Bill of Lading and Effect of Commercial Arbitration Agreement -With Special Reference to English and American Decisions- (선하증권과 중재합의의 효력 - 영ㆍ미의 판례를 중심으로 -)

  • Incorporation of an arbitration clause by reference to other documents occurs in many international business transactions. The reference is either to another document that contains arbitration clause or to trading rules which contain the arbitration clause, without the main contract mentioning that arbitration has been agreed upon. In fact, incorporation by reference in to a contract of an arbitration clause set forth in another agreement is deemed valid in any number of circumstances, even when the parties to the two contractual instruments are not the same. Difficulties arise when, instead of an express arbitration provision, a contract contains a clause which refers to the trading rules of a certain trade association, so-called external arbitration clause. The U.S. courts which will presume that the parties intended to arbitrate under a particular set of rules when they expressly mentioned arbitration in their agreement, have sometimes refused to enforce contract clauses that do no more than refer to particular trading rules, even if these rules contain provisions binding the parties to arbitrate their disputes. The courts in such cases tend to be careful in determinig whether intent to arbitrate is present. In maritime contracts, the arbitration clause in a charter party is often referred to in the bill of lading. Such reference usually is held binding upon the parties to the contract of carriage, their knowledge of such practice being presumed. A nonsignatory may compell arbitration against a party to an arbitration agreement when that party has entered into a separate contractual relationship with the nonsignatory which incorporates the existing arbitration clause. If a party's arbitration clause is expressly incorporated into a bill of lading, nonsignatories … who are linked to that bill … may be bound to the arbitration agreement of others. An arbitration clause in a charterparty will be incorporated into a bill of lading if either - (a) there are specific words of incorporation in the bill, and the arbitration clause is so worded as to make sense in the context of the bill, and the clause dose not conflict with the express terms of the bill; or (b) there are general words of incorporation in the bill, and the arbitration clause or some other provision in the charter makes it clear that the clause is to govern disputes under the bill as well as under the charter. In all other cases, the arbitration clause is not incorporated into the bill.

Image Processing-based Validation of Unrecognizable Numbers in Severely Distorted License Plate Images

  • This paper presents an image processing-based validation method for unrecognizable numbers in severely distorted license plate images which have been degraded by various factors including low-resolution, low light-level, geometric distortion, and periodic noise. Existing vehicle license plate recognition (LPR) methods assume that most of the image degradation factors have been removed before performing the recognition of printed numbers and letters. If this is not the case, conventional LPR becomes impossible. The proposed method adopts a novel approach where a set of reference number images are intentionally degraded using the same factors estimated from the input image. After a series of image processing steps, including geometric transformation, super-resolution, and filtering, a comparison using cross-correlation between the intentionally degraded reference and the input images can provide a successful identification of the visually unrecognizable numbers. The proposed method makes it possible to validate numbers in a license plate image taken under low light-level conditions. In the experiment, using an extended set of test images that are unrecognizable to human vision, the proposed method provides a successful recognition rate of over 95%, whereas most existing LPR methods fail due to the severe distortion.

Changes in Dietary Guidance: Implications for Food Composition Tables

  • New Dietary Reference Intakes (DRIs) forthe United States and Canada have recently been set for both macronutrients and micronutrients, and are likely to be of interest to health professionals in Korea as well. DRIs are now available for nutrients that did not have Recommended Dietary Allowances set in the past (amino acids, n-3 and n-6 fatty acids, total fiber, added sugar, choline, boron, nickel, and vanadium). Furthermore, the units for the DRIs do not always match those traditionally carried on food composition tables (FCTs). FCT developers will also need to consider carrying new variables to allow the calculation of folate intake in $\mu$g of dietary folate equivalents, vitamin E intake as mg of a-tocopherol (not as mg of a-tocopherol equivalents), and vitamin A intake as $\mu$g of retinol activity equivalents (not as $\mu$g of retinol equivalents). Because the new recommendations for upper levels of intake sometimes refer to a specific form or source of a nutrient, nutrients occurring in foods must be separated from added or supplemental forms for vitamin E, niacin, and folate; pharmacological magnesium must be carried as a separate variable; and preformed vitamin A must be separated from vitamin A from carotenoids. The Modified LVQ method for Performance Improvement of Pattern Classification (패턴 분류 성능을 개선하기 위한 수정된 LVQ 방식)

  • This paper presents the modified LVQ method for performance improvement of pattern classification. The proposed method uses the skewness of probability distribution between the input vectors and the reference vectors. During training, the reference vectors are closest to the input vectors using the probabilistic distribution of the input vectors, and they are positioned to approximate the decision surfaces of the theoretical Bayes classifier. In order to verify the effectiveness of the proposed method, we performed experiments on the Gaussian distribution data set, and the Fisher's IRIS data set. The experimental results show that the proposed method considerably improves on the performance of the LVQ1, LVQ2, and GLVQ.

Fast FCS-MPC-Based SVPWM Method to Reduce Switching States of Multilevel Cascaded H-Bridge STATCOMs

  • Finite control set model-predictive control (FCS-MPC) has received increasing attentions due to its outstanding dynamic performance. It is being widely used in power converters and multilevel inverters. However, FCS-MPC requires a lot of calculations, especially for multilevel-cascaded H-bridge (CHB) static synchronous compensators (STATCOMs), since it has to take account of all the feasible voltage vectors of inverters. Hence, an improved five-segment space vector pulse width modulation (SVPWM) method based on the non-orthogonal static reference frames is proposed. The proposed SVPWM method has a lower number of switching states and requires fewer computations than the conventional method. As a result, it makes FCS-MPC more efficient for multilevel cascaded H-bridge STATCOMs. The partial cost function is adopted to sequentially solve for the reference current and capacitor voltage. The proposed FCS-MPC method can reduce the calculation burden of the FCS-MPC strategy, and reduce both the switching frequency and power losses. Simulation and experimental results validate the excellent performance of the proposed method when compared with the conventional approach.

  • This study applied reference metadata recognition using bidirectional GRU-CRF model based on pre-trained language model. The experimental group consists of 161,315 references extracted by 53,562 academic documents in PDF format collected from 40 journals published in 2018 based on rules. In order to construct an experiment set. This study was conducted to automatically extract the references from academic literature in PDF format. Through this study, the language model with the highest performance was identified, and additional experiments were conducted on the model to compare the recognition performance according to the size of the training set. Finally, the performance of each metadata was confirmed.

A Study to Establish Target Exposure Index for Chest Radiography (흉부방사선검사의 목표노출지수 설정을 위한 연구)

  • This study purpose to establish an appropriate target exposure index(EIT) using dose area product(DAP) and exposure index(EI) based on chest radiography. First, the system response experiment was conducted with radiation quality of RQA5 to compare the dosimetry and dose area product of equipment. Next, EI and DAP were acquired and analyzed while varying the dose in the diagnostic at 70kVp using a human body model phantom. The signal to noise ratio(SNR) of the obtained results was analyzed in the diagnostic with in the diagnostic reference level(DRL) application range. The DRL at percentage 25% had a dose of 0.17 mGy and EI was 83, and at percentage 75% the dose was 0.68 mGy and EI was 344. As the dose increased, the SNR in the subdiaphragm increased. To set the EIT, calibration must first be performed using a dosimeter and set within the DRL range to reflect the needs of the medical institution.

  • The thermo-hydro-mechanical (T-H-M) process is one of major issues in the performance assessment of a high level waste (HLW) repository. An engineering-scale test was planned and its experimental set-up has being installed, to validate the T-H-M behavior in the buffer of a reference disposal system. The experimental set-up consists of 4 major components: the confining cylinder with its hydration water tank, the bentonite block, the heating system, and the sensors and instruments. The monitoring and data acquisition system is employed to control the heater to maintain the temperature of $95^{\circ}C$ at the interface of the heater and bentonite blocks and to collect signals from sensors and instruments installed in the bentonite blocks.

  • In this paper, we propose a high performance L1 cache structure for the high clock CPU. The proposed cache memory consists of three parts, i.e., a direct-mapped cache to support fast access time, a two-way set associative buffer to reduce miss ratio, and a way-select table. The most recently accessed data is stored in the direct-mapped cache. If a data has a high probability of a repeated reference, when the data is replaced from the direct-mapped cache, the data is stored into the two-way set associative buffer. For the high performance and fast access time, we propose an one way among two ways set associative buffer is selectively accessed based on the way-select table (WST). According to simulation results, access time can be reduced by about 7% and 40% comparing with a direct cache and Intel i7-6700 with two times more space respectively.

Establishment of Quantitative Analysis Method for Genetically Modified Maize Using a Reference Plasmid and Novel Primers

  • For the quantitative analysis of genetically modified (GM) maize in processed foods, primer sets and probes based on the 35S promoter (p35S), nopaline synthase terminator (tNOS), p35S-hsp70 intron, and zSSIIb gene encoding starch synthase II for intrinsic control were designed. Polymerase chain reaction (PCR) products (80~101 bp) were specifically amplified and the primer sets targeting the smaller regions (80 or 81 bp) were more sensitive than those targeting the larger regions (94 or 101 bp). Particularly, the primer set 35F1-R1 for p35S targeting 81 bp of sequence was even more sensitive than that targeting 101 bp of sequence by a 3-log scale. The target DNA fragments were also specifically amplified from all GM labeled food samples except for one item we tested when 35F1-R1 primer set was applied. A reference plasmid pGMmaize (3 kb) including the smaller PCR products for p35S, tNOS, p35S-hsp70 intron, and the zSSIIb gene was constructed for real-time PCR (RT-PCR). The linearity of standard curves was confirmed by using diluents ranging from $2{\times}10^1{\sim}10^5$ copies of pGMmaize and the $R^2$ values ranged from 0.999~1.000. In the RT-PCR, the detection limit using the novel primer/probe sets was 5 pg of genomic DNA from MON810 line indicating that the primer sets targeting the smaller regions (80 or 81 bp) could be used for highly sensitive detection of foreign DNA fragments from GM maize in processed foods.
