제품안전분야의 국내표준 개발을 위한 로드맵의 개발 (Development of a Road-map for Promoting Product Safety Standards)

  • In 2002 Product Liability Act newly got into effect in Korea so that efforts for Product Safety got a new chance to promote safety standardization. Under the supervision of the Korean Agency for Technology and Standards (ATS) and the Korea Standards Association (KSA), the enterprise titled "Standardization of Product Safety" took the first step in 2000. Thenceforth a lot of standards and guidelines for product safety have been developed. The results of the enterprise were in the type of technical manual as well as report, technical guidelines, and specific technical safety standards. In this paper, the authors narrated those sequential efforts for Product Safety, and introduced the basic concept on which standardization of Product Safety Management System was conducted and individual safety standard has been developed. Based on this systematic concept, a global road-map as well as specific road-maps for developing safety standards in individual industry were supplied. Finally, suggestions for proceeding to the whole risk management system including other risky factors were appended.

자가용 전기설비 안전관리자의 PL인식 조사 및 사고사례 연구 (The Study on Facility Accident Case and PL Recognition of the Safety Manager in Electric Installation for Private Use)

  • 본 논문에서는 자가용 전기설비에서 전기안전관리자의 PL인식과 전기설비의 사고발생에 관한 것을 조사하였다. 설문대상은 자가용 수용가 450호를 선정하였으며, 이중 154호가 설문에 응신하여 35.8[%]를 차지하였다 전기안전관리자의 58[%]는 PL에 관해 잘 알고 있었으며, 42[%]는 인식하고 있지 않았다. 이들 중 82.4[%]는 전기설비에 PL법이 적용되어야 된다고 하였으며, 5.8[%]만이 PL법의 적용이 필요 없다고 대답하였다. PL적용의 이유로는 전기설비와 제품의 안정성을 위한 것이 64[%], 동일사고의 방지가 19[%]를 차지하였다. 또한 변압기 사고가 가장 많은 부분을 차지하였으며, 케이블 사고가 그 뒤를 따랐다. 설문조사 결과로부터, 전기안전관리자들은 PL내용에 많은 관심이 있었으며, 그들은 전기사고에 관한 PL적용의 필요성을 기대하고 있었다.

제조물책임법상 제조물로서 의약품의 결함 (Defective Medicine according to Product Liability Law)

  • In Product Liability law, the 'defection' of the manufactured products is its key concept, defined in detail. The concept had been already developed through the precedents and theories for the past years even before the PL law was enacted and the concept was listed. Especially, the medicine products need the different approach, because they might directly harm to the human life and body due to their being injected or taken, unlikely other manufactured articles. Since the medical products have the double contradictory functions such as effects and side effects, the defection decisions become so difficult. However, because there are high concerns that wrong medical products will directly harm the human life and body, the decision standards should be more strengthened. The decision standards should include the risk-effect standard as the considered components and make the customer-expecting standard as the final standard. The decision time for defection should be made considering the science technology level when the medical products were provided, not when the accident occurred. It is the most important for the manufacturers to prevent the damages by making and selling the non-defective medicine products for themselves, rather than by taking the legal remedy means afterwards. Therefore, the non-defective guidelines for the medicine manufacturers will help increase the effects and minimize the side-effects.

22.9[kV]이하 XLPE 전력케이블의 열 충격 시험 및 절연파괴 특성 (The Properties of Dielectric Breakdown and Thermal Stresses below 22.9[kV] Class XLPE Power Cable)

  • 2002년부터 시행되어오고 있는 제조물 책임법에 의해 사고케이블의 원인분석과 사고패턴에 대한 데이터베이스화가 중요하다. 더욱이 가속열화상태에서 전력케이블 사고의 패턴 및 모의실험은 데이터베이스 시스템 구축에 필요하다. 본 논문에서는 열 열화 따른 22.9[kV]이하 케이블의 열 충격시험을 수행하였다. 이 시험은 IEC60811-3-1에 따른다. 시험결과로부터, 22.9[kV]급 A사 전력케이블은 표면이 변색되었고 길이방향으로 급격하게 감소되었다. 특히, A사 전력케이블의 열 중량 특성이 심하게 변함에 따라, 케이블 제조상의 문제일 것이라 추측된다. 만약 전력케이블의 제조상의 결함에 의한 것이라면, 피해자들은 PL환경 하에 손해배상을 받을 수 있을 것이다.

  • As consumer, one of the most important things how to get manufactured good is an assurance of quality. We have a consumer protection law which is weaker than product liability law(so called PL law), but stronger than civil law. In this special issue, we want to explain PL law which will be legislated within not long time and to propose a method of protection and defence in building and housing field. As the quality control of constructor, ISO 9000 series for quality assurance and CM (Construction Management) for quality assister are concerned in all construction process. Therefore, above mentioned PL law is very serious problems which are applied in apartment housing, if applied, a little part as not real estate will be possible.

PL시대에 있어서 품질보증을 위한 공정관리기법 (Process Control Techniques for Quality Assurance in the Product Liability Age)

  • In the product liability age the demand on quality is extremely high and inspection and test are automated. The process capability indices $C_p, {\;}C_{pk}$ and p control chart widely used to provide unitless measure of process performance and process control. Traditional process capability indices $C_p, {\;}C_{pk}$ do not represent the process variation from target value. The convention p chart for control of fraction nonconforming becomes inadequate when the fraction nonconforming becomes very small such as PPM level production system. This paper proposes process performance measure considering quadratic loss function and cumulative counts control chart for control of PPM level production system.

수입업자의 제조물책임(PL) 분쟁에 관한 연구 (A Study on the Dispute of Product Liability in Korean Importers)

  • Since enactment of the Product Liability Act(PLA) on July 2002, Enterprises in Korea should be insured the Product Liability under the Act. Therefore they had to make a special team and organize it to match with the Act. However, some enterprises didn't follow and prepare the team for the dispute resolution. For example, in America, many enterprises had been attacked the PLA and in Japan, as well. but Korea is rare for the PLA. Thus, this is to research the PLA for protecting the disputes. Upon this study, 1 would like to suggest some issues and a revision of the PLA. Those are the purpose of my research. In this study, it consists of 5 chapters for achieving the purpose of the research. Introduction of this study is mentioned in Chapter 1, and Chapter 2 is for outline of the PLA in Korea. At Chapter 3, the cases are analyzed in the disputes of importers to address important things we have to check. After the analysis, resolution methods in general on import practices are suggested at Chapter 4. Also, this study is summarized at Chapter 5 including further research. In this research, 1 find out complex of Product Liability insurance and issues related with PLA. For protecting the issues and disputes; importers should prepare a agreement of arbitration during the preparation of contracts. Nothing can be better than prevention on any disputes, but they can be happened sometimes without any intentions or by mistake. Solving these issues, the resolution methods of this research are the most valuable. The mediation and the negotiation do not force any legal matters. So, the dispute through them does not have a positive resolution, and the effectiveness of them is very low. Due to the resolution of issues, arbitration is a desirable resolution. In Korea, most people do not know about the arbitration due to the lack of understanding of arbitration. Currently arbitration related with Product Liability has not been followed up promptly because procedures and judgement from a court take for a long time. In sum, in order to solve the disputes properly, they should be supported by the arbitration system to concrete essential objectives, so to speak, protection of the victim and the improvement of arbitration. In addition, the systematic arrangements would be required to carry out all the methods above mentioned. Those are for manufacturers, importers, and customers for the dispute resolution.

PL법 환경을 고려한 배전 케이블 종단부의 전기적 사고 연구 (A Study on Electrical Accident of Distributing Cable Termination Considering PL Law Environment)

  • This paper introduces experimental investigates of an accident pattern for the distributing cross linking-polyethylene(XLPE) cable terminations considering product liability(PL) law environment. The influence of defects such as thickness and length decrease of XLPE, an impurity on XLPE and the gap between stress-con of housing and semi-conductor on insulating properties of the termination have been studied. The thickness and length decrease of XLPE decrease ac breakdown strengths. Breakdown traces of XLPE that is damaged by knife displayed ellipse shape. The gap of between stress-con and semiconductor deteriorates dielectric strength of XLPE seriously.

PL법 실행에 따른 ISO 9001;2000과 KS 및 제품 안전경영(PSM) 통합시스템 구축의 설계에 관한 연구 (Research about Integrated System construction design of ISO 9001;2000, KS and Product Safety Management by PL(Product Liability) law practice)

  • PL has been developed centering around England and America. Recently many countries are introducing PL system changing the world a single economic bloc based on the rapid development of Technology and Economy. This paper is studied with related literatures and theses, organizational consulting cases within the framework of the firm as the central operating bodies of PL system. In the past, Some papers about System Integration which was operated as a same Certificate System and enacted in a single organization, was studied and presented. But most of papers was a theoretical study related model and conception. In this situation Government supports PSMS of a single system at government expense to 100­200 companies for improving organizational confrontation ability of PL this year. This paper proposed a design and effect of Integration system model based on the analysis of ISO 9001:2000, KS, PSMS and ISO 14001. The integrated system has the following three distinctions. Firstly, KS is a national establishment, national leading certification and forcing standard. Secondly, ISO 9001:2000 and ISO 14001 are an international organization's establishment, non­official certification and optional standard. Finally, PSMS isn't a national law and forcing matter. And it isn't the concept of certification but the operational system by itself. Also if a lawsuit by defect is happened, it is very dangerous. This paper, which is integrated by four management systems and has many consulting cases, is the first in this department and is different from others. Also If people has the basic knowledge about management system, they can directly connect it to the organizational system according to this paper's guidance. It is very good result in this study because the law of PL is executed now.

중소 제조업의 융합모형 설계에 따른 핵심성과지표 적용 사례 (Application of KPI based on Coupling Model Design in Medium and Small Manufacturers)

  • It is important to manage quality and safety of a product for coping with fast-paced world effectively. This paper demonstrates an integrated model between ISO 9001 Quality Management System and Product Safety Management System. And the paper presents a method which decides key performance indicators (KPI) to be concentrated on the effectiveness of system operation. A case study shows an process for industry to implement the developed methodology.
