Case analysis of trade dispute between Korea and India (한.인도간의 통상분쟁 현황과 사례 분석 -인도의 반덤핑 관세정책을 중심으로-)

  • As traditional import regulations have decreased all over the world in recent decades, the usage of "unconventional" trade protection measures has grown in the developing countries. In particular, antidumping investigations have risen rapidly and have growing in India and China. Therefore, this thesis aims to provide countermeasures to our government and Korean exporting companies by studying characteristics of antidumping. India is one of the most frequent initiators of antidumping cases by protecting their industries and impeding imports from FTA. This year, economic exchanges of Korea and India will be increasing by the conclusion of CEPA. This will lead to the increase of dispute by import regulations. Under such circumstances, to decrease Indian antidumping cases Korea will respond as follows. i)If antidumping laws, system and practice of India have injustice or are different from WTO rules, our government will have to indicate injustice and actively urge Indian government to make corrections. For example, they are continuous bilateral contact about the problems, fallacy of calculation of dumping margin, and intense investigations into cause and effect relationship and losses in dumping market, ect. ii)Our government should give more support to the small and medium exporting company which have difficulties in dealing with trade conflicts, counseling, arbitrating a lawyer. iii)Our government which is in control of domestic trade relief system should strengthen its investigation ability about new regulations and moniter import regulations of India. Over the long time, Korean companies need to export competitive advantage items of a higher value-added business and build solidarity by technology transfer. Accordingly, that will result in the decrease of trade dispute in India.

  • For moving cargo between the North Pacific region and Northern European ports, the Northern Sea Route, along Russia's coastline, is 35-60% shorter than the traditionally used routes through the Suez or Panama Canals. in addition to its shorter distance, there exist extensive ports und shipping infrastructure, and the potential for developing new markets in Russia and other northern countries including Korea and Japan. These incentives attracted considerable attention from the international shipping and shipbuilding industries and have formed a cooperative international research program, called as the International Northern Sea Route Programme (INSROP) This paper is a general compilation of the historical usage, recent trade developments, the physical environment, and the practical considerations that may shape future operational mode of shipping in the NSR based on results from INSROP reports. This study focuses mainly on an operation of commercial icebreaking cargo vessels that may be utilized along the NSR.

  • The aim of this study is as follows. The first, What are the most important factors Affecting Global Single Window Usage and its Performance in Korean Trade Related Companies? The factors proposed for this study includes The pressure of trading companies in other country, Support of government, top management support, partnership among (makers distributors, retailers, customs service), education and training We gathered detailed data on our sample companies mainly from publicly available sources : Korea Customs Service. A structured questionnaire was used to collect information about: (1) general fact about the company (size, lines of business, products and services provided, employee, and some financial data about exporting), (2) To investigate the factors of the five contexts described above on korean export-import companies's global single window. The result are as follows. The analysis result revealed that the pressure of trading companies, support of government are influential variables on the affecting global single window in korean trade related companies.

Review of Rice: Production, Trade, Consumption, and Future Demand in Korea and Worldwide

  • Being a staple food for more than half of the population of the world and South Korea, rice is an important crop. For the past 20 years, global paddy rice cultivation area and production have shown an annual growth of 0.46% and 1.61%, respectively. Global rice consumption for food and processing has increased by 1.37% and 3.68%, respectively. Due to the main reason for such increasing human population, it is expected that from 439 million tons in 2010, additional 116 million tons will be needed in 2035. Global rice imports and exports have doubled in the last 20 years. However, in spite of such increment, global rice exports in 2013 were 8.4% of the total production. It is thought that rice protection policies in the producing countries are the main reason for such small scale of rice trading. In the past 5 years, India recorded the largest growth rate in rice exports (51.4%), whereas China showed the largest growth rate in imports (61.0%). For global utilization of milled rice during the same period, approximately 79.4% was used as food, 7.2% as animal feeds, and 1.4% for processing. Regionally, Asia has shown a similar pattern to the global rice usage, whereas utilization for processing in America, for food in Africa, and for animal feed in Europe was relatively higher than the global rice usage. Korea's cultivation area and production since the last 5 years, are 0.5% and 0.8% of those of the world, respectively. Its annual rice export is approximately 3,000 tons, which is 0.01% of the global rice export. Korea's rice utilization is high for food and low for feed and for processing relative to global rice utilization. Therefore, a review must be conducted to increase Korea's utilization of rice for processing and for feed production.

Factors Influencing the Reuse of Mobile Payment Services in Retail

  • Purpose: This study tests the suitability of a new technology acceptance model for a mobile payment system by checking how statistically significant the change is from the UTAUT (Unified Theory of Acceptance and Use of Technology) and UTAUT 2 models. Research, Data, and Methodology: We surveyed 250 students at Incheon University who are using the mobile payment system. The analysis was conducted on 243 valid questionnaires. The survey was conducted for one month in October 2018. The collected data were analyzed using SPSS and hierarchical regression analysis was applied. Results: Using hierarchical regression analysis, this study confirmed whether the newly added hedonic motivation, switching cost, and perceived risk variables in the UTAUT2 model are good explanatory variables. Mobile payment usage experience was found to have a moderating effect on mobile payment reuse intention. According to the analysis, the UTAUT2 model brought about more influential change than the variables of the UTAUT model. Conclusions: This study found that consumers' psychological factors added in the UTAUT2 model greatly influenced the reuse intention for mobile payment. As an implication of this study, mobile payment providers need to develop strategies that could meet hedonic motivation, switching cost and perceived risk for their customers.

  • The purpose of this study is to suggest logical foundation and points which are necessary for establishing E-commerce cf Korean shipping companies' development strategy and activation plan. In order to do empirical analysis, two step analyses are adopted. Firstly, this study examines the effects of the shipping company character and the shipping environment character on the usage of E-commerce in the shipping companies. Secondly, this study examines the effects of usage of E-commerce on the performance in shipping companies. In the empirical analysis, research hypotheses are being tested mainly by a structural equation model(SEM).

  • As in more than half of the litigated cases, non-conformity of the goods is alleged by the buyer and, hence, the question aries of whether the buyer has given notice within a reasonable time and is thus allowed to rely on the lack of conformity at all, differences in interpreting the meaning of "reasonable time" in Article 39(1) CISG endanger uniformity of international sales law in a core area. This uniform interpretation of the "reasonable time" in Article 39(1) CISG can, however, not be achieved by merely making recommendations to courts and arbitral tribunals that case law from other CISG jurisdictions should be considered. This can at best lead to confusing results. As you know, the determining of reasonable time is depending on the circumstances concerned with the particular case. So the term 'reasonable time' has proven too imprecise due to its flexibility without defined uniform scale to assist the practitioners in a uniform application of Art. 39(1). Therefore I suggested the factors that influenced the determining of the reasonable time. The factors currently influencing whether an Art. 39(1) notice is given within reasonable time in international practice are: any international trade usage and practices, the nature of the remedy chosen by buyer, the nature of the goods delivered and the mode of dealing with the goods.

  • 최근의 통상환경중 "Logistics" 혁명을 통한 컨테이너 운송의 신속화, 인터넷혁명을 통한 전자상거래 활성화는 EDI, EC등을 통해 "Paperless trade"가 실현을 앞당기고 있다. 본 논고는 이러한 물류혁명과 인터넷 정보기술의 발달로 대두되는 문제중 기존의 종이서류로서의 운송서류를 전자식 운송서류로 대체하는데 따른 문제점과 이의 활성화 방안에 대해서 살펴보고자 한다. 인터넷 전자거래가 활성화되어지면 기존의 종이서류들은 전자메시지로 대체될 것으로 여겨진다. 이에 따라 전자계약서, 전자송장, 전자보험증권, 전자선하증권 등이 출현할 것이지만 이중 무엇보다도 전자식 운송서류중 유통성 운송서류의 전자화는 그간 전자화의 핵심부문으로 여겨서 상당한 중요성을 두어왔다. 현재 이용되는 유통성 운송서류는 그간 선하증권의 지연도착문제와 이에 따른 추가 경비의 소요, 또한 선하증권 발급에 따른 부대경비의 과다소비, 종이서류로서의 선하증권의 위조에 따른 사기문제 등에 제기되어 졌고 이에 따라 선취화물보상장 등의 현실적 대안이 제시되었지만 이 또한 여러 문제점을 야기시켜왔다. 전자식 운송서류는 이러한 문제점을 다소 해소할 수 있는 방안으로 알려져 왔다. 전자거래가 활성활 될 미래에는 운송서류의 전자화는 필연적으로 대두되게 될 것이고, 이러한 전자화에 있어 해상운송장의 사용은 바람직한 모델로 여겨지고 있다. 그렇지만 전매가 잦은 산업에 있어 해상운송장은 자체의 유통성의 미비로 인해 그 사용에 문제점이 있고, 실제 상관행에서 많은 이점을 가진 선하증권의 발행 욕구를 충족시켜 줄 수 있어야 할 것이다. 본 논고에서는 전자식 운송서류의 활성화 방안으로 첫째, 전자식 운송서류에 관한 법률정비가 필요할 것으로 여겨지며 둘째, 유통성 전자식 운송서류에 있어 관리기관의 안정성이 확보되어야 할 것으로 여겨지며 셋째, UCP에서 전자식 운송서류에 관한 조항이 삽입되어져야 할것으로 여겨지며 넷째, 여러 측면에서 우위성을 지닌 전자무역거래의 활성화는 점차적으로 운송서류의 전자화를 활성화시키는데 반드시 필요한 명제로 등장할 것으로 여겨진다.

The Impacts of the Service Quality of the Trade Promotion Agency on the Performance of Seoul Metropolitan and Local Exporting Firms (무역지원기관 서비스품질이 수도권 및 지역 수출기업의 수출성과에 미치는 영향)

  • We investigate the structural relationships between quality of service from Trade Promotion Agency(TPA), environmental uncertainty, and firms' uses of the service, export market orientation and export performance, using data from Korean export firms, Seoul Metropolitan export firms and local export firms. In particular, this article attempts to analyze how firms' uses of service from TPA may be influenced by their export market orientation, environmental uncertainty, and the service quality. The results from the study show that in Seoul Metropolitan export firms, TPA's service quality, environmental uncertainty, and their export market orientation have positive effects on their uses of service from TPA, which leads to increase in their export performance. The study also finds a solid evidence that, in Seoul Metropolitan export firms, environmental uncertainty has a positive effect on their export market orientation, which enhances their export performance. The study, however, finds that in local export firms, environmental uncertainty and export market orientation do not significantly affect their uses of service from TPA and export performance, respectively.
