  • This study conducted a basic study to develop ISM Code operation evaluation module, which is part of development of Safety Management System(ISM Code) Implementation supporting module. In particular, the significant of this study is that it established AHP operation evaluation analysis process, the design of questionnaire, and the hierarchical structure of operation evaluation model standard, focusing on the development of ISM Code operation evaluation module. Also, this study has its value in the point that it attempted to apply AHP scheme, which is part of the main decision-making in management science field, to develop operation evaluation module.

  • "International Safety Management(ISM) Code" means the International Management Code for the Safe Operation of Ships and for Pollution Prevention as adopted by the Assembly, as may be amended by the International Maritime Organization. This Code have brought into force internationally since 1th July, 1998 by incorporated to the new Chapter Ⅸ in the SOLAS Convention. Accordingly those States which give effect to the SOLAS Convention will have to ensure that rules giving effect to the Code are introduced into their domestic legislation. The purpose of this Code is to provide an international standard for the safe management and operation of ships and for pollution prevention, by this to reduce the maritime casualty which could caused by neglect of person. To achieve this purpose the ISM Code specifies a number of broad 'safety management objectives' for owning or operation companies, and it requires that such companies should establish, implementing and maintain a written Safety Management System(SMS) covering a whole range of safety environmental and related matters. These requirements of the Code could effect on the carrier in some points such as duty of due diligence to care for cargo, due diligence to make the vessel seaworthy and burden of proof etc. In this respect, We should know that the ISM Code could effect on the carrier advantageously or disadvantageously subject to whether the carrier observed the requirement of the ISM Code. Although it does not add cause of liability or increase limitation of liability imposed to the carrier.

A Study on the Change of Domestic Marine Accidents and Insurance rates According to Enforcement of ISM Code (ISM Code 도입에 따른 국내 해양사고 및 보험율 변화에 관한 연구)

  • The variation of marine accidents and ship's insurances is to be the measurement of assessment concerned effect of importing ISM Code because each kind of ship accident's expenses and compensation for the loss have an effect on the ship's insurance and P&I insurance. Therefore in this study, we had grasped the accomplishment of importing ISM Code, using analysis of the variation of marine accidents and ship's insurances in domestic shipping companies from one year ago to 8 years after importing ISM Code. As the result of analysis, compared with the period of a year before carrying out ISM Code, marine accidents were showed a decrease of about 14.4% at 8th year of importing ISM Code. Also, the insurance had tended downward every year.

  • The variations of marine accidents and ship's insurences are measures for assessing the effects of ISM Code implementation, bemuse expenses for the treatment of ship accidents and compensations for the loss have an effect on the ship's insurence. In order to understand the results and accmplishements of ISM Code implementation in Korea, the rise and the fall of marine accidents and ship's insurences were analyzed and examined in domestic shipping companies from one year before implementation to eight years after implementation of ISM Code. As the result of analysis, compared with the period of a year before implementation of ISM Code, the decrease of about 14.4% in marine accidents was shown in the 8th year after ISM Code implementation in Korea, and ship's insurance rates tended to decrease from year to year.

  • In 1994, the International Maritime Organization (IMO) adopted the International Safety Management Code (ISM Code) as SOLAS convention to ensure the safe operation of ships and to protect marine environment from pollution In December 2002, the IMO adopted the International Ship and Port Facility Security Code (ISPS Code) in the Chapter XI-1 of SOLAS to ensure the security of ships, crew, cargo and port facility. With 1 July 2004 being the coming into effective date of ISPS Code, there is a sense of urgency among the shipping companies and port authorities to accomodate the ISPS Code. Although both the ISM Code and the ISPS Code are based on the management system concept introduced in the ISO 9001, two Codes pursue different objective. Accordingly, it is meaningful to compare and analyze the requirements of three standards. In this article, the backgrounds, principles and requirements of three standards are analyzed and presented to offer several suggestions on the establishment and implementation of security measures in compliance with the ISPS Code to the shipping industry in time.

A study on applying of the ITC-Hulls & ISM Code for the Accident of the Foundering Ship (선박침몰사고에 따른 ITC 협회약관 및 ISM Code 적용에 관한 연구)

  • This paper was provided to apply the ITC-Hulls Clauses & ISM Code for the accident of sunken ship which was occurred by seamen's barratry. For the causes of the sunken accident, the underwriter insisted toot shipowner submerged the vessel intentionally for the purpose of the insured amounts, while shipowner protests toot the ship was submerged because of crews faults. In this connection, the judge sentenced toot this accident was caused by humans errors as the Provisions of 6.2.4 of ITC-Hulls, however shipowner is responsible for hiring onboard qualified seafarers and carrying out the due diligence for performing ISM Code for ensuring ship's safety and seaworthiness.

  • IMO(International Maritime Organization) is existed the movement for revising ISM Code so that the maintenance history and the trouble information given trading in a ship can be transferred. An empirical analysis was made on the influence that will have upon shipping industry through surveying on the recognition on ISM Code revision in employees of the relevant field and on the expected problems given being amended ISM Code as the above. In conclusion, the positive effect is judged to be more in the aspect of ship safety, which is the aim of ISM Code, rather than the negative effect, which may take place given being revised ISM Code. In other words, the clean market can be formed through this because fairness is maintained on both sides given trading in a ship by which opening the maintenance record and the trouble history is applied equally to a buyer and a seller. Ships can be reduced a loss of time and cost in preventing similar problems and seeking solution that may appear in important equipments, through this maintenance record. Also, based on these materials, it comes to be available for analyzing a risk of ship and preventing and managing a risk, thereby being increased ability of maintenance and repair in a ship, resulting in being judged to likely contributing to ship safety and environmental-pollution prevention.
