Assessment of Offshore Wind Resources Within Japan's EEZ Using QuikSCAT Data

  • In this paper, offshore wind resources within the Japan's EEZ (Exclusive Economic Zone) are assessed using wind speed data from the microwave scatterometer SeaWinds onboard QuikSCAT. At first, from the 10m-height wind speed from QuikSCAT, 60 m-height wind speed is estimated by using an empirical equation for height correction. Based on the 60 m-height wind speeds, annual energy Production is calculated under an assumption of installing 2 MW wind turbines every $0.64km^2$. The annual energy production is then accumulated for the entire Japan's territorial waters and EEZ ($4.47{\times}10^6km^2$). As a result, it is shown that the total energy Production is estimated to be $4.86{\times}10^4$ TWh/yr. This offshore wind energy Potential within the EEZ is approximately 50 times higher than the actual annual electricity production in Japan.

An analysis of the fishing characteristics of Korean large purse seine fisheries in Japanese waters (우리나라 대형선망어업의 일본수역 조업특성 분석)

  • The breakdown of the Korea-Japan fishing negotiations since 2016 has made it impossible for many domestic fishing vessels to operate in the Japanese EEZ water, and large purse seine fishing vessels are one of them. Mackerel is a highly migratory fish species, circulating in the East China Sea, South Sea, West Sea and East Coast throughout the year, and goes through a period of wintering, spawning, growth and feeding migration. In this study, in order to find out the dependence of large purse seine fishing vessels on mackerel fishing in the Japanese EEZ waters, we analyzed the characteristics of mackerel by large purse seine fisheries in the Japanese EEZ waters from 2010 to 2016. The catch and fishing details were investigated. The total catch of mackerel by large purse seine fishery, the average catch rate of mackerel in Japanese EEZ is 4 percent per year. The amount is estimated at 10.2 billion won per year. Although there was an effect, it was not judged to be a significant factor, and it was found that the amount of catch and fish price in the domestic waters had a greater influence on the total catch than the Japanese EEZ waters.

Variations in species composition of fishes caught by trawl survey in the northwestern East Sea of Russian EEZ and southwestern East Sea of Korean EEZ (러시아측 동해 북서부 해역과 한국측 동해 남서부 해역 트롤 조사에 어획된 어류의 종조성 및 양적변동)

  • To examine species composition, abundance and biomass of fishes in the northwestern East Sea of Russian EEZ, trawl survey were conducted at 31 sampling stations from 2006 to 2008. Also, trawl survey were conducted at 21 sampling stations in the southwestern East Sea of Korean EEZ from 2006 to 2008. A total of 67 fishes were collected in the northwestern East Sea of Russian EEZ, a total of 39 fishes were collected in the southwestern East Sea of Korean EEZ. Among them, a total of 53 fishes were collected in the northwestern East Sea of Russian EEZ only, and a total of 25 fishes were collected in the southwestern East Sea of Korean EEZ only. Mean abundance per area which caught by trawl survey in the northwestern East Sea ranged from a high of $116,478inds./km^2$ in 2008 to a low of $19,737inds./km^2$ in 2006. And mean abundance per area in the southwestern East Sea ranged from a high of $89,129inds./km^2$ in 2006 to a low of $8,234inds./km^2$ in 2008. Mean biomass per area which caught by trawl survey in the northwestern East Sea ranged from a high of $11,333kg/km^2$ in 2008 to a low of $2,439kg/km^2$ in 2006. And mean biomass per area in the southwestern East Sea ranged from a high of $6,273kg/km^2$ in 2006 to a low of $1,062 kg/km^2$ in 2008. Cluster analysis, based on a Bray-Curtis similarity matrix of fourth root transformed data of number of species and individuals per area, showed division into three different groups by depth in the northwestern and southwestern East Sea.

Some Considerations on the Establisment of the Exclusive Economic Zone in Korea (한국의 배타적 경제수역 설정에 관한 연구)

  • The purpose of this paper is to search for reasonable and fair principles applicable to the delimitation of the Exclusive Economic Zone(which is called the EEZ, hereinafter) around the Korean Peninsula th-rought the comprehensive study of maritime boundary, which is one of the most important issues in the law of the Sea. So far, the sea has been exploited for activities such as fishery, transport and military stratedy, and en-vironmental policy and so on. From this time on, however, it becomes important to us as the major trea-sure-house of various resources which will be developed and used for diversified purposes. For these rea-sons, nowadays, more and more countries of the world are competing to secure waters as much as possible within their jurisdiction. And the regime of the EEZ was created as a result of this international trend. At last, it has been institutionalized as the 200-mile EEZ of a legal notion in the Convention on the Law of the Sea, which was adopted at the Third United Nations Conference on the Law of the Sea, in Jamaica on December 10, 1982. In adapting to this EEZ institution, Korea is faced with several complicated problems as it is bounded on three sides by the sea and all of its neighboring countries such as the PRC, the DPRK, Japan, Russia etc are less than 400 miles away between opposite countries. Therefore, when trying to delimit the boun-dary for the EEZ, it appears necessary to analyze applicable principles and rules of international law for delimitation mainly through the Convention on the Law of the Sea, and studies the trends of actual State practices and recent international precedents. It is hoped that such knowledge will enable Korea to secure sufficient resources and other sovereign rights without conflicting with the neighboring countries concer-ned. For the achievement of the above mentioned object. I analyzed the necessities of the establishment of the EEZ in Korea, the difficulties and practices of Korea's neighbors, and the changes and forthcoming trends in Korea's relations with its neighbors concerned on the basis of the general explanation of the EEZ regime. In conclusion, it is my opinion that for the establishment of the EEZ delimitation which neighbors around the Korean Peninsula should be applied reasonable and equitable principles considering the rele-vant circumstances which characterize the area definitely as well as the UN Convention on the Law of the Sea, 1982.

A Study on the Transition Situation of Korean-Japan Fisheries Agreement and Improvement Issue of Bilateral Fisheries Relations (한일 어업질서의 이행 실태와 어업관계의 개선 과제)

  • This study aims to evaluate the status of implementation of bilateral-fishery order since the Korea-Japan Fisheries Agreement came into effect in 1999 in order to improve fisheries relationships between two countries. The agreement regulates bilateral-fishery order by the principle of the EEZ regime and mutual benefits among countries. (e.g. the mutual agreed fishing in EEZ and cooperation for resource management). However, the Korea-Japan Fisheries Agreement has some limitations such as reducing quotas of the mutual agreed fishing in EEZ, strengthening Japanese fisheries regulation, insufficient cooperation for fisheries management and joint countermeasures. In order to improve fisheries relationships between the two countries, it is imperative to rebalance quotas for the mutual agreed fishing in EEZ, to establish effective resource management systems in the Intermediate zone, to invigorate fisheries cooperation in the private sector, and to introduce new management systems by species over the all waters around East Asia. To accomplish such measures, it is necessary for Korean and Japanese governments to improve fisheries relationships based on trust and cooperation, achieving a win-win situation. Additionally, it is required to incorporate fisheries management among Korea, China, and Japan.

A Consideration of the Decision-Making Efficiency Concerning the Removal of Oil Spills by Foreign Ships in the EEZ (EEZ내 외국 침몰선박 잔존유 제거 의사결정 효율화 방안 고찰)

  • The removal of oil spilled by the sinking of a foreign ship in Korea's Exclusive Economic Zone (EEZ) began in May 2019 four years after the ship sunk near Jeju Island. The cleanup was conducted by a foreign company that was contracted to the ship-owner's protection & indemnity (P&I) insurance company. In contrast to the time taken to begin the cleanup, the operation itself was completed in just 22days. Compared to similar cases, the decision to begin the removal was a delayed one. This study analyzes all 93 documents related to the ship's sinking and the eventual cleanup, confirming delays in administrative decision-making on the removal, and identifies factors that influenced this delay. These factors include a neglect of accident-related data verification, and other, legal, technical, environmental, and human aspects. Finally, this study suggests ways to improve decision-making efficiency. As the first study dealing with the cleanup in the EEZ, this research is expected to facilitate decision-making and influence the formulation of policies in the future.

Legal Issues Relating to Artificial Islands, Installations and Structures in the Exclusive Economic Zone or on the Continental Shelf and Korea's Practice (국제해양법상 인공섬, 시설 및 구조물 제도의 쟁점과 우리나라의 입법태도에 관한 고찰 -배타적 경제수역 및 대륙붕을 중심으로)

  • Artificial islands, installations and structures have been used as a major means for ocean development and management since the early 20th century. The International legal regime to regulate the man-made offshore structures also have evolved and the UN Convention on the Law of the Sea (UNCLOS) acts as a basic international instrument for that purpose. Although the Convention includes more detailed provisions on man-made offshore structures, there are some legal issues regarding jurisdiction of coastal State on the man-made offshore structures in the Exclusive Economic Zone (EEZ) or on the Continental shelf. For this reason, this article begins by reviewing the 1958 Convention on the Continental shelf and the UNCLOS by focusing on the EEZ and the Continental shelf regime governing the man-made offshore structures. It next examines some controversial international legal issues that have emerged from the regulation of man-made offshore structures in the EEZ or on the Continental shelf. This is followed by a review of the Korean domestic laws regulating artificial islands, installations and structures in the EEZ or on the continental shelf. Finally, it closes by summarizing the findings of the above examinations, and suggests some recommendations for future works.

A Study on International Disputes with Korean Distant-Water Sea Fisheries (한국의 원양어업관련 국제분쟁 사례연구)

  • The primary objective of this thesis is to study, case by case, the international disputes for fishing rights between fishing nations and costal states never imagined till the introduction of the UN Convention on the Law of the Sea adopted in 1982 and came into effect in November 16, 1994, which governs the high seas and EEZ in a new manner. Such a study is to provide help in the understanding on this new marine system and how to deal with. This is addressed by the perspectives of disputes (a) in the high seas between fishing nations having traditionally enjoyed the principle of the freedom of the high seas and costal states, (b) in the EEZ between fishing nations and costal states possessing the exclusive jurisdiction over living marine resources and sovereign rights for determining allowable catch and the surplus in its EEZ. The article can be divided into four main parts. First, both the general principles of the settlement of international disputes, and the nature and procedures described in the UNCLOS are introduced. Second, it gives cases of tuna long-liner, North Pacific trawler and squid jigger occurred in the coastal states EEZ, and analyses the problem in both terms of its background and final judgment. It further describes the possible issues in case it depends on the International Tribunal for the Law of the Sea for its settlement. Third, closely tied to above, important points such as the right of hot pursuit, prompt release of vessel and crew, and the limits of cooperation with costal states inspector on board fishing vessels are considered mostly based on the UNCLOS, Bilateral Agreement and UNIA. Finally, the article concludes as follows ; The need for broad analyses on the nature of international suits and legal system for the settlement, to win the case before the International Tribunal for the Law of the Sea or coastal states court, is really acknowledged. However, considering the lack of previous studies about it, it is preferably recommended that governmental efforts for making legal standards to cover the judicial costs, for helping industry out of becoming bankrupt.

  • 최근 각국은 자국의 해양자원을 보존한다는 명분으로 EEZ선포를 서두르고 있다. 한반도 주변과 같이 서로 인접한 수역에서의 EEZ설정은 필연적으로 각국의 이해관계가 상충될 수밖에 없고 따라서 이의 해결을 위해 인접국들은 합의에 의해 공동어로수역을 설정하고 이를 공동을 관할하려 할 것이다. 이 논문은 각국이 공동어로 수역을 설정하여 접속수역에 대해 인접국에게 관할권을 부여할 경우 초래될 수 있는 점을 게임이론과 정치경제적인 접근으로 이러한 문제를 다루었다. 즉, 접속수역에서 인접국은 자원의 채취에 있어서 다국과의 차별적인 규제를 시행하고 타국도 마찬가지의 정책을 구사할 경우 도덕적 위해(moral hazard)에 의해 각국의 접속수역에서의 자원이 가속적으로 고갈될 수 있다는 점을 보이고 있다. 또한 단기적인 전략적 산업정책의 수행은 타국의 희생하에 시장점유율을 확대시키며 그 결과 이윤의 이전을 가져오며 이는 자국 후생의 향상을 가져올 수 있다는 브랜드-스펜서(Brander-Spencer)의 결과는 수산자원과 같은 갱생지원의 경우에는 적용될 수 없다는 점을 보이고 있다.
