A Study on the Copyright Survey for Design Protection in Metaverse Period

  • Among human intellectual creations, the right granted by law to what is worth protecting is defined as intellectual property rights. Copyright is a legal right to creative finished products made by individuals, and in recent years, this legal right has been recognized as very important. In other words, copyright is a system created to protect the rights of individuals who created creations and to recognize their efforts. Works subject to copyright vary from poetry, thesis, novels to designs, paintings, music, and architecture, and the scope of the subject is gradually expanding. Recently, research has begun on how far the Metaverse design area absorbed into the real world among works. Computer-generated video productions and software program works are also subject to digital copyright protection, but it is also true that the interpretation of the author protection law for works, designs, and trademarks in the virtual world is unclear. This study aims to analyze copyrights based on case studies and theoretical backgrounds on copyright protection and to discuss the protection limitations of Metaverse design in the virtual world. In other words, the direction for the protection of Metaverse design is presented through clear distinction and definition of copyright protection in the tertiary virtual world. This study aims to present methods for design copyright protection in the era of Metaverse, respect copyright holders' creative activities, and develop our culture through protection of creations.

  • As logistic environment of digital resources is rapidly changing, protection of the intellectual property for digital resources has been recognized as one of important issues. Digital Rights Management (DRM) has taken much interests from ISP, authors and publishers of digital content as an integrated approach to create a reliable environment for access and the use of digital resource. In this paper we proposed a dynamic digital rights management system based on adaptive agent theory (ARPA : Adaptive Resource Protection Agent) to address problems facing contemporary DRM approaches : static rights management problem solving and strengthened monitoring/tracking system. We introduced a dynamic mission control scheme to realize dynamic digital rights management. We incorporated adaptive agent theory to implement on-and off-line tracking and protection. Through the implementation of protype system, the process, the process dynamic digital rights protection will be demonstrated.

  • This study is a qualitative study applied with in-depth interviews and phenomenological analysis. The objective of this study was finding out the function of the elder protection agency by interpreting the meaning developed from the experience of the workers about the role of the elder protective service agency. As a result of the analysis, the essential themes were 'Struggling and working hard', 'Obstacles that cannot be lifted', and 'Reaching the time to be reborn as an organization for the elderly human rights.' The common essence of these themes is 'The road to human rights orientation: a destination that must be reached, though not easy to go.' In order for the meanings to be settled and to fit in to the community, it was suggested it is a situation in which both internal and external renewal of the institution for the protection of the elderly is most needed. In addition, much as it turned out that legal and institutional support must be provided so that the elder protection agency can be reborn as human rights organizations with more professionalism, it was proposed to follow the institutional improvement plan derived from this study.

  • The distinctive design of apparel product is the crucial factor that provides the powerful competitive advantage and customer satisfaction. However, knock-offs or copycats easily copy the design of apparel product and its problem tends to be assented in real world. Design right is one of intellectual property rights that would be produced by intellectual activity and the appropriate means to establish the exclusive rights to the design should be established. Legal protection to the design right is the system that can prelude copycats from eroding an exclusive position in the market place. The present study was to analyze the trend of registration of design rights in apparel products and to point out problems of current protection law to design.

  • The present study was to analyze the trend of registration of design rights in apparel products and tc point out problems of current protection law to design. The research data was total 1,850 design rights in apparel that have been registered to the Korean Patent and Trademark Office from the first design registered in March 1, 1963 through those registered in April 24, 2003. All design rights were analyzed by the year, by the type of product, and by the type of applicant. And also design rights registered under the revised design registration system(without examination) were analyzed by the trait. The results of the study were as follows: (1) Sweater & polo shirts, underpants, and the Korean traditional dress were three major single categories registered in apparel : (2) 54.3% of total design rights in apparel was registered since the legal system of design rights has been revised in March 1, 1998 : (3) Registration by individual applicant were 71.7% of total; (4) About 60% of total design rights were for aesthetic, but in some categories such as vest. brassiere, undershirts, designs for function were more frequently registered than others. And total 68 design rights for the symbol of the organization or uniform, were registered in upper outerwear and pants : (5) As problems of the current legal protection system for designs, the term of “design”(expressed in Korean), double registration of similar designs, malicious intention to register other's trademark as his/her own design. The current legal system for design rights were more used for the product that has relatively long life cycle. And the revised law has been effective in encouraging the registration of design rights. However. the current design law still has some problems to be revised to prevent design rights or trademark infringement.

The Design of License Agent Rights Protection (디지털 저작권 보호를 위한 라이센스 에이전트의 설계)

  • As the logistic environment of digital contents is rapidly changing, the protection of the digital rights for digital content has been recognized as one of critical issues. Digital Right Management(DRM) has taken much interest Internet Service Provider(ISP), authors and publishers of digital content as an interested approach to create a trusted environment for access and use of digital resources. This paper propose an interested digital rights protection scheme using license agent to address problems facing contemporary DRM approached : static digital rights management, and limited application to on-line environment. We introduce a dynamic mission control technology to realize dynamic digital rights management. And we incorporate license agent to on- and off-line monitoring and tracking. The proposed system prevent illegal access and use by using PBD security method real time action monitoring for user, data security for itself.

  • The web-based technology allows anybody who has access to the Internet to get all kinds of information from the World Wide Web. It brings about issues regarding intellectual property and copyright threats. After content is downloaded, no further protection is provided on the content that has been accessed. DRM (Digital Right Management) technologies came out to ensure the protection of copyrighted content and information. In this paper, we propose architecture of license-based digital rights management system for protection of contents and principles' rights such as contents creators, providers, distributors, and uses in contents distribution value-chain over Internet. This system makes on-line processing of all value-chain from creator to purchaser possible, compared with existing DRM products only supporting only limited distribution between distributor and purchaser.

Effects of Intellectual Property Rights Protection on Services Export Diversification in Developing Countries

  • The effects of the betterment of enforced intellectual property rights (IPRs) provisions on services export diversification are investigated. The analysis used an unbalanced panel dataset of 76 developing countries over the period of 1970-2014. The empirical analysis is based on the feasible generalized least squares estimator. It suggests that the implementation of weaker IPR protection fosters services export diversification in less developed countries (i.e., those whose real per capita incomes are less than US$US$ 1458.60), including those with a low level of export product upgrading. Conversely, in relatively advanced developing countries (countries whose real per capita income exceeds US$ 3356.80), including those with high levels of export product upgrading, the implementation of stronger IPR laws induces greater services export diversification. Finally, the analysis revealed the existence of a non-linear relationship between IPR protection and services export diversification. The implementation of stronger intellectual property laws spurs services export diversification in countries with high degree of IPR protection, especially when IPR protection exceeds a certain level, recorded here as having a score of 1.197. In contrast, in countries with weaker IPR protection, in particular those with IPR protection levels that score less than 0.915, it is rather the implementation of weaker intellectual property laws that promotes services export diversification.

  • This study aims to explore how to improve students' rights based on their age and development stages. To this end, we analyzed a survey that had been carried out with 1,065 students from elementary, middle and high schools in 2 most populated counties in Korea, focusing on the differences in their perception with regard to the right to survive, develop, be protected and participate. The result of the analysis showed that high school students' sense of rights was at the lowest in general, while being particularly low in their sense of participation rights. However, when it comes to the development rights and protection rights, the level of recognition of middle school students were as low as those of high school students. Based on the results, we suggested that a proactive effort to guarantee adolescents' participation rights is required, and that education of human rights should be emphasized not only for children but also for their supporters. In the follow-up study, it is required to investigate the differences between development stages and regions by including participants with diverse ages and residential areas.

  • The Internet presents a unique platform for disseminating digital content such as music, video, games, software, text, business and proprietary corporate information. It promises ubiquitous access, while at the same time fundamentally challenging the traditional rules of ownership and distribution of content. In such environment, safe protection and proper delivery of digital content would be a crucial requirement toward a new e-business model. Research on the Digital Rights Management (DRM) focuses on filling this functional vacancy of the market transition by providing a more viable business model based. XrML(eXtensible Rights Markup Language) provides a universal tool for specification of rights, fees, and issuing conditions(licenses) associated with the use and protection of digital content. ContentGuard has developed XrML to unify the Digital Rights Management(DRM) specifications and encourage interoperability. It seems that all working groups of DRM agree to use XrMl for their right description language.
