  • Japan has enacted the Public Records and Archives Management Law from 2011 in order to prevent mismanagement of records management and to fulfill accountability to the public. However, in 2013, The Designated Secrets Protection Act was enacted before the Public Records and Archives Management Law brought changes to administrative institutions. The Designated Secrets Protection Act have raised concerns that the public's right to know and the transparency of administration are being retreated, especially the development of freedom of information and records management systems. This article analyzed the background of the establishment of Designated Secrets Protection Act and the contents of legal composition. It also identified the possibility of human rights abuse in the aptitude assessment system, the lack of independent monitoring agencies, the impossibility of internal accusations, and the possibility of wide confidentiality designation. Furthermore, analyzed how the problem affects Japanese records management and freedom of information system. Through this, I suggested the improvement of the system of the secret level records management system in Korea, the establishment of the clear purpose of the secret record management, the application of the Tshwane principle, and the establishment of the independent and professional monitoring agency.

  • This research discusses how to improve the current environment for record management in relation to the Revision of the Law of Record Management in South Korea. Three major issues are: 1) Legal status of the National Archives & Records Service of Korea as the government institution in charge of managing centrally records, 2) System for the education and training of professionals who specialize in record management, and 3) Foundation of the national museum and archives of records. Findings are as follows: First, the existing 'National Office of Records' as the government institution in charge of managing records, should be promoted to the 'National Archives & Records Service of Korea' in order to be administered by the class of a vice-minister in the Ministry of Government Administration and Home Affairs. Second, the qualification criteria which currently requires the Master's degree of Record Management, should be modified to include the Bachelor's degree in the field in order to expand the pool of professional human resources. Also, to hire the public officials for record management, either the positions of 'researcher/record manager group' should be created, or the existing positions of librarian, archivist, and record manager should be integrated into the new position of 'record culture group'. Third, the most significant task for the office of record management of local governments is to inherit and further develop the traditional culture and documentary legacy which are unique to those local communities and governments at various levels, and a priority should be given to those tasks. Therefore, when the Law of Record Management will be later revised, the establishment of the office of record management for local governments at every level should be required, and the museum and archives of records should be also established as a significant part of the institution. Unique local culture and history of particular communities should be collected and preserved in systematically specialized and differentiated ways in those institutions of record management, and the names should be uniquely given to the institutions according to the characteristics of local governments.

  • The discussion on local archives management institutions started in the early 2000s and has been steady. In the law, local records management institutions first appeared in 1999, and in 2007, the establishment of local records management institutions by local governments became compulsory. The archival institutions of local government, however, were actually founded in the Gyeongnam Province, 2018, and in the Seoul City, 2019, over 10 years after the revision of the law. And as of 2021, various local governments, including Gyeonggi-do, are conducting research to establish local archives management institutions. This is the time when domestic records management institutions are introduced in earnest. However, it is still unclear how regional archives will operate in practice, particularly how they will accommodate the management of private archives, which has long been regarded as the mission of regional archives. In this thesis, the past discussions on the local record management institutions will be reviewed focusing on private record management. In this regard, it is intended to examine the current state of private records management of local records management institutions through the current status of local records management institutions in operation, and to seek directions for local records management institutions based on this.

  • This paper seeks to know a out the 'University and College Archives', which are to be established under the provision of 'the Law on the Management of the Institutions', and briefly mention the relation with the library, looking into the concept and backgrounds of archives. The enactment of the law became the ground to establish but there is no practical guidelines on the structure, formation, management, and contents of archives, even worse, people do not know well what the archives is. Therefore, I think so know about academic archives should start understanding basic concept, meaning, and necessities of the archives. In Europe, university archives have been established from 1830s, after the other archives had been established. In America, universities, which had been grown owe to the rapid economic development and the increasing of high educated people, began to establish their archives as a way to invest to improve their being and promote continuing growth. This is to prove their being and value in the society by collecting and preserving records and documents produced in the development of universities. Therefore, university archives can be said that it is the receiving agency for the producers of the university records, researching functional purpose, contents of university records, and relation with other institutions or records. This is the very difference from university libraries as collecting agencies. Nevertheless, university libraries and archives can help each other to activate their functions and improve their positions in universities through cooperating for the policy of digital records preserving and approaching them because the tendency of informationization forces universities to stand on various information resources to serve for routine university works. Each institutions of universities needs archival records due to various reasons. It is especially necessary to preserve and manage archival records to prove the confidence of records.

  • This study aims to analyze the features and problems of the Korea's national records archiving system established in 1999, as well as to suggest the countermeasures. First, in Korea, permanent records are archived by the administration, legislature and judicature separately. However, around the world there are very few cases where a national archives controls the records of the administration alone, whereupon there is the need to set up an integrated archiving system regarding the records of the administration, legislature and judicature. Second, in Korea, the records archiving system leans too much towards the centrally-controlled system, which is urgent to be solved. 'Record Management Act' stipulates that all the public records, including nonpermanent ones, shall be managed by National Archives, wherewith National Archives is overburdened. Hereat, it may be desirable for National Archives to manage very important records that deserve to be archived permanently and for Record Center to archive other records, which needs to be made into law.

  • Records Management Act of a country is the basis for understanding its archives management system. Germany is regarded as a country that achieved remarkable development of the system in the process of nationalism and unification based on romanticism in the 19th century. In addition, the federal and local governments enacted and operated their own laws based on the administrative system of the federal structure. Recently, the National Archives of Korea is discussing ways to improve its expertise and the system of operation in conducting national records management. Therefore, it is meaningful to analyze Germany's Records Management Act, which has a management system of long-standing historical records and examine its features. In this study, we analyzed and derived the characteristics of the Federal Records Management Act, which is the standard for the management of Federal Records in Germany.
