise of ship engine room and cabins with the internationally allowable noise exposure level and noise exposure time. Recently, the problem of engine-room noise is more serious because of shipowner wants to make small number and larger size of cylinder. Therefore, engineers work in a ship engine-room for a long time have the trouble of hearing when they are exposed the high noise level. In this study, two kinds of vessels were used to investigate the noise of engine room, engine-control room, bridge, offices and cabins. As criteria of sound levels, A-weighted sound pressure level and octave band pressure level were used.

  • Recent Class requirements and IMO recommendations concerning Hull Strength Monitoring (HSM) have prompted an increasing number of shipowner to adopt monitoring systems on bulk carriers and tanker. Such systems are designed to give warning when stress levels and the frequency and magnitude of ship motions approach levels which require corrective action. When fitted these systems provide enhanced operational safety and efficiency. This paper describes a development beyond the standard BMT HSM system through the integration of stress, motion and radar-based sea state monitoring with powerful, on-board, artificial intelligence (AI) tools. The latter utilises conceptual clustering techniques as an aid to pattern recognition in stress, fatigue. motion and sea state data clusters. This, in turn, provides additional operational guidance for ship's staff. Feedback from applications of the standard BMT HSM and extended HSM systems on board the British Steel Bulk Shipping fleet is described.

장기 계류 어선에 대한 보험자의 면책에 관한 연구 (A Study on Exemption of Insurer for a Long Period Laid-up Fishing Vessel)

  • A squid gill-net fishing vessel Jayueoroho which was being insured ITC-Hulls and was laid up long period illegally under the condition of unmanned in the Pert of Kamcheon. On 30, March, 1993, the fishing vessel moved out toward the high sea by assistance of two tugboats, 12 miles southeast from Teajongdae, to discharge sewage. At that time the shipowner, the skipper, chief engineer and two labourers were boarding, and a fire was broken out by electric leakage at sea. For all their efforts of fire-fighting operation the fishing vessel foundered with explosion. In this case, she had been breached the warranties of legality, especially Korean maritime acts concerned, and the warranties of seaworthiness(MIA 39(5)) as attributable cause because of unmanned on board by wilful misconduct of the insured. Therefore it is prima facie evidence that the insurer is not liable for any loss attributable to the wilful misconduct and breach of warranties of the insured in MIA 1906.

선박보검과준의 결정요인에 관한 연구 (A Study on Determining Factors of Hull Insurance Rate)

  • Korean property and liability insurance companies have underwrited hull insurance without proper undrewriting ability. But after April 1996. in case of Korean insurance market being opened the companies have to make hull insurance rate by themselves. Accordingly, in this study, the writer embodies important factors in making hull insurance rate by an empirical survey. In empirical survey, the writer used a questionnaire, 74 proper data was obtained from 96 officers working in making hull insurance rate in 12 Korean property and liablity insurance companies and 24 the foreign companies at home. Reliability was tested by Cronbach's Alpha and a conceptual validity by Factor Analysis. Hypothesis estabilished in this study was tested by Correlation and Multiple Regression Analysis. Results of testing hypothesis are as follows: Firstly, the traits of insurer and the assured influence significantly(P<0.05) on making hull insurance rate. Secondly, expected loss ratio, ship manager, ship's age, insured amount, level of the cost of repairing and salvage, shipowner, period of insurance, level of overseas rating, profit and expense, trading limits, ship's classification, conditions of insurance, and ship's size influence significantly(P<0.05) on making hull insurance rate.

정기용선계약에서 제3자 화물손해 책임에 관한 연구 (A Study on the Liability for Third Party's Damage on the Time Charter-parties)

  • 우리나라의 정기용선 관련법은 2007년에 상법의 기존 규정에 대해 근본적으로 바꾸지 않고 유지하는 방향으로 개정함으로써 본 계약에서 중요한 제3자에 관한 권리 의무의 문제는 제외하였다. 따라서 현재, 정기용선과 관련하여 제3자에 대한 책임 문제를 해결하는데 상법을 통한 해결 방법의 도출보다는 법적 실무적인 사례들의 검토를 통해 논의하는 것이 적절하다 판단되고 있다. 정기용선계약은 당사자인 선주와 용선자 간에 이뤄지는 사적계약이며 계약의 특수성에 의해 제3자의 운송물에 손해가 발생하였을 때에 책임 주체를 명확히 하는 것이 어렵다. 이에, 선의의 제3자에 대한 운송물의 재산적 권리 보호를 위해 정기용선계약 하에서 선주와 용선자 중 누가 운송인인지를 구분 확정하는 것에 대한 법적 실무적인 기준의 정립이 필요하다. 현재, 정기용선 계약에서 당사자 간의 유책자 판단에 대해 법적 성질을 이용한 확정 방법은 그 명확성에 대해 논쟁 중인 실정이다. 이에 본 연구에서는 정기용선계약의 특성에 입각하여 제3자의 화물 손해에 대한 책임 주체의 자격확정을 어떻게 할 것인가에 목적을 두고, 이에 따라 제3자 손해의 책임 주체를 찾아내기 위해 정기용선계약에서 논란이 되어 온 법적 성질을 검토 고찰하고 운송인의 자격을 확정할 수 있는 이외의 방법이 있는지, 또 운송 계약 하에서 책임 주체로서 운송인 확정을 위한 방법이 무엇이 있는지 검토 한다. 본 연구는 제3자 손해에 대한 구제 방안으로 당사자 간의 운송인 확정의 방법, 용선계약 내에 Inter-Club Agreement의 포함을 통한 제3자의 손해에 대한 책임 분담의 방법, 제3자의 구제 방안에 대한 규정의 상법에의 도입 또는 개정을 통한 방법을 검토하며 이러한 방법들이 정기용선계약 하에서 발생한 제3자의 손해 처리에 용이한 도움이 될 것이라 제시해 본다.

정기용선계약에서 반선지연에 의한 선주의 상실수익과 손해배상청구 (Shipowner's Lost Profit and Its Claim resulted from Delay in Redelivery under Time Charter)

  • Achilleas호 사건은 정기용선계약에서 용선자의 반선지연에 의한 선주의 상실수익과 그 손해배상청구와 관련된 사안이다. 이 사건에서 중재판정부는 정기용선계약상의 반선지연이, (1) 다음의 계약에 대한 지연, (2) 드라이독에 대한 지연, (3) 본선의 매매에 대한 지연 등을 초래할 수 있다고 말하고, 이들이 반선지연에 대한 위험이라는 것을 해운업에 종사하는 자에게는 이미 인식되고 있으며, 또 시장이 항상 변동한다는 것도 알려져 있는 사실이라는 것을 인정하였다. 그리고 손해의 범위가 예상한 것보다 컸다는 사실은 손해배상청구상에 문제가 되지 않으며, 선주가 주장하는 손해의 종류가 추가사항의 체결 시에 당사자에 의한 계약위반으로부터 발생한 것이기 때문에 선주의 주요한 청구는 '통상손해'에 해당한다고 하여 중재인 다수결로 이것을 인정하였다. 이것에 비해 용선자는 지금까지 반선지연에 대해 상실수익이 인정된 선례는 없기 때문에 일반적으로 알려진 손해배상액의 산정기준은 동 원칙의 '통상손해'에 기초하여 반선해야 할 일자로부터 실제로 반선된 일자까지의 시장용선료와 계약용선료와의 차액을 근거로 해야 한다는 것이다. 따라서 상실수익이 손해배상액으로서 인정되기 위해서는 동 원칙의 '특별손해'를 근거로 용선자가 계약체결 시에 스케줄대로 반선하는 것이 중요하다는 취지의 통지를 받고 반선지연에 의한 손해에 대해 책임을 진다는 것을 인식하고 있었던 것이 필요하다고 주장하여 상소하였다. 본 연구에서는 정기용선계약에서 반선지연에 의한 선주의 상실수익과 그 손해배상청구와 관련된 지금까지의 여러 판례를 분석한 후, 특히 Achilleas호 사건 판결내용을 중심으로 그 함축된 의미를 고찰하는데 목적을 두고 있다.

해양원격의료 지원제도 개선을 위한 관련 법령정비 방안 (De Lege Frenda for Improvement of Marine Telemedicine Service System)

  • Expansion and spreading of marine telemedicine is rather restricted due to the conflict of laws relating to medical service and lack of provisions in the Seafarers' Act, Medical Service Act, etc. Thus, this study is intended to reveal the current status and problems of marine emergency medical advice system for the furtherance of health care of seafarers and emergency medical assistance conditions and deduce relevant proposals for legislative improvements thereof in order to resolve underlying problems and issues. The results of this study can be summated as follows. First, in respect of directions to provide marine emergency service based on marine telemedicine system, emergency radio medical advice system needs to be strengthened to meet domestic and international instrument, marine telemedicine system needs to be provided through integrating u-Health technology and special marine medical center needs to be established. Second, regarding directions to provide health promotion service based on the marine telemedicine system, a new process of health care service for seafarers needs to be devised and provided involving seafarers' life cycle covering from prior to boarding to after leaving a ship. The conclusions of this study can be given as follows. First, the following new provisions need to be introduced in the Seafarers' Act. (1) The Minister of Oceans and Fisheries and a shipowner shall conduct matters pertaining to preventive health promotion and care for seafarers; (2) a provisions regarding establishment of seafarers' health promotion center by the Minister; (3) a special exemption permitting marine telemedicine service and qualification requirements for marine telemedicine assistant; (4) shipowner's obligation of carrying seafarers' health measuring equipment on board. Second, the relevant provisions regarding medical care persons needs to be revised in such a way that master or chief officer shall be appointed to be in charge of medical care on board. Last but not least, it is also essential to amend and update the minimum standards on drug and medicines to be carried on board and medicine chest and equipment on board.
