The North Korean Nuclear problem and disarmament of Outer Space (북한 핵문제와 우주군축)

  • Nuclear issue is a good example showing globalization of the international regime. The history showed nuclear weapons may cause the extinction of human races when the first nuclear bombs fell down to Japan in August, 1945 and people became increasingly eager to achieve peace. Military buildup for national security is a matter of existence in the international society. However, disarmament or arms control to secure international peace and safety which is also the purpose of the Charter of the United Nations may be the most important task for us to realize peace of the mankind. Today, disarmament, together with amicable settlement of international conflicts and collective security system, is an important means to maintain and promote international peace and safety. It might be our permanent task to realize complete disarmament but, as the Preamble of the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) expressed general and complete disarmament, the international society has clarified its effort for complete disarmament. Thus, taking a look into the international regime on the nuclear issue and progress related to the nuclear issue in North Korea, the study was intended to introduce the globalization of the nuclear issue, review the international effort for nuclear disarmament based on the concept of the 'common heritage of the mankind' and with respect to the United Nations Committee on the Peaceful Uses of Outer Space (COPUOS) and controls over nuclear weapons, and then evaluate the North Korean nuclear issue, which is in direct relation with South Korea and international laws, in terms of the space law and disarmament acts. The collective security system along with policies to prevent dissemination of nuclear weapons should also be emphasized and implemented to cope with the North Korean nuclear issue.

Safety Analysis on Pedestrian Crossings in Urban Corridors with Bus Rapid Transit System (중앙버스전용차로 횡단보도의 보행 안전도 평가)

  • Seoul metropolitan government has introduced Bus Rapid Transit (BRT) systems in some major urban corridors on July 1st, 2004, and has reported that it was successful on the ground that bus speed has been increased in the corridors with BRT system and that it has also resulted in the increase of bus patrons. However, there comes a negative claim that BRT has increased the number of fatalities in the same corridors. This study first aims at developing safety evaluation indicators of pedestrian crossings, then compares values of those indicators from pedestrian crossings with and without BRT systems. The safety evaluation indicators of pedestrian crossing are developed as: the number (or ratio) of conflicts between pedestrians and vehicles, the number (or ratio) of vehicles violating pedestrian signals, the number (or ratio) of pedestrians remaining crossings at red signals, and the number (ratio) of pedestrians walking beyond crossing areas. When we compare values of these indicators for both pedestrian crossings with and without BRT system, it has turned out that crossings with BRT systems has more number of conflicts than the crossings without BRT systems, but it cannot be said that the ratio of conflicts will be different between two crossing types. It means that the number of conflict will increase as the number of pedestrians and vehicles in the crossings. When we note that BRT system intrinsically attract more number of pedestrians who get-in or get-off bus stops, we cannot said that BRT system will be safer for pedestrians.

Holistic Hierarchical Approach to Integrated Water Resources Management in the Tumen International River (두만강 국제하천 통합수자원 관리를 위한 포괄적·단계별 접근방안)

  • The Tumen River basin is relatively small(${\approx}33,000km^2$), it has many potential conflicts between the riparian countries. Especially, until recently, it could have not drawn the socio-potitical attention from its central governments because of the geopolitical unique characteristics as edges of mainlands. since 1990's the various plans have been suggested for resolving the problems in this area as an international attention from, e.g UNDP, began to be given. However, the international cooperative structure has not been established in systematic way which has paramount importance. In the research, based on the problems identified in the previous paper, the necessities for independent unit, so called 'Tumen River Watershed Management Commission' were suggested for holistic and hierarchical resolution in accordance with integrated management and international river based on 'limited territory sovereignty' which is a general principle in international river management. For this purposes, hierarchical problem solving approach which consists of 3 phases were developed. They include major objectives and behavioral guidelines for achieving equity between riparian countries based on international cooperation and integrated watershed management as fundamental concept. In conclusion, rational plan for future water use, management and primary framework of Tumen River for international cooperation were composed and strategic approach for the North-East Asian community foundation was suggested.

Consumers' Perception on Legal Liability of the Online Reviews (온라인 사용후기에 대한 법적책임의식에 관한)

  • As hostile online reviews can have a negative impact on a company's reputation, it is not surprising that online reviewers and business owners often get involved in conflicts which sometimes evolve into legal disputes. This research examines the legal dispute case in which the business owner charges an online reviewer for a defamation. Further, this research compares the supreme court's decision with general public's view on this defamation case, using a survey method. From the legal point of view, an online reviewer's primary motive determines whether the online reviews are defamatory statements or not. Specifically, if an online reviewer's primary motive is to increase the overall benefits for the public society, the online review does not bear any legal liability. According to our survey, consumers' view aligns with the final decision of the supreme court. They believe that online reviews should bear a minimum level of legal liability as online reviews often contain useful and valuable information which can enhance overall public benefits.

Reorganization of the International Fisheries Regime in the East Sea - Case by Korea and Japan Squid Angling Fisheries - (동해에 있어서 한국과 일본 오징어채낚기어업의 재편방향)

  • This study intends to review the development of Squid Angling Fisheries of Korea and Japan and subsequent changes in the fisheries regime as well as management conditions and to examine reorganization directions. Although catches and productivity are all increasing in Korea and Japan as the squid resource in the East Sea is improving, the number of fishing vessels and the conditions of fisheries management are showing a symmetrical relationship. The former is increasing in Korea and decreasing in Japan while the latter is aggravating in Korea and rather stable in Japan. And while the competition between the two countries for more fishing grounds and catches are not that serious since the resource is relatively increasing, the catch and price competition with other domestic fisheries is a more significant problem. Furthermore, even though light restriction is implemented in both countries in order to suppress over-competition, it is adopted as a means to curtail management costs and block over-investment rather than to adjust international or inter-fisheries circumstances. Japan has been implementing the TAC system on squid resources since 1998. However, it has a different meaning than as a resource management method in its original sense because it is based on the highest catch level of the past and takes into consideration the fishermen's management conditions. In case of Korea, it is necessary to establish a plan to strengthen its fisheries management competence to address its shrinking catch in the Japanese waters. The developments mentioned so far have appeared amidst the increase of squid resources, and if such conditions disappear, problems such as international allocation of catches and fishing seasons, access to fishing grounds, and domestic conflicts among different fisheries will emerge.

An Empirical Study on Trade Claim Management from a Relational Perspective

  • Purpose - This study is designed to provide new insights on trade claim management by typifying trade claims from a relational perspective, which defines trade as an organic combination that exchanges relationships based on a mutual goal instead of conflicts between obligations and rights of the contracting parties. Design/methodology - This is a phenomenological study that aims to typify trade claims based on a relational perspective and extract implications for trade claim management. The research procedures of this study are as follows. First, international commercial dispute cases applying the CISG are collected. Second, the cases collected are quantified through content analysis. The variables for quantification are developed based on a relationship perspective. Third, cluster analysis is conducted on coded data to typify cases. And finally, this study compares the characteristics of each type using analysis of variance and suggests implications for the strategic management of trade claims from a relational perspective. Findings - Results show that trade claims are divided into four clusters, depending on whether flexibility is accepted or not and which party violates mutuality. There is also a difference between the claimant and the cause of the claim, according to the cluster. Based on the results, this study suggests that the buyer and the seller should employ different strategies depending on the type of trade claim and presents proposals for strategic claim management. Originality/value - Firstly, this study extends the theoretical discussion on trade claims by applying relational contract theory. Prior studies on trade claims have been primarily based on traditional contract theory. The second is to analyze trade claims quantitatively. Prior case studies on trade claims have mainly relied on qualitative research. Finally, the study contributes to international commercial practice by typifying trade claims and presenting options for strategic management.

Digital Marketing in the Condition of Wartime Posture in Ukraine

  • Strengthening global geopolitical instability in the world leads to an aggravation of international conflicts; it destabilizes the domestic political situation in countries, violates the rights and freedoms of man and citizen, and also activates economic crime. The full-scale invasion of the Russian Federation on the territory of Ukraine and the deployment of military operations in a large territory of a sovereign country have created a number of destabilizing factors in the development of digital technologies and negatively affect the state and trends of digital marketing, which allows establishing interaction with a wide audience and facilitating the search for new customers in various places. The purpose of the research lies in substantiating the theoretical and applied principles for studying the features of digital marketing in the conditions of wartime posture in Ukraine. In the course of the research, general and special methods of economic analysis have been used and applied, namely: analysis and synthesis; analogies and comparisons; generalization and systematization; graphic and tabular methods. Regarding the results of the research of digital marketing in the conditions of wartime posture in Ukraine, it has been established that the intensification of the development of digital marketing is caused by the crisis phenomena of social-economic, social-political and military nature, as well as exacerbated by the challenges of the COVID-19 pandemic. It has been proven that highly developed countries use innovative digital technologies more effectively in the field of marketing, which indicates the importance of the Multidimensional Index of Digitization (the USA - MID: 0,92-0,92; the UK - MID: 0,80-0,97; Japan - MID: 0,80-0,88; Canada - MID: 0,78-0,81; Germany - MID: 0,78-0,88; France - MID: 0,72-0,76), however, the developing countries record much lower values (Ukraine - MID: 0,22-0,48). Accordingly, the level of cybersecurity in highly developed countries is also significantly higher than in transitive countries, in particular, in the United States (GCI: 0,919-0,999); Great Britain (GCI: 0,783-0,995); Canada (GCI: 0,818-0,978) and in Ukraine (GCI: 0,501-0,661).

  • Since the Soviet Union collapsed, Russia has been aggressively seeking a role and place in the U.S.-led international order. Russia conditionally cooperated with the U.S. global policy, efforts to protect and expand the national interests in Post-soviet region. In this context, Post-soviet space is the arena of the struggle among the world powers. Especially in Ukraine as the Axis power of Post-soviet space, hegemony conflicts so called 'New Cold War' between Russia and western powers including U.S. have appeared. This paper examines what are Russian military security strategy and policy, how these come to fruition in Ukraine, what are important factors of complications and its aspect.

A Study on the Formation and Development of Collective Security System and the Possibility of Security System Shift in East Asia (집단안보체제의 형성 및 발전요인과 동아시아 안보체제의 변화 가능성 연구)

  • For the last 70 years, the U.S.-led bilateral security system, or "Hub-and-Spokes" system, has been applied to Northeast Asia, and the system has been successfully settled in terms of stability and economic achievements of the region. Given the increasing complexity of the security environment of East Asia, it is plausible to consider the possibility of a security system shift from bilateral alliances to collective security. In order to analyze the driver of collective security system, this study developed three factors of formation and development of collective security system - main threat, intensity of the threat, and confidence among countries in the system - by reviewing international political theories related to security cooperation. Comparing the formation, development, and achievements of NATO and SEATO, the study figures out that the existence of the main threat, the high intensity of the threat, and the strong confidence among countries in the security system are the primary drivers for a successful collective security system. Based on the result, the study also analyzed the possibility of a security system shift in East Asia. Considering contemporary international conflicts such as U.S.-China strategic competition, Russia-Ukraine War, and growing threats posed by North Korean nuclear and missiles, the study anticipates that the necessity of a collective security system that will replace the current security system of the region would arise. Still, although some issues between countries should be overcome, the growing intensity of the threats will promote cooperation among countries by improving their confidence.
