부산수산물의 유통개선정책에 관한 연구 (A Study on Policy of Distribution Improvement of Fishery Products in Busan)

  • In 2006, the share of fisheries distribution in Busan amounted to 1.9 million ton, which was 41 percent of the whole country. In details, coastal fishery 334 thousand ton(14% of the whole country), deep sea fishery 452 thousand ton(82%), import fishery 964 thousand ton(70%), export fishery 157 thousand ton(43%) were distributed in Busan region, respectively. According to distribution share, import(50%), deep sea fishery(24%), coastal fishery(18%), export(8%) are main category of fisheries distribution in Busan. After the institutional changes in 1997, that is, from monopoly to the competitive systems are implemented, the share of sales volume through a home trust market decreased gradually since 2000. Especially, the share of direct sales in farming fisheries sector amounted to 73.8 percent of total production volume, 80.7 percent of production value in 2005. Furthermore, the share of fisheries sale through e-commerce is increasing owing to the growth of IT and competitive price of its products. and the sale share of large discount store is also on the 10% more increase. Hereafter these structure changes of fisheries distribution in Busan will be more intensified. Therefore, after reflecting the change in distribution policy of Busan Fisheries, the directions of distribution policy should be established, as follows. $\cdot$ Distribution policy to prepare for increasing of non-trust market sales $\cdot$ Fisheries distribution policy to prepare for increasing of direct transaction like e-commerce $\cdot$ Distribution policy to prepare for increasing of sales ratio in large discount store $\cdot$ Distribution policy for making up sound purchasing circumstance of Fisheries $\cdot$ Distribution policy for reducing the fisheries distribution cost $\cdot$ Distribution policy to prepare for increasing of direct carrying the deep sea fisheries and import fisheries to Seoul and $Inch'{\breve{o}}n$ section $\cdot$ Distribution policy for implementing the information system for managing fisheries transaction $\cdot$ Distribution policy for advancing the export & import management of fisheries $\cdot$ Distribution policy for establishing transaction principle reflecting the peculiarity in fishery distribution(to enacting independent fishery law)

우주(宇宙) 상업활동(商業活動) 규율(規律)에 있어서의 우주법(宇宙法)의 발전적(發展的) 위상(位相) (Developments in Space Law in regulating commercial space activities)

  • This paper examines current developing status of space law as defined in terms of its unique principle that "the utilization of outer space for all mankind's interest". As commercialization of space activities has brought about heated debate on its legitimacy with respect to that principle, space law has come to witness a dual situation. One is the realization of that principle in establishing commercial space activities system where all mankind's interest is respected through the non-discriminatory distribution mode of space benefit. In satellite telecommunication system, the INTELSAT Organization assures its public service policy while protecting itself against a competition from separate systems. For remote sensing, commercialization of LANDSAT Systems promoted since 1984 seems not to affect present non-discriminatory distribution of data and information obtained. On the other hand, active participation of private entity aiming at commercial profit enables national government to manage more effective control and supervision of those activities with a view to promoting national interests. Also, newly developed private rules and regulations are emerging in business relations about commercial space activities. Extended capacity of national government assuring its national interest in production and distribution of international resources that is outer space, and regulation of space activities by newly developed rules and customs provoke a concern about a identity problem of space law. The best way to summarize this perspective might consist in saying that non space law regulations, which are not assumed as aiming at the promotion of all mankind's interest, are confirming their role about space related activities. For those reasous, we are now facing a developing status of space law as developments of commercial space activities continues.

우주 정책에 대한 고찰 및 최근 쟁점 분석 (A Study on the Specific Area of Space Policy and Analysis of Recent Issues)

  • 최근 우주 분야는 국내외적으로 국가 경제 및 안보의 중요한 요소로 자리 잡고 있다. 이러한 우주 분야의 발전을 위해서는 정책이 매우 중요한 역할을 수행해야 한다. 하지만, '우주 정책'에 대한 명확한 설명과 정의가 부족하여, 우주 정책에 참여하고자 하는 많은 연구자들이 어려움을 겪고 있다. 이에 본 논문에서는 '우주 정책'에 대해 정의를 내리고, '우주 정책'을 '우주 연구개발 정책', '우주 경제 정책', '우주 법·제도 정책', '우주 안보 정책', '우주 외교 정책'으로 구분하여 설명한다. 또한 각각의 우주 정책 분야의 중요한 요소가 무엇인지에 대해 분석한다. 복잡해지는 우주 분야와 같이 우주 정책도 다양한 관점에서의 접근이 필요한 시점이다. 본 논문을 통해 우주 정책 및 향후 주요 이슈에 대한 이해를 가질 수 있을 것이다.

중국 해양관련 법령의 발전과 입법체계에서의 지위 및 해석 (Development of Chinese Maritime Related Laws and Status and Interpretation in Legislation System)

  • The most important bases of maritime laws in China are laws enacted by Constitution, a legislative institution of National People's Congress and Legislation of NPC Standing Committee. However, in reality, the institution, which become the basis of Chinese marine policy and leads overall maritime affairs, is a State Council of the Chinese central government and many objects of our researches on Chinese marine policy and laws are composed centering on this administration law. Therefore, in understanding Chinese maritime laws, it becomes an important prerequisite to understand relevant laws (statutes), administration law, statutes of local province, mutual authority relationships of these legislative institutions, and interpretation authority regarding laws (statutes). In May 2003, Chinese State Council ratified and declared ${\ll}$Guideline of the national maritime economic development plan${\gg}$ and this is the first macroinstructive document enacted by the Chinese government for promoting maritime economy in integration development. This plan guideline shows very well a new policy and deployment direction of maritime policy in China. China is already striving to lead its maintenance stage of domestic legislation into a new stage under the UN maritime laws agreement system and this is an expression of intention to take national policy regarding the ocean as a new milestone for the national economy through concurrent developments in various fields such as national territory, economy, science technology, national defense, and maritime biology. In this point, Chinese maritime policy and maritime legislation provide lots of indexes of lessons in many parts. In particular, regarding Korea, which has to solve many issues with China in Yellow Sea, East China Sea, and Balhae, we have to realize that we can maximize national interest only with a systematic approach to research on changes of domestic policies and maritime legislation within China. In addition, in understanding Chinese maritime related laws, we have to realize it is an important task to not only understand legislative subjects for mutual creation of order within the entire frame of law orders of China but also to predict and react to direction of policy of Chinese domestic legislation through dynamics of these subjects.

The New Developments of China's Space Policy

  • China's Space Activities in 2011 (thereafter 2011 White Paper) was published by Information Office of State Council of the Peoples Republic of China on December 29, 2011, and it was the third space white paper after 2000's space white paper and 2006's space white paper. The 2011 White Paper summarizes splendid achievements China had received in space area since 2006, and systematically introduces the principles of China's space activities; at the same time, it also presents the world the policies, measures and key areas of China's space activities in the following five years. This 2011 White Paper is the most detailed, concrete, and integrated elaboration of China's space policy, and it will be the guideline for China to explore outer space with peaceful purpose in the next five years. Compared with 2000's and 2006's White Papers, the 2011 White Paper indicated that Chinese government adjusted space policies under the new circumstance. The 2011 white paper stressed China's position on use of outer space for peaceful purpose and highlighted the new idea of scientific and innovative development in space industry in the next five years.

Target Practising in a Global Commons: The Chinese ASAT Test and Outer Space Law

  • When the People's Republic of China destroyed one of its own defunct meteorological satellites, the Fengyun-1C, at an altitude of some 865 km above the earth's surface, the PRC was accused of initiating, or at the very least risking an(other) arms race in outer space also. The test also gave rise to a few legal questions as to the permissibility of this test, and the broader permissibility of using space for military and other weapon-touting activities, Whilst the test cannot be considered to constitute a direct threat to international peace and security so as to invoke relevant legal principles and consequences in terms of the UN Charter for example, it highlights the importance of such clauses in international space law as requiring international cooperation and consultation, due regard for the interests of all other countries both on earth and in outer space, and the further development of general regimes of registration and space debris-prevention. From that perspective, the PRC violated international outer space law not so much by the test itself but by the accompanying lack of information, consultation and due regard for other states', and indeed mankind's, interests.

호스피스기관 간호사의 호스피스 법제화에 대한 인식 (Nurses' Perception on Hospice Law in Hospice Institutions)

  • Purpose: The purpose of this study was to investigate the nurses' perception on hospice law in hospice institutions using questionnaire and to recommend bill of hospice law. Method: The data were collected from 95 nurses who have experienced in hospice care using a self-completion questionnaire. To analyze prescriptive data, content analysis was done using an analysis scheme developed by the investigators. Results: The separate hospice law suggested was types and purpose of law, certification of patient, living will and right to attorney, staff, institutions, service, and payment. The analysis scheme consisted of 6 categories and 17 subcategories. 83 significant statements were analyzed and categorized. Hospice nurses indicated that their operation, financing, manpower, institution, patient right, drug management is needed to enact for bill. Conclusions: The results of this study on hospice law contents will contribute to build the national hospice system in Korea.
