A Study on the Maritime Law According to the Occurrence of Marine Accidents of MASS(Maritime Autonomous Surface Ship) (자율운항선박의 해양사고 발생에 따른 해상법적 고찰)

  • Recently, with the rapid development of ICT(Information and Communication Technology) and AI(Artificial Intelligence) technology industries, the emergence of MASS(Maritime Autonomous Surface Ship), which were thought only in the distant future, is approaching a reality. Along with the development of these amazing technologies, changes in the private law sector, such as liability, compensation for damages, and maritime insurance, as well as in the public law sector, such as maritime safety, marine environment protection, and maintenance of maritime order, have become necessary in the field of maritime law. In particular, with the advent of a new type of ship called MASS that does not have a crew on board, the kind and type of liability, compensation for damages, and insurance contracts in the event of a marine accident will also change. In this paper, the general theory about concept, classification, effectiveness and future of MASS and the general theory about concept and various obligations and responsibilities under the maritime law for discussion of MASS are reviewed. Next, in addition, regarding the problems that may occur in the event of a marine accident from MASS, the status as a ship, the legal relationship of the chartering contract, obligation to exercise due diligence in making the vessel seaworthiness, subject of responsibility, and liability for damages and immunity are reviewed from the perspective of maritime law. In addition, in the degree four of MASS, the necessities of further research to clarify the attributable subjects and standards of responsibility in the event of a marine accident, as well as the necessities of institutional improvement such as technology development, enactment and amendment of law and funding are presented.

A Discussion on Container Loss Accidents and Responses During Ship Voyage (선박 운항 중 컨테이너 해상유실 사고 및 대응에 관한 고찰)

  • In 2021, the Joint Group of Experts on the Scientific Aspects of Marine Environmental Protection (GESAMP), a U.N. advisory research institute, cited container loss as one of six sources of marine litters in shipping. The sinking of the X-P ress Pearl in May 2021 caused a catastrophic environmental pollution accident in which the loaded containers were moved to the shore, and the plastic pellets were loaded inside covered the coast of Sri Lanka. With this history, the International Maritime Organization (IMO) will discuss prevention and follow-up measures for container loss during ship voyages, as an agenda at the 8th Sub Committee on Carriage of Cargoes and Containers meeting in September 2022. To establish Korea's response direction at the IMO meeting, this study identified major causes of container loss accidents, and considered the response through analysis based on the accident investigation report and related professional data. As a result, it was found that the major cause of container loss during voyages was the enlargement of container ships, bad weather, and poor loading of containers. In particular, the need to prepare countermeasures for the deterioration of the operational safety of large container ships due to bad weather was identified. Additionally, integrated monitoring of the implementation of international conventions is required, for the safe sea transportation of container cargo. In particular, in terms of preservation of the marine environment, it is necessary to supplement the system for the recovery of lost containers. Finally, it was found that it is necessary to establish systems that can complement each other in the shipbuilding and shipping industries, in terms of shipbuilding as well as ship operation, to fundamentally prevent container loss accidents at sea. It is judged that it is difficult to resolve the various factors of container loss at sea during voyages, by responding from an individual perspective.

  • Fishing village is becoming the central base of fishing industry and it plays a major role. However, there is a decrement of marine resources and some difficulties with the deterioration of fishing industry management. In order to solve these problems, there should be some developments(e.g. fishing village toursim development) on various undergoing government and the private organization programs. Nevertheless, there are not guidelines for fishing village tourism development to utilize for practical business. Therefore, it is necessary to understand the current status and guidelines regarding the development of fishing village for coastal planner. The primary purpose of this study is to investigate the characteristics of fishing village development works in Korea and Japan. The second purpose is to identifie success factors after analyzing individual success cases. Based on evidence from the literature and a dialogue with village leader, a literature review on extracting success cases for guidelines were selected according to criteria such as the degree of contribution to an increase in income of the fishing village, the degree of contribution to an increase in consumption of marine products using local natural resources, the number of tourists that visits the village. Finally we propose guidelines for future fishing village development projects. The guidelines based on the successful cases, as well as the major factors about the objectives and direction of fishing village tourism development, suggested as follows. 1)Plans for land use, 2)Development of tourist resources, 3)Plans for views, 4)Plans for resource protection, 5)Plans for operation and marketing.

An Electrochemical Evaluation on the Corrosion Property of Metallizing Film (용사 도막의 내식성에 관한 전기화학적 평가)

  • There are many surface protection methods for numerous steel structures being used under severely corrosive environment, one of them, metallizing(thermal spray) is a available protection method which is comparatively and recently developed for surrface protection of various steel structures. However coating film obtained by spraying is to be needed increasingly more good corrosion resistance due to accelerating of environmental contamination. In this study, coating films(DFT:$200{\mu}m$) are performed with arc spray by wire metal and their types of films are pure zinc, pure aluminum, alloy film(Al:Zn=85:15) and alloy film(Al:Zn=95:5). And corrosion resistance of their films was investigated with electrochemical methods in seawater solution. Pure aluminum film showed a relatively somewhat good corrosion resistance compared to among those of other films and alloy films also showed a good corrosion resistance compared to pure zinc film. Especially it was observed that pure aluminum film showed a comparatively good corrosion resistance than that of alloy film named as galvarium spray(Al:Zn=85:15) in seawater solution. Morphology of corroded surface of pure zinc film appeared the pattern like intergranlar corrosion, however films of pure aluminum and alloy metal showed a general corrosion pattern.

Assessment of Environmental Radioactivity Surveillance Results around Korean Nuclear Power Utilization Facilities in 2017

  • Background: Government conducts environmental radioactivity surveillance for verification purpose around nuclear facilities based on the Nuclear Safety Law and issues a surveillance report every year. This study aims to evaluate the short and the long-term fluctuation of radionuclides detected above MDC and their origins using concentration ratios between these radionuclides. Materials and Methods: Sample media for verification surveillance are air, rainwater, groundwater, soil, and milk for terrestrial samples, and seawater, marine sediment, fish, and seaweed for marine samples. Gamma-emitting radionuclides including $^{137}Cs$, $^{90}Sr$, Pu, $^3H$, and $^{14}C$ are evaluated in these samples. Results and Discussion: According to the result of the environmental radioactivity verification surveillance in the vicinity of nuclear power facilities in 2017, the anthropogenic radionuclides were not detected in most of the environmental samples except for the detection of a trace level of $^{137}Cs$, $^{90}Sr$, Pu, and $^{131}I$ in some samples. Radioactivity concentration ratios between the anthropogenic radionuclides ($^{137}Cs/^{90}Sr$, $^{137}Cs/^{239+240}Pu$, $^{90}Sr/^{239+240}Pu$) were similar to those reported in the environmental samples, which were affected by the global fallout of the past nuclear weapon test, and Pu atomic ratios ($^{240}Pu/^{239}Pu$) in the terrestrial sample and marine sample showed significant differences due to the different input pathway and the Pu source. Radioactive iodine ($^{131}I$) was detected at the range of < $5.6-190mBq{\cdot}kg-fresh^{-1}$ in the gulfweed and sea trumpet collected from the area of Kori and Wolsong intake and discharge. A high level of $^3H$ was observed in the air (Sangbong: $0.688{\pm}0.841Bq{\cdot}m^{-3}$) and the precipitation (Meteorology Post: $199{\pm}126Bq{\cdot}L^{-1}$) samples of the Wolsong nuclear power plant (NPP). $^3H$ concentration in the precipitation and pine needle samples showed typical variation pattern with the distance and the wind direction from the stack due to the gaseous release of $^3H$ in Wolsong NPP. Conclusion: Except for the detection of a trace level of $^{137}Cs$, $^{90}Sr$, Pu, and $^{131}I$ in some samples, anthropogenic radionuclides were below MDC in most of the environmental samples. Overall, no unusual radionuclides and abnormal concentration were detected in the 2017's surveillance result for verification. This research will be available in the assessment of environment around nuclear facilities in the event of radioactive material release.

WETLANDS CONSERVATION AND ITS VISION FOR TAIWAN

  • Wetlands provide vital habitats for fish and wildlife while offering numerous other benefits. As in some other countries, however, Taiwan has witnessed the loss of a significant portion of its coastal wetlands due to large-scale reclamation projects along the coast. Most of the wetlands that still remain are seriously being threatened by both human activities and natural changes, such as drainage for agricultural production, filling for industrial development, discharge of wastes and drought. The administrative performance of the existing authorities and legislation in Taiwan has mostly been ineffective in protecting these precious, sensitive areas. This paper introduces the distribution of wetlands in Taiwan and highlights their invaluable functions and potential economic value. It also discussed the recent activities, both initiated by the government and the NGOs, to protect wetlands in Taiwan. Based on the above discussion, the paper identifies the wide-range of current problems related to their management and proposes the vision should have to save wetlands for the future. It argues that establishing clear policies and effective institutional mechanisms on wetland protection and conservation, classifying the wetlands for better management, and fully promoting public awareness and consciousness of the importance of the wetlands will not only be beneficial but will also address the urgent need to safeguard the wetlands in Taiwan. Additionally, the paper recognizes that international cooperation and collaboration on wetland restoration is essential and most challenging.

A Study on the Problems and Improvements in the Related Law in order to Introduction of the Electronic Letter of Credit in Korea (한국의 전자신용장 도입을 위한 관련 법률상의 문제점과 개선방안에 관한 연구)

  • The 21st century is witnessing the explosive increase in the usage of internet and international electronic transactions. Due to the unique characteristics of the electronic information, substantial part of such transaction can and do take the form of cross-border transactions. However, there have not been settled appropriate set of rules applicable to the international electronic transactions. Currently, in respect to e-L/C transactions in international trade, there are laws such as Electronic Transaction Basic Act in our country, E-Trade Promotion Act, E-Signature Law, Act on Promotion of Information and Communication Network Utilization and Information Protection and Marine Charter 5 in the Commercial Law. Nevertheless, a complete legislation, that is a uniform rule for e L/C which could support e L/C transactions fully hasn't been established yet. Accordingly, those laws concerned need to improve to regulate e-L/C transactions. The purpose of this paper is to look into the national status for law readjustment to prepare for a new electronic environment and to use appropriately the e-L/C issued by electronic means, and to conduct a comparative analysis on the related regulations to introduce a pertinent laws and propose related regulations to contribute to the making of effective laws to regulate e-L/C.

Valorization of Cork Waste to Improve the Anti-Corrosion Properties of Concrete Reinforcements

  • Corrosion of steel reinforcement is the most important mode of concrete structures damages. It strongly depends on the composition and physicochemical properties of the cementitious medium. The use of waste materials as lightweight aggregates in concrete is environmentally recommended in polluted environments such as marine and/or industrial atmospheres in order to reduce its porosity and ensure the requested protection of reinforcing steel. The present study investigated the effect of waste cork addition on corrosion resistance of steel rebar in mortar specimen prepared in the laboratory. The main objective of this study was to improve the corrosion resistance of reinforcing steel. Another objective of this study was to valorize this ecological product and preserve the environment. Results obtained from various electrochemical tests indicated that the presence of a fine cork powder substantially improved the corrosion resistance of steel in the mortar contaminated by chloride ions. This improvement was reflected by a notable decrease in corrosion current density and a shift of corrosion potential of the steel towards more noble values. Moreover, the presence of a fine cork powder in the mortar had no adverse effect on its mechanical properties.

A Study on the Impact of the COVID-19 Pandemic on the Rights and OSH of Seafarers and Tendency in 2022 Amendments of Maritime Labour Convention (팬데믹이 선원의 권리 및 안전보건에 미친 영향과 2022년 해사노동협약 개정 동향 연구)

  • The COVID-19 pandemic can be deemed one of the greatest hardships faced by mankind in the 21st century. All industries have been severely affected and workers are still experiencing deep difficulties due to the changed working and living environment. Seafarers have been recognized by the international community as key workers since the pandemic began. They are also working internationally to establish a Level Playing Field through the protection of their rights through the Seafarers' Employment Agreement and the implementation of international labour standards. However, despite the obligations under international conventions to be implemented by State parties and the recommendations by international organizations, the rights of seafarers under the Maritime Labour Convention were violated were violated and their occupational safety and health of seafarers were further threatened throughout the pandemic. This article analyzes the impact of the international shipping industry and the implementation of the Maritime Labour Convention based on each country's measures during the COVID-19 pandemic. Furthermore, the amendments of the Maritime Labour Convention adopted through the fourth Special Tripartite Committee were analyzed based on the conference documents and reports to comprehend the implied meaning. The adopted eight amendments to the Maritime Labour Convention are expected to positively affect the seafarers' rights, safety and health in the future, but the international community's efforts should continue because the issues of maximum working hours, maximum service period on board, and the repatriation of seafarers still remain unsettled.

Fish Community Structures and Distribution Characteristics of Fisheries Resources in the Osip Stream and Wangpi Stream, Fishery Resources Protection Areas (내수면 수산자원보호구역 오십천 및 왕피천의 어류군집 구조 및 수산자원 분포특성)

  • The objectives of this study were to analyze the fish community structures and distribution characteristics of fisheries resources in the Osip Stream and Wangpi Stream, fishery resources protection areas. For the study, we conducted fish samplings four times in the two streams from April to October 2019. In Osip Stream and Wangpi Stream, we sampled 31 species and 29 species and the dominant species were Zacco platypus (28.6%) and Squalidus multimaculatus(41.7%), respectively. According to the life type of fish species, primary freshwater species were collected 18 species(58.1%) and 21 species(72.4%), and migration fishes were sampled 4 species (12.9%) and 6 species (20.7%) in Osip Stream and Wangpi Stream, respectively. Fisheries resources species showed high relative abundance in June, and the fish biomass was highest in October. As a results of comparing the previous studies with this study, both rivers showed high biodiversity and were found to maintain stable populations of fishes. According to analysis of tolerance guilds, the proportion of tolerant species, based on the number of individuals, was composed of 14.4% and 1.1% in Osip Stream and Wangpi Stream, respectively. This very low ratio of tolerant species confirmed that both streams have very good physiochemical environment conditions. From the above results, it was judged that the fishery resource protection areas of Osip Stream and Wangpi Stream have high ecological function and preservation value. For sustainable use and management of fishery resource protection areas of Osip Stream and Wangpi Stream, it is suggested that biological disturbance management, fish discharge projects considering environmental capacity, efforts to improve the habitat environment, and establishing a fishery resource protection areas management system were necessary as considerations.
