Identification and Analysis of the Legal Status of International Maritime Organization Instruments

  • Identifying which international maritime legal instruments are mandatory or recommendatory is complicated task even for maritime regulatory bodies. Although International Maritime Organization (IMO) had tried to ease the complexity by adopting guidelines on uniform wordings for making reference to other instruments in IMO parent conventions, there has still been some confusion identifying the mandatory status of IMO instruments. The aim of this study was to map out a step-based guideline to resolve the complexity of the mandatory status of IMO instruments to the maximum extent possible. This study reviewed the history of IMO rule-making process to find the root cause of the problem, then analyzed the approaches of regulatory enforcement bodies to check the practices. In conclusion, readers are directed to find such information as to legal status of IMO instruments and an improvement is proposed to enhance the transparency of information sharing for maritime industry to make better informed decisions.

BUILDING A CONCEPTUAL MODEL OF EFFECTIVE LEARNING IN INTERNATIONAL CONSTRUCTION JOINT VENTURES

  • Learning has become an important aspect for any organization to stay relevant and competitive in the corporate world of survival. In construction industry, the international construction joint ventures (ICJVs) provide an excellent platform with opportunity of learning among partners seeking to develop new area of competency and improve their overall competitiveness for their next project endeavor. This paper discusses the development of a conceptual model of effective learning in ICJVs using four major stages of development in a typical joint venture (JV) 's process. The study identified that there are three key constructs that contribute to effective learning comprising learning conditions in the JV's pre-inception stage, success factors of JV for learning in the forming & organizing stage, and learning actions in the implementation & adjustment stage. The effective learning outcomes are measured by the characteristics of learning organization during the JV's completion & evaluation stage. Details and issues of each stage and the methodology of research will be presented and discussed.

  • Recently, Korea has been established and operated International Schools manifesting to improve the nation's capacity of the foreign languages skill and to cultivate internationally trained professional manpower. In order to achieve the vision of a world-class educational organization, it has to be designed for the facility standards to meet the international accreditation standards. Therefore, the main purpose of this study is to research about basic resources through comparison of facility conditions between public schools in Korea and international accredited schools. By comparing those two different plan drawings are found the following things. First, Schools which established with International Accreditation Standard are prepared detailed criteria for the facility, Furthermore information about the furnishings included, in addition to specific equipments for classes are stated to be prepared. Secondly, it is more effective when special classrooms such as music and science are equipped with various spatial elements, enough educational equipment storage, teacher's study rooms, practical training rooms and student's activity rooms to support various teaching programs and learning efficiently. Lastly, there was a clear tendency that not only hardware but also software standards for the audiovisual room and library have been more enhanced to enable multidisciplinary educational approaches with the recent education training trend.

  • In Ubiquitous Information society, real shape of spatial information and accurate position information are required. Spatial information standardization is needed to service for the people. International standard was defined to ensure compatibilities of various standards, technologies, and terminologies and to promote mutual trade certain criteria and standard forms were established through international agreement. International standard is made by International Organization for Standardization, and International Standard Organization Technical Committee 211 manages the geographic information field. ISO TC 211 is working on LADM (Land Administration Domain Model) which defines administration law and spatial surveying component related to land and efficiently manages data and land systems of the countries. This study introduced processing of standardization of a surveying package which is related with LADM and comparing it with Korea Cadastral information system.

  • Domestic hotel businesses are confronted with new market circumstances. Clear accounting and moral management in company which have been reserved or ignored during the past high economic growth period were emphasized. As global standard such as international standard of accounting system, clear accounting, international standard management, and flexibility of employment are emphasized, which is different management is now accomplishing. During these system changes, organization member's identity was threatened a lot. So organization members were required to adopt new environment. Hotel have influence on organizational accomplishment, thought and behavioral response of organization members according to cultural type and share of organization culture. This study are focused culinary team culture as subculture in hotel. What kind of culture more effective to the culinary group\ulcorner What kind of culture are grouped each hotel, include difference imported brand hotel and domestic brand hotel.

  • The revised ISO9000 family of standards represents a significant improvement on the 1994 version and, if implemented well within organizations, should facilitate the development of effective, process-oriented Quality Management Systems. This paper describes how the International Standardized Testing Organization (ISTO) tests the understanding of ISO9000 : 2000, and presents an analysis of the results of the first examinations held in the UK, USA, Mexico and Hong Kong, in February and March 2001.

  • As the international trade has been increased, unified worldwide standards are getting more important and necessary. At the TBT(Agreement on Technical Barrier to Trade) of WTO(World Trade Organization) and the CTI meeting of APEC(Asia-Pacific Economic Cooperation), they made an agreement with applying International Standards to National Standards gradually. In addition, ISO (International Organization for Standardization) established the ISO/IEC Guide 21, a guideline for applying International Standards to National Standards. In these environment, Korean Industrial Standards has to be prepared for it. This paper introduce the comparison between Korean Industrial Standards and ISO Standards about the standards of sampling and testing the fresh concrete, based on ISO/IEC Guide 21 by ISO and the Applying guideline by Korean Agency for Technology and Standards, and then discuss the problem about applying them. The overall objective is to establish the applying guideline on construction fields, which is civil and building engineering part(KS F) of Korean Industrial Standards.

Review on the Legal Status and Personality of International Organization Hosted in Korea - In Case of AFoCO Secretariat - (글로벌시대 국내유치 국제기구의 법인격 - 한·아시아산림협력기구(AFoCO) 사무국의 사례를 중심으로 -)

  • In 2012, the Korean government has hosted the AFoCO Secretariat in Seoul. The AFoCO Secretariat is established by Agreement between the Governments of the Member States of the Association of Southeast Asian Nations and the Republic of Korea on Forest Cooperation (AFoCO Agreement) which is initiated by the Korea. The Korea government, however, does not have any laws and regulations to regulate the matter of legal status and legal personality of nationally hosted international organizations including the AFoCO Secretariat. Therefore, the legal status and legal personality of AFoCO Secretariat in international and domestic arena are still not clear. To articulate such issues and to propose some answers, this article analyzes the international and domestic legal theory and practice about the status and legal personality of public international organizations. As a result, it is common in the literature to delimit international organizations by some standards. One characteristic is that international organizations are usually created between states. A second characteristic is that they are established by means of a treaty. And as a third characteristic, international organizations must possess at least one organ which has a will distinct from the will of its members. According to those criteria, the AFoCO Secretariat can be categorized as a public international organization. It means that the AFoCO enjoys certain privileges and immunities as a public international organization and must confer legal capacity in Korea even there is no domestic laws and regulations conferred the status and legal personality to it. It, however, will be a better way to confer domestic legal personality on the AFoCO Secretariat through a domestic act like an "Act on the Assistance of International Organization Attraction". This act will stipulate the legal status of international organization in Korea including the privileges and immunities as well as the matter of assistance of hosting international organizations.

The Effects of Professors' Transformational Leadership on the Improvement of Chinese Students' University Satisfaction: The Mediating Effects of University Identification

  • The Leaders in organization play various core roles in workers' performance and organizational performance. A leader presents a vision and a direction to enable members to achieve higher performance. Especially, transformational leadership suggests members a strong vision and influences them to have identification with the organization. Based on previous researches, transformational leadership is a close connection to identification with job and organization satisfaction. This study explains the influence of the university professors' transformational leadership on students' university satisfaction and university identification. In this study, the subjects of statistical analysis are Chinese international students studying in Korea. As a result, first, professors' transformational leadership enhanced the level of students' university satisfaction. Second, university identification had a partial mediating influence on the relationship between professors' transformational leadership and students' university satisfaction. Professors' transformational leadership had an influence on the students' identification with their universities. Through this process, students become aware of identification and more satisfied with their universities. As a result of the transformational leadership of the professor, the identification and satisfaction of the international students will be improved and they will be better able to adapt to their study life and achieve high results. The purpose of this study is to emphasize the roles of transformational leadership as a necessary leadership for the successful study abroad life of Chinese students studying in Korea today.

The Study on the Determinants of Export Performance in terms of Integrated Approach - the Case of Exporting Firms in Gwangju - (수출기업의 통합적 성과결정요인에 대한 연구 - 광주 소재 수출기업을 중심으로 -)

  • The main objective of this study is to examine the mediating effect of 'international entrepreneurship' on the relationship between the determinants related to export and export performance. Data was collected from a survey of 200 exporting firms in Gwangju, Korea. The results of the study are as follows ; First, 'international entrepreneurship' are produced a mediating effect when the determinants affect export performance. Second, Resource-based factors and Industry organization factors have a positive impacts on export performance. However, relationship factor as a determinant does not have statistically significant correlation to export performance. Accordingly, in orer to enhance export performance, exporting firms in Korea should try more to prepare for resource-based factors and industry organization factors as determinants. In addition to these, if CEOs of exporting firms are equipped with international entrepreneurship spirits, they can increase the performance of their exporting firms. So they have to manage their exporting firms very strategically so that they can make their firms' export performance better and better.
