환경부의 화학물질관리법, 화학물질등록 및 평가에 관한 법률, 고용노동부의 산업안전보건법의 화학물질 관련 내용 비교 (Comparison between the Chemical Management Contents of Laws Pertaining to the Ministry of Environment and the Ministry of the Employment and Labor)

  • Objectives: The exponential growth of chemicals, an area of high concern in developed countries like the US (i.e., the Gore Initiative) and in the EU (i.e., REACH), as well as recent chemical accidents in Korea, have provoked nationwide concerns and resultant legal enforcement. This study aims to compare the laws of the Ministry of Environment (the Chemical Substances Control Act (CSCA), Act on the Registration and Evaluation, etc. of Chemical Substances (ARECS)) with those of the Ministry of the Employment and Labor (Occupational Safety and Health Act (OSHA)). Methods: Each law pertaining to the Ministry of Environment and the Ministry of the Employment and Labor was downloaded from the official legal information system (www.law.go.kr). The objectives of each law and the major contents related to chemical management were compared and summarized. Results: The CSCA and the ARECS are focused on the protection of people and the environment, while the OSHA relates to the protection of workers. The right to know of people and workers has been reinforced. The former two laws emphasize prevention, but the OSHA contains both preventive and post-accident measures. The role of the Ministry of Employment was reinforced with the promulgation of the CSCA and ARECS, which contain regulations such as adjacent area impact evaluation, risk control planning, chemical statistical survey and construction and operation of information, provision of risk control plans, response to chemical accidents and registration of chemical substances. Conclusion: We found that the three laws discussed here have several similar clauses designed to protect people and the environment from risks that may be caused by the use of chemicals, even though there are some differences among them in terms of objectives and contents. This review concluded that several clauses that can be regarded as double regulation should be unified in order to minimize the waste of government administrative resources and socio-economic losses.

  • The Process Safety Management (PSM) by the Law of Industry, Safety and Health has been performed for preventing major accidents of chemical plants since 1996. In terms of preventing chemical accidents more precisely, it is essential to develop a tool for quantitative risk assessment. For this, KOSHA (Korea Occupational Safety and Health Agency) developed an Integrated Risk Management System (IRMS). The system is designed to assimilate data on chemical plant hazards from external database, to integrate these data with location information(topographic and demographic), and to make them user-friendly accessible. The system consists of several main functions: display of five major Korean petrochemical complex layout display of equipment layout with its information utilizing the external database, zonation of the hazard effected area with consequence analyses, the most probable accident scenario generation, accident/incident database and calculation of frequency of accident using equipment reliability database, etc. The highlight of IRMS is to provide the risk contours using GIS(Geographical Information System) technology. IRMS is intended to manage hazardous installation more systematically and effectively, to reduce the number of accident remarkably, further minimizing production loss in the plant. The system is now under application to about 500 PSM sites as well as and emergency authorities in Korea by KOSHA (Korea Occupational Safety and Health Agency)

건설공사 유해위험방지계획서제도의 효과분석에 관한 연구 (A Study on the Effectiveness of the Risk Assessment Regulations for Construction Works)

  • The Risk assessment regulation(RAR) is one of the essential articles of the Occupational safety and health law for the construction industry along with safety and health management expense and safety organization regulation. However, arguments regarding the working time of the safety assessment documents, the person in charge of documentation, weakness in legislative enforcement etc. are ongoing. Thus this study aims to analyze the effectiveness of RAR for the guidance of enhancing the effectiveness of RAR. The findings are; 1) the effectiveness of RAR is recognized, however the indirect effectiveness ie, enforcement of safety activities, previewing of drawings etc. are bigger than the direct effectiveness of accident prevention, 2) to enhance the effectiveness of RAR site inspection procedure has to be utilized, 3) further research for identifying and getting rid of negative factors in RAR is recommended.

Using Workers' Compensation Claims Data to Describe Nonfatal Injuries among Workers in Alaska

  • Background: To gain a better understanding of nonfatal injuries in Alaska, underutilized data sources such as workers' compensation claims must be analyzed. The purpose of the current study was to utilize workers' compensation claims data to estimate the risk of nonfatal, work-related injuries among occupations in Alaska, characterize injury patterns, and prioritize future research. Methods: A dataset with information on all submitted claims during 2014-2015 was provided for analysis. Claims were manually reviewed and coded. For inclusion in this study, claims had to represent incidents that resulted in a nonfatal acute traumatic injury, occurred in Alaska during 2014-2015, and were approved for compensation. Results: Construction workers had the highest number of injuries (2,220), but a rate lower than the overall rate (34 per 1,000 construction workers, compared to 40 per 1,000 workers overall). Fire fighters had the highest rate of injuries on the job, with 162 injuries per 1,000 workers, followed by law enforcement officers with 121 injuries per 1,000 workers. The most common types of injuries across all occupations were sprains/strains/tears, contusions, and lacerations. Conclusion: The successful use of Alaska workers' compensation data demonstrates that the information provided in the claims dataset is meaningful for epidemiologic research. The predominance of sprains, strains, and tears among all occupations in Alaska indicates that ergonomic interventions to prevent overexertion are needed. These findings will be used to promote and guide future injury prevention research and interventions.

현행 및 개정안 환자안전법의 자율보고시스템에 대한 비판적 고찰 (Critical Considerations on Autonomous Reporting System of Current and Revised Patient Safety Law)

  • 2015년 1월 28일 제정되었던 환자안전법이 2016년 7월 26부터 시행되고 있다. 환자안전법은 환자안전문제에 있어 사후적인 민 형사상 책임추궁에 초점을 두고 있던 과거시스템에서 탈피하여 사전적으로 의료오류(medical error)의 예방을 위해 보고시스템을 통하여 각종 오류를 수집 집적한 후 얻어진 결과물을 진료에 반영함으로써 위해를 예방하고자 하는 방식으로 이루어져 있다. 이 법의 유효성을 위해서는 환자안전사고의 예방 보고 재발 방지 등을 위한 환자안전관리체계구축의 핵심적인 전제인 '환자안전사고의 자율보고 및 보고 학습시스템'의 활성화가 관건이다. 그리고 이 시스템이 활성화되기 위해서는 무엇보다도 많은 양의 보고자료축적이 필수적인 전제요건이다. 그럼에도 불구하고 약 17개월 동안 단 2건에 불과한 보고가 있었을 뿐이다. 외국의 선례에서는 이 문제를 해소하기 위하여 부분적으로 의무보고시스템을 도입하고 있다. 본 글에서는 현행 자율보고시스템의 타당성과 발의되어 있는 두 개정안을 비판해보고, 부분적 의무보고시스템의 도입을 제시해보고자 한다.

진단용 방사선발생장치의 안전관리에 관한 규칙과 원자력법의 용어통일 개선 방향 (Terms Standardization between the Rules of Diagnosis Radiation Equipment Safety Management and Atomic Energy Law : Problems and Suggestions)

  • 진단용 방사선발생장치의 안전관리에 관한 규칙과 원자력법에서 사용되는 용어들이 일부 상이하게 기술됨으로서, 실무종사자들의 혼란을 막기 위해 본 연구를 실시하였다. 우리니라의 원자력법은 국제방시선방어위원회(ICRP)의 권고에 띠라 우리나라의 실정에 맞게 지속적으로 수정, 발전한 반면에, 진단용 방시선발생장치의 안전관리에 관한 규칙은 부분적인 수정함으로서, 용어의 혼란을 초래하게 되었다. 진단용 방사선발생장치의 안전관리에 관한 규칙과 원자력법을 비교하면 수정해야 할 사항들은 다음과 같았다. 1. 진단용 방사선발생장치의 안전관리에 관한 규칙과 원자력법에서 사용되는 용어와 단위가 다르다. 업무의 특성상 사용되는 특별한 용어를 제외하고, 공통으로 시용되는 용어의 통일은 반드시 필요하다. 비록 이원화된 방사선안전관리 체계일지라도 규제와 지도의 기준은 일원화되어야 할 뿐 아니라 방사선업무에 종사하는 자나 방사선안전관리 실무에 종사하는 자에게 혼란을 주어서는 바람직하지 못하다. 2. 진단용 방사선발생장치의 안전관리에 관한 규칙에는 다음의 규정이 추가되어야 한다. 1) 환자와 병원 방문객에 대한 방사선방어 2) 임신중인 여성환자의 방사선피폭제한 3) 의료상피폭으로 인정되지 않는 자의 방사선피폭제한 4) 임신 중인 여성 의료관계종사자의 피폭관리

독성 한약재의 법적 규제에 관한 연구 (Study on The Regulation on Poisonous Medicinal Herbs)

  • Objective: Poisonous Medicinal herbs can be considered as a risk factor to public health unless they are prescribed by Doctor of traditional Korean medicine. The proper method to manage them should be prepared to prevent risk factors caused by misuse and abuse of the poisonous medicinal herbs and enhance public health. Methods: In this dissertation (paper), the definition, scope, management status, data about pharmacology and toxicity and media release regarding adverse reaction were understood after organizing documents, laws and regulations concerning poisonous medicinal herbs. Also, management methods are suggested by analyzing related examples and regulations in China, Japan and Hong Kong, where the use of herbal medicine is general. Results: Methods for items for poisonous medicinal herbs, safety information management, management based on standardization of traditional processing methodology and reorganization and revision of related laws and regulations are established. Conclusion: Proper laws and regulations are not yet established to manage poisonous medicinal herbs in Korea. In this regard, it is urgent to establish laws and regulations which can apply independently. The purpose of the laws and regulations should be to enhance management of poisonous medicinal herbs and prevent incidence of addiction and death, improving the public health.

보건의료관련 법령의 동의에 관한 민법적 검토 (Review and Interpretation of Health Care Laws Based on Civil Law)

  • 본 글에서는 보건의료관련 법령 중 「연명의료결정법」, 「정신건강복지법」, 「장기이식법」, 「인체조직법」, 「약사법」, 「에이즈예방법」, 「결핵예방법」, 「감염병예방법」을 검토하였다. 이들 법률에 민법적 사고가 필요한 부분은 환자의 자기결정권과 동의에 관한 부분이다. 그리고 환자가족을 통한 의사결정이 환자의 의사결정을 대행하는 것인지 환자가족이 환자를 위하여 고유의 권한으로 의사를 결정하는 것인지와 관련하여 성년후견제도에서 후견인의 동의대행과 비교하여 이해할 필요가 있다. 보건의료관련 법령은 환자의 자기결정권과 그 실현을 위한 동의대행의 문제에서 민법과 깊게 연관되어 있음에도 불구하고 개개 법률의 관련 규정은 민법의 동의에 관한 원칙이나 성년후견제도와 별개로 규정되어 있음을 확인할 수 있다. 보건의료관련법령의 일차적 목적이 환자의 자기결정권 실현에 있지 않다고 하더라도 의료관련 행정이 통일적으로 운영되기 위해서는 민법의 의사결정 및 그 대행에 관한 원칙을 이해할 필요가 있다.

n-Propanol+acetic acid 및 n-propanol+n-propionic acid 계의 하부 인하점 측정 및 예측 (The Measurement and Estimation of Lower Flash Points for n-Propanol+Acetic acid and n-Propanol+n-Propionic Systems)

  • Flash points for the flammable binary systems, n-propanol+acetic acid and n-propanol+n-propionic acid, were measured by Cleveland open cup tester. The Raoult's law, the van Laar equation and the UNIQUAC equation were used for predicting flash points and were compared with experimentally-derived data. The calculated values based on the van Laar and UNIQUAC equations were found to be better than those based on the Raoult's law. And the predictive curve of the flash point prediction model based on the UNIQUAC equation described the experimentally-derived data more effectively than was the case when the prediction model was based upon the the van Laar equation.

The Measurement and Prediction of Minimum Flash Point Behaviour for Flammable Binarry Solution Using Pensky-Martens Closed Cup Tester

  • The flash point of liquid solution is one of the most important flammability properties that used in hazard and risk assessments. Minimum flash point behaviour (MFPB) is showed when the flash point of a liquid mixture is below the flash points of the individual components. In this paper, the lower flash points for the flammable binary system, n-decane+n-octanol, were measured by Pensky-Martens closed cup tester. This binary mixture exhibited MFPB. The measured flash points were compared with the values calculated by the Raoult's law and the optimization method using van Laar and UNIQUAC equations. The optimization method were found to be better than those based on the Raoult's law, and successfully estimated MFPB. The opimization method based on the van Laar equation described the experimentally-derived data more effectively than was the case when the prediction model was based upon the UNIQUAC.
