  • With recent news reports on violent crimes committed by foreigners, public hatred toward foreign criminals and fear about such crimes are growing, calling into question public safety measures implemented by the police and the immigration system. At the same time, due to globalization and structural changes in the labor market, it is certain that the influx of migrant workers will continue to increase. Against this backdrop, this paper seeks to examine the current status of foreign nationals staying in Korea and their criminal records focusing on Suwon city, and propose public safety measures the police could take with regard to crimes committed by foreigners. Also, the paper looks into public safety measures of the Korea Immigration Service and Suwon city, and suggests short- and long-term measures to prevent crimes committed by foreigners. The paper begins by examining the current public safety measures of the police and Suwon City concerning crimes committed by foreign nationals residing in Korea. Based on such examination, it points out insufficient patrol and investigation personnel as problems, and recommends short- and long-term measures for future improvement. This paper maintains that for the Korean society to successfully deal with the increasing number of foreigners in Korea, the current immigration system and public safety measures of the police will have to change. While the police alone cannot reduce the crime rates at local and national levels, nonetheless, proactive measures by the police are needed given the growing number of migrant workers and immigrants in Korea. Also important are mindset changes not only of relevant authorities, but also of the public. The paper recommends a set of short-and long-term public safety measures the police should institute to efficiently deal with crimes committed by foreigners.

  • Article 117, Paragraph 1 of the 「Constitution」 states that "Local governments may enact provisions relating to local autonomy, within the limit of Acts and subordinate statutes". It restricts the enactment of effective self-government laws. The fundamental problem-solving is securing the right to self-governing legislation through constitutional amendment. Therefore, it must be revised to "Local governments can make regulations on self-government to the extent that they handle resident welfare affairs in accordance with the subsidiarity and do not violate the law." In the long-term perspective, the current education council problem, which is contrary to the constitution, has to be revived as a constitutional independent education committee system, and the voting agency and the executive agency must go together and education councilors must have about 10 years of experience in education and education administration. The current superintendent's election system is of great significance in establishing democratic legitimacy by ensuring residents' right to vote and securing a superintendent's representation of residents. It hasn't been long since the system was implemented, but there are some side effects and it is argued that the election system should be replaced by the appointment by the head of the local government, the running mate system or the joint registration system. However it is thought that it is necessary to minimize and supplement the side effects rather than fixing the system as it violates the Constitution of the local education autonomy system.

  • The measures to extend local education autonomy are as follows: First, it is necessary to correct the confusion of the legal system of the local education autonomy system. For this, Article 12, Paragraph 2 and 4 of the 「Special Act on Local Autonomy and Decentralization, and Restructuring of Local Administrative Systems」 which state that "The State shall endeavor to consolidate systems for autonomy in education and local government" and "The implementation of autonomy in education and the autonomous police system shall be prescribed separately by Acts" should be deleted. Second, it is necessary to clarify unnecessary legal matters and regulatory measures for unification at the national level and to proactively consider the introduction of the legal trust system, in which education affairs are designated as local governments' own work and the state carries out specific affairs. The decentralization of local education finance is a key factor for the development of local education autonomy, and it requires the transfer of authority and resources to the region, and the enhancement of local autonomy and corresponding responsibility. First, the ratio of special grants must be adjusted further (from 3% to 2%) or the ratio of national policy projects must be lowered. Second, the provision that requires a consultation with a mayor/governor when making a budget covered by transfers from general accounts should be deleted. Third, it is necessary to remove the elements that limit the authority of city and provincial councils. Fourth, it is necessary to integrate the national education tax and the local education tax to create the education autonomy tax (tentative name) for only one independent purpose. Fifth, it is necessary to strengthen the distribution of the total amount of grants and abolish the settlement regulations for the measurement items of standard financial demand. Sixth is the expansion of the participation of stakeholders and experts in the grant distribution process. Seventh, it is necessary to establish a long-term employment system by designating the education finance field as a special field. Eight is the expansion of cooperative governance.

  • South Korea's socioeconomic status is high enough to support services for the protection of crime victims. Until now, the Ministry of Justice was the only institution to protect and support the victims, but recently the national police is included. This is considered preferable, since the police is the one to contact the victims first- they can provide immediate support after the incident. Several limits in current laws and crime protection system exist. Therefore, given the importance of protecting victims, model of public-private joint forms should be considered. In premise of establishing a new relationship between the public-private joint system of justice and the maintenance, the range of police's involvement with crime supports will be determined. In the case of developed countries, the police and private organizations maintain close cooperation, appearing as substantial care and support for crime victims. Therefore this study reviews the problems in crime victim protection, assistance from the police stage, and suggest the improvements as follows. The first is to redefine the role of the police who first contacted in the crime victims protection support, the second is to establish a permanent cooperation framework, such as victims specialized police, victims protection agency, the third is to develop services for victim protection available from the police stage, and the fourth, opening Victim Support Center functioning as a temporary accommodation or safety zone for the personal protection of victims. The fifth is to regularize solution conference for victims' protection, and the sixth is to divide of roles in state organization government in charge of victim's protection and local government responsible for victim's support.

  • The burden of addressing the damage and financial losses caused by disaster events falls primarily on local governments. Given this reality, preparing for disasters and assessing the effects of disaster management would be more effective if both were carried out at the local level. However, disaster management in South Korea is realized at the national level, revolving around the central government. The Ministry of Public Safety and Security, which was newly established after the sinking of MV Sewol, was criticized for failing to carrying out its role as a "disaster control tower" in dealing with the earthquakes near the city of Gyeongju in 2016. The criticism, as well as deep anxiety concerning the ministry's ability to effectively respond to disasters, means that there is a need for a practical alternative plan to the current method of dealing with disasters. As such, there is an increasing call to re-examine the role of the police force, which played an integral part in past disaster response efforts, in future disaster events. Among the various activities the police force performs, this study focused on one particular role and function of the police, namely community policing. Specifically, this study examined community policing within the context of local governments. The primary purpose of community policing is crime prevention. But the police must respond to citizens' expectations and desires that the police expand the scope of its role. Thus, to maximize public safety and order, the police must be actively engaged in conducting disaster response activities. Hence, this study concentrated on the measures, including community policing, that need to be taken to enable the police to respond rapidly and effectively to disaster events, thereby minimizing losses, and to contribute meaningfully to disaster recovery efforts. Because community policing requires public cooperation, community-oriented disaster response and disaster management are closely examined. This study basically seeks to expand the scope of community policing to strengthen disaster safety. Furthermore, this study aims to assert that disaster safety can be promoted by establishing a cooperation system between the police and private security; changing how the role of community policing in disaster response activities is perceived; increasing professional manpower and establishing a comprehensive and independent department dedicated to disaster-related matters; and merging consultative organizations into one organization. Additionally, this study states that an integrated CCTV platform and police cars on disaster prevention patrol duties would enhance the capability of the police to respond to disasters and perform their community policing activities.

  • Recently, our company has entered the modern knowledge company, government policy and regulation has a big influence on people's lives. • The occurrence of complicating, multilateral social condition demands the strategy for facing many social state and consolidating public security against criminal loss. The lacking ability of local police for preventing crime can't satisfy the demand of security and can't get rid of fear of crime. At last, it brings a distrust of public confidence and became a factor of serious social crisis. We have problems - not only making an alternative plan for preventing crime, but also introducing CPTED(Crime Prevention Through Environmental Design) by environmental design, to expect crime prevention and to select systemic crime prevention system and the most suitable model. And we have a goal - to recognize the importance of guard activity for local crime, analyse public safety activity in community & focusing guard activity as a strategy for them, apply CPTED in police and private security company as a local crime prevention & setting effective model, and, make it as an index for preventing & dealing with intellectual, brutal crime. The rapid growth in the guarding-activity field lighten the burden of police for crime-prevention. But the misjudgement of some people blocks it to be settled institutionally. It needs to reconsider what is the effective crime-prevention method, at this point of time when the all parts of a nation changing into unlimited competitive, private self-control system.

  • While welcoming the distributing of the powers of the Ministry of Education, which is currently being promoted, to the city and provincial offices of education, I am very concerned that this will expand and amplify the powers concentrated in one central institution to 17 local institutions closer to the field. Until now, the Ministry of Education and the Office of Education have served as co-cause providers as important reasons for hindering school education. The transfer of the authority of the Ministry of Education is highly likely to be deformed as soon as it results in the quantitative reduction of the functions and roles of the existing Ministry of Education and the quantitative expansion of the roles and functions of the city and provincial offices of education. In the reality that no legal device for school autonomy has been established, it is highly likely that emphasizing the principle of school autonomy in our educational climate, which is deeply rooted in the vertical bureaucratic administrative culture, will end with a simple measure or stop at the level of imitation. Therefore, a more stable device is needed to check the authority of the city and provincial office of education and the superintendent of education to take over the authority of the Ministry of Education. This is also a system that is still required even when school autonomy becomes legal. Therefore, it is necessary to revitalize the independent education committee, establish a local education committee in the city and province education office, and activate the resident participation system (resident proposal system, resident voting system, resident litigation system, resident audit request system).
