해양경계획정제도에 대한 중국의 입장과 통킹만 사례고찰 (Maritime Boundary Delimitation Regime for the Gulf of Tonkin Dispute and China's Position)

  • Coastal states are adopting maritime boundary delimitation as their primary maritime policy because maritime jurisdiction directly relates to vast economic interest. This becomes specially important and sensitive when complex maritime boundary issues are involved between neighboring coastal states. China has not actively carried out nor declared maritime boundary delimitation until recently with any country except Agreement between China and Viet Nam on the demarcation of the territorial water, the exclusive economic zones and the continental shelf of China and Vet Nam in the Gulf of Tonkin on 25 December 2000 (hereinafter, the Gulf of Tonkin Agreement). The principles that governs maritime boundary delimitation are to consider primarily an agreement between States concerned, however, if no agreement can be reached, all relevant circumstances are considered to achieve an equity between concerned States. Relevant circumstances are length of coastline, form of coastline, existence and position of island or islands, speciality of geology/topography, and factor of economy and deffnce. Factors which sinologists are considering in regard to continental shelf delimitation of the Yellow Sea are as follows; i) geographical factor, ii) geological factor, iii) topographical factor, iv) environment and ecological (factor, v) historic interest, and vi) social and economic interest. The 'Gulf of Tonkin Agreement' is completed by basically applying the principle of delimitation according to median line which seems that China has adopted the maritime boundary delimitation principle of 'half and half' which was the intention of chinese government. At the same time, China recognized Viet Nam's dominion and sovereign right over the partial exclusive economic zone and the continental shelf of Dao Bach Long Vi in Gulf of Tonkin. This case can be considered as an example of mutual concession or compromise in delimiting maritime boundary for states of concerned.

우리나라 보건의료법의 현황과 과제 - 법정책학적 연구방법론을 중심으로 - (The Present State and Subject of Health Care Law System in Korea)

  • There is the limit of the traditional legal hermeneutics and fragmentary or individual theoretical legal approach to suggest the desirable solution of Korean health care law system to have many issues. Law & politics research is the legal research method to suggest the resonable understanding and seeking the measures through various approach, decide and evaluate that the legal methods can be functioned as the optimum system design. Law & politics research has some procedure. 1. It is demanded to catalog the comparison target of legal system by its topic. 2. It is demanded to compare it with Korean situation. 3. The realistic and empirical legal research to the compared policy alternatives is needed. 4. Reflecting the results of this research work, the desirable policy idea must be adopted. 5. The accomplishment of this policy idea must be come true as a specific legislation through interest coordination. 6. This plan must be come into force and the feedback to effect of society must be examined closely. Here I will review generally the contribution of law & politics research to health care law system because of the problem of time and the insufficiency of law & politics research. The constitutional consideration is important to support the interest coordination because of the shortage of resources. The comparative law research can compare our health care system with those of other countries and seek some desirable alternatives. If we discuss the law system plan in a long time and synthetically from different perspectives, more desirable helath care law system can be deducted.

  • In this paper, we propose the coordination scheme in a single-manufacturer-multiple-retailer supply chain system. Traditionally, the bargaining power of the single manufacturer is superior to those of retailers. The business environment supported by the e-business scheme may give rise to new business behavior. The multitude of retailer requests the manufacturer to relax the his unilateral lot-sizing policy while they are willing to compensate more than the manufacturer's expected loss caused by abandon his superior bargaining power. The side payment aggregated by the multiple retailers is transferred to the manufacturer according to the degree of the manufacturer's relaxation from the current unilateral lot-sizing policy.

  • The government had invested national resources in nano technology actively since 2000 to promote the R&D of nano technology. In addition, the government reorganized the science and technology administration system recently enacting new laws related with science and technology to promote the efficient policy of science and technology. At this point, we need to understand the status of national R&D expenditures for the efficient priority setting and budget coordination of national R&D expenditures by the concerned variables such as program objectives, sector of performance, character of work and technology fields and suggests the policy implications.

보건의료발전계획 수립의 시급한 필요성 (The Urgent Need to Establish the Plan for Development of Health and Medical Services)

  • Although 19 years have passed since the enforcement of the Framework Act on Health and Medical Services, the Plans for Development of Health and Medical Services has not been established. This Plan is a 5-year basic long-term plan that covers the whole of health and medical services. This Plan should point to the direction of 30 long-term plans of healthcare, and this Plan should serve as a combination and coordination of 30 long-term plans and 22 related laws. The United States, the United Kingdom, and Japan have established long-term healthcare plans (4-, 10-, and 20-year plans, respectively). The long-term health plan of the United States has been approached bottom-up, those of the United Kingdom and Japan have been approached top-down. The rapid environmental changes that Korea is and will be experiencing emphasize urgently the need for establishing the Plan for Development of Health and Medical Services.

EU의 스마트 전문화 및 미국의 제조업 르네상스 정책에 대한 비판적 검토와 한국 지역산업정책 방향 (A Critical Review of the EU Smart Specialization and US Manufacturing Renaissance Policies and New Directions for Regional Industrial Policy in Korea)

  • 본 논문은 EU의 스마트 전문화 전략과 미국의 제조업 르네상스 정책을 비판적으로 검토하고 한국 지역산업정책의 방향을 제안한다. EU의 스마트 전문화 전략은 기업가적인 자기발견과 전략적 조정, 미국의 제조업 르네상스 정책은 생태계에 기반한 산업공유자산의 구축, 그리고 한국의 지역산업정책은 클러스터에 기반한 지역혁신체제 구축으로 요약된다. EU와 미국 정책 사례는 지역산업정책이 지리적으로 착근되어야 한다는 점을 예증하고 있다. 또한 산업과 기술간 융 복합을 위해 산업정책과 혁신정책을 연계시킴으로써 정책수단 혼합의 적실성을 보여주고 있다. 그리고 국가의 역할도 산업 생태계에서 민주적인 규율을 착근시키는 조정자, 매개자로서 자리매김하고 있다. 이러한 점을 고려하면 향후 지역산업정책은 산업과 기술 간의 연계를 촉진할 수 있는 플랫폼 방식으로 전환되어야 한다.

The knowledge management system deals with information gathering, process, and implementation for the organizational performance advantage. Optimal Operation for Green Supply Chain in Consideration of Collection Incentive and Quality for Recycling of Used Products

  • In recent years, for the purpose of solving the problem regarding environment protection and resource saving, certain measures and policies have been promoted to establish a green supply chains (GSC) with material flows from collection of used products to reuse of recycled parts in production of products. In this study, we propose an optimal operation of the GSC while considering the collection incentive of the used products and quality for recycling of used products. Two types of decision-making approaches are used for product quantity, collection incentive of used products and lower limit of quality level of reusable parts in the used products for recycling in the GSC. One is the decision-making under an independent policy in decentralized supply chains where a retailer and a manufacturer make decisions so as to maximize profits individually. The other is the decision-making under a cooperative policy in centralized supply chains where a retailer and a manufacturer make decisions cooperatively so as to maximize the whole system's profit. Additionally, we also discuss supply chain coordination as a manufacturer-retailer partnership based on profit sharing. Furthermore, we show the effect of the quality of the reusable parts on the optimal decisions. The collection incentive of the used products was found to bring more profitability to the GSC activity.

Purchasing and Inventory Policy in a Supply Chain under the Periodic Review: A Single Manufacturer and Multiple Retailers’ Case

  • Over the years, most or many companies have focused their attention to the effectiveness and efficiency of their business units. As a new way of doing business, these companies have begun to realize the strategic importance of planning, controlling, and designing their own supply chain system. This paper analyzes the coordination issues in supply chains that consist of one manufacturer and multiple retailers operating under uncertain end customer demand and delivery lead-time. We use the Genetic Algorithm (GA) to determine the appropriate ordering and inventory level at which the manufacturer and multiple retailers can maximize the profit of the chain. This is performed under three controlling policies: the traditionally centralized controlling policy under the manufacturer's perspective, the entire chain’s perspective, and lastly the coordinating controlling policy with an incentive scheme. The outcome from the study reveals that the coordinating controlling policy with an incentive scheme can outperform the traditional centralized controlling policies by creating a win-win situation in which all members of the chain benefit from higher profit, thus resulting in more willingness from all members to join the chain.

  • 본 연구에서는 사회적 도전과제 해결을 임무로 설정하여 이론과 정책을 개발하고 있는 임무지향적 혁신정책론의 관점에서 사회문제 해결형 연구개발정책을 점검하고 그 시사점을 살펴본다. 이를 위해 시민사회의 참여, 정부의 동태적 능력의 확보, 선도적 투자와 후속 투자의 유도의 측면에서 '제2차 과학기술기반 사회문제 해결 종합계획'을 분석했다. 이 계획은 사회문제 해결형 혁신을 위한 시민참여의 제도화, 정부의 조정·통합능력 강화와 새로운 생태계 형성을 위한 제도들을 도입하고 있다. 그러나 기존 활동의 경로의존성이 있기 때문에 이를 넘어서기 위한 구체적인 프로그램이 요구되는 상황이다. 또 선도적인 투자를 이끌어내기 위해서는 커뮤니티 케어, 기후변화 대응과 같은 사회정책 분야의 전략 사업과 혁신정책을 통합적으로 전개하는 것이 필요하다.
