참여의 특권 배제에 관한 미국 독점금지법 법리와 그 시사점 (The U. S. Antitrust Law on the Exclusion of Medical Staff Privilege and its Implication)

  • If the medical staff privileges, which mean the eligibility to practice at open hospitals, are excluded in the United States, antitrust claims based on the violation of the Sherman Act have been raised a lot. The proliferation of these lawsuits in the United States, which are characterized as antitrust lawsuits, can be understandable situation. The reason is because doctors who don't belong to specific hospitals are seriously damaged, if the medical staff privileges are excluded and doctors cannot use facilities of open hospitals. In order to decide to allow the privileges of certain doctors, hospitals have to rely on peer review to maintain high quality of medical services, and it is not easy to find alternative of peer review in the professional areas like healthcare. However, there are possibilities that members of the peer review can abuse power to unfairly exclude privileges of potential competitors. In this sense, it is asserted in the U.S. antitrust lawsuits that the restraint of medical staff privilege can be the illegal restraint of trade in violation of section 1 of Sherman Act and can be monopolization or an attempt to monopoly by hospitals in violation of section 2 of Sherman Act. As Korea adopted open hospital system quite recently, there is still no case related with the exclusion of medical staff privileges. However, medical staff privilege system of Korea is not different from that of the United States in principle. Thus, the U.S. jurisprudence on the exclusion of medical staff privileges can be referred in the interpretation of "practice that interferes with or restricts the activities or contents of the business" based on Article 19.1.9 of Monopoly Regulation and Fair Trade Law of Korea.

  • NCAP(New Car Assessment Program) makes vehicle manufacturer improve safety performance through free competition and customers guarantee vehicle selection by providing information of vehicle safety. That's why it is important not only to meet the regulation, but also to cope with NCAP. EuroNCAP(European New Car Assessment Program) side tests have conducted by using Progressive MDB and Euro SID II in order to reproduce crash test between two vehicles over 10 years. However various researches report that Progressive MDB and Euro SID II do not reflect evolving vehicle design, impact performance and biofidelity of human. Therefore EuroNCAP has the plan to conduct AE-MDB side crash test using WorldSID which is more evolved from 2015 by replacing Progressive MDB and EuroSID II. Automobile manufacturers need to develop safety performance for new test closely. This paper is to find test set-up parameters which affect into dummy injury instead of restraint system and to research on its tendency. It is processed with mini and small car to know influence as changing vehicle size and also analyzed by DFSS(Design for six sigma) which is one of optimization tools. DFSS is vaildated by simulating CAE with L18 orthogonal array of 6 control factors adjustable as EuroNCAP requirement.

시위 방향 비대칭 단면의 복합재료 박벽보의 동특성 연구: II. 다중-셀 (Dynamic Characteristics of Composite Thin-Walled Beams with a Chord-Wise Asymmetric Cross-Section: II. Multi-Cell)

  • 이번 연구에서는 앞서 Part I [1]에서 수행한 단일-셀(single-cell) 모델에 이어, 시위 방향으로 비대칭성 단면을 가지는 다중-셀(multi-cell) 복합재료 박벽보(thin-walled beam) 모델을 선정하여, 단면의 형상에 대한 이론적인 동특성을 해석하였다. 이를 위해 와핑 구속 효과와 전단 변형 효과, 보의 테이퍼비와 단면비 등을 고려하였다. Part I에서와 마찬가지로 다중-셀 단면의 질량 및 강성 계수와 고유 진동수 등의 특성을 조사하였다. 특히, 다중-셀과 단일-셀 단면을 비교하고, 다중-셀 단면의 고유 진동수에 미치는 테이퍼비와 단면비의 영향을 비교 분석하였다. 또한, 단면의 비대칭성과 와핑 함수를 보정하지 않은 경우에 대해 그 결과를 비교하였다.

  • This paper presents research about improvement of fault detection algorithm in FRTU on the feeder of distribution system. FRTU(Feeder Remote Terminal Unit) is applied to fault detection schemes for phase fault, ground fault, and cold load pickup and Inrush restraint functions distinguish the fault current and the normal load current. FRTU is occurred FI(Fault Indicator) when current is over pick-up value also inrush current is occurred FRTU indicate FI. Discrete wavelet transform(DWT) analysis gives the frequency and time-scale information. The neural network system as a fault detector was trained to discriminate inrush current from the fault status by a gradient descent method. In this paper, fault detection is improved using voltage monitoring system with DWT and neural network. These data were measured in actual 22.9kV distribution system.

  • The cogeneration facilities (COGN) into the power distribution system can cause operational problems - reenergization of distribution feeders under repair by utility personnel, voltage variation and regulation because of output power of COGN, and lost of coordination at emergency state - on an electrical utility system. This paper deals with momentary voltage dips as the parallel interconnection operation of COGN in the power distribution system. PSCAD/EMTDC simulation tool is used to show the behavior of momentary voltage dips. In addition, restraint solution for momentary voltage variation is presented.

  • These days, automobile industry pays considerable attention to child occupant safety. As the US adopted requirements for universal and uniform anchor systems for child restraints, manufacturers for child seats put an enormous effort to improve the protective properties of Child Restraint System (CRS). Various standards have been studied and announced by different countries. The anchorage system is the most important in the CRS and the rules of universal anchor are to provide devices which are independent of safety belts. A new concept called International Standard Organization Fixture (ISOFIX) has been announced. It suggests some designs for the CRS. In this study, the suggested designs are evaluated with domestic products. Tests are performed and the results are incorporated into a finite element modeling process. As the finite element model is established, various numerical tests are conducted and the numerical results are discussed. A commercial software system is utilized for the nonlinear finite element analysis.

  • The actual behavior of joint is traditionally disregarded in steel frame design. In fact, the structural analysis of steel frames is generally carried out by assuming that joints fulfil the ideal condition of either a hinge or a fixed-end restraints. In this way, calculations are made somewhat simpler, but the structural model is not able to reflect the actual structural response. Therefore, steel frame classification system for estimation or analysis about behavior of steel frame should be established, and range that each connections belongs should be divided definitely. This research presents realistic and practical moment-rotation relation through investigation and analysis of steel frame beam-to-column classification system.

  • This paper addresses a problem of machining determination of input quantity in a multi-stage flexible flow system with non-identical parallel machines considers a subcontracting, machining restraint, and machine yield. We develop a nonlinear programing with the objective of minimizing the sum of in-house processing cost and subcontracting cost. To solve this model, we introduce a single-processor parallel genetic algorithm(SPGA) to improve a weak point for the declined robustness of simple algorithm(SGA). The efficiency of the SPGA is examined in comparison with the SGA for the same problem. In of examination the SPGA is to provide the excellent solution than the solution of the SGA.

  • Distance relay is being used for transmission line protection. Recently, current differential relay is used with high reliability in power system. This kind of relay is reported that it has a reliable detection ability, even so high impedance faults take place in transmission line. Therefore it is expected to use and expand widely in many utilities. Tripping of the relay is decided according to the difference between differential and restraint current. However the tripping criterion can be changed by the manufacturers. This paper presents an operational scheme of current differential relay for transmission line protection with graphical model. It is developed for educational purpose for students interesting in power system and protection engineer in utility. MATLAB is used to establish the models.

  • Most important factor to consider funnel performance is exhaust gas temperature and exhaust gas concentration Electric equipments on the wheelhouse top affected exhaust gas temperature. So, it is important that electric equipments keep away from high temperature. Though exhaust gas concentration is not a regulation and restraint, the exhaust 9as can cause serious problems for the on-board air quality and result in irreversible damage to the ship and people. So, we pocus on the exhaust gas concentration also. When judge whether a measured concentration is acceptable or not, criteria based on the LTEL (Long Term Exposure Limit). In this paper, we carried out the smoke simulation study. For this analysis, we used FLUENT which is commercial CFD (Computational Fluid Dynamics) code.
