조선노동당 제8차대회 당규약 개정과 '당중앙의 유일적 영도체계'의 조직적 변화: 김정은 정권의 당정군관계를 중심으로 (The Revision of the Rules of the Workers' Party of Korea and the Organizational Changes of the 'Monolithic Guidance System of the Party Core': Focusing on Party-Government-Military Relations in Kim Jong Un Regime)

  • 2021년 8차 당대회에서 개정된 조선노동당 규약은 김정은 정권의 북한의 사회주의·공산주의에 대한 이데올로기 규정변화, 새로운 전략적 노선 및 최근 정세변화를 반영하는 한편, 중앙과 지방을 포괄하는 당 조직체계 상 주요 변화를 포괄한다. 본 연구는 9차례 개정된 조선노동당 규약 전체를 대상으로, 2021년 1월 개정 당규약이 명시한 '당중앙의 유일적 영도체계'의 조직적 변화를 분석함으로써 김정은 정권의 권력구조, 즉 수령제 및 당·정·군관계를 평가한다. 2010년 3차 당대표자회 후계구도를 거쳐 2012년 4차 당대표자회 이후 공식출범한 김정은 정권은 2022년 4월 집권 10년을 앞두고 당 수반이자 국가 수반인 김정은을 중심으로 한 유일영도체계를 제도화하고 새로운 당·정·군 조직 재편을 통해 일원적 지도·집행체계를 확립했다. '당중앙의 유일적 영도체계'는 당 수반-총비서의 당중앙위원회 기구를 통한 '조직영도'의 체계로 구축되며 김정은 시대 당-국가체제의 제도화와 일원화를 동시에 보여준다. 이러한 조직적 개편은 2020년 코로나19 팬데믹 이후 '삼중고'를 겪고 있는 김정은 시대 북한의 위기관리체제 확립의 특성을 보이며 향후 김정은 정권의 통치구조를 이해, 전망하는 데 중요한 함의를 가진다.

A Basic Study on the Maritime Performing Party System and the Difference between the Maritime System and China's system

  • "United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea" was passed in July 3, 2008. on September 23, 2009 signing ceremony was held in Rotterdam. The system of maritime performing party is a special system in the transport convention, and constitutes an integral part of the Convention. Maritime performing party system is not the first system which brings in the carrier's independent contractor, but it is the most comprehensive and thorough one. It unified the duty of carrier's independent contractor in the maritime segment, and it is also an important progress in the developing process of international maritime legal system. There are some differences between the maritime performing party and China's current related system, i.e, the port maritime performing party and the intermediate performing party are included in the maritime performing party, and they can enjoy the carrier's exception clause and limitation of liability.

  • CISG article 74 establishes the general formula applicable in all cases where an aggrieved party is entitled to recover damages. It provides that damages for breach of contract comprise all losses, including loss of profits, caused by the breach, to the extent that these losses were foreseeable by the breaching party at the time the contract was concluded. An aggrieved party may claim under article 74 even if entitled to claim under article 75 or 76. The latter articles explicitly provide that an aggrieved party may recover additional damages under article 74. Articles 75 and 76 apply only in cases where the contract has been avoided. Article 75 measures damages concretely by reference to the price in a substitute transactions, while article 76 measures damages abstractly by reference to the current market price. Article 76 (1) provides that an aggrieved party may not calculate damages under article 76 if it has concluded a substitute transaction under article 75. If however, an aggrieved party concludes a substitute transaction for less than the contract quantity, both articles 75 and 76 may apply. Pursuant to article 77, damages recoverable under articles 74, 75 or 76 are reduced if it is established that the aggrieved party failed to mitigate losses. The reduction is the amount by which the loss should have been mitigated. Article 78 entitles a party to interest on the price and any other sum that is in arrears.

Third Party Funding in International Arbitration and its most current Development in Asia -Issue of Security for Costs and its main Cases

  • Third-party funding in international and domestic disputes is a fast-growing trend and it is increasingly used by large, solvent companies that simply wish to share risk in their finance. On January 10, 2017, the Civil Law Amendment Bill was passed in Singapore and on June 2017 an "Arbitration and Mediation Legislation (Third Party Funding) Bill" in Hong-Kong had a third-party funding to finance the international arbitration and other dispute resolutions expressly approved. This arbitral tribunal's expanding discretion over critical interim measure of security cost was in issue. In Essar v. Norscot (2016), the arbitrator found that the additional third-party funding costs were recoverable as "other costs of the parties." In here, the decision showed the issue of a tribunal's power over cost measures could spread out to be reviewed and broadened through the legislative process. A recent investor-state arbitration case of ICSID, RSM Production Corporation v. Saint Lucia, covered the express awarding of security for costs where a claimant was funded by a third-party funder. It seems inevitable that the volume of third-party funding industry will grow more as time goes on. The next step would be to formulate guidelines on how to determine criteria against which an application for security for costs is measured.

Lean Adoption in Third Party Logistics Industry to Achieve Efficient Logistics Activities

  • Purpose: This study focuses on lean implementation evaluation in Third Party Logistics (TPL) industry by using the lean principles measurement from Toyota Ways which consist of 14 principles. The core goal of this study is to appraise the lean implementation level in Third Party Logistics in East Java of Indonesia in order to achieve efficient logistics, distribution and transportation activities. Research design, data and methodology: This study uses a sample of 80 respondent who are Third Party Logistics managers in East Java Province, Indonesia. Data collection uses a questionnaire and standard statistical test was performed in order to analyze questionnaire. Results: The implementation level of lean management in Third Party Logistics shows that application of principle 3 (utilizing pull systems) has a higher score than the other principles. This situation shows that management give the best performance in plan process. They prioritize customer requirement in every process designed. However, the principle 8 (using reliable technology) show the weakness performance. Conclusions: Overall, this study shows the Third Party Logistics in East Java Province of Indonesia have applied the lean principle quite well, although the scores are only slightly above the average. This condition provides a strong basis for further lean implementation, especially for improving logistics, distribution and transportation activities in Third Party Logistics Business.

  • Over the past decades the concept of Third-Party Logistics(TPL) has generated considerable interest in American and European industries. It involves outsourcing logistics activities that have traditionally been performed within an organization. The functions performed by the third-party logistics can encompass the entire logistics process or, more commonly, selected activities with that process. Increasing corporate emphasis on such concepts as reengineering and supply chain management has led many companies to consider the use of such third-party logistics. This study examines the possibility of applying existing American research of the third-party logistics to Korean companies and investigates the criteria for the use of third-party logistics in Korea. To design the model and generate the hypotheses, this study conducted a comprehensive literature survey on the third-party logistics. To test the hypotheses, this study collected data from 229 companies from the public companies in Korea through a questionnaire survey and conducted descriptive analysis, correlation analysis, factor analysis, and multiple regression analysis using the SPSS for Windows Ver. 7.5 package. This study is hoped that it may contribute to the understanding and introducing of the third-party logistics in the fields of the firms. But there were some restrictions that the respondents were not covered all kinds of firms. These and other major findings from this study imply that existing American studies may be applicable the Korean companies and that this study may complement the deficiencies of the existing studies. Thus, the summary of the literature review, the research model and hypotheses, and empirical findings in this study will provide useful ideas for future research and deep insights for successful logistics management.

국내 인터넷 전문 쇼핑몰의 파티웨어 디자인 개발을 위한 디자인 현황 분석 (Analysis of Design for Domestic Internet Shopping Malls Party Wear Design Development)

  • Internet shopping malls have rapidly developed within the economic recession due to changed lifestyle according to digitalization. Furthermore, customers in the 20~30s, the main consumer base of internet shopping malls in Korea, have begun to enjoy the new cultural trend of party culture, thus creating a new fashion market combining party and fashion. Therefore, the purpose of this study is to analyze design characteristics of internet party-wear shopping malls to provide guidelines and to present basic data for design development of party-wear in internet shopping malls. Research method was used by combining literary research with empirical research of analyzing design by capturing pictures of internet party-wear shopping malls. The following conclusion was drawn from research results. First, Party-wear consumption of internet shopping malls is increasing along with the increased sales of clothing fashion products of internet shopping malls. Second, design analysis results regarding 11 internet shopping malls selling party-wear was presented that consumer emotion and trend were combined according to distinct characteristics to display romantic style, romantic style mixed with modern or casual characteristics, sexy, and etc. Third, dress was presented as the most common item with 52.3% in item analysis executed on 588 pictures captured in 11 shopping malls. Ribbon was shown as the most common detail and trimming item, with 28.7%, and corsage and frills were each presented as 13%.

기초지방선거 정당공천 개선방안 (Party Nomination System in the Local Government Elections)

  • 민주국가에서 정당이 선거 후보자를 내는 것은 매우 당연한 원칙이다. 그럼에도 불구하고, 기초지방선거에서 정당공천 폐지 문제는 쉽게 해결될 수 있는 문제가 아니다. 그래서 기초지방선거의 정당공천에 관한 최근의 논쟁과 해외사례를 정리하고 합리적인 대안을 모색해보았다. 정당공천과 관련된 논쟁은 기존 정치권은 반대의 입장에도 불구하고 정당공천 폐해를 극복하기 위하여 폐지 또는 새로운 대안의 모색이 필요하다는 논의가 많다. 실증적 조사에서도 정당공천제의 폐지에 많은 집단들이 동의하고 있다. 그렇지만 정당 공천의 폐지에 따라 나타날 수 있는 부정적 파급효과가 여성할당문제이다. 그래서 정당공천의 폐지에 따라 나타날 수 있는 부정적 파급효과를 고려하면서 몇 가지 대안을 제시하였다. 그 대안은 참여주체 확대, 정당표방제 도입, 지방정당제 도입, 상향적 공천절차 활용 등이다. 이러한 방안 중 참여주체 확대방안이 논리적으로 최적대안으로 제시하였으나 대안의 확정은 사회적 합의절차를 거쳐서 확정되어야 할 것이다.

한국 정당의 이슈 소유권(issue ownership)과 유권자 투표행태: 20대 총선을 중심으로 (Perceptions of Issue Ownership and Party Choice: A Case of the Korean Legislative Election, 2016)

  • 이슈 소유권(issue ownership)은 특정 이슈나 현안을 해결할 수 있는 정당의 능력에 대한 평판이다. 특정 이슈에 대해 다른 정당보다 최상의 해결책을 가지고 있는 것으로 인식되는 정당이 해당 이슈를 소유하고 있다고 말한다. 기존연구에 의하면 유권자는 중요하다고 생각하는 이슈의 소유권자로 인식되는 정당에 투표하는 경향이 있다. 다시 말해 이슈 중요성(salience)은 이슈 소유권 투표(issue ownership voting)에 영향을 미치는 조건이다. 본 연구에서는 이슈 소유권 투표의 또 다른 조건으로 이슈 소유권을 주장하는 정당의 행태에 따라 이슈 소유권에 대한 인식이 투표에 미치는 영향을 살펴본다. 2016년에 실시된 20대 총선 당시 더불어민주당은 경제정당으로서의 면모를 강조하고 새누리당과는 다른 성장 전략을 제시하면서 새누리당이 소유하고 있는 경제 이슈 소유권을 뺏어 오려고 했다. 연구결과, 19대 총선과 비교해 민주당이 경제 이슈 소유권자라는 인식이 정당 지지자 및 이탈자, 무당파 집단에서 모두 증가하면서 민주당의 선거 전략은 유권자에게 어필한 것으로 나타났다. 뿐만 아니라 민주당이 경제 이슈 소유권자라는 인식은 경제 이슈를 가장 중요하게 생각하는 유권자가 민주당을 선택하는 데 영향을 미친 것으로 나타났다. 반면 새누리당이 경제 이슈 소유권자라는 인식이나 국민의당이 경제 이슈 소유권자라는 인식은 경제 이슈를 중시하는 유권자의 해당 정당 투표에 영향을 미치지 않았다. 본 연구는 이슈 중요성 이외에 정당의 행태가 이슈 소유권 투표에 영향을 미치는 조건이라는 것을 밝힘으로써 이슈 소유권 이론에 기여한다.

  • The third party logistics(3PL) is given a definition as logistics activities providing a comprehensive logistics services, all or partly outsourced by the customer on long-term contract basis, ranging from making logistics strategies to implement information technology services. The growth of the Third Party Logistics (TPL) business has been caused many firms to penetrate into the field from different industries. In this study, it is presented to describe a definition and development process of the third party logistics and shown to present strategic issues comparing to third party logistics in foreign and domestic area. and apply to some issues of importance when managing the continued TPL business strategy in domestic area.
