정보통신표준화와 관련된 특허POOL 구축사례분석 (Analysis on the construction examples of patent pool in Telecommunications standardization activities)

  • 최근의 정보통신 관련 표준화 활동에 있어서 특허권의 조화 문제를 위하여 특허POOL이 활성화되고 있는 추세이다 본 고에서는 이러한 표준화와 관련된 특허POOL의 최근 주요한 사례들을 집중적으로 다루어 보았다. 특허POOL 팔용 사례들을 다룸으로써 특허POOL의 여러가지 실제적인 의미들을 진단할 수 있을 것으로 본다. 본 고에서는 특허POOL의 형성 특성별로 전형적인 구축 사례로서 조직적 규모를 갖춘 전문적인 관리 기구인 MPEG LA(Moving Picture Experts Croup Licensing Administrator)의 설립을 통하여 운영됨으로써 특허POOL 구축의 선구적 효시가 되고 있는 MPEC-2 특허POOL과 특허POOL이 분열된 유형인 DVD 특허POOL, 기업 외세에 의하여 형성된 유형인 IEEE1394 특허POOL, 그리고 이동통신 기술 분야의 UMTS(Universal Mobile Telecommunications System)에서 형성되고 있는 특허POOL을 분석하여 소개한다

손해배상액과 무효심판 판례를 이용한 특허 로열티율 산정 회귀모형 (Regression Models for Determining the Patent Royalty Rates using Infringement Damage Awards and Inter-Partes Review Cases)

  • 무형자산의 가치평가에 많이 사용되고 있는 수익접근법과 시장접근법의 특성을 모두 가지고 있는 로열티공제법을 사용하여 지식재산권의 경제적 가치를 평가할 때, 로열티공제법의 중요한 투입변수인 로열티율을 객관적으로 산정하는 수리적 모형을 제시한다. 이를 위하여 미국의 특허침해 손해배상액을 로열티율로 산정한 판례를 참고로 하여 로열티율을 종속변수로, 당해 특허권의 특허지표를 독립변수로 하여 로열티율 산정 회귀모형을 적용한다. 또한 미국의 당사자계재심(Inter-Partes Review)판례를 참고로 하여 특허무효거절 결과를 종속변수로 하고 당해 특허권의 특허지표를 독립변수로 하여 로지스틱회귀 모형을 적합시킨다. 최종 로열티율은 위의 로열티율 산정 회귀모형에서 산출된 로열티율과 로지스틱회귀모형에서 산출된 특허무효거절 확률을 결합하여 산정한다. 마지막으로, 본 논문에서 구축된 모형에 의해 산정된 로열티율과 기준 방식에 의해 산정된 로열티율을 비교하여 제안된 모형의 객관성과 신뢰성을 분석한다.

  • In this study, the patent trends for noise barrier and noise reducing device have been analyzed, for the development of adaptive noise barrier according to the transmission characteristics of railway noise. Using patent search engine, keyword searching for patents after 1980 in Korea was performed. The first 667 patents details were reviewed for the extraction core(ie, key) patents. From this review, finally 70 patents were built as DB. From this analysis of core patents, system requirements for development of noise reducing device were obtained.

특허 시스템의 정량 분석을 위한 시스템 다이내믹스 모형 (A System Dynamics Model for Quantitative Analysis of Patent Systems)

  • In this paper, a system dynamics model for explaining the application, grant and maintenance of patents is provided. Existing literatures regarding the patent application system are mostly econometric approaches that consider only economic variables such as GDP and R&D. The model in this paper includes patent variables such as disputes as well as economic variables. Moreover, we show that the model can be used in not only a quantitative prediction but also policy experiment. The results of the policy experiment shows that strengthening protection of patents tend to increase the propensity to patent more than R&D investment.

스마트 수술 의료시스템 기술 생태계에 대한 국가 간 비교 연구: 특허 데이터 분석을 중심으로 (National Comparative Study on the Technology Ecosystem of the Smart Surgical Medical System: Focused on the Patent Data Analysis)

  • We explore technology ecosystem of smart surgical medical system by analyzing patent data applied for in Korea and Japan. First, a review of trends of patent application by country/technological domain show that there exist a minority of technology domains focused on R&D, which represent their trends have been increasingly active. Also, while a number of Japanese firms mainly consist of the patent market of Japan, in case of the Korean market, a few universities, SMEs, and foreign firms are found to be the main applicants. As a result of the network analysis with the links as the relations of co-patenting, the relationships, which are active of convergence and knowledge spillover among the heterogeneous technology domains within each market, as well as the technology domains, which are the most active in international cooperation among each homogeneous domain, could get derived and visualized in the ecosystem. In addition, the technology domains in each patent market with leading locations, roles, and influence in the network can also be identified through the centrality analysis. In this study, the analysis for technology competitiveness are carried out focusing on patent activity and patent impact. The results denote that across all domains, the Japanese market may possess higher patent activity and patent impact compared to the Korean market. In consequence, we derive the position map for comparison by country and technology domain from a perspective considering comprehensively the multi-dimensional attributes based on the results of both network analysis and technology competitiveness.

특허의 피인용에 영향을 끼치는 요인에 대한 연구: 미국 자동차 특허를 중심으로 (A study of factors affecting citation of patents: Focusing on US automotive patents)

  • 특허의 피인용 수는 특허의 질적 가치와 기업의 가치와 긍정적인 상관관계가 있으며, 특허의 질적 가치를 나타내는 지표 중 하나이다. 본 연구는 특허의 피인용 수에 영향을 끼치는 주요 요인을 살펴보기 위하여, 국제특허분류코드인 IPC가 다양한 분야인 자동차 산업을 대상으로, 글로벌 상위 자동차 업체 14개사의 미국 특허 47,354건에 대하여 음이항 모델 회귀분석을 수행하였다. 분석결과, 출원후 경과년도, 특허의 청구항 수, 특허 패밀리 국가 수, 특허 패밀리 수, IPC 코드의 총 수뿐만 아니라, IPC 다양성 수가 특허의 피인용 수에 긍정적인 유의미한 영향을 미치는 것으로 나타났다. 본 연구의 결과는 향후, 대학, 연구소 및 기업의 기술이전이나 라이선싱을 위한 전략을 세우는 데 있어서, IPC 다양성 지표를 함께 고려할 수 있는 기초적 근거를 제공할 수 있을 것으로 기대된다.

기술-산업 연계구조 및 특허 분석을 통한 미래유망 아이템 발굴 (Discovery of promising business items by technology-industry concordance and keyword co-occurrence analysis of US patents.)

  • This study relates to develop a quantitative method through which promising technology-based business items can be discovered and selected. For this study, we utilized patent trend analysis, technology-industry concordance analysis, and keyword co-occurrence analysis of US patents. By analyzing patent trends and technology-industry concordance, we were able to find out the emerging industry trends : prevalence of bio industry, service industry, and B2C business. From the direct and co-occurrence analysis of newly discovered patent keywords in the year, 2000, 28 promising business item candidates were extracted. Finally, the promising item candidates were prioritized using 4 business attractiveness determinants; market size, product life cycle, degree of the technological innovation, and coincidence with the industry trends. This result implicates that reliable discovery and selection of promising technology-based business items can be performed by a quantitative, objective and low- cost process using knowledge discovery method from patent database instead of peer review.

해외 특허출원이 한국 제조업 기업 수출과 매출에 미치는 영향 실증분석 (Patenting abroad and its effects on exports and sales in Korean Manufacturing firms)

  • With the advent of a recent knowledge-based society, interest in patents is steadily increasing. The patent is an important indicator that can capture the level of R&D investment and technology development. In an era of deepening new protectionism and the pandemic of COVID-19, patents play an important role in sustainable economic development and establishing a strong domestic industrial ecosystem. In this paper, we analyze the impact of patent applications on the corporate performance of the Korean manufacturing industry over the past 21 years from 1999 to 2019. We divide patents into overseas patents and domestic patents and analyze the respective effects on the entire manufacturing industry, ICT industries, and non-ICT industries. Major findings are summarized as follows. First, patents have a positive effect on both exports and sales of Korean manufacturing companies. Second, overseas patents have a greater impact on corporate performance than domestic patents. Third, Patents have a more positive effect on ICT industries than on non-ICT industries.

국내 약침 특허 현황에 대한 분석연구 (Review on the Pharmacopuncture Patent in Korea)

  • Objectives : The purpose of this study was to analyze the trend of pharmacopuncture in Korean patent in order to establish database for patent technology. Methods : Electronic literature searches for Korean patents related to pharmacopuncture were performed in two electronic databases (Korea Intellectual Property Right Information Service and National Digital Science Library) to June 2017. Patents that were not Korean ones, did not use medicinal herb, only described method of manufacture, or had nothing to do with pharmacopuncture were excluded in this study. The status and application date of patents, Medicinal herb, target diseases, International Patent Classification (IPC), model of experiment and extracting methods were analyzed. Results : A total of 379 patents were retrieved. Based on our inclusion/exclusion criteria, 297 patents were excluded. Of 82 included patents, 27 patents did not include experiments using pharmacopuncture, and 9 patents were invented for treating animals such as pig or calf. In IPC analysis, Bee Venom, Panax (ginseng), Angelica, and Paeoniaceae were used frequently. Musculoskeletal diseases were the most targeted diseases followed by nervous diseases. For extracting, hot water extraction, distillation extraction, and solvent extraction using alcohol, ethanol, or methanol for solvent were commonly used. Conclusions : These data are useful for inventing new patent and extending range of pharmacopuncture in clinical use, however, more systematically analyzed patent studies and pharmacopuncture-related studies for new application on various diseases are needed in further studies.
