Canadian Domain Name Arbitration (캐나다의 도메인이름중재제도)

  • On June 27, 2002 Canadian Internet Registration Authority (CIRA) launched dot-ca domain name dispute resolution service through BCICAC and Resolution Canada, Inc. The Domain name Dispute Resolution Policy (CDRP) of CIRA is basically modelled after Uniform Domain Name Dispute Resolution Policy(UDRP), while the substance of CDRP is slightly modified to meet the need of Canadian domain name regime and its legal system. Firstly, this article examined CIRA's domain name dispute resolution policy in general. It is obvious that the domain name dispute resolution proceeding is non-binding arbitration to which arbitration law does not apply. However it still belongs to the arbitration and far from the usual mediation process. Domain name arbitrators render decision rather than assist disputing parties themselves reach to agreement. In this respect the domain name arbitration is similar to arbitration or litigation rather than mediation. Secondly it explored how the panels applied the substantive standards in domain name arbitration. There is some criticism that panelists interprets the test of "confusingly similar" in conflicting manner. As a result critics assert that courts' judicial review is necessary to reduce the conflicting interpretation on the test of substantive standards stipulated in paragraph 3 of CDRP. Finally, it analysed the court's position on domain name arbitral award. Canadian courts do not seem to establish a explicit standard for judicial review over it yet. However, in Black v. Molson case Ontario Superior Court applied the UDRP rules in examining the WIPO panel's decision, while US courts often apply domestic patent law and ACPA(Anticyber -squatting Consumer's Protection Act) to review domain name arbitration decision rather than UDRP rules. In conclusion this article suggests that courts should restrict their judicial review on domain name administrative panel's decision at best. This will lead to facilitating the use of ADR in domain name dispute resolution and reducing the burden of courts' dockets.

Determinants of Firms' Standardization Activity: Evidence from the Korean Service Firms (기업의 표준화활동 결정요인 : 우리나라 서비스기업에 대한 실증연구)

  • The paper investigates the determinants of firm's standardization activity in the Korean service industry. Standardization variables as dependent ones are standardization management at the firm level, domestic standardization activity, and international standardization activity. The independent variables include innovative activities(R&D intensity and patent application), firm size, export ratio, network, and firm's organization characteristics. We estimated the logistic regression model, using the data from 102 Korean service firms. The empirical findings are as follows. First, R&D intensity has a positive effect on international standardization activity, but not on the standardization management at the firm level and domestic standardization activity. Second, patent application has a negative effect on the standardization management at the firm level. Third, firm size doesn't have any influence on firms' standardization activities in the service sector. Fourth, the level of chief executive officer's interest on standardization is a very important factor in determining firms' efforts to participate standardization process, regardless of types of standardization activity.

  • This paper analyzed on the relationship between R&D productivity of renewable energy and the Emissions Trading Scheme using OECD's country-specific patents and R & D input data. We empirically tested whether this R & D productivity has been substantially improved before and after the implementation of the emissions trading scheme and whether emission trading scheme has been promoted technology progress of renewable energy. Analytical methods used in this study, Negative Binomial Models which was proposed by Hausman et al. (1984). According to the results of this analysis, the R & D productivity of renewable energy was improved by emissions trading scheme, which was statistically significant at the 99% confidence interval [CI]. The R&D productivity of renewable energy was higher in Annex I countries. This research is significant in that R&D productivity was analyzed in associated with the emission trading scheme rather than it was analyzed by simply comparing R&D productivity.

Outcomes of transcatheter closure of ductus arteriosus in infants less than 6 months of age: a single-center experience

  • Purpose: Transcatheter device closure of patent ductus arteriosus (PDA) is challenging in early infancy. We evaluated PDA closure in infants less than 6 months old. Methods: We performed a retrospective review of infants less than 6 months of age who underwent attempted transcatheter device closure in our institution since 2004. To compare clinical outcomes between age groups, infants aged 6-12 months in the same study period were reviewed. Results: A total of 22 patients underwent transcatheter PDA closure during the study period. Patient mean age was $3.3{\pm}1.5months$, and weight was $5.7{\pm}1.3kg$. The duct diameter at the narrowest point was $3.0{\pm}0.8mm$ as measured by angiography. The most common duct type was C in the Krichenko classification. Procedural success was achieved in 19 patients (86.3%). Major complications occurred in 5 patients (22.7%), including device embolization (n=1), acquired aortic coarctation (n=2), access-related vascular injury requiring surgery (n=1), and acute deterioration requiring intubation during the procedure (n=1). Two patients had minor complications (9.1%). Twenty-four infants aged 6-12 months received transcatheter device closure. The procedural success rate was 100%, and there were no major complications. The major complication rate was significantly higher in the group less than 6 months of age (P=0.045). There was a trend toward increased major complication and procedural failure rates in the younger age group (P<0.01). Conclusion: A relatively higher incidence of major complications was observed in infants less than 6 months of age. The decision regarding treatment modality should be individualized.

Pathogenesis and Prevention of Intraventricular Hemorrhage in Preterm Infants

  • Intraventricular hemorrhage (IVH) is a serious concern for preterm infants and can predispose such infants to brain injury and poor neurodevelopmental outcomes. IVH is particularly common in preterm infants. Although advances in obstetric management and neonatal care have led to a lower mortality rate for preterm infants with IVH, the IVH-related morbidity rate in this population remains high. Therefore, the present review investigated the pathophysiology of IVH and the evidence related to interventions for prevention. The analysis of the pathophysiology of IVH was conducted with a focus on the factors associated with cerebral hemodynamics, vulnerabilities in the structure of cerebral vessels, and host or genetic predisposing factors. The findings presented in the literature indicate that fluctuations in cerebral blood flow, the presence of hemodynamic significant patent ductus arteriosus, arterial carbon dioxide tension, and impaired cerebral venous drainage; a vulnerable or fragile capillary network; and a genetic variant associated with a mechanism underlying IVH development may lead to preterm infants developing IVH. Therefore, strategies focused on antenatal management, such as routine corticosteroid administration and magnesium sulfate use; perinatal management, such as maternal transfer to a specialized center; and postnatal management, including pharmacological agent administration and circulatory management involving prevention of extreme blood pressure, hemodynamic significant patent ductus arteriosus management, and optimization of cardiac function, can lower the likelihood of IVH development in preterm infants. Incorporating neuroprotective care bundles into routine care for such infants may also reduce the likelihood of IVH development. The findings regarding the pathogenesis of IVH further indicate that cerebrovascular status and systemic hemodynamic changes must be analyzed and monitored in preterm infants and that individualized management strategies must be developed with consideration of the risk factors for and physiological status of each preterm infant.

  • In this paper, we review an outline as premise for environmental analysis of green IT which has basic stage through the world in order to make knowledge map of green IT. We can analyze genuine environment for green IT based on this premise, and we expect that we can also use to analyse power of competition based on intellectual property after performing these environmental analysis.

An Experimental Study on the Relationship between Information Type and New Product Development Process (신제품 개발 과정과 정보 유형 간의 관계에 관한 실험적 연구)

  • In this paper, we examine the relationship between information type and new product development process. Information that was provided for new product development can be divided into two categories. One was relative information that could be used as a basis for comparison such as patent data. The other was absolute information that must be fulfilled in the new product such as key customers requirements. An experiment was conducted with staffs in an R&D department in order to analyze the impact of the different information types on the development process of new product. It was found that the group with the absolute information recognized the given information repeatedly, which in turn results in a highly technical idea with good teamwork. The group with the relative information created a superior product with better application, appearance and product efficiency through the frequent refinements of given ideas. This paper concludes with the implications of the results to the new product development process and supporting information systems.

  • The base of Indian milk production is the millions of nondescript cows and buffaloes in rural areas, fed mainly on crop residues and agro-industrial wastes. The mainstay of the feeding system is straws and stovers. Therefore the approach to increase the fibrous residues utilisation for animal production was ideal and useful. The methods available for the above purpose were not found acceptable in rural areas owing to certain practical problems. The development of urea molasses block was, therefore aimed at solving the practical field problems. Urea Molasses Block has been developed as a feed supplement that can bring forth an effect of rumen manipulation thereby increase the conversion rate of feeds. The formula and process technology were thus developed. Before starting the mass production and popularisation the product was tested in controlled condition in farms and also in villages. Encouraged with the results the feed is now commercially manufactured under Indian Patent No. 156047.

  • This paper proposes an R&D opportunity scan framework for information and telecommunications company in aging society. The framework consists of trend analysis, market-oriented search, technology-oriented search, and R&D Portfolio development. We identify technology themes in the market-oriented search by developing market scenarios and analyzing a new business model framework. And then we search prospective technologies in the technology-oriented recess by technology scanning and patent analysis. By matching technology themes with prospective technologies, generate an R&D portfolio. Finally, we evaluate the risk of the proposed R&D portfolio.

  • Unilateral hypoplasia of the pulmonary artery is an uncommon anomaly, which commonly develops in combination with congenital cardiovascular defects such as tetralogy of Fallot, patent ductus arteriosus and septal defect of atrium or ventricle, but may also present as an isolated lesion. We have recently experienced a case of the left pulmonary artery hypoplasia in adult by chance of during the general health screen, which diagnosed by chest X-ray, chest spiral CT, lung perfusion and ventilation scan, digital substraction angiogram and bronchoscopy, then presented hereby with the review of relevant literature.
