미국 의료개혁법의 의료보험 의무가입 제도에 대한 연방대법원의 합헌결정 (The Constitutionality of Individual Mandate under the U.S. Patient Protection and Affordable Care Act of 2010)

  • The Unites States has been plagued with soaring health care costs and an alarmingly large number of uninsured population. The Patient Protection and Affordable Care Act of 2010 ushered in the most sweeping health care reform in the United States since the introduction of Medicare and Medicaid in 1965 to address these issues. The law's requirement for individuals to purchase health insurance (the so-called "individual mandate"), however, not only caused a political stir but also prompted constitutional challenges. Some questioned whether the federal government, lacking general police power, could require its citizens to buy unwanted insurance based on its enumerated powers under the U.S. Constitution. This paper summarizes the decision of the U.S. Supreme Court on the constitutionality of individual mandate, and explores how the decision relates to Korea's own universal health care.

The Relationship Between Monetary and Macroprudential Policies

  • This paper analyzes the interaction between monetary and macroprudential policies mainly in the context of the non-cooperation among policy authorities. Each policy authority's optimal response is to tighten its policy measures when other authorities' policy measures are loosened. This indicates that the two policies are substitutes for each other. This result still holds when an additional financial stability mandate is assigned to the central bank. The condition for the response functions to converge to a Nash equilibrium state is analyzed along with the speed of convergence, showing that they depend on the authorities' preferences and the number of mandates assigned to policy authorities. If the financial supervisory authority (FSA) assigns greater importance to the output gap or a stronger financial stability mandate is assigned to the central bank (CB), the probability of non-convergence increases and the speed of convergence declines even when the condition of convergence is satisfied. Meanwhile, if the CB considers output stability as an important task, the probability of convergence and the speed of converging to a state of equilibrium are high. Finally, when a single mandate or small number of mandates is/are assigned to each authority, stability is more quickly restored as compared to when many mandates are assigned.

A Humanity-Centered Vision of Soft Power for Public Diplomacy's Global Mandate

  • Remarkably, despite the growing frequency and severity of global problems such as climate change, earthquakes and health pandemics, public diplomacy has remained largely focused on the goals of state actors and threats from other actors. The Covid-19 pandemic exposed the consequences of focusing on individual actors of public diplomacy, including their competitive quest for soft power, over the more pressing needs of humanity and public diplomacy's global mandate. The aim of this piece is to expand the vision of soft power from a competitive state-centric perspective to a broader and more collaborative, humanity-centered perspective. Although public diplomacy's link to power may appear recent and linked to Nye's (2004) concept of soft power, research suggests that it may stem from the traditional diplomacy's "diplomacy of imperialism" (Langer, 1935) that immediately preceded public diplomacy's rise. While this diplomatic heritage may currently dominate public diplomacy perspectives, humankind's global heritages and evolutionary capacity for cooperation suggest another vision is possible. The paper draws upon Alexander Vuving's (2009) explanation of how soft power works in a comparative analysis with Nye's original works to sketch out a new humanity-centered perspective of soft power. The paper concludes with implications of a humanity-centered perspective of soft power for public diplomacy's global mandate.

  • The legal communicable diseases are classified two group, 62 diseases in the existing domestic animal Infectious disease prevention Act. There is problem that standards of administrative measure are unjustly suspected when infectious disease outbreaks between two groups, Therefore, A reclassification of many diseases should be diversified, the standards of administrative measure at the infectious diseases outbreak should be desired. Also, It suggest that central government should mandate local government to be able to assign legally designated disease about specific endemic diseases.

  • Recent criticisms of the conduct and use of risk assessment by regulatory agencies have led to a wide range of proposed remedies, including changes in regulatory statutes and the development of new methods for assessing risk. The mandate to this Committee was more limited. Our objective was to examine whether alterations in institutional arrangements or procedures, particularly the organizational separation of risk assessment from regulatory decision-making and the use of uniform guidelines for inferring risk from available scientific information, can improve federal risk assessment activities. Before undertaking to determine whether organizational and procedural reforms could improve the performance and use of risk assessment in the federal government, the Committee examined the state of risk assessment and the regulatory environment in which it is performed. In this chapter, we define risk assessment and differentiate it from other elements in the regulatory process, analyze the types of judgments made in risk assessment, and examine its current government context. Because one chronic health hazard, cancer, was highlighted in the Committee's congressional mandate and has dominated public concern about public health risks in recent years, most of our report focuses on it. Furthermore, because activities in four agencies--the Environmental Protection Agency (EPA), the Food and Drug Administration (FDA), the Occupational Safety and Health Administration (OSHA), and the Consumer Product Safety Commission (CPSC)--have given rise to many of the proposals for changes in risk assessment practices, our review focuses on these four agencies. The conclusions of this report, although directed primarily at risk assessment of potential carcinogens as performed by these four agencies, may be applicable to other federal programs to reduce health risks.

  • The global rise of greenhouse gas(GHG) emissions and its potentially devastating consequences require a comprehensive regulatory framework for reducing emissions, including those from the transport sector. alternative fuels and technologies have been promoted as a means for reducing the carbon intensity of the transport sector. Renewable fuel policies were historically motivated by energy security concerns, and to promoted agricultural industries. In the last decade, biofuels have also been discussed as low or net-zero carbon soures of energy for transportation. Hence, the development of biofuels has been supported by a range of policy instruments, including volumetric targets or blending mandates, tax incentives or penalties, preferential government purchasing, government funded research, development in world-wide. As one of the most powerfuel instruments, renewable fuel mandates require fuel producers to produce a pre-defined amount(or share) of biofuels and blend them with petroleum fuel. In this study, we reviewed Renewable Fuel Standard(RFS, USA), Renewable Transport Fules Obligation (RTFO, UK) as a renewable fuel mandate policy to reduce GHG. This includes not only mandate system for blending of biofuels in transport fuels, but also sustainability to use biofuels in this system.

사칠논쟁(四七論爭)의 연원과 문제의식 - 『입학도설(入學圖說)』과 「천명도설(天命圖說)」을 중심으로 - (On the Problems of Iphakdosoel and Chunmyongdosoel, as the philosophical background of the Four-Seven Debate)

  • 본고는 "입학도설"과 "천명도설"의 문제의식을 중심으로 사칠논쟁의 연원을 밝힘으로써 조선유학이 오늘의 우리에게 갖는 의미를 재확인하려는 것이다. 사칠논쟁은 조선 성리학의 대표적인 이론논쟁으로, 이로부터 파생되는 인심도심논쟁, 인물성동이논쟁, 미발심체논쟁 등 심성설 중심의 이론탐구는 조선유학의 중요한 특징을 이루는 것으로 평가되어 왔다. 그런데 지금까지의 접근은 대체로 이러한 이론논쟁을 현실을 도외시한 조선성리학의 공리공론성을 보여주는 것으로 치부하거나, 아니면 현실을 도외시한 이론논쟁이긴 하지만 한국인이 지닌 철학적인 사고능력을 보여주는 철학논쟁으로 평가하기도 하였다. 그러나 양촌의 "입학도설"에서부터 나타나는 성리학에 대한 기본이해는 성리학이란 수기치인지학으로서 결코 현실과 유리될 수 없는 것이며, 이상사회는 통치계층의 도덕성실현위에 모든 사람들의 도덕성이 실현됨으로써 완성되는 것이었다. 따라서 인간의 도덕성의 근거를 밝히고, 수양의 목표를 제시하며, 선악의 유래를 명확히 함으로써 현실적인 악을 극복하고 선을 실현하고자 하는 것이 핵심이 된다. 이런 문제의식은 추만의 "천명도설"에서도 그대로 계승된다. 추만의 "천명도설"은 우리의 도덕성은 천명으로서 주어져 있으며 이를 근거로 천인합일이라는 이상에 도달할 수 있음을 분명히 밝히려는 것이었다. 그리고 이러한 본격적인 심성논쟁이 의리실천을 학문의 핵심으로 생각하는 도학의 전통이 세워진 이후 도학자임을 자부하던 학자들 사이에서 계속되었다는 것은 이것이 결코 현실과 유리된 공리공론이 아니었음을 우리에게 보여준다. 즉, 조선유학이 가진 인간의 도덕성에 대한 신뢰와 도덕성의 실현을 통해 인간사회의 문제를 근본적으로 해결하려는 인간에 대한 가치론적 이해는 오늘의 우리에게도 큰 철학적인 의미를 갖는다.

  • Virtually every state in US has adopted laws and regulations that mandate the generic substitution of brand-named prescription drugs in order to reduce sky-rocketing drug costs. In the late 1970s, many state governments began to recognize the need of generic substitution and requested Food and Drug Administration (FDA) to consult with this issue. FDA did consult which drugs were interchangeable each other based upon the available scientific and experimental evidences given to the agency along with New Drug Application (NDA) and Abbreviated New Drug Application (ANDA).   • The borderless global economy has accentuated the importance of knowledge as the most critical source of competitive advantage. Thus, knowledge management has become a strategic mandate for most world-class organizations. A key enabler for implementing an effective knowledge management system is advanced information technology. Strategies for developing an enterprise-wide knowledge management system Infrastructure with embedded information technology are discussed. In particular, this paper discusses the concept of a knowledge management life cycle- -knowledge capture, knowledge development, knowledge sharing, and knowledge utilization, and how applications of new information technology support each step of the knowledge management practices within and between organizations is suggested.
