Licensing Contract between International Joint Venture Partners and Compensation Structure (국제합작투자에서 합작파트너 간 내부기술계약과 기술대가 지급방식 선택에 관한 연구)

  • Licensing contracts between partners in International Joint Ventures(IJV) have not only aspects of relation contract, which is interdependent and long-term cooperative relationships in interpartner but also aspects of discrete contract which is exposed to opportunistic risk caused by IJV partners who maximize individual profit instead of joint payoff maximization. In this circumstance, appropriate compensation structures such as lump-sum and royalty can reduce conflicts and spur interpartner cooperation. In addition, compensation structures that stipulate each party's rights, duties, and responsibilities under various sets of environmental conditions have strong implications for transaction cost minimization and joint payoff maximization. On the other hands, compensation structures such as lump-sum and royalty in IJV licensing contract have benefits and costs depending on IJV partners uncertainty, partner dependency, and environment uncertainty. Therefore, the purpose of this paper is to empirically show how partner uncertainty, partner dependence and environment uncertainty influence compensation structure chosen by licensor in IJV.

A Study of the Impact of Knowledge Sharing and Utilization on the Characteristics and Joint Performance of the Participants in an International Joint Ventures

  • The study is to investigate the impact of the knowledge sharing and utilization among the participants in international joint ventures on the characteristics and the joint venment performance of the participants. The specific areas of the investigation for significant impacts of knowledge sharing & utilization by international joint ventures are contract compliance, motivation & willingness for business participation, management autonomy, organizational culture and the joint performances, and the characteristics that are unique to the participants in international joint ventures are empirically investigated as well. The findings of the empirical analysis are as follows: knowledge sharing & utilization has positive impacts on the areas of contract compliance, management autonomy, motivation & willingness for business participation and organizational culture, and, in return, the areas of contract compliance, managerial autonomy, and motivation & willingness for business participation appeared to have positive effects on their joint venture performances.

  • The new type of prefabricated joint for 161kV XLPE cable have been developed. we, LG Cable & Machinery Ltd., made an huge contract with an foreign country's Power company for the supply of cable and accessories, the training of jointing and termination work to local personnel, technical assistance by joint venture and the supervision of installation and commissioning. By the end of 1997, one of several routes under the contract successfully finished being constructed and specially tested on site. In operation, now this underground transmission line proves well the reliability and efficiency of prefabricated joint and termination applied first time in foreign country.

Contract Theory Based Cooperative Spectrum Sharing with Joint Power and Bandwidth Optimization

  • In this paper, we proposed a contract theory based cooperative spectrum sharing scheme with joint power and bandwidth optimization under asymmetric information, where the primary user (PU) does not know the secondary users' (SUs) private information. To improve performance, PU needs to provide incentives to stimulate nearby SUs to help forward its signal. By using contract theory, PU and SUs' negotiations are modeled as a labor market. PU and SUs act as the employer and employees, respectively. Specifically, SUs provide labor (i.e. the relay power, which can be used for forwarding PU's signal) in exchange for the reward (i.e. the spectrum access bandwidth which can be used for transmitting their own signals). PU needs to overcome a challenge how to balance the relationship between contributions and incentives for the SUs. We study the optimal contract design which consists of relay power and spectrum access bandwidth allocation. We show that the most efficient SUs will be hired by the PU to attend the cooperative communication. PU can achieve the same maximum utility as in the symmetric information scenario. Simulation results confirm that the utility of PU is significantly enhanced with our proposed cooperative spectrum sharing scheme.

Supply Chain Coordination Under the Cap-and-trade Emissions Regulation (탄소배출권거래제도에서의 공급망 조정 모형)

  • This paper considers a supply chain consisting of a manufacturer under the cap-and-trade emissions regulation and a permit supplier. We study joint production quantity and investment in reducing permit production cost decisions for centralized and decentralized supply chains. We formulate two supply chain contracts with aims to coordinate the decentralized supply chain; wholesale price contract and cost-sharing contract. Under the cost-sharing contract, the manufacturer shares a part of the investment in reducing permit production cost and then is allowed to purchase emission permit at a lower price. We analytically find that the proposed cost-sharing contract with reasonable parameters can coordinate the supply chain whereas the wholesale price contract is not desirable to achieve the system-wide profit. Numerical example is followed to support the analysis.

  • Most of the construction works in domestic are not direct undertaking work, but by a contract method including subcontracting. Therefore, a general contractor for each project jointly carry out construction work with a specialty contractor for each engineering type. However, in terms of contract, this method is not a joint venture contract, but a subcontract. Accordingly, this system can cause various problems between the prime contractor and the subcontractor. Therefore, this study aims to extract and present the actual obstacle factors in terms of specialty contract company performing specialty construction work for construction project. The presented contents are expected to present the standard for the cooperation system that the prime contractor and the subcontractor can win-win.

A Study on the Optimal Concession Contract Decision Model between Port Authority and Terminal Operators (항만공사와 터미널운영사간 최적임대계약 결정에 관한 모형)

  • The competition between port authorities (PAs) and terminal operating companies (TOCs) in providing port logistics services has gained importance. The PAs enter into leasing contracts with TOCs in various ways. This study aims to model a contract method that maximizes the joint profit between a PA and a TOC. Particularly, this study aims to model the equilibrium by comparing four types of contract schemes in the non-coordination, cooperation, Cournot, and collusion models. The results of the analysis show that the two-part tariff scheme generates a higher joint profit than the fixed and fee contracts. It is understood that risk- and profit-sharing between the PAs and TOCs helps the latter to maximize the throughput and the joint profit. These results are expected to provide an important theoretical basis for decision-making about port rent and freight between the PAs and TOCs.

  • Purpose: Since the implementation of the Chemical Substance Management Act, data on the number of occurrences by annual chemical accident in Korea and the contractor's contract data received from the competent authority were used. After the implementation of the contract reporting system, the contribution to the reduction of chemical accidents is summarized by statistical data. The characteristics of each region, month, type and those of similar industries and human life were compared and analyzed. Method: 4 years of chemical accident statistics from 2015 to 2018 and since 2003, we have used data from the Chemical Safety Clearing-House (CSC), which provides safety information on cases of chemical accidents. Results and Conclusion: The risk of accidents increases as a number of unskilled workers are put into the workplace during the period when the hazardous chemical handling process is temporarily suspended. Through the reporting for awarding a contract, the operators are strengthening the safety management of chemical accidents by educating unskilled workers and wearing personal protective equipment.

  • Purpose : To describes the important aspects of the foot and ankle movement and function used when git and balance strategy. Method : The foot and ankle was a very important roles in the lower limb movement and gait. This study summarizes the physiologic movement of knee to the PNF lower extremity patterns. Result : The ankle joint composed of the talocural joint, the subtalarl joint, transverse tarsal joint, talocalcaneonavicular joint. The onset of dorsiflexion muscle activity starts in pre swing gait patterns. First contract muscle is the extensor hallucis. Activity of tibialis anterior and extensor digitorum longus quickly follows in mid swing gait phase. During stance phase, the soleus and gastrocnemius muscle provided plantar flexor torque, which muscle reacts quickly to restrain ankle dorsiflexion, and contributes modulated control of the ankle motion in gait patterns. Conclusions : The understanding of ankle kinematics, could provide a good therapeutic approach for improving gait patterns in patients with various pathological condition.

  • In this study, we wanted to investigate and analyze the current status of international joint research conducted on researchers who have actually conducted or are doing international joint research and to identify difficulties in promoting international joint research based on this study and propose ways to promote future international joint research. As a result, autonomy of research subjects needs to be guaranteed for the revitalization of international joint research, establishment of international joint research guidelines and contract legal infrastructure, simplification and unification of administrative work system and supplementation of performance-related regulations will be necessary.
