A Study on the Admissibility of the Virtual Machine Image File as a Digital Evidence in Server Virtualization Environment (서버 가상화 환경의 가상머신 이미지에 대한 법적 증거로서의 허용성에 관한 연구)

  • As many companies are considering to use server virtualization technology to reduce cost, the crime rates in virtual server environment are expected to be increasing rapidly. The server virtualization solution has a basic function to produce virtual machine images without using any other disk imaging tools, so that investigating virtual servers are more efficient because the investigator only has to collect the virtual machine image and submit it to the court. However, the virtual machine image has no admissibility to be the legal evidence because of security, authenticity, procedural problems in collecting virtual machine images on virtual servers. In this research, we are going to provide requirements to satisfy security, authenticity and chain of custody conditions for the admissibility of the virtual machine image in server virtualization environment. Additionally, we suggest definite roles and driving plans for related organizations to produce virtual machine image as a admissible evidence.

Transfer Learning Backbone Network Model Analysis for Human Activity Classification Using Imagery (영상기반 인체행위분류를 위한 전이학습 중추네트워크모델 분석)

  • Recently, research to classify human activity using imagery has been actively conducted for the purpose of crime prevention and facility safety in public places and facilities. In order to improve the performance of human activity classification, most studies have applied deep learning based-transfer learning. However, despite the increase in the number of backbone network models that are the basis of deep learning as well as the diversification of architectures, research on finding a backbone network model suitable for the purpose of operation is insufficient due to the atmosphere of using a certain model. Thus, this study applies the transfer learning into recently developed deep learning backborn network models to build an intelligent system that classifies human activity using imagery. For this, 12 types of active and high-contact human activities based on sports, not basic human behaviors, were determined and 7,200 images were collected. After 20 epochs of transfer learning were equally applied to five backbone network models, we quantitatively analyzed them to find the best backbone network model for human activity classification in terms of learning process and resultant performance. As a result, XceptionNet model demonstrated 0.99 and 0.91 in training and validation accuracy, 0.96 and 0.91 in Top 2 accuracy and average precision, 1,566 sec in train process time and 260.4MB in model memory size. It was confirmed that the performance of XceptionNet was higher than that of other models.

Primary School Spatial Characteristics and Architectural Design Methods based on Prospect and Refuge Concept (조망과 은신개념으로서의 초등학교 공간특성과 건축설계 방법연구)

  • With the possibility of preventing crime through environmental design, CPTED guidelines have been introduced and applied to various places. However, although guidelines may be a useful design tool, there are also limitations to referencing it in the early conceptual phase of school architecture. Therefore, the purpose of this study is to examine the concept of "prospect and refuge", which serves as the basis of CPTED, and derives architectural characteristics and application methods based on the concept. For the case study, this research selected six small to medium-scale elementary schools with outstanding creative ideas built within the last 10 years. The results showed that the spatial characteristics of the "prospect" can be achieved by organizing the three-dimensionality of the space, vista prospect, and design attention on circulation areas. The concept of "refuge" was realized through the segmentation of the mass and spatial enclosure. Although the subjects had different social conditions and educational directions in Korea, this study may be used as a theoretical framework for designing a safe school environment.

  • This article is a reexamination of the feminist criminal narrative I wish for what is forbidden by Yang Gui-ja in the context of the rise of the women's movement and consumer culture of the middle class in Gangnam in the 1980s and 1990s. At this time, the explosive media culture served to strengthen the ideology that placed the middle-class family at the center as well as the consumption culture. The combination of consumer media culture, women's movement and democratization created a soft and domestic male image while visualizing the material foundation of the middle class in the 1990s of South Korea. In this novel, the domestic male image transforms the feminist criminal narrative into the narrative of the femme fatale attacking the stability and dignity of the middle class family, and at the moment of the transformation, the feminist woman Kang Min-ju is killed by a lower class man who has admired and loved her. This novel is not only current but also signifying as a text that overlaps sociocultural reproduction and feminist issues of the middle class based on Gangnam in the 1990s. This is because it shows the sociocultural context of femicide, such as serial murder of targeting women, as a core code of criminal narrative to be held in Korea since the late 1990s.

A Study on the Digital Forensics Artifacts Collection and Analysis of Browser Extension-Based Crypto Wallet (브라우저 익스텐션 기반 암호화폐 지갑의 디지털 포렌식 아티팩트 수집 및 분석 연구)

  • Recently, due to the nature of blockchain that guarantees users' anonymity, more and more cases are being exploited for crimes such as illegal transactions. However, cryptocurrency is protected in cryptocurrency wallets, making it difficult to recover criminal funds. Therefore, this study acquires artifacts from the data and memory area of a local PC based on user behavior from four browser extension wallets (Metamask, Binance, Phantom, and Kaikas) to track and retrieve cryptocurrencies used in crime, and analyzes how to use them from a digital forensics perspective. As a result of the analysis, the type of wallet and cryptocurrency used by the suspect was confirmed through the API name obtained from the browser's cache data, and the URL and wallet address used for the remittance transaction were obtained. We also identified Client IDs that could identify devices used in cookie data, and confirmed that mnemonic code could be obtained from memory. Additionally, we propose an algorithm to measure the persistence of obtainable mnemonic code and automate acquisition.

The Influence of Positive Thought about Social Capital on Social Participation of the Elderly Koreans (사회 자본에 대한 긍정적인 생각이 한국노인의 사회 참여에 미치는 영향)

  • We investigated the influences of positive thought about social capital on social participation of the elderly Koreans. The study design was cross-sectional analysis of the National Statistic Office Study of Korean Society Statistics Survey 2003. Participants were total of 8,586 representative samples. Two types of social participation were investigated: meeting attendance and volunteer obligations. The base model included five thoughts about social capital that must be settled as a priority in Korea, i.e., reducing the differences between the rich and the poor, reducing the crime rate, reducing regulations and corruption, improving the moral level, eliminating environmental pollution. Social participation was influenced by positive thoughts about social capital, and different kinds of thoughts had different influences on different types of social participation. The elderly who responded positively to 'reducing the differences between the rich and the poor' attended all two types of social participation more. Along with education and health status, positive thought about social capital is another important factor that influences increased social participation. It may also compensate for deteriorating health with increasing age by promoting social participation. Encouraging social participation is a good way to improve the health of the elderly, as are efforts to change thought about social capital positively.

A Study on Evaluation Parameters of Safety City Models (안전도시 모델의 평가지표에 관한 연구)

  • As interest in urban safety has increased since COVID-19, various institutions have developed and used indicators that evaluate the safety city model. Yongsan-gu was ranked No. 1 in 2021 by Social Safety Index evaluation and was selected as the safest city in Korea. However, the Itaewon disaster in Yongsan-gu in 2022 caused many casualties. The study of indicators for evaluating cities' safety was necessary. This study aims to examine domestic and foreign safe city models and review the differences between each model and the indicators used to evaluate safe cities. As a result of collecting 11 safe city models and analyzing each evaluation index, safe city models can be classified into program-based safe city models, such as the World Health Organization's International safe community and the UN Office for Disaster Risk Reduction's International Safe city. Considering the diversification of threats to safety, it is reasonable to comprehensively consider digital security, health safety, infrastructure safety, personal safety, environmental safety, traffic safety, fire safety, crime safety, life safety, suicide, and infectious diseases when evaluating safe cities as evaluation parameters.

Histogram-Based Singular Value Decomposition for Object Identification and Tracking (객체 식별 및 추적을 위한 히스토그램 기반 특이값 분해)

  • CCTV is used for various purposes such as crime prevention, public safety reinforcement, and traffic management. However, as the range and resolution of the camera improve, there is a risk of exposing personal information in the video. Therefore, there is a need for new technologies that can identify individuals while protecting personal information in images. In this paper, we propose histogram-based singular value decomposition for object identification and tracking. The proposed method distinguishes different objects present in the image using color information of the object. For object recognition, YOLO and DeepSORT are used to detect and extract people present in the image. Color values are extracted with a black-and-white histogram using location information of the detected person. Singular value decomposition is used to extract and use only meaningful information among the extracted color values. When using singular value decomposition, the accuracy of object color extraction is increased by using the average of the upper singular value in the result. Color information extracted using singular value decomposition is compared with colors present in other images, and the same person present in different images is detected. Euclidean distance is used for color information comparison, and Top-N is used for accuracy evaluation. As a result of the evaluation, when detecting the same person using a black-and-white histogram and singular value decomposition, it recorded a maximum of 100% to a minimum of 74%.

  • The Korean Society of Law and Medicine has faithfully played the role of professional academic organizations last 20 years in terms of academic activities, accumulated achievements, diversity, professionalism, and influence on academic circles. The Korean Society of Law and Medicine and the Journal of Medical Law serve as a platform for academic information and exchange of opinions on medical law. Medical law began in the midst of increasing conflicts and disputes caused by medical malpractice and the enactment and legal coercion of medical care as pressure on medical workers. It tried to find a way to coexist with each other through the encounter and convergence of medicine and law. Medical criminal law extends from traditional crimes in the realm of life and body protection to bioethics violations caused by the development of biomedical technology, corruption and economic crime in the medical field. Medical law has evolved into a comprehensive legal area dealing with legal issues raised in medical treatment, healthcare, bioethics, and life sciences technology. On the legal side, medical law is not independent legal areas. It is overlapping with traditional law areas such as civil law, administrative law, criminal law, social law, civil and criminal procedure law. However, it is now established as a convergence study in medicine, bioethics, life science, as well as in various fields of law. It has become an area where collaboration is needed with the field of law, medicine, ethics, sociology and economics. Medical criminal law has undergone a dynamic development over the last two decades. The development of medicine and medical technology provides new and innovative methods of diagnosis and treatment. The achievements and risks of revolutionary developments in biotechnology, genetic engineering and medicine coexist. While there is a dazzling achievement that mankind has hoped for: combating disease and improving health, it also creates unwanted side effects and risks to humans. There is a need to reconsider ethical and legal principles. The discovery and development of patient identity and autonomy has changed the medical doctor-patient relationship. Furthermore, it was complicated by the triangle relationship of patients, medical doctors and insurance. Legal matters are also complicated. This is why the necessity of legislation is emerging. Criminal punishment provisions are also required. The Medical Law and Biomedical Law are systematically and coherently deformed as mosaic-based legislation that takes place whenever there are social issues, citizens' needs, and medical organizations' interests, rather than sufficient enactment and revision procedures. It needs a complete overhaul, and this is possible through interdisciplinary collaboration which is the strength of The Korean Society of Law and Medicine.

Policy suggestions for active reporting of medical professionals for early detection of child abuse (아동학대의 조기발견을 위한 제도적 개선 방안: 「아동학대범죄의 처벌 등에 대한 특례법」이 정한 의료인에 의한 신고를 중심으로)

  • The Act on Special Cases Concerning the Punishment, etc. of Child Abuse Crimes intends to encourage reporting and punishment of child abuse by using the concept of 'crime' in child abuse cases. Article 10 of the Act imposes duty to report child abuse on a number of different professions, including medical professionals. Currently, more than 80% of child abuse cases occur among family members and the detection rate of child abuse is as low as 0.5% in Korea. On the other hand, medical professionals can identify child abuse relatively clearly with specific medical opinions. Therefore, it is necessary that medical professions are informed of this duty and does not bear disincentive from reporting. This paper makes policy suggestions in this regard. First, it is necessary that medical students and medical professionals receive regular education about the obligation to report child abuse. Education should include details of the reporting duty, as well as the fact that there is legal obligation to report even if the child abuse is "suspicious", not certain. Second, it is imperative to establish and implement protective programs for medical professionals who report child abuse. The current law provides a rough framework for protection of people who report child abuse, but it is necessary to produce detailed guidelines that are applicable in the context of medical setting. Education for medical students and medical professionals should include the contents of these guidelines, so that they do not hesitate reporting because they fear the aftermath of reporting. Third, it is highly recommended that physicians use the national Baby/Infant Health Checkup Program as an opportunity to detect child abuse. In Korea, the Baby/Infant Health Checkup Program provides physicians to periodically monitor health condition of all babies and children until the age of 71 months. In order to utilize this program for early detection of child abuse, it is imperative that the bBaby/Infant Health Checkup Program is modified to involve child abuse experts and medical professionals who participate in the program are educated about child abuse.
