Liability in the context of space tourism

  • This article is dedicated to my colleague and friend Professor Soon-Kil Hong, Ph.D, who is the famous President of the Korean Association of Air and Space Law and distinguished teacher at the prestigious Hankuk Aviation University. I had the honour and pleasure to teach there a few years ago - upon his gracious invitation. Professor Soon-Kil Hong has made a long, outstanding and impressive career in aviation and space activities, both from a practitioners and academic perspective. That is why I have tried to find a subject which addresses these facets of his personality although this humble article cannot do justice to the great merits of Professor Soon-Kil Hong. This article discusses the liability aspects for damages and injuries to passengers on suborbital flights, by examining: 1. Recent developments regarding space tourism 2. Suborbital flights in relation to the Chicago Convention 3. The application of space law treaties to space tourism 4. 지구화시대 초국가적 권위체가 복지국가 체제에 미치는 영향에 관한 연구 : 유럽연합의 사회정책을 중심으로 (A Study of Global Impact on Welfare State : with Special References to the Social Policy of EU)

  • 본 논문은 국민국가가 복지정책과 같은 국내정책을 구상하고 입안하고 실행하는데 있어서 초국가적 권위체의 영향력 때문에 자율적 정책능력이 침식되고 있는지를 살펴볼 목적으로 작성되었는데, 그 과정과 결과는 다음과 같다. 첫째, 사회정책의 영역에서 유럽연합(공동체)법와 국내법간의 위상관계를 직접 적용성(direct applicability)과 우위성(supremacy)이라는 두 개의 중범위적 개념을 통해서 밝히고자 하였다. 그 결과, 유럽연합의 법이 실제적으로는(de facto) 회원국의 법에 직접적으로 적용이 되며, 따라서 우위에 있다고 할 수 있으나, 법률적으로는(de jure) 아직까지 모호한 단계라는 사실을 유럽사법재판소의 판례를 통해서 규명하였다. 둘째, 이러한 법률적 모호성이 어떻게 유럽연합의 사회정책에 반영되어 왔는가를 살펴보기 위하여 로마조약(1957) 이후 암스테르담 조약(1997)에 이르기까지의 약 40년간에 걸친 유럽연합 사회정책의 발전을 의사결정 방식을 중심으로 간략하게 살펴보고 그 한계를 규명하였다. 셋째, 이렇듯 유럽연합의 사회정책이 일정한 한계를 보일 수밖에 없는 이유로서 본 논문은 유럽 회원국간 복지수준의 현격한 차이와 사죄정책 영역에 대해서만큼은 국민국가 위주의 결정방식을 선호하는 유럽시민들의 사회적 여론을 제시하였다. 결론적으로, 경제적 통합이 가장 선구적으로 이루어지고 있다고 평가받는 유럽의 경우도, 초국가적 권위체로서의 유럽연합이 회원국의 정책적 자율성에 도전하지 못하고 있는 이러한 사실을 고려해 볼 때, 지구화된 자본이 개별 국민국가의 정책적 자율성을 침식할 수 있다는 논리에 근거한 '수렴이론'은 아직 보편적인 이론체계로 발전하지 않은 가설수준의 논의임을 알 수 있다.

Japanese Space Policy - Where is she going?

  • Passing 26 years from 1970 when the first satellite was launched into the orbit, Japan developed and successfully launched H-II from Tanegashima Space Center in 1994. During those period, Japanese space policy has experienced a big shake from independent development to technology import from the US, and back again to independent development. In general, the H-II rocket which was manufactured by 100% domestic technology, brings Japan from the old era (experimental stage) to the new era (practical use stage). Fundamental Policy of Japan's Space Activities, which decides such policy as mentioned, was revised in January, 1996 this year after an interval of 7 years. This revised outline confirms the result of Japanese space technology until present and identifies the future direction and framework of her space activities for a period of coming ten years on the basis of a ong-term perspective towards the 21st century. However, when comparing with the last Fundamental Policy in 1989, there seems no big change in it, and a long-term perspective is also not seen there. The description varies on some important points in international space law, like international cooperation, protection of environment, commercial use, etc. In addition, the immaturity as well as the necessity of broader discussion are felt because neither this Fundamental Policy nor The National Defense Program Outline treated any national and international security matters concerning outer space. Considering the present time when Japan enters into the practical use of outer space, such as application, commercial use and launching service, etc, it is doubtful whether new Fundamental Policy was properly planned or not. It seems necessary to use several measures by which the public opinion, opinions from industry and debate on the security are reflected in the policy making.

한국농촌의 다문화사회의 특징 (A Study on the Traits of Multicultural Society of Rural Areas in Korea)

  • The objectives of this study were to study multicultural society of rural areas in Korea. USA immigration law permits permanent settlement but Korea immigration law prohibits permanent settlement. USA adopted the territorial principle but Korea adopted the personal(nationality) principle. So a large number of people immigrated and settled in USA and mass(collective) immigrants is usual in USA. But foreign workers(temporary immigration) and international marriage women(individual immigrants) is usual in Korea. According to the positive law, foreign workers cannot settle down in Korea. So international marriage women immigrants are main cause of multicultural society in rural areas in Korea. This is the particularity of multicultural society in rural areas in Korea. So it is necessary to differentiate multicultural society policy according to areas and residents. Many peoples see multicultural society from a point of view of human rights and welfare. But it is also necessary to see multicultural society from a point of view of economic and policy.

발사국의 개념재고 (The Concept of the 'Launching State' Revisited)

  • Commercialization and privatization of outer space has been developing to the extent that public space law regime established at the UN seems to be somewhat incompatible with the today' s commercial launching services. Thus, this paper analyzes, at first, the UN space treaties to specify the obstacles for promoting commercial use. The necessity of some covert amendment of UN treaties is suggested through the national space legislation. Then three state practices are examined to propose a new concept of the "launching state" including the Sea Launch project, since the concept of the "launching state" is of the major importance to enact an effective national act to better accommodate UN space treaties to the present necessity.

Legislation on Space Security: South Korean and Poland Challenges

  • This article refers to the Space security legislation in South Korea and Poland. Both states have already prepared some legislation on Security in Space- the question is the following- if there is still a need of progress and if those presented legislation are sufficient for the practical purposes of the peaceful uses of Outer Space. South Korea is a much more experienced state in using space than Poland; the same seems with the legislation. Poland as less experienced state in this matter has lots of ambitions to create the efficient legislation on Space security, so it must follow the good examples of states and institution in this matter. One of them is Korea. On the other state, Poland as a Member of EU must implement the European law in space security (in particular SSA), which seems to be priceless and efficient for the international cooperation in Space.

  • The purpose of this research is to conduct an empirical analysis regarding Korea's 'Marine Protected Areas (MPA)' from an international comparative perspective. The authors would like to present the policy direction of marine protected areas based on the result of the research. The result of this study can be summarized in the following manner: First, the total designated size of marine protected areas in Korea is very small compared to the sizes of other OECD nations . Second, while some nations have expanded the extent of marine protected areas in accordance with international agreements and criteria, Korea has not done so. Accordingly, we propose the designated dimensions of marine protected areas should be constantly expanded to keep pace with international trends.

  • 중국의 새로운 해양정책법(Maritime Policy Law: MPL)은 중국해안경비대 등의 중국 해양경찰 기관들의 임무를 규제하고, 중국의 주권, 안보, 권리, 이해관계를 보호한다고 주장한다. [하지만] 중국이 본토 주위 및 남중국해에서 넓은 해역에 대한 권리를 주장하고 있다는 점에서, MPL은 훨씬 광범위하게 적용될 수 있다. 중국이 제기하는 대부분의 해양 주장이 국제법에 부합하지 않는다는 점을 고려하면, 이렇게 해양법 집행 관할권을 광범위하게 적용하는 것은 문제의 소지가 많다. MPL이 분쟁해역 또는 공해에서 외국선적 선박에 대한 관할권을 주장한다면, 이는 국제법 위반이다. 무력 사용에 관한 MPL의 많은 규정 역시, 해양법 집행 관할권의 사용에 관한 국제 규칙 및 기준을 위반한 것이며, 모든 국가의 영토 온전성이나 정치적 독립성에 반하는 위협이나 무력사용을 금하는 유엔헌장에도 위배된다. 중국은 MPL을 남중국해와 동중국해에서 불법적인 영토 및 해양 주장을 제기하기 위한 구실로 사용할 수 있으며, 다른 연안국의 배타적경제수역 내 자원 권리 행사를 방해하기 위한 구실로도 사용할 수 있다.

한국보건사회연구원의 역할 (The Role of Korea Institute for Health and Social Affairs)

  • Korea Institute for Family Planning (KIFP) was established on July 1, 1971 (Law 2270) and Korea Health Development Institute (KHDI) was established on April 19, 1976 (Law 2857). Korea Institute for Population and Health (KIPH) was formed through the merger of KIFP and KHDI (Act 3417) on July 1, 1981. Korea Institute for Health and Social Affairs (KIHASA), the former KIPH, was renamed KIHASA on December 30, 1989 (Law 4181) with its additional function of research in social security. It was transferred on January 29, 1999 to the Office of State Affairs Coordination pursuant to the Law on the Establishment, Operation and Promotion of State-Sponsored Organizations (Law 5733). Annually it conducts approximately 50 short- and long-term research projects to accumulate a wide range of research experience. Also it studies and evaluates the primary issues of national health services, health and medical industries, social insurance, social security, family welfare, and population. it conducts joint research projects and active information exchange programs with related domestic and international organizations through seminars and conferences. It executes specific research and development projects according to the government's requests. it educates and trains people domestically and abroad by disseminating a wide-range of information on health and social affairs. it conducts national household surveys on areas of fertility, health and medical care of the disabled, the elderly, and low-income earners. The mid- and long-term research goals of KIHASA should be established and managed systematically. A new organization such as 'Center for Policy Evaluation' is needed to enhance research abilities and experiences. Able research personnels should be recruited and current researchers should try to develop their abilities.
