Systematic Improvement of Safety Management-Related Laws in Domestic Demolition Works (국내 해체공사 안전관리 관련 법령의 체계적인 개선방안)

  • Generally speaking, the demolition works is the subsequent construction activity which has been done after building life-span of twenty two years or so. However, it was not prepared suitable systems and laws and regulations as long-term solutions. In this study, it was suggested the improvement guideline of safety management-related laws in domestic demolition works. The three improvement of laws was suggested as follows. ${\bullet}$ First, it was suggested proposals for demolition works standards in safety management plan of management law for construction activity. ${\bullet}$ Secondly, it was provided improvements for standard safety work guide of demolition works of industrial safety and health law. ${\bullet}$ Third, it was proposed integration method of redundancy in safety management plan and risk assessment regulations.

  • Safety in the laboratory has been a growing interest due to recent recurrences of the fatal accidents such as physical or chemical explosions. It is not easy to determine, to what extents the industrial safety and health law should apply the laboratory. Most laboratory workers are not sufficiently trained and recognized for the generic features of safety and health. The actual conditions of safety and health in the laboratory are not appropriate for laboratory workers. Safety and health in the laboratory is unfortunately in the dead ground. Therefore, it is most imperative to secure safety in the laboratory. This study proposes a method to improve safety in the laboratory.

  • The safety & health can not be accomplished by only one side's effort of labor and management. To establish high level of occupational safety & health system, we have to recognize the extent of participance and need to study about how to keep the labor-management cooperation in good condition. The purpose of this paper is to make better suggestions such as how to improve the labor-management cooperation and how to establish the efficient occupational safety & health law through studying the labor-management cooperation system in the occupational safety & health.

  • In this paper, I analyzed the industrial system and agriculture system about safety between korea and australia. An agriculture which is one of the national security industry, has recognized the importance. International country have attention to the automatization of machine for the improvement of agriculture. However, because of modernization of agriculture, the rate of accurrence about agriculture accident has increased dramatically. Especially the rate of accurence of agricultural accident is higher than the other industrial accident in the developed country. Because of these reasons, developed country has efforted to the agriculture systemabout safety. Australia law for the safety system of agriculture is very well and the rate of accident in the self-management agriculture is included in the statistics of industrial but The rate of accident in self-management agriculture is very higher. Korea has many middle size factory to make new goods and factory accurre very many accident. Because Korea government research the theory and practical affairs for the industrial system about safety and health to protect industrial accident In future we have to try new method about Agriculture Safety of Korea.

  • Since 1996, like other countries the PSM(Process Safety Management) System has been applied into chemical plant in Korea in accordance with the Occupational Safety & Health Law section 49 paragraph 2. This report is to point out the status and the area of concern, further suggest alternative measures along with the wide and in-depth idea of improvement and recommendation to prevent from industrial accident.

  • There are something unreasonable, unsatisfactory on the law system for laboratorial safety enforced by the government from April 2006. Therefore, the system should be reviewed and revised to be satisfactory for current research condition. This study is to analyze research areas for improving laboratorial safety and to show safer ideas. With more detail, more practically improving ideas have been shown for systemizing safety assessment in advance, effective organization of laboratory, safety committee and their regulation. It is expected that better safety level all the concerned engagement, reasonable revision of safety regulation of laboratory, can be made by this research result.

Investigation on the Health and Safety Hazards of Construction Workers

  • The construction workers might be at the risk of many occupational injuries and illnesses. To protect workers from various hazards, industrial health and hygiene systems were specified for the construction workers by law. It is important to know the actual health and safety(H&S) conditions by tasks and the characteristics of injuries and illnesses of construction workers. This study was designed to investigate the actual conditions of construction workers exposed to various harmful substances and work elements including evaluation of health status of each worker and general H&S system. Questionnaire was sent to 600 construction workers nationwide and totally 367 people responded to it having 61.67% of response rate. The common construction hazards were dust(29.6%), noise(19.3%), repetitive motions(12.0%), handling excessive heavy materials(11.2%) in order. The repetitive motions and handling heavy materials related to muscle disorders accounted for 23.2%. The accident and injury types were in order of overexertion, falling, overturning, dropping or flying, electric shock, collision, etc.

A Study on Reasonable Improvement of Legal Requirement for Fire Proofing for Steel Structures in a Chemical Plant (화학플랜트에서 철골구조물 내화기준의 합리적인 개선에 관한 연구)

  • It is noted that the disaster such as fire, explosion, collapse has been rapidly increased caused by strength deterioration of steel structures at petrochemical plant during fire. In this regard, it is stressed out that the legal requirement for fire proofing for steel structures at petrochemical plant should be carefully reviewed since the current legal requirement such as Industrial Safety & Health Law, Architectural Law has a conflict and different way of approach. In addition, it is our point of view that the present law should be revised to consolidate into single law including engineering design criteria to reflect unreasonable legal requirement. It is further our point of view that the performance certificate for fire proofing like UL-1709, basis of maintenance should be appropriately and reasonably provided in line with global practice.

Comparative Legal Study of Workplace Thermal Environment Management Legislation (작업장 온열환경 관리 법제의 비교법적 고찰)

  • Objectives: The Ministry of Employment and Labor has revised the articles regarding management of the thermal environment in the workplace. Currently, two types of regulations exist together with indoor workplaces as the scope of application. It appears that the time has come to discuss regulations. In this study, we aim to identify the feasibility of and problems with the current system through a comparative legal review of workplace thermal environment management laws from around the world. We suggest directions for improving South Korea's workplace thermal environment management laws. Methods: For the several selected countries, we analyzed the classification and content of obligations stipulated for the thermal environment, the presence or absence of specific measures for thermal environment management, legal status and content, and the scope of application of thermal environment provisions and measures. The investigated content was classified according to Zweigelt-Kotz's legal theory. Results: In some countries, employers' obligations for regulating the thermal environment are broadly divided into two types: results and actions. The scope of application of provisions and measures on the thermal environment was extensive, with most of the selected countries targeting general workplaces. Conclusions: In the case of South Korea, restricting and classifying target workplaces and imposing separate obligations to manage a workplace thermal environment goes against global practices, and stipulating legal orders and separate action obligations in guidelines does not conform to the characteristics of South Korea's legal system, meaning that improvement is needed.
