Improvement and Application for Environmental Conservation Value Assessment Map(ECVAM) of Nationwide Land in Korea

  • This study is aiming at improving the Environmental Conservation Value Assessment Map(ECVAM) of National Land in Korea. The ECVAM items are composed of legal and environmental/ecological assessments. A popular method applied to ECVAM is an overlay environmental/ecological assessment items. The purpose of this study is to offer complementary items of the ECVAM by examining assessment items. In this study we assessed the ECVAM by five methods. Method 1 is Grade 1 areas of each administrative district; Method 2 is comparing overlapped areas of each assessment items Grade 1, 2 and permission of each assessment items duplication; Method 3 is Grade 1, 2 areas by only singular assessment items; Method 4 is Grade 1 areas only of Method 2; and Method 5 is Grade 2 areas only of Method 2. Method 1 showed Seoul and other metropolitan cities revealed a large proportion of Grade I regions by the legal assessment items. Gang won-Do, showed a large proportion of Grade I regions by the environmental/ecological assessment item. Method 2 showed 93.4% of diameter Grade II(standard for stability); forest diameter item accounted for 99.9% by Method 3, Method 4 showed 95.7% of forest diameter, and forest density accounted for 66.4% by Method 5. This study contributes to reduce the complexity in the process of manufacturing ECVAM of National Land, and to raise the flexibility in the process of managing and updating this map.

  • International economic and legal cooperation can ensure the transition of agriculture to the trajectory of sustainable development. The paper considers in detail the set of common goals and problems of an international nature, the solution of which is aimed at global legal regulation of cooperation between states. It is also noted about the impact of information technology on agricultural development. The following methods of scientific cognition are used: a historical, systematic approach to research, method of analysis, and synthesis. Research results: a scientific idea of the importance of international cooperation in general and global collaboration in the field of agricultural production in particular. It is stated that states are obliged to cooperate, regardless of differences in their political, economic, and social systems, in various areas of international relations to maintain international peace, security and promote worldwide economic stability and progress, the common good of peoples. It is emphasized the need to build such relations in the agricultural sector, which take into account the interests of all states.

소방업무 제도개선을 통한 심리적 불안 요인 감소 방안 (A Study on the Reduction of Psychological Unrest Factors through the Improvement of Fire Service System)

  • The purpose of this study is to identify psychological anxiety factors related to firefighters' field activities and suggest improvement measures. To investigate the actual status of psychological anxiety factors, a survey was conducted on approximately 3,500 current firefighters, and the responses of 505 people who participated in the survey were analyzed. As a research method, frequency analysis and cross-analysis were conducted according to the general characteristics of the participants to determine the actual level of psychological anxiety in each work field and the results were analyzed. As a result of the analysis, it was statistically confirmed that firefighters feel a lot of psychological burden due to legal and institutional inadequacies during dispatch, return, or field activities, and frequent friction with civil servants is also a major cause of psychological anxiety. Therefore, based on the results of this study, it is proposed to establish a permanent legal support team in each city and province, designate and operate a hospital dedicated to psychological treatment, and establish a special provision for traffic accidents during the return of fire trucks so that firefighters can concentrate on their duties without psychological anxiety. do.

  • 연구대상판결은, (1) 상속재산분할은 그 성질상 협의의 성립과 동시에 종료하고 그 후에는 그 협의에서 그 채무를 부담한 상속인과 그 채권을 취득한 상속인 간의 채권채무관계가 남을 뿐이라는 점, (2) 협의분할의 법정해제를 인정할 경우 소급효를 갖는 상속재산의 재분할이 불가피하게 되어 법적 안정성이 크게 저해된다는 점을 근거로 하여, 협의분할의 법정해제를 부정하였다. 그러나 (1) 상속재산협의분할은 실질적으로 공동상속인 상호 간의 지분교환 양도 포기에 상당한 처분의 성질을 가진다는 점, (2) 공동상속인 전원에 의한 협의분할의 합의해제에 있어서도 소급효를 갖는 상속재산의 재분할이 불가피함에도 불구하고 합의해제의 유효성을 인정하는 데 아무런 이론(異論)이 없다는 점에서, 협의분할이 실질적으로 공동상속인 간의 부담부증여와 같은 성질을 가지는 경우에는 협의분할에 대한 법정해제도 인정하는 것이 온당하다. 다만, 상속재산분할협의는 공동상속인 전원이 참여해야만 성립되는 계약이므로, 협의분할시 상속인 일방이 부담한 채무의 불이행을 이유로 하는 협의분할의 법정해제도 그 일방을 제외한 다른 공동상속인 전원의 의사표시에 의해서만 가능하다고 보아야 한다.

  • 본 연구는 공유와 연결이라는 4차 산업혁명의 핵심적인 가치를 구현하고 있는 신규 사업인 승차 공유경제 산업의 현황과 경제·산업적, 법률적 쟁점에 관해 논의하고자 했다. 대립하고 있는 두 집단 간의 입장을 이해하고자 공유 경제의 산업적 쟁점 및 법률적 쟁점에 대한 국내외 사례에 관한 문헌 조사를 통해 연구를 진행했다. 연구 결과 승차공유 산업은 생산, 공급, 분배, 소비가 하나의 플랫폼에서 이루어지는 종합경제의 면모를 보였다. 접근이 용이한 모바일 애플리케이션 기술을 통해 이용자에게 가치를 공유하고 새로운 서비스로 종합할 수 있게 만들었다. 택시 산업과 승차공유 산업의 갈등 해결을 위해 본 연구는 승차 공유 기업은 합법적인 서비스 제공을 위해 기여금을 내거나 택시 총량제 방안을 마련하고, 택시업계는 서비스 개선과 새로운 공유 플랫폼 서비스를 선택했던 소비자의 입장에 관한 이해가 필요할 것임을 제안한다. 본 연구는 공익과 사익 간의 균형 문제와 법적 안정성 문제에 관한 종합적인 분석 및 정책을 제안했다는 점에서 큰 의의가 있다.

정기용선계약상 대내적 법률관계 (Internal Legal Relationship Under the Time Charter Party)

  • There are several ways to implement charter parties in the operation of the vessel. Under the time charter party, the charterer borrows the vessel from the shipowner and uses the vessel to benefit his business. The time charter party's legal relationship can be divided into internal and external relationships. This article deals with an internal relationship. The legal matters between the shipowner and charterer are regulated by the agreement. The NYPE is the most widely circulated type of time charter party. According to the NYPE, navigational matters fall upon the shipowner while business matter falls upon the time charterer. There are vague parts in interpreting NYPE articles. NYPE Art. 8, called the employment clause, is one of them. The Master employed by the shipowner should follow the order of the charterer. Whether the charterer has the right to order the Master of the vessel to follow the navigating route recommended by him was addressed in the Hill Harmony case by the UK Supreme Court. The court was affirmative. Under the Ocean Victory case, whether the time charterer has an obligation to order the Master to go out to escape heavy weather from the berth at the port was at issue. The Japanese lower court decided negatively. There is a tendency that many countries insert default rule in the maritime law to apply it to the case at issue in a case where there is no agreement. It serves the enhancement of legal stability; China, Japan, and Germany are such countries. The author thinks that Korea should follow the above three countries' revision of their maritime law.

신용장(信用狀) 거래(去來)에 있어 신의성실(信義誠實) 원칙(原則)의 적용(適用)에 관한 고찰(考察) (A Study on the Application of Principle of Good Faith in L/C Base Transaction)

  • Letter of Credit between buyer and seller in International Trade Transaction is the means of payment which makes International Trade operate smoothly by guaranteeing an exporter against non-payment and an importer against non-delivery. Therefore, the parties to a sale apply UCP500 established by the International Chamber of Commerce, in accordance with principle of the freedom of contract among the parties concerned, to look to their own legal stability. However, we may recognize some cases to have been applied principle of faith and trust, one of the dominant principles of the civil law, by the Korean Supreme Court and other cases to have not been applied that principle by the Korean Supreme Court. The Court shall apply UCP500 strictly as long as the parties concerned adopt UCP500 in view of the legal stability. In other words, in case that the Court applies principle of faith and trust to the case related to L/C, this rule - principle of faith and trust - should apply to the subject matter which have not stipulated in UCP500 under certain restriction. We suggest keeping in mind points to korean companies as follows; First, the parties to a sale shall understand L/C basis transaction and principles related to L/C deeply. Second, the exporter shall prepare documents in compliance with L/C and fulfil his or her obligation according to UCP500 and L/C related to the contract. Third, as buyer or importer, when he or she receive the shipping documents with discrepancies from the notifying bank, he or she makes him or herself clear to all the parties concerned. Fourth, as bank, she shall examine all the documents according to UCP500 and L/C related to the contract, and if any document with discrepancies, the bank, by all means, shall approach applicant first, and then decide whether to pay the credit amount to beneficiary or not to.

Performance Analysis of Transport Time and Legal Stability through Smart OTP Access System for SMEs in Connected Industrial Parks

  • According to data from the National Police Agency, 75.5 percent of dead traffic accidents in Korea are truck accidents. About 1,000 people die in cargo truck accidents in Korea every year, and two to three people die in cargo truck accidents every day. In the survey, Korean cargo workers answer poor working conditions as an important cause of constant truck accidents. COVID 19 is increasing demand for non-face-to-face logistics. The inefficiency of the Korean transportation system is leading to excessive work burden for small logistics The inefficiency of the Korean transportation system is causing excessive work burden for small individual carriers. The inefficiency of the Korean transportation system is also evidenced by the number of deaths from logistics industry disasters that have risen sharply since 2020. Small and medium-sized Korean Enterprises located in CIPs (Connected Industrial Parks) often do not have smart access certification systems. And as a result, a lot of transportation time is wasted at the final destination stage. In the logistics industry, time is the cost and time is the revenue. The logistics industry is the representative industry in which time becomes money. The smart access authentication system architecture proposed in this paper allows small logistics private carriers to improve legal stability, and SMEs (Small and Medium-sized Enterprises) in CIPs to reduce logistics transit time. The CIPs smart access system proposed in this paper utilizes the currently active Mobile OTP (One Time Password), which can significantly reduce system design costs, significantly reduce the data capacity burden on individual cell phone terminals, and improve the response speed of individual cell phone terminals. It is also compatible with the OTP system, which was previously used in various ways, and the system reliability through the long period of use of the OTP system is also high. User customers can understand OTP access systems more easily than other smart access systems.

  • The general soil nailing support system may result in excessive deformations particularly in an excavation zone of the existing weak subsoils. Pretensioning the soil nails then, could play important roles to reduce deformations mainly in part of the nailed-soil excavation system as well as to improve local stability. Morever, soil nails are installed underneath roads, underground structures, and subway structures, thereby resulting in difficulties in nail remval after completion of temporary soil nailed walls. Hence, to date, in order to solve the technical difficulties and avoid legal issues related to the construction of soil nails underneath the surrounding areas and structures, the removable soil nailing system has been developed and used. But, Therefore, a new soil nailing technique called Removable Post-tensioned Soil Nailing(RPTN) system has been developed in the current study. In this study, an investigation of the RPTN system has been conducted by carrying out field measurement. Hence, the RPTN system can reduce ground displacement and enhance stability of the soil nailed walls.

일반화물선에서 비표준화물(철재상자)의 안전한 운송을 위한 고찰 (A Study on the Safe Transportation of a Non-Standardized Cargo (Steel Box) for General Cargo Ships)

  • 국제항해선박과 국내항해 카페리선박에 적용되었던 "화물적재고박 등에 관한 기준"이 2018년 1월부터 국내 항만을 운송하는 일반화물선박에도 적용 되었다. 이에 따라 일반화물선을 통해 제주도를 기점으로 국내 주요항만으로 운송되고 있던 크기와 형태가 다른 비표준 철재상자와 같은 새로운 형식의 화물에 대한 법적인 성질을 분류하고 그 분류에 따라 안전하게 적재하고 고박할 수 있는 방안이 필요하게 되었다. 본 연구는 현장 조사와 관련기관 자료 수집을 통해 철재상자의 크기, 형태 등을 분석하였고, 이를 기반으로 철재상자의 법적인 지위를 관련 국내법령과 국제규범을 비교 분석하였으며 그 검토결과를 바탕으로 일반화물선의 화물창에 안전하게 적재하고 고박하는 방법을 검토하였다. 철재상자는 관련 국내법령과 국제규범 등에 따르면 비표준화 화물의 한 종류인 보호외벽이 있는 팔렛트 상자로 분류할 수 있었다. 또한, 일반선박의 화물창에 철재상자를 적재하는 경우 선박 화물창에 빈틈이 없도록 꽉채워서 적재하여 운송하는 방안이 검토되었다. 검토된 화물창내 빈틈없이 꽉채우는 적재·운송 방안이 안전한지에 대한 검증은 선체구조 안전성과 선박복원성 확보 여부를 통해 확인하였다. 선체구조 안전성에 대한 검증결과 화물창내에 적재할 수 있는 화물의 총중량에 대한 선박의 화물창 바닥과 양측면의 구조강도 값은 만족하였으며, 선박복원성은 GoM 값과 3가지 횡경사각별 복원정곡선 및 복원정이 만족되었다.
