  • As to the sphere of application, Article 78 CISG undoubtedly applies to interest on the purchase price. Furthermore, the provision also applies to "any other sum that is in arrears". This language has been interpreted to encompass expenses that one party had on behalf of the other as well as reimbursements when the purchase price is reduced according to Article 50 CISG. However, it is questionable whether this language also extends to claims for damages. Legal scholars seem to agree that one has a right to interest on damage claims under Article 78 if the amount in question has been liquidated vis-a-vis the other party. Whether this right to interest also applies to unliquidated sums, is controversial, however. In this study, as a result of taking into account the puspose of Article 78, we could find the fact that regardless of whether the exact amount of damages has been specified yet, the breaching party still owes compensation to the other party from the time of the breach and, accordingly, the non-breaching party should be entitled to interest payments on the loss from that time. Consequently, Article 78 applies not only to liquidated but also to unliquidated damages.

  • Total debt in the People's Republic of China surged to nearly 290% as a ratio to GDP by the second quarter of 2016, mostly on account of non-financial corporate debt. The outpouring of credit to stem the impact of the global financial crisis accentuated industrial overcapacity in traditional sectors, such as steel, cement, and energy, while feeding asset bubbles in the property, equity and bond markets. At the Chinese corporate level, this has translated into weakened fundamentals and a fall in industrial profits, particularly of SOEs. As debtors struggle to service interest payments, non-performing loans (NPLs) have been on the rise. This paper assesses the financial fragility of the Chinese economy by looking at risk factors in the non-financial sector. We apply quantile regressions to a dataset containing all Chinese listed companies in Standard & Poor's IQ Capital database. We find higher sensitivity over time of corporate leverage to some of its key determinants, particularly for firms at the upper margin of the distribution. In particular, profitability increasingly acts as a curb on corporate leverage. At a time of falling profitability across the Chinese non-financial corporate sector, this eases the brake on leverage and may contribute to its continuing increase.

  • This paper describes difficulties for the producer's distribution and the user's acquisition of the spatial data because the circulation of them is complicated according to its kind in Korea. The way to overcome these difficulties would be to develop the clearing house system to incorporate GIS technology on Internet. This research proposes the problem statement, the architecture, and the operating environment of the system. The system contains the functions such as metadata generation, metadata registration, metadata version management, catalogue creation and update, reports generation, forms processing, metadata search, payments, GIS information pool, and spatial data browsing.

  • Currently, automated payment services provide intuitive user interfaces by adapting various wireless communication devices with mobile services. For example, companies like Samsung, Google, and Apple have selected the NFC payment method to service payments of existing credit cards. An electronic payment standard has been released for NFC activation within Korea and will strengthen the safety of payment service communications. However, there are various security risks regarding the NFC-based electronic payment method. In particular, the NFC payment service using the recently released lightweight devices cannot provide the cryptographic strength that is supported by many financial transaction services. This is largely due to its computational complexity and large storage resource requirements. The chaotic map introduced in this study can generate a highly complicated code as it is sensitive to the initial conditions. As the lightweight study using the chaotic map has been actively carried out in recent years, associated authentication techniques of the lightweight environment have been released. If applied with a chaotic map, a high level of cryptographic strength can be achieved that can provide more functions than simple XOR operations or HASH functions. Further, this technique can be used by financial transaction services. This study proposes a mutual authentication technique for NFC-PCM to support an NFC payment service environment based on the chaotic map.

Determinants of Continuance Intention in Mobile Payment Services: Based on the IS Success Model

  • Highly competitive environment has been forcing e-commerce industries to seek strategies to achieve competitive advantages. Mobile payment is a kind of service that allows mobile phone user to easily and conveniently initiate payments and transfer funds using their mobile phone anytime, and anywhere. This study is designed to identify factors that affect the intention of continued use of mobile payment services between users in Korea and Laos. As a result, first, in the case of Korean consumers, system quality, information quality and service quality were shown to have a positive effect on trust and satisfaction. In addition, trust and satisfaction were shown to have a positive effect on continuance intention. Second, in the case of Laotian consumers, system quality and service quality were shown to have a positive effect on trust, and system quality and information quality were shown to have a positive effect on satisfaction. In addition, trust and satisfaction were shown to have a positive effect on continuance intention. The study has its implications by analyzing factors affecting the continuance intention with the comparison of the customers from a developed nation and a developing nation, providing a direction of development for developing competitive advantages for those in development. For the developed, the study provides a guideline of what to modify and supplement in cases of entering the markets of developing nations.

  • Bitcoin-based blockchain technology provides an infrastructure that enables anonymous smart contracts, low-cost remittances, and online payments. However, the block-chain technology that implements the bitcoin has scalability constraints in tradeoffs between throughput and latency. To solve these problems, the Byzantine fault tolerant block-chain technique has been proposed. This technique improves throughput without increasing latency by selecting a leader and constructing many microblocks that do not contain proofs of work within the existing block by the leader. However, this technique may be less secure than existing techniques in selecting the reader.

  • The ability of smartphones to facilitate various services like mobile banking, e-commerce and mobile payments has made them part of consumers' lives. Conjoint analysis (CA) is a marketing research approach used to assess how consumers' preferences for products or services develop. The potential applications of CA are numerous in consumer electronics, banking and insurance services, job selection and workplace loyalty, consumer packaged goods, and travel and tourism. Choice-Based Conjoint (CBC) analysis is the most commonly used CA approach in marketing research. The purpose of this study is to utilise CBC analysis to investigate the relative importance of smartphone attributes that influence consumer smartphone preference. An experiment was designed using Sawtooth CBC Software. 326 students attempted the online survey. Utility values were derived by Hierarchical Bayes (HB) estimation and used to explain consumers' smartphone preferences. All the six attributes used for the study were found to significantly influence smartphone preference. Smartphone brand was the most important, followed by the price, camera, RAM, battery life, and storage. This study is one of the first to use Sawtooth CBC analysis to assess consumer smartphone preference based on the six attributes. We provide implications for the development of new smartphones based on attributes.

In this paper, I surveyed and analysed the general trend and test/certification trend of mobile commerce software, and developed the mobile commerce software quality evaluation metrics base on ISO/IEC 9126 and ISO/IEC 12119, the standard about the quality evaluation.

  • Recently, as the number of Smart Phone users increase, the simple payment system has been able to make payments using only card information such as a registered password without extra authorized certificate authentication or input of card information. In this paper, it will examine and analyze simple payment system provided by IT companies and financial institutions and the simple payment system that operates global online payment system by case view of operational direction. Then with this examination, it will study ways to improve the problems with terms of convenience and stability in terms of users. In this paper, it will analyze the inconvenient problem in using the QR code system that recently introduced and will propose solutions. Also, it will propose suggestions to solve inconvenience that caused by system that supports NFC simple payment terminal in Korea is not universalize by analyze case study on the overseas simple payment system. It will also propose opinions on the matters that customer having responsible for event of a small financial accident related to loss or theft when using the simple payment system. Then it will suggest expected requirements to prepare new security technical countermeasures and solve the conditions of meeting expectation satisfaction of users.

  • The seller has to deliver goods and hand over documents as required by the contract. It is very important that ownership of goods shall be transferred by the documents from the seller to the buyer. Where terms of payments is made under documentary payment such as negotiable order Bill of lading or any transport documents for symbolic delivery of goods shall be more important between the parties concerned. The buyer may withdraw or cancel the contract where the buyer accept the foul Bill of Lading and demand damages where the buyer accept the other documents which are not in accordance with requirements by the buyer. Withdraw or cancel of contract can be made where discrepancy of documents comes into fundamental breach of contract. In conclusion transport documents by the seller will be used to determine appropriation of transport document to the contract. Therefore the seller has to deliver the proper shipping documents to the buyer. Where the breach of the seller's obligations to deliver documents the buyer has the right of requiring performance, contract avoided, claiming damage to recover the contract under CISG. The significance of transport documents has been focused in this study and careful examination of documents shall be needed to prevent any dispute or differences between the parties.
