A Study on Arbitration Qualification of Intellectual Property Right Dispute - Focus on Korea and China - (지적재산권분쟁의 중재적격에 관한 연구 -한국과 중국을 중심으로-)

  • In the intellectual based society of the 21th century, intellectual property of nation and enterprise management has been the key element of nation's competitiveness and development. Therefore in countries like Korea, China, and many other countries, intellectual property of advancement strategy are being constructed and intellectual properties are protected at national level. Top priority task of protecting the intellectual property is to efficiently resolute intellectual property right disputes. Considering the nature of intellectual property right and arbitrage system, arbitration to solve intellectual property disputes is realistically the best method. However, not all cases of them are qualified. In order to relieve the intellectual property disputes through arbitration, qualification must be obtained. During the process, generally and globally, intellectual property right dispute is evaluated by three parts, intellectual property right contract dispute, intellectual property right violation dispute, and intellectual property right validity dispute. Based on UN's "Convention on the Recognition and Enforcement of Foreign Arbitral Awards Agreement" in 1958, June 10th, in New York, both arbitrage organization and judgment can be approved in both Korea and China countries. However, as of today, there is a big gap of arbitration qualification between two countries, which can be troublesome if intellectual property right disputes arise. For instance, in Korea, intellectual property right contract disputes and intellectual property right violation disputes are both generally accepted as arbitration qualification. However for intellectual property right validity dispute, arbitration qualification is only accepted for non-registered intellectual property as in copyright entity. It does not apply to other registered intellectual property right as in patents. In China, arbitration qualification is accepted for intellectual property right contract dispute, and also accepted for intellectual property right violation dispute to copyrights but restricted to others. As for intellectual property right validity dispute, arbitration qualification is completely denied. Therefore, when there is an intellectual property right dispute between Korea and China, the biggest problem is whether China will accept arbitrage judgments made in Korea. Theoretically, arbitrage judgement made in Korea should be also accepted in China's court. However, considering the criticism of China's passive nature of arbitration qualification for its own local intellectual property right disputes, it's very unlikely they'll actively accept arbitrary judgment made in foreign countries. Korea and China must have a more open minded approach for intellectual property disputes and arbitration qualification. Base on WTO's Intellectual Property Right Agreement, it's being defined as private right. Therefore, sovereign principle should be the basic principle of solving intellectual property right disputes. Currently, arbitration qualification is expanding internationally. So both Korea and China must also follow the trend expand the arbitration qualification with a more open minded and forward looking approach, for the good of intellectual property disputes.

  • Due to developments in information technology and ensuing changes in the concept of time and space, the significance of national boundaries has been weakened, bringing to attention the heightened competition among nations. In order to respond to these transformations, the Korean government is increasing its efforts to raise the authenticity of the National Technology Qualification System(NTQS) by closely linking NTQS testing method and procedure to practical knowledge and skills in the industry field. This initiative is based on the recognition that the human resources development is a crucial factor in determining a nation's competitiveness. This study aimed, first of all, to diagnose the problems directly and indirectly affecting the testing method in the current NTQS. And then, differentiated solutions according to grade and improvements in the testing infrastructure were suggested. The ultimate purpose was to provide a blueprint for enhancing national competitiveness through increased authenticity and efficiency of the NTQS. Research methods applied during this study include: the collection and review of qualification-related literature; a series of conferences with leading experts; interviews with vocational educators and researchers from qualification-related institutes; a survey of national qualification holders from a variety of professions and industries; and participatory observation at qualification exam centers. This research suggested policy recommendations as follows; First, measures to improve for testing method of professional engineer Second, measures to improve for testing method of Master craftsman Third, measures to improve for testing method of Engineer, Industrial Engineer, Craftsman Fourth, plans for the establishment of operation system for a computerized testing Fifth, institutional perspective on establishing qualification infrastructure Sixth, operational perspective on establishing qualification infrastructure

  • The equipment composed of many complicated electronic stuffs undergoes diverse stresses caused by mechanical vibrations during its service. Thus, to ensure its proper operation in the field a simulated vibration test has to be carried out in the laboratory with the Vibration Qualification Level, the test specification, which can include the real environment. In this paper we intent to deal with method and procedure for determining the Vibration Qualification Level so as to estimate the vibration-endurance for the equipment precisely.

  • Along with the international technology transfer market, as the domestic market grows, more professional technology analysts are needed and it became more necessary to investigate the qualification of those experts to cope with growing market. In this study, the current working condition of those experts is described, qualification system is analyzed and more realistic suggestions on the system to activate the market and to encourage the experts will be introduced. The study was performed based on the questionnaire sent to the person who works in related fields, such as industry, technology transfer center, universities, etc.

  • The International System for Education and Qualification of Welding Personnel has been implemented based on the harmonized European System for education and qualification of welding personnel. This paper gives an overview of the International System focusing on the training guidelines and the quality assurance system developed. Systems for harmonization of Certification of Welding Personnel and for supporting companies using welding to implement ISO 3834 have been developed by EWF and are presently being transferred to IIW in line with the EWF/IIW agreement established in 2000.

  • The current government strives to train those supposed to drive the national economy, and bridge the gap between qualification and industrial sites through competency-based qualification systems, not the educational background. In this regards, the government is planning to adopt the course evaluation qualification system. The course evaluation qualification system, on a basis of the NCS, is a system to qualify certain people completing the education and training fulling a specific requirement for a national technical qualification in case they meet the internally and externally assessed criteria. This can be seen as an attempt to practically link between job training and qualifications. The NCS model and learning module in the cadastral field are already utilized as the training and eduction in the specialized school and colleges. However, the current national technical qualification system is considered as a main system because the course evaluation qualification system has not been introduced yet. This study analyzed the process of the course evaluation qualification system, and conducted a survey to solicit feedback on introduction of course evaluation qualification system, Besides, the NCS evaluation model is presented in order for the introduction of course evaluation qualification system in the cadastral fields.

A Study on Correlations of Job Competence and Job Fitness with Functions of National Technical Qualification in Mechanical Field (기계분야 국가기술자격 기능에 따른 직무능력 직무적합성과의 관계에 관한 연구)

  • To determine the influence of qualification on field and currency, the model is presented that there is the connection between job competence and job fit about the function of qualification. To find out this connection, the study is being done and based on this, a clue of qualification on field and currency is tried to figure out. First, in case of national technical qualification holders in Machinery field, the type of the function of qualification(signal, guide, screen functions) of job competence and job fit shows correlation between them. Second, the job competence and job fit of the owner of national technical qualification in Machinery field is mostly affected by signal function. Thirdly, the mediating effect of job competence on the effect of the function of qualification on job-fit is showed by the types of function of qualification. Guide function does not have any mediation effect, but signal function and screen function have the mediation effect. Especially, out of all, signal function is the most affecting factor of mediating effect. Lastly, the model of the relationship between subordinate factors by types of function of qualification on job competence and job fitis presented.

  • The purpose of this research was to draw implications for preparing utilizing and management course assessment type of national technical qualification based on the awareness of teachers in industrial secondary vocational high schools. To achieve it, this researcher analyzed the awareness about management course assessment type of national technical qualification of teachers at industrial secondary vocational high schools and analyze possibility to introduce course assessment qualification, degree of agreement for expected effects, and importance and necessity for the matters to be considered when introducing management course assessment qualification. Concrete results of this research are as follows. First, the degree of understanding management course assessment type of national technical qualification at industrial secondary vocational high schools was common, but the degree of agreement for introducing goal, purpose, and necessities was low. Second, for the expected effects to be obtained when acquiring course assessment qualifications, there were acquisition of qualification at the same time of education, suggestion of studying goal from an angle of concrete and significant performance, systematic education based on NCS, possibility to develop and form training career, and possibility to acquire industrial field-centered knowledge and technology in order. Third, to draw priority of each item to be considered when introducing course assessment type of national technical qualification at industrial secondary vocational high schools, the importance and necessities were analyzed. As a result, for the sectors whose requirements are more than average, there were flexibility of course assessment type qualification classes, preparation of proper measure by NCS revision, relief of edited classes of necessity ability unit, etc.

  • In order to promote software industry, it is essential to train and utilize specialized software human resources in the industry. It is required to establish an appropriate qualification system for the industry in order to train and utilize the qualified human resources. The current national qualification system in the IT area cannot cope with the development of software industry and does not provide various qualifications required to the software workers. We analyze the problems of the current national qualification system for the software industry and propose a framework for improving the qualification system. Based on the review of the software skill standard and a range of technology levels, we suggest a new integrated qualification system that provides a variety of qualifications for various software skills at various levels. Also we propose policy alternatives for institutionalizing the new qualification system.
