An Investigation and Analysis of the Product Liability of Manufacturers in Shenzhen

  • Product liability refers to the liability of producers, distributors and suppliers for consumers' property losses or personal injury caused by that product. This paper conducted a survey related to product liability issues in Shenzhen City, and did an in-depth analysis of current problems. Finally, the paper puts forward corresponding suggestions for improvement of Shenzhen City product liability status.

바이오안전성의정서에서의 책임복구체제에 관한 법적 고찰 (A Legal Analysis on the Liability and Redress Regime under the Cartagena Protocol on Biosafety)

  • This study reviews the proposed liability and redress regime under the Cartagena Protocol on Biodiversity. Several core elements for the regime are discussed in comparison with those listed in the 1999 Basel Protocol on Liability and Compensation for Damage resulting from the Transboundary Movements of Hazardous Wastes and their Disposal. These are (1) scope of the rules and procedures; (2) channeling of liability; (3) legal standing; (4) definition of damage; (5) standard of care; (6) ancillary sources of compensation; (7) limitation of liability; (8) financial guarantees; and (9) mutual recognition and enforcement of judgments. Korea has given relatively little attention to the issue of liability and redress in the context of LMOs trade. As the Protocol is expected to enter into force soon, Korea needs to develop appropriate implementing domestic mechanisms for the Biosafety Protocol. Establishing an adequate domestic liability and compensation scheme will be one of the most important mechanisms not only to comply the Protocol but to ensure safety of LMOs in general. A further research is needed on the basis of a comparision of relevant legislations in different countries as well as analysis of current laws related to the accidents arising from LMOs trade, such as product liability laws, food safety laws, liability provisions in some environmental legislations.

MITIGATION AND REMISSION OF CONTRACTOR'S DEFECTS LIABILITY IN KOREAN CONSTRUCTION CONTRACTS

  • The purpose of this study is to improve regulations such as law and standard contract forms related to defects liability in Korea. Defects liability has been one of the major causes of construction contract disputes in Korea in recent years. It is important to avoid or resolve disputes regarding defects liability through regulations containing clear criteria and to specify the standard regarding the mitigation and remission of the contractor's defects liability. This study was carried out through document research and analysis of judicial precedents. The following are the courses of improvement regarding the mitigation and remission of defects liability in Korea. First, laws and standard contract forms must contain more detailed clauses regarding exemption of a contractor's defects liability, which clearly set out the scope of the defects liability of the contractor. Second, the current system for defects liability favors the owner rather than the contractor - it is necessary to change the defects liability system in order to give the owner and the contractor an equal standing. Third, strict liability is taken on by the contractor even when the term of guarantee for defects lasts longer than the legally set period of liability for defects. Hence, it is necessary to improve the system by alleviating the liability of the contractor through applying negligence liability as opposed to strict liability during the term of guarantee.

  • Product liability is becoming a real issue to exporters, manufacturers world wide. The purpose of this study is to examine the product liability of Korean exporters, manufacturers, etc. under Product Liability Laws and Regulations of China. For this purpose, firstly we deal with the Product Liability Laws and Regulations of China. Secondly we analyze the case study concerning the Product Liability in China. From the analysis of case study, Korean exporters, manufacturers, etc. are required to pay close attention to the following : the correspondence of English with Chinese in the warning phrases, the possibility of application of strict global standard in case of existence of product liability, the proper treatment of evidence in the process of litigation, the application of strict liability and the shift of responsibility for evidence on to a defendant, the observance of procedures prescribed by the country in design and manufacture of the product, the manufacture of product to come up to country standard in quality, the consideration of diverse expression in the preparation of warning sign, the importance of quality control and inspection system in case of local procurement of parts and raw materials, Finally, this paper contributes to help the Korean Exporters, Manufacturers, etc. to build up the proper countermeasures regarding product liability under the product liability regulations of China.

Effects of Stockholders' Secondary Tax Liability on Corporate Investment

  • This study analyzes the impact of secondary tax liability borne by stockholders, an exception to the principle of limited liability, on corporate investment. The paper constructs a model of a firm to examine the effect of this secondary tax liability, finding that the violation of limited liability increases firms' expected bankruptcy costs, thereby reducing investments. By means of an empirical analysis, the paper examines whether firms with the largest shareholder stake exceeding 50%, the condition under which secondary tax liability is incurred, decrease their investments. The results show that firm investment is highly concentrated in observations of cases in which the largest shareholder stake does not exceed 50%. Investments decrease sharply in cases where the largest shareholder stake exceeds 50%. The results here provide implications pertaining to how exceptions of the limited liability principle, existing only in Korea, affect corporate investments.

중국계약법상 화물운송대리에서의 계약책임과 귀책원칙 (A Study on the Legal Character of Contractual Liability in Freight Agency under Chinese Contract Law)

  • Generally, the liability for breach is defined as the civil liability that arises from the conduct of violation of a contract. There are two notable principles governing liability for breach that have fundamental impacts on the unified Contract Law of the People's Republic of China (hereinafter Chinese Contract Law) in the remedies. In China, during the drafting of the Contract Law, there was a great debate as to whether damages for breach of contract ought to follow the fault principle or to follow the strict liability principle. Ultimately the Chinese Contract Law follows the model of the CISG on this point, namely, it follows the strict liability principle (article 107) with an exemption cause of force majeure. Under Chinese Contract Law, it is interpreted as strict liability in principle. Strict Liability is a notion introduced into Chinese Contract Law from the Anglo-Saxon Law. The strict liability or no fault doctrine, on the contrary, allows a party to claim damages if the other party fails to fulfill his contractual obligations regardless of the fault of the failing party. Pursuant to the strict liability doctrine, if the performance of a contract is due, any non-performance will constitute a breach and the fault on the party in breach is irrelevant. This paper reviews problems of legal character or legal ground of contractual liability in Chinese contract law. Specifically, focusing on the interpretation of Chinese contract law sections and analysis of three cases related contractual liability in freight agency, the paper proposes some implications of structural features of Chinese contract law and international commercial transactions.

  • 제조물책임(Product Liability : PL)이란 제조물의 결함으로 인하여 소비자 또는 제3자의 생명, 신체, 재산 등에 손해가 발생했을 경우 그 제조물의 제조자 또는 판매자 등에게 손해배상 책임을 부과시키는 법으로 국내에서는 제조물책임법은 2002년 7월 시행되었다. 본 연구에서 FMEA를 이용한 화학제품의 제조물책임 대응체계를 구성하였으며, 깍N-Dimethyethylamine을 사례로 적용하여 연구를 진행하였다. 우선 화학제품의 취급설명서 역할을 하는 MSDS(Material Safety Data Sheet)를 통해 제품의 정보를 파악하고, 제품의 결함으로 인한 영향을 분석하는 FMEA기법을 적용하여 결함의 심각도, 결함의 발생빈도 및 검출도의 곱으로 정의된 RPN(Risk Priority Number)에 의하여 위험성을 정량적으로 제시하였다.

중국의 사용자책임에 관한 연구 - 불법행위책임법 제35조를 중심으로 - (A Study on the Vicarious Liability of Employers in China - Focus on Article 35 of Tort Liability Law -)

  • With the development of market economy, it has been a legislative trend to establish a system for vicarious liability of employers. China also established Tort Liability Law of People's Republic of China in 2009 and ruled responsibility of the employers for the acts for their employees through Art. 35. First, the employer's right to indemnity to an employee should be recognized, because employer's superintendence is much weak and economic power is similar between them. Second, an employer should take a responsibility for an unpaid employee as vicarious liability, because the Law did not exclude them from employees. Lastly, in case the Law conflicts with Interpretation of the Supreme People's Court on Certain Issues Concerning the Application of Law in Trying Cases Involving Compensation for Personal Damage, the Law should be regarded it has priority based on several related Principles. Regarding these matters, this study guides you to an analysis of vicarious liability of employers in China, benefits with a view to the perfection of the vicarious liability regime.

의료기관 자본구조에 대한 상충관계이론과 자본조달 순위이론 실증분석 (An Empirical Analysis on Trade-off Theory and Pecking Order Theory for Medical Institutions's Capital Structure)

  • Based on the findings of a study focused on medical institutions(Fama & French, 2002), this study determined possible causality between determinants of capital structure and liability level, while estimating targeted debt ratio. Moreover, it also examined hypotheses about the adjustment of targeted debt ratio and the of fundraising patterns, so that it verified the relative priority of trade-off theory and pecking order theory. First, profitability had positive(+) relationships with liability level, while investment opportunities had negative(-) relationships with liability level. This finding supported pecking order theory, and non-liability tax shield effects had negative(-) relationships with liability level as estimated in both trade-off theory and pecking order theory. Next, this study verified trade-off and pecking order theory at once by means of regression analysis about the variation of liability level in associations with disparity from targeted debt ratio and short-term fluctuation of profit and investment. As a result, it was noted that liability level became mean-reversed to targeted liability ratio but slowly, SO it was difficult to assert that such mean reverse may support trade-off theory. However, the finding that most of short-term fluctuations of profit and investment are absorbed into liabilities supported pecking order theory. On the other hand, it was found that the larger scale of medical institutions is more supportive of pecking order theory in the associations between liability level and profitability and the fundraising patterns than trade-off theory.

  • What is the most important in articles of food is hygienic safety. Because food Is the most common thing in our everyday life, however, the importance of its hygienic safety and other many problems caused by food may be easily neglected. What is more, food is can be dangerous as much as it is directly related to human life and accidents from the same cause may have different effects on the victims according to physical and environmental differences of individuals. Thus PL action for food requires more thorough prevention and measure. Korea has been enforcing 'the Product Liability Act' since the 1/sup 1st/ of July 2002. Product Liability (PL) is liability of the manufacturer or the seller of a product to compensate for the death or injury of consumers or the loss of properties caused by the defect of the product. This study surveyed consumers' response to and the effects of the enforcement of the Product Liability Act, investigated how consumers perceived the importance of food safety and the risk of defective food based on PL standards and their experience in damage by food through a questionnaire survey, and analyzed collected data through empirical analyses (reliability analysis, factorial analysis, regression analysis and ANOVA t-test) using SPSS 10.0. Based on the results of analysis, the researcher proposed strategies for coping with the Product Liability Act in the food industry.
