법령과고시 - 하도급사 보호를 위한 기획재정부 계약예규 개정

  • 기획재정부는 불공정하도급거래로 과징금을 부과받거나 하도급법을 상습적으로 위반한 자의 경우 공공공사 PQ입찰 시 최고 7점의 감점(종전 3점)을 부과하는 등 건설 하도급사 보호를 위해 계약예규를 개정했다. 이번 계약예규 개정은 대한설비건설협회가 건설산업 공생발전위원회와 동반성장위원회에 참여하면서 회원사의 권리보호를 위하여 건설공사 불공정하도급 거래 방지 제도개선을 지속적으로 추진한 결과이다.

  • 국무조정실 산하 규제개혁기획단은 지난 10월 18일 국토연구원 대강당에서 건설업역, 하도급, 입찰제도 등 건설산업 규제 합리와 방안에 대한 방향 설명 및 업계 의견을 수렴하기 위한 공청회를 개최하였다. 그러나 정부 건설개혁안에 대해 일반 건설업계를 제외한 건설업계는「규제개혁이라는 미명하에 일반 건설업자에게만 독점적 지위와 특혜를 보장하려는 불공정한 처사」라고 주장하면서 공청회가 무산될 뻔하는 위기를 맞기도 했다. 한편 이날 대한설비건설협회는 박종학 회장을 비롯한 회장단과 임직원이 참석하여 <일반∙전문의 구분 폐지에 대한 의견>, <저가하도급심사 합리화에 대한 의견>, 등, 정부의 건설생산체계 개편 방안과 관련하여 협회의 의견을 강력히 주장하였다.

A Study on Factors Affecting the Results of Excavation Reports from 2014 to 2016 (발굴조사보고서 평가결과에 영향을 미치는 요인에 관한 연구 -2014년~2016년도 보고서 평가결과를 중심으로-)

  • Although the evaluation system for excavation reports has been in operation for over 10 years, there has been no research on the evaluation system. First, this study examined the changes of the evaluation system, and secondly, it analyzed the evaluation factors affecting the evaluation results. As a result of institutional analysis, the present evaluation result is being utilized in PQ, and it is suggested that the evaluation subject institution is limited to the excavation institution, which may cause disadvantages to the participating museums. We also pointed out that a small number of jury members are currently evaluating the report and therefore need to reinforce it to ease the burden of assessment. As a result of evaluation factor analysis, it was confirmed that the target score was lower but the actual effect score was higher. In addition, it suggested that the indicators should be improved because the report system, headings, natural archaeological environment, scope and method of survey, and editing and printing indicators are less influential than other indicators. In addition, we conducted a regression analysis of each group by examining the appropriateness of classification amounts according to current excavation costs. As a result of the analysis, the cost of excavation in the second and third groups in 2015 and 2016 was found to affect the score. This emphasized the need for an in-depth approach to estimating the taxonomic value of the group, which is inconsistent with the initial objective of not affecting the assessment results according to excavation costs.

  • The purpose of this study is to suggest a systematic procedural model for selecting competent project promoter. The proposed model was made by comparing domestic regulations and procedures with foreign nations', and through interviews with experts and literatures survey. The summaries of this paper are as follows. The current promoter selection procedure was evaluated by reviewing relevant papers, regulations and existing model. Some obstructions which hinder PPI project activation were identified, those are inadequacy of promoter qualification and negotiation process, lack of communication between parties, etc. Some alternatives which remove major obstructions are embodied in the model. The suggested model is comprised of PQ(prequalification), two phased evaluation for the technical proposals which include alternate, communication meeting, etc. To manage the overall procedure well, an involvement of professional "project promoter selection team" would be highly recommended. They will participate in each evaluation stage with full activities, and provide government with some technical materials for selecting promoter as coordinator.

  • Since many accidents have occurred in Korea in these days, many people have lost their health and have been damaged. The damages caused by fires which occur to many buildings where many people always reside takes a substantial share of the total damages. And since the proportions of the domestic fire protection designing/supervising industries are relatively much disregarded compared to other kinds of work, it is in the situation that there are many cases of serious damages because the fire protection equipment didn't exert the proper functions on fire after a building is constructed since the supervision against the poor construction along with the inadequate design. In order to improve such situations, in case of the design industry, the criteria on registration and workforce placement, the scope of operation, the design documents required when requesting the agreement to the construction permits, the responsibilities and authorities about the jobs of the fire protection facility designers must be improved and, in case of supervising industry, the registration criteria, the operation scope and the kinds, methods, targets and criteria of supervision, the criteria on the additional placement of assistant supervisors, the contents and scope of work must be improved, the PQ system and Public Supervision System must be reviewed and the systems for preventing any poor supervision must be improved in order to pursue the security of the people and their properties at the same level as the other kinds of work by preparing for the firm position and foundation of the fire protection design and supervision.

A Study of Improvement on Accident Rate Index of Construction Industry (건설업 산업재해발생율 평가지표 개선방안)

  • Since the introduction of the converted accident rate in Pre-Qualification(PQ) process in 1992, the safety evaluation system has contributed to a reduction of construction accidents and development of the safety management system in public construction projects. As the comprehensive evaluation method the government plans to introduce includes the indicators 'accident rate' and 'death rate per 10,000 workers', the influences on the safety evaluation in the bidding process would be broader in public sector construction projects. However, the current safety evaluation system is operated by different estimating standards in the bidding process. At this point, a study of improvement on the safety evaluation index is required to review its current conditions and to propose its efficient operating method. Therefore, the purpose of this study is to analyze problems of the current safety evaluation system through the questionnaire survey on the qualified workers in construction safety management and to propose an improvement plan for the problems noticed. Our results suggest the standards of the unified process for the safety evaluation index, the size of construction firms needed for accident rate estimation, and the improvement plan for unreported accidents. The proposed improvement plan enables the reasonable estimation and efficient operation of the safety evaluation index, and further, it would contribute to reducing construction accidents through the activation of voluntary safety management by construction firms.

  • To help a owner selecting proper contractors about the specified contract, the Evaluation and Public Announcing System of the Contractor's Construction Capacity has been introduced since 1997. But, the system has been done violence to its original meaning and purpose as time went on. When annually announcing the Contractor's Construction Capacity, especially, there was frequently a large range of opinion on the issues. On that account, MLTM(Ministry of Land, Transport and Maritime Affairs) has had to make a alteration to improve those and is making efforts for a constructive policy now. The purpose of this paper is to conduct a basis study on the Integrated System after reflecting points to be considered about improvements and the current of the times.

An Inquiring Demand for Certification of Contract Foodservice Management Company by in-depth Interview and a Review about the System in a Related Field (심층면접(In-depth interview)을 활용한 위탁급식전문업체 인증제도 도입에 대한 요구 조사 및 관련분야 제도에 대한 고찰)

  • This study was performed to inquire demand for indroducing certification on contract foodservice management company(CFMC) and review about the system in a related field. The methodology was practiced an in-depth interview for grasping demand on certification of CFMC and composition on an appraiser group. Content analysis was reviewed about the system in a related field. Large enterprises and small and medium-sized enterprises were positive opinion on a certification of CFMC and they suggested that education and research institution, industry, government, association will be included in appraiser group. The review about the system of a related industry was investigated by field such as similar product and service with restaurant industry, similar service with hotel and tourism industry. And similar purpose with a certification of CFMC was put in operation as PQ(pre-qualification) and selecting an adequate corporation in architecture industry. Therefore, a certification of CFMC should be tried to scientific introduction by objective verification.

건설기술자 경력관리는 이렇게(2)

  • 지난해 건설기술관리법 시행령 이 개정됨에 따라 지난 3월 1일부터 특급건설기술자는 기술사만 가능하고 학· 경력기술자는 초급까지만 인정되는 등 건설기술자 경력제도가 대폭 개선되었다. 이에 따라 건설교통부는 개정된 경력신고 제도를 건설기술자가 제대로 이해하지 못해 불이익을 받는 일이 없도록 하기 위하여“건설기술자 경력관리 이렇게 하시면 됩니다”홍보책자를 발간했다. 이 홍보 책자는 이제 막 입문하는 초급기술자부터 특급기술자에 이르기까지 전체 57만여명의 건설기술자 누구 나 쉽게 경력관리가 가능하도록 건설기술자의 경력신고 절차, 교육훈련, 각종 통계자료 및 주요 유권해석 등을 알기 쉽게 매뉴얼 형식으로 정리하였다. 이 책자에 따르면 건설기술자가 개정 전의 규정에 의한 기술등급을 받기 위하여 반드시 숙지해야 할 사항으로 는 오는 8월 31일까지 자신의 학력·자격·경력 등을 한국건설기술인협회 등 경력관리수탁기관에 신고하여야 하고 내년 2월 29일까지 1주의 전문교육을 이수하여야 한다. 또한 건설기술자가 근무처 경력신고시 종전의 국민연금 등 4대 보험 자료 원본을 제출하던 것을 해당 공단 홈 페이지 출력물로 대체가 가능, 경력신고가 훨씬 간편해졌다. 참고로 건설기술자의 경력관리 자료는 설계 등 용역업자의 사업수행능력(PQ) 평가시 수행경력 확인, 건설관련 업체 등록시 기술능력 확인, 건설기술자 현장배치시 적정여부 확인 등에 활용되고 있다. 본지는 건교부가 발간한“건설기술자 경력관리 이렇게 하시면 됩니다”홍보책자를 3회에 걸쳐 게재한다.
