Refusal to Dealing of Essential Facilities under Fair Trade Act -Focused on Adoption of Broadcasting Contents- (공정거래법상 필수설비의 거래거절 -방송 콘텐츠의 적용을 중심으로-)

  • As broadcasting contents are recognized as a key competition means, there are issues raised such as improvement of terrestrial retransmission system, introduction of PAR in broadcasting market and so forth. Especially, in pay broadcasting market, strategic partership between SP and PP leads to contents exclusivity for competitors, which causes to hinder normal competition and limit viewers' right of access. Consequently, not only is it claimed that essential facilities doctrine should be adopted in broadcasting market, but also clause of content equal access in IP TV law and adoption of prohibited acts regulation can be viewed in the same context. However, adoption of essential facilities doctrine in broadcasting market is likely to be counterproductive because of the differences of philosophies, economies and legal systems on which general facilities and contents are based. Therefore, it is time for a essential facilities concept, a fundamental concept of a refusal to dealing of essential facilities, and basic works to review specific cases and precedents implemented in competition laws market This study aims to review and propose beforehand if adoption of essential facilities doctrine is appropriate for broadcasting contents.

Characteristics of Korean Export Clothing Articles to Each Important Market (한국 수출의류제품의 주요 수출시장별 특성)

  • The purpose of this study was to identify the characteristics of export clothing articles in Korea. For the purpose, the proportion and unit price of each export clothing articles were analyzed to each important market. The results of the study were as follows : First, on the proportional aspect, to all world market, SITC 845(Articles of apparel, of textile fabrics, n.e.5.), 842(Women's clothing, of textile font knittedabrics), and 841 (Men's clothing of textile fabrics, not knitted), 844(Women's clothing, of textile, knitted or crocheted) and 846(Clothing accessories, of textile fabrics), 848(Articles of apparel, clothing access., excluding textile), 843(Men's or boy's clothing, of textile, knitted, crocheted.) in order were in large exported, after the mid-1990's. To each important market, the proportion of export clothing articles was varied. Second, on the unit price aspect, to all world market, the unit price of export clothing articles went down slightly. For each item, 844(Women's clothing, of textile, knitted or crocheted) went up a little, 843(Men's or boy's clothing, of textile, knitted, croche.) and 845(Articles of apparel, of textile fabrics, n.e.s.) went down a little, 841(Men's clothing of textile fabrics, not knitted), 842(Women's clothing, of textile fabrics), 846(Clothing accessories, of textile fabrics) and 848(Articles of apparel, clothing access., excluding textile) went down greatly. The unit price to industrialized countries, newly industrializing countries, developing countries in order was high, reflecting the developing stage of each nation's.

  • Policy introducing open access to the wireless network has been under discussion in the Korean mobile telecommunications industry. The policy, which directs mobile operators to allow mobile portals other than their own ones to access their network and subscribers, is expected to vitalize mobile Internet market through competition among portals.   • The present paper investigates the technological and conceptional characteristics of peering and transit in internet interconnection. Especially, the market with two ISP competing for customers is modeled and the outcome with peering is compared with transit. This paper also analyze the congestion effects on retail price and network capacity. When there is congestion effects occurring from network sharing, the retail price is increased and the fixed fee is decreased with the degree of congestion. Finally, the optimal access charge assuring the socially optimal retail price and network capacity is derived.

  • The most significant change and trend in the information security market in the year of 2014 is in relation to the issue and incidents of personal information security, which leads the area of information security to a new phase. With the year of 2011 as the turning point, the security technology advanced based on the policies and conditions that combine personal information and information security in the same category. Such technical changes in information security involve various types of information, rapidly changing security policies in response to emerging illegal techniques, and embracing consistent changes in the network configuration accordingly. This study presents the result of standardization and quantification of external access inference by utilizing the measurements to fathom the access authorization performance in advance for information security in specialized networks designed to carry out certain tasks for a group of clients in the easiest and most simple manner. The findings will provide the realistic data available with the access authorization inference modes to control illegal access to the edge of a client network.

  • With the opening of a KTX on April 1st, 2004, Gwangmyung Station was opened. It is a station for KTX only. As it is not located at the center of a city, it doesn't have as good access mode system as Seoul, Deajun Station. In addition, because it is constructed within a limited development district, the development of catchment areas is not enough. At the beginning of the opening, demand falls short of their expectation so Importance of Access Mode System is issued. For the revitalization of Gwangmyung Station, Korea National Railroad focuses on the construction of Access Mode System such as the beginning of shuttle bus service between Kwan-ak and Gwangmyung station on June, 2005, opening of shuttle electric train between Yongsan and Gwangmyung station December, 2006, and the completion of parking tower in Gwangmyung station. After opening to Access Mode System, demand has been increasing. As market is changing, the railway line capacity between Seoul and Siheung reaches a limit, this research tries to review the way to setup sufficient Access Mode System.

Capital Markets for Small- and Medium-sized Enterprises and Startups in Korea

  • This study describes the structure of the capital markets for small- and medium-sized enterprises (SMEs) and startup companies in Korea, which is an emerging market that has experienced drastic changes. The overall capital market can be divided into private and public capital markets. In the private capital market, most of the demand for capital comes from non-listed private firms, including startups and SMEs. In the case of SMEs and startups, the KOSDAQ, the Korea New Exchange (KONEX), and primary collateralized bond obligations (P-CBOs) are part of the public capital market. SMEs and startups are generally incapable of raising sufficient capital owing to their low credit ratings, and they largely have limited access to primary markets to issue shares and borrow money. The Korean government has developed a systematic financial aid program to provide funds to these companies. The fund for SMEs has significantly contributed to the development of the venture capital market. Many Korean banks provide substantial lending to SMEs, but this lending is available only because of the Korean government's loan recovery guarantee. Furthermore, SMEs can issue corporate debt in the form of primary collateralized bond obligations through government guarantees, but such debt issuances have placed increasing pressure on public guarantee institutions.

Information Cascade and Share Market Volatility: A Chinese Perspective

  • The purpose of this paper is to understand the underlying dynamics for the share market bubbles in China during the most recent decade. By using the behavioral finance theory and the Shanghai Composite index prices during the periods from 2005 to 2008 and from 2014 to 2015 as the study samples, we find that the large volatilities in the Chinese share market are closely related to information blockage, which impedes share prices to timely respond to economic conditions as well as external shocks and increases (decreases) the demand of shares when the supply is difficult to adjust. Although the Chinese government has introduced a series of programs designed to increase more reliable information to the public, the share market still tends to confront issues of information asymmetry. The potential reason is that the reforms did not change the long-stand situation in China, where individuals or groups related to government bureaucracy who play a dominant role in the society are given priority to gain access and obtain information that benefits. By identifying the main reasons for the large volatilities in the market, policy makers are given advice as to which areas they may need to focus on to improve future market performance.
