A Review on the Scope of the Right of Integrity : Focusing on the Case about the Popular Music (저작권법상 동일성유지권의 범위에 관한 검토 : 대중음악에 관한 사례를 중심으로)

  • In 2012, Psy's music video 'Gangnam Style' spread through parodies, and gained explosive popularity. In 2016, there was a case so-called as 'baseball ground cheering song' in which a author(songwriters) claimed an infringement of the 'right of integrity' related to cheering songs used by professional baseball teams. In response, the court denied violating the right of integrity in 2019. These cases have different effects depending on whether or not the 'right of integrity' is claimed. This study attempted an economic analysis in addition to a legal analysis of the right of integrity. Korean copyright law regards even simple changes that go against the author's will as a infringement of the 'right of integrity' even if they do not harm honor or reputation. Such legislation is one of the most strongly protected forms in the world, so it cause many problems. Meanwhile, we analyzed the cost-benefit analysis of Psy's 'Gangnam Style' case and the 'baseball ground cheering song' case. As a result of the analysis, the right to integrity is inefficient in quantitative and qualitative aspects. Therefore, the right of integrity should be reconsidered with the focus on 'popular music'. In particular, considering the development of information communication technology and changes, a revision direction is needed to meet the purpose of the copyright act. Furthermore, in order to solve the legal issues under the Copyright Act, the requirement for infringement of the right of integrity should be relaxed. Then, we proposed the establishment of a proviso clause on the right of integrity.

  • 최근 'healing'이라는 단어가 여기저기에서 많이 사용되고 있다. 과도한 업무와 스트레스에 지친 직장인들뿐만 아니라 학생들까지도 'healing'을 찾고 있는 추세이다. 그러다 보니 자연스럽게 명상이나 요가, 음악 치료와 같은 심신의 건강, 회복과 정서적인 안정을 위한 여러 가지 활동들을 찾게 되었으며 스마트폰이 발달함에 따라서 지금은 스마트폰의 애플리케이션을 이용하여 쉽고 간편하게 음악 치료를 이용하고 있으며, 두뇌와 비타민의 합성어인 BTamin 음악이 유행처럼 번지게 되며 뇌파 (Bectro Encephaio Graphy : EGG)에 대한 관심도 높아졌다. 본 논문은 안드로이드 마켓의 Music Therapy for sound sleep 애플리케이션의 알파 웨이브 음악을 RightMark Audio Analyzer 프로그램을 통하여 분석 해보았다.

The Effects of Relaxation Music on the Body Flexibility and Stress (이완음악이 신체유연성과 스트레스에 미치는 영향)

  • Background : The purpose of this study is to identify how the relaxation music listening during exercise influences body flexibility and stress. Methods : Twenty healthy adults 20s and 30s who lack of body flexibility were recruited and each subjects performed exercise during the relaxation music listening or no listening. Bach, aria of linear G was used as the relaxation music. The experiment was conducted for 4 weeks. In this study, PASW ver 18.0 was utilized to perform non-parametric tests for comparisons. Result : The result with respect to the dependent variables are as follows: When non-parametric tests were conducted to compare body flexibility at the test of the right ear touch behind head by left hand and the stretching hands test between the two groups after exercise, they showed significant differences in statistical terms (p<.05). Conclusion : From the above results of the study it was found that the application of the relaxation music during the exercise is effective, it improved the body flexibility of the right ear touch behind head by left hand and the stretching hands more than the exercise without the relaxation music did. The outcome of the experiment may provide basic data for developing an effective way to increase body flexibility.

An fMRI Study on the Differences in the Brain Regions Activated by an Identical Audio-Visual Clip Using Major and Minor Key Arrangements (동일한 영상자극을 이용한 장조음악과 단조음악에 의해 유발된 뇌 활성화의 차이 : fMRI 연구)

  • The purpose of this study was to examine the differences in the brain activation evoked by music arranged in major and minor key used with an identical motion film during the fMRI testing. A part of the audio-visual combinations composed by Iwamiya and Sano were used for the study stimuli. This audio- visual clip was originally developed by combining a small motion segment of the animation "The Snowman" and music arranged in both major and minor key from the original jazz music "Avalon" rewritten in a classical style. Twenty-seven Japanese male graduate and undergraduate students participated in the study. Brain regions more activated by the major key than the minor key when presented with the identical motion film were the left cerebellum, the right fusiform gyrus, the right superior occipital, the left superior orbito frontal, the right pallidum, the left precuneus, and the bilateral thalamus. On the other hand, brain regions more activated by the minor key than the major key when presented with the identical motion film were the right medial frontal, the left inferior orbito frontal, the bilateral superior parietal, the left postcentral, and the right precuneus. The study showed a difference in brain regions activated between the two different stimulus (i.e., major key and minor key) controlling for the visual aspect of the experiment. These findings imply that our brain systematically generates differently in the way it processes music written in major and minor key(Supported by the User Science Institute of Kyushu University, Japan and the Korea Science and Engineering Foundation).

Different Effects of Sound Stimuli on Performing Left-and Right-Hemispheric Tasks (뇌의 좌반구와 우반구의 작용에 미치는 음의 서로 다른 영향)

  • In order to examine the different effects of noise and music on mental tasks, an addition of figures as a left-hemispheric task and a pattern search as a right-hemispheric task were given to elementary school pupils under conditions of jet noise stimulus, music stimulus, and no-sound stimulus, respectively. Results showed that effects of music and noise stimuli during these tasks were significantly different. The subjects under music stimulus tended, when performing additions, to show occasional short periods in which they produced substantially less than their own average rate of work. This is due to interaction between calculation and hearing music in the left hemisphere, whereas there was no detrimental effects on the task of addition under noise stimulus as well as no-sound stimulus because the addition and the noise may be separately processed in different cerebral hemispheres. As effects of noise on performing search task, the subjects tended to show instantaneous agitations in their working curves. Since noise with no-meaning is processed in the right hemisphere, it may be explained as an interacting effect in this hemisphere.

The results of this study are summarized as followings ; First, the introduction of ancient score reads that musicians should have inherent character and right mind and harmonious sound exerts influence on human being. It emphasized that the proper expression of music is the stabilized mind and right idea. Second, the introduction of anthology lays stress on proper meaning, that is, lyrics that is not indecent nor loose. It asserted that right lyrics should not be pressing nor frivolous, but rather slow. Lastly, the introduction of both ancient score and anthology commonly present 'recovery of ancient music'. It was confirmed that the ultimate purpose of intellectuals and musicians in 19th century was to aim at slow, but harmonious and right music.

Opera Clustering: K-means on librettos datasets

  • With the development of artificial intelligence analysis methods, especially machine learning, various fields are widely expanding their application ranges. However, in the case of classical music, there still remain some difficulties in applying machine learning techniques. Genre classification or music recommendation systems generated by deep learning algorithms are actively used in general music, but not in classical music. In this paper, we attempted to classify opera among classical music. To this end, an experiment was conducted to determine which criteria are most suitable among, composer, period of composition, and emotional atmosphere, which are the basic features of music. To generate emotional labels, we adopted zero-shot classification with four basic emotions, 'happiness', 'sadness', 'anger', and 'fear.' After embedding the opera libretto with the doc2vec processing model, the optimal number of clusters is computed based on the result of the elbow method. Decided four centroids are then adopted in k-means clustering to classify unsupervised libretto datasets. We were able to get optimized clustering based on the result of adjusted rand index scores. With these results, we compared them with notated variables of music. As a result, it was confirmed that the four clusterings calculated by machine after training were most similar to the grouping result by period. Additionally, we were able to verify that the emotional similarity between composer and period did not appear significantly. At the end of the study, by knowing the period is the right criteria, we hope that it makes easier for music listeners to find music that suits their tastes.

  • Before Smartphone releases, playing music form previous cellphone is very limited, so we need mp3 player instead. However, when Smartphone releases, a function of playing multimedia became one of the important things in Samrtphone including all functions of mp3 player. Even though it is easier to use since you can play music and multimedia in one device, it still has problem issues on the sound quality. This thesis will discuss about functions of EQ from Smartphone music players. After that, we will to achieve high fidelity sound through balance adjustment of Right Mark Audio Analyzer program.

  • The functions of playing musics and multimedia have become essential in one device as a smart phone since the smart phone appeared. It is very convenient, but it contains controversial arguments about sound quality, so many smart phone users use the music player application. By using these music applications, people start to think about the relationship between music playing and sound quality. However, those applications are not perfect, so it is hard to choose a good application. This thesis is about the advantages of the sound quality of music player applications that are currently sold in Android Market through RightMark Audio Analyzer program, and plans to suggest android music player application system design by analyzing applications by covering disadvantages of these applications.

  • The patent right is that creators are received the right of monopoly for supporting their creation work perseveringly but sometimes it causes infringement of freedom of creation. In this study, we examine the patent of music game in arcade game field and also examine Konami's, which is a main producer in this field, institutes many lawsuits repeatedly. It brought on diversion of rivals and depression of game market. We examine the abuse of music game patent through the case of Konami. We examine the negative influence through all music game market that creativity blocked by repetitive patent lawsuit institutes from little change of operation device and music game hardware even though it is reasonable for guarantee of new technology patent in game field which is a idea industry. We examine the lawsuit cases of abuse of music game patent in Korea, China and Japan and we analyze market change through the cases. We recommend policy for this industry development.
