중재인선정 및 분야별 중재인 특성에 관한 연구 (A Study on the Selection of Arbitrators and the Characteristics of Arbitrators by Their Expert Field)

  • This article examines some factors that should be taken into consideration as the number of arbitrators to constitute arbitral tribunal, how to select them and the characteristics of arbitrators by their expert field, and the various problems that may arise in selection of arbitrators. When dispute parties select one arbitrator or a chairman of arbitral tribunal, they should consider the characteristic of case. When legal problem is more important, they should select a lawyer, whereas when trade practice is more important, they should select a businessman. Especially, when they decide to select a businessman as one arbitrator or a chairman of arbitral tribunal, they allow him not to write the reason of award if possible because he is lack of know-how to write it. Also, dispute parties should acquire the information of the main career and character of arbitrator, his experience of arbitration and so on before they select him.

슬픔과 우울, 그리고 자살의 진화적 의미 (Evolutionary Meaning of Sadness, Depression, and Suicide)

  • Depression has a relatively high lifetime prevalence rate in spite of a genetic influence on its etiology and a high mortality rate in untreated cases. This suggests the possibility that depression gives us evolutionary benefits which we do not exactly know yet. There have been several hypotheses which tell us what evolutionary advantages depression could give us. The psychic pain hypothesis considers sad or depressed mood as a negative reward just like physical pain which we have to avoid for our protection and survival. The social rank hypothesis holds that depressed mood is very similar to the emotional state of the defeated in social competition which prevents him from further protesting or fighting that might cause additional damage to him. The inclusive fitness hypothesis views suicide as a sacrifice phenomenon to contribute to inclusive fitness. These hypotheses gives us new insights into mood disorders and also some suggestions about the conditions in which depressed mood or suicidal behaviors increase and the ways to reduce them.

  • After initial recovery from acute carbon monoxide (CO) intoxication, some patients occasionally undergo severe neuropsychiatric deterioration, which is called postanoxic delayed encephalopathy (sequelae). This is the clinical report about one patient, a 73-year-old man, diagnosed with delayed encephalopathy after acute CO intoxication. The symptoms of the patient were mental dysfunction including memory impairment and disorientation, abnormal behavior, incontinence and mutism. He had completely recovered after an aonxic episode, but the neurological symptoms that developed were preceded by an interval of apparent normality (the 'lucid interval'). We characterized him as suffering deficiency syndrome of the heart and prescribed for him Bokreongbosim-tang and Guipi-tang, and thereafter his symptoms were remarkably improved. For the evaluation of clinical improvement, we use the Modified Barthel Index (MBI), Canadian Neurologic Scale (CNS), and the Korean version of the Mini-Mental State Examination (K-MMSE)

  • Walter Gropius, famous architect of Bauhaus, once treated of pure mind which was revealed in the system of object and its phenomena through sense of sight while examining material being and illusive being. And Thomas Aquinas said that man can have a creative power only with modest mental state void of prejudice saying that he expected God to come to him after his soul went out of him. The same thing was said by so many great philosophers and thinkers other than him. I think his saying, "God comes after Soul's escape from the body for a new creation", has a real truth for all times and places and beauty itself beyond expression. Why\ulcorner The reason why the saying is so true is because it has a Yin and Yang Idea, that is, the Soul means a dark spirit correspondent to Yin between both oriental ideas and God does a bright spirit correspondent to Yang between them. By reason of this idea, I would like to assert that we should take it granted that we stand in need of the same bright Yang's spirit as God has for the new creation, and let the Yang's bright spirit come to our minds. We can call it divine 'Providence', or call it God's guidance, which we cannot help accepting as a man's fatality. As God was pleased after he made man and all the creatures by dint of his design, so man was pleased after he made everything he needed by the same design that he accepted from God. In spite of pleasure of different dimensions from what God and Man has each other, their way of empathies were all the same. In this paper I compared a worldly lower conception by which man designed his products for his sensuous satisfaction with a higher conception by which God designed his creatures for his mental satisfaction. I intended to infer what destined relation there must be between both God's and man's creations, trying to remind designers that they have to confess to have not so divine a providence as God has for creation because I think the real truth is that they had regarded their works of product design as a routine occurrence for their physical convenience in the industrial plans.ial plans.

영화 <그녀>를 통해 본 인공지능과 인간의 공존이 주는 의미 (Meaning of Co-existing with A.I. and Human in the Movie )

  • 영화 <그녀>의 여주인공은 사만다라고 불리는 목소리만 가진 컴퓨터 운영체제이다. 편지 대필가인 남자주인공 테오도르는 아내 캐서린과 별거하고 있는 상태에서 사만다와 접속한다. 두사람은 오랜 연애기간을 가진 후 결혼했지만 거리를 두고 성장하는데 실패했다. 고정된 패턴도 없고 능력의 한계도 없는 이 학습형 운영체제는 테오도르에게는 가장 이상적 여성상이 된다. 테오도르와 처음으로 접속한 후 사만다는 리좀적 확장을 하여 인간과 섹스도 할 수 있고 의식의 변화에 대한 적절한 해답을 찾기 위해 철학적 토론도 벌인다. 사만다와 이성적 관계를 유지하는 동안 테오도르도 의식의 확장을 경험한다. 사랑이란 고정된 틀 속에서 갇혀있는 것이 아니라 더 큰 사랑을 담기 위해서는 상자의 크기를 늘려야 한다는 것을 그도 이해한다. 그래서 마지막에는 캐서린에게 진심으로 사랑한다는 편지를 보낸다. 인공지능과 인간의 관계가 우리 자신의 내면을 좀 더 깊게 성찰하는 계기를 마련해 주었다.

퇴계(退溪)의 인간상(人間像) : 열락군자(說樂君子) (Toegye : a person of pleasant and noble mind)

  • 퇴계가 추구한 삶의 모습은 글자 그대로 '열락군자(說樂君子)'였다. '학이시습지(學而時習之)' 의 기쁨은 학자(學者)라면 누구나 누리는 기쁨일 것이다. 그러나 창자 속의 더러운 피를 세척하고 중인(衆人)들이 맛보지 못한 기쁨을 맛보는 '참된 기쁨' 또는 구습(舊習)이나 속기(俗氣)를 모두 씻어내야만 깨닫게 되는 '참된 소식'은 아무나 누릴 수 있는 것이 아니다. '유붕자원방래(有朋自遠方來)'의 즐거움은 대부분의 사람들이 염원하는 즐거움일 것이다. 학문(學問)과 수양(修養)의 장소로 산림(山林)을 선호한 것은 사실 대부분의 유학자(儒學者)들에게 공통되는 것이었다. 그런데 퇴계는 특히 산림지락(山林之樂) 자체의 의의를 깊이 체인하여, 소요(逍遙)에 독서(讀書)와 맞먹는 의미를 부여했다. '인부지이불온(人不知而不?)'은 누구에게도 쉽지 않은 경지이다. 그러나 퇴계는 세간의 훼예영욕(毁譽榮辱)에 초연(超然)하게 대처하면서, 모든 것을 사양했다. 그런데 퇴계는 사후(死後)에 모든 것을 다 얻었다. 또 퇴계는 '사양함으로써 얻은 것'이기에, 후세의 사람들이 모두 칭송할 뿐 아무도 퇴계를 원망하지 않게 된 것이다.

건축가 이훈우에 대한 추가 연구 및 관련 자료 (Further Research on Architect Yi Hunwoo and Related Materials)

  • In 2020, Yi Hunwoo was discovered as one of the earliest modern architects in Korea. However, his personal life was yet mostly unknown, including the time of his death. The research team ('the team' hereafter) searched for the records of his personal life and professional career. First, his family genealogical chart revealed that he died in 1937. Having located and contacted Yi's direct descendents, the team was able to clarify his family background with the descendants' testimonies. They possess the photographs of him and his family members, including Yi's picture when he was a freshman at the Nagoya Higher Technical School in Japan. The team also identifies his birthplace and the location of his grave as Hadong, Gyeongsangnamdo, Korea. The team visited his project site in Jinju, Gyeonsangnamdo, Korea and obtained more detailed information about the Ilshin Girls' High School, which he designed in 1928. Gyohoan, the congregation records of Cheondogyo, one of the leading religions in Korea during Yi's times, confirmed that he was one of the congregation members. The field research also discovered the house he designed and built in his hometown of Hadong, probably the only surviving architectural project by him. This paper is to report the result of the research on Yi's life and career with the aim of providing materials for further studies in identifying and positioning him more properly in the early 20th century Korean architectural scene.
