개물림 사고에 대한 소유자의 법적 책임에 관한 소고 - 미국의 개물림 법제와의 비교를 중심으로 - (A Review of the Legal Responsibility of Dog Owners regarding Dog Bite Accidents - Focused on a Comparison with American Dog Bite Legislation -)

  • 우리나라의 경우 반려동물을 사육하는 가구가 점점 많아지는 경향이고, 특히 반려견이 사람을 물어 사상(死傷)을 입히는 인신사고가 자주 발생하고 있다. 이는 미국에서 소위 '개물림(Dog-bite) 사고'라고 지칭되는 인신사고이다. 개물림 사고는 피해자에게 상당한 신체적 정서적 피해를 입히는 심각한 공중 보건의 문제이자 지역사회에도 측정하기 어려운 숨은 비용을 양산하게 된다. 우리나라도 이러한 개물림 사고에 대하여 동물보호법, 민법, 형법을 통하여 규율하고 있다. 특히 2018. 3. 20. 동물보호법의 일부개정을 통하여 맹견의 견주 등에게 강화된 주의의무와 처벌에 관한 법제를 마련하기도 하였다. 한편 미국의 일부 주에서는 이러한 현상을 반영하여 개물림 사고에 대하여 단일법에서 개 혹은 동물의 유형, 손해의 형태, 손해의 배상범위, 책임 인정의 범위 등에 관한 세부사항을 규율하고 있다. 본고에서는 개물림 사고에 관한 다양한 법제를 지니고 있는 미국 일부주의 법제 현황을 검토하여, 우리나라의 법제와 비교 분석하고자 한다. 이를 통하여 우리나라의 개물림 사고에서 특히 견주의 책임에 대한 현행법에서의 문제점이 무엇인지 및 그 보완을 위한 대책으로서는 어떠한 것이 있는지 등을 검토해보고자 한다.

해상에서의 선박 음주운항 단속 강화를 위한 법 제도 분석 (An Analysis of Legal System for Strengthening Actions against Operating Vessels Under the Influence of Alcohol at Sea)

  • 최근 5년간 해상에서 음주운항으로 적발된 건수는 총 567건으로 대부분 어선에서 발생하고 있으며, 음주운항으로 인한 사고건수는 69건으로 5명이 사망하고, 1명이 실종되는 등 해상에서는 음주운항으로 인한 사고로 인적 물적 피해를 주고하고 있다. 그러나 음주운항으로 사회적 피해가 증가하고 있으나, 현행 법령상 처벌은 위반행위의 중대성에 비해 가볍게 처리되고 있는 실정이다. 이에 음주운항으로 인한 사고의 재발방지를 위해 우리나라의 음주운항 사례를 분석하고, 외국의 음주운항 단속 규정을 비교 검토하였다. 또한 선박 종사자를 대상으로 음주운항의 위험성을 계도 홍보하는 한편, 관련 법률 및 제도를 개선해야 한다. 그리고 해상에서 선박에 대한 해양경찰에서의 단속을 강화하여 음주운항 사고를 줄이기 위해 노력을 지속해야 하며, 향후 선박에서의 음주로 인한 안전사고가 사전에 예방될 것으로 기대된다.

A Study on the Implement of AI-based Integrated Smart Fire Safety (ISFS) System in Public Facility

  • Even at this point in the era of digital transformation, we are still facing many problems in the safety sector that cannot prevent the occurrence or spread of human casualties. When you are in an unexpected emergency, it is often difficult to respond only with human physical ability. Human casualties continue to occur at construction sites, manufacturing plants, and multi-use facilities used by many people in everyday life. If you encounter a situation where normal judgment is impossible in the event of an emergency at a life site where there are still many safety blind spots, it is difficult to cope with the existing manual guidance method. New variable guidance technology, which combines artificial intelligence and digital twin, can make it possible to prevent casualties by processing large amounts of data needed to derive appropriate countermeasures in real time beyond identifying what safety accidents occurred in unexpected crisis situations. When a simple control method that divides and monitors several CCTVs is digitally converted and combined with artificial intelligence and 3D digital twin control technology, intelligence augmentation (IA) effect can be achieved that strengthens the safety decision-making ability required in real time. With the enforcement of the Serious Disaster Enterprise Punishment Act, the importance of distributing a smart location guidance system that urgently solves the decision-making delay that occurs in safety accidents at various industrial sites and strengthens the real-time decision-making ability of field workers and managers is highlighted. The smart location guidance system that combines artificial intelligence and digital twin consists of AIoT HW equipment, wireless communication NW equipment, and intelligent SW platform. The intelligent SW platform consists of Builder that supports digital twin modeling, Watch that meets real-time control based on synchronization between real objects and digital twin models, and Simulator that supports the development and verification of various safety management scenarios using intelligent agents. The smart location guidance system provides on-site monitoring using IoT equipment, CCTV-linked intelligent image analysis, intelligent operating procedures that support workflow modeling to immediately reflect the needs of the site, situational location guidance, and digital twin virtual fencing access control technology. This paper examines the limitations of traditional fixed passive guidance methods, analyzes global technology development trends to overcome them, identifies the digital transformation properties required to switch to intelligent variable smart location guidance methods, explains the characteristics and components of AI-based public facility smart fire safety integrated system (ISFS).

일 지역 중·고등학생의 흡연실태 (A Study on the Actual Conditions of Smoking in Middle and High School Students in One Region)

  • To investigate the actual conditions of smoking in middle and high school students in Chinan County, I used a sturctured questionnaire for 1,579 students attending twelve middle-high schools from December 1, 1998 to December 20, 1998. I collected and data correlated the using an $SPSS-PC^+$ 1. The smoking rate of middle-high schoo1 students in Chinan County was 17.9%, relatively high. This smoking rate was different according to the gender, grade, religion, and economic situation. In mals, high school students, non-religious, students low income family students, the smoking rate was higher. The smoking rate of high school students was almost the same as the smoking rate of adults, generally higher than that of foreign teenagers. Because the smoking rat of studinets in the third grade of middle school and in the first grade of high School was six times higher, increased education should be conducted during this time in an attempt to curb the sudden increase of the smoking rate. The smoking rate of girl students was 5.0%; this has increased mor than three times from ten years ago. Consequently, counter measures should be taken against the smoking of female students as well as juvenile smoking in general. In addition, the smoking rate of middle-high school students showed interesting differences when correnated with enviornmental factors. Students with low grades, who are not satisfied with school life, who don't have both parents, who have uncaring parents who nare too strict or too arbitary, who have smoking parents, or who have experienced smoking commonly smoked. Therefore, to lower the smoking rate we should improve the school environment, improve a student's interest in school life. And parents or siblings should lead by example and quit smoking at home. Schools should educate students more effectively concerning the harmful effects of smoking and create an accurate understanding of its dancers. From the beginning, we should teach students never ever to touch cigaretts. 2. The surve discovered that most students started out of curiosity, or solicitantion from friends or elders at middle school, and had been smoking one to five cigarettes for more than a year. They obtained cigarettes at stores and most of them have friends who smoke. As a result anti-smoking education should be conducted at elementary schools prior to middle school. More than 95% of the teenagers who smoke had friends who smote and smoked out of curiosity or the recommendation of elders. Thus, we must focus on teenagers who smoke in group, rather than individually. Fuyrthermore, the strict application of the regulation of tobacco sales as well as tobacco cooperation from retailers are needed. While students did not show any mood or academic achievement difference after beginning smoking, 58.1% of the students a health situdation that was worse. Juvenile smoking is more harmful to the juvenile than adult smoking is to the adult. This should be focused on in an anti-smoking campaign. 3. Students who smoke hada more positive attitude toward smoking than students who don't smoke. Students who smoke had a tendency to have a nuetral position and are not concerned about smoking compared to non-smoking students. The survey showed that the great number of students had a nuetral position. Because this nuetrality may increase Juvenile smoking, education that provides an exact understanding of smoking should be performed to build the correct attidude toward smoking. 4. Middle school students smoke when angry, gloomy, anxious, a lone and when they have some problems to solve, on when they feel inconveniened in other wores, they smoke to reliver stress. They also smok due to addiction. Because smoking is not a praetical method to relieve stress, a program which helps to acquire positive relief stress should be provided to help reduce smoking. 5. About 65% of students who smoke want to quit smoking because of health problem, 78% of them have tried mor than once to quit but failed due to weak will power and peer pressure from friends who smoke. Juvenile smoking is group, oriented. Thus, the program that advances less smoking will be the one that focuseds on groups. 6. As for advice to students who want to quit smoking, "persuasion" was used most commonly, followed by a "presentation on how to quit smoking". Another method were severe punishment. About 70% of the students wanted the anti-smoking guide at school. 7. Most students (73.5%) had a position that more anti-smoking education at school is needed. Obriously, then, anti-smoking education at middle-high schools should be reinfoced. Although the education which explains the harmful influence of tobacco is known as an efficient way prevent smoking; it does not influence students who already smoke. Therefore, for students who smoke, multi-dimensional approaches must be attempted that include physical training, phychokogical approache, consultation and discussion, medical chek-ups, audio-visual education technigues, and professonal instructors, in addition, because smoking students have more negative on lukewarm attitude to anti-smoking education anti-smoking education should be conducted through a communicative style by dedicated teachers who care about students.
