  • Purpose - When recovered through arbitration a contractual penalty that is disproportionately high can become grounds for challenging an arbitral award or an obstacle to its enforcement within Russian jurisdiction. This article investigates how violation of the principle of proportionality can affect the enforcement and challenging of arbitral awards in Russia. Based on the examination of the current legislation, along with the analysis of recent court cases on the subject, the ultimate object of this article is to discern practical recommendations for Korean practitioners who are looking to challenge and/or enforce arbitral awards in Russian courts. Design/methodology - The research process included the reviewing of current Russian legislation conducted in concurrence with academic literature review, searching and analyzing recent court cases where the relevant legal provisions and concepts were applied, and formulating practical implications of the research at its final stage. Analysis of recent court cases showed two conflicting trends of whether a disproportionate penalty can be considered a public policy violation. The authors offer practical recommendations on how to substantiate a relevant claim regarding contractual penalty reduction by the court, depending on the desired outcome. • This paper addresses legislation status of air route design standard of Korea. Korea Ministry of Construction and Transportation's Order Number 300 (March 28, 2001) prescribes that firstly, the design of air routes in Korea should be in accord with International Civil Aviation Organization(ICAO)'s recommendations published in Annex 11: Air Traffic Service and Procedures for Air Navigation Services: Aircraft Operations (ICAO Doc 8168-OPS, 1986), and secondly, United States Federal Aviation Administration(FAA)'s Terminal Instrument Procedures (FAA, 1976). An investigation on the current air route specifications of Korea reveals that they are in accord with neither ICAO's recommendations nor FAA's standards in that the width of Korea's air routes are narrower that the international recommendations and standards. As a member state of ICAO, it is imperative for Korea to follow the international standards. In that purposes, Korea should legislate and regulate the detail standard for air route design. For the legislation, FAA regulations are to be followed because FAA rules contains more detail specifications while ICAO recommendations includes allows a range of policy decisions, which may result in a confusion in practice.

  • Nowadays, crowdfunding presents a promising development. This research focuses on the influence of platform strategy and market response on the success of crowdfunding from the perspective of the elaboration likelihood model (ELM) theory. Detailed product specifications, crowdfunding difficulty coefficient, vivid advertising video such as introduction and music, and recommendations from relevant figures are all used to depict platform strategy. Meanwhile, we use the number of lovers, followers, comments and 1 RMB backers to measure the level of market response. And thus, we model the impact of platform strategy and market response on crowdfunding success with empirical studies based on 400 samples of observed value. We found firstly that there exist significant positive relations between the total amount of funds pledged and detailed product specification, vivid advertising video, recommendations from relevant figures and the number of 1 RMB backers. Secondly, the crowdfunding difficulty of projects affects negatively, and significantly, the total amount of funds pledged. Thirdly, the influence of the number of lovers and followers on funds pledged is not significant.
