A Study on History of Criminal Policy in Korea (한국(韓國)의 형사정책(刑事政策)에 관한 역사적(歷事的) 고찰(考察))

  • During the ancient times, there was no separative judicial system and administrative , legislative and judiciary functions were ultimately concentrated in the all-powerful monarch. And the three states developed state organization , adopting hieratical structures and placing at the pinnacle . State Codes were promulgated to initiate a legal system to rule the people, these codes instituted under influence of China codes. The people tradition sees crime control as the preservation of the authority of hereditary rulers. In the period of the Koryeo dynasty, government accepted a serious of detailed penal code from Tang dynasty . Legal response to crime stressed preservation of the dynasty rather than making citizen behave according to certain rules. In the period of Early Joseon , the compilation of Grand Code for state administration was initiated, the Kyeongkuk Taejeon ,became comer stone of the dynastic administration and provided the monarchial system with a sort of constitutional law in written form. This national code was in portant means of criminal policy at that time, Late Joseon , the impact of Western culture entering through China gave further impetus to pragmatic studies which called for socio-economic reforms and readjustment. Approach to criminal justice policy emphasized more equitable operation of the criminal justice system ,rehabilitation and crime control. Korea-Japanese Treaty concluded on 22 August ,1910 and proclaim a week later ,Japan gave the coup de grace to the Korea Empire and changed the office of the Resident - General into the Government - General . Thus korean criminal policy were lost during a dark ages ,which lasted for 36 years after fall of Joseon Dynasty (the colnial period,1910${\sim}$1945). After 1945 Korea's liberation from Japanese colonial rule, the occupation of devided Korea by the United States and Soviet Union frustrated the efforts of Koreans to establish an independent government, and the transplantation of two conflicting political ideologies to south and the north of the 38th parallel further intensified the national split. U.S. military government office occupied the south of the 38 the parallel and placed emphasis on democracy of criminal policy. ln 1948, the U.S. military government handed over to the ROK government its administrative authority.

Suggestions to Improve the Effectiveness of National Radiological Emergency Response System (국내 방사능재난대응체계 실효성 제고를 위한 제언)

  • Although the national radiological emergency response system has been improved by incorporating lessons from the Fukushima nuclear power plant accident and recent domestic natural disasters, it has not fully incorporated these lessons. In addition, it cannot deal with a variety of aftermath of the radiological disaster. Even for the same disaster, the national emergency response system should comply with multiple domestic laws in our country. Furthermore, there are a few discrepancies between the articles of the domestic laws that the national radiological emergency response system should address. Therefore, this study investigates the characteristics of radiological disasters, examines articles on the domestic laws related to the national radiological emergency response system, and analyses the Japanese government's responses to the Fukushima nuclear power plant accident. Based on the results of the review, suggestions for the improvement of the national radiological emergency response system in terms of response organization and framework have been proposed in this study.

  • I. introduction. A government goal at the present is established to make a welfare nation and to keep people's safe living, but it is criticised that when a large-scale disaster happens, the authority concerned could not deal with it, causing many people injured and material damage. Moreover, in these days, cities have many risk factors. extremely large and intelligent building, industrial facilities and underground equipment have many risk themselves along with scientific progress. The cope with disaster effectively, government must have efficient organization, skillful personnel, tool, facilities and so on. To reduce the damages, what's the most effective government organization\ulcorner II. Government organization for managing disaster In a few decades, a large-sized accidents broke out in korea, for example, collapse of Sampoong department store, break of Sungso bridge, explosion of Daegu city gas, gas explosion accident at Ahyon-dong etc. but government has not any adequate disaster response organization. Especially, after collapse of Sampoong department store broke out, Disaster Management Act is enacted to solve the past problem. According to Disaster management Act, disaster is limited in manmaid disaster. Therefore, in this thesis, disaster management is inspected theoretically, organization of disaster management for pattern of disaster, and role, duty of government organization, emergency relief organization system and actual conditions are analyzed. there are some problems. there are trials and errors. the government has changed the disaster management organization by the disaster management law. the organization consists of central and local government. but both of government do not work together harmoniously. in thesis, I would like to introduce the advanced nations disaster management organization, and study our central, local government organization. III. Conclusion Change and development of the government disaster management organization is the goal of this thesis. we have to increase public service in response and manage disaster. protecting civilian's life from the disaster is very important responsibility of government. there would be better way of government disaster management organization.

A Study on the Effect of Technological Innovation Capability and Technology Commercialization Capability on Business Performance in SMEs of Korea (우리나라 중소기업의 기술혁신능력과 기술사업화능력이 경영성과에 미치는 영향연구)

  • With the advent of knowledge-based society, the revitalization of technological innovation type SMEs, termed "inno-biz" hereafter, has been globally recognized as a government policymakers' primary concern in strengthening national competitiveness, and much effort is being put into establishing polices of boosting the start-ups and innovation capability of SMEs. Especially, in that the inno-biz enables national economy to get vitalized by widening world markets with its superior technology, and thus, taking the initiative of extremely competitive world markets, its growth and development has greater significance. In the case of Korea, the government has been maintaining the policies since the late 1990s of stimulating the growth of SMEs as well as building various infrastructures to foster the start-ups of the SMEs such as venture businesses with high technology. In addition, since the enactment of "Innovation Promotion Law for SMEs" in 2001, the government has been accelerating the policies of prioritizing the growth and development of inno-biz. So, for the sound growth and development of Korean inno-biz, this paper intends to offer effective management strategies for SMEs and suggest proper policies for the government, by researching into the effect of technological innovation capability and technology commercialization capability as the primary business resources on business performance in Korean SMEs in the light of market information orientation. The research is carried out on Korean companies characterized as inno-biz. On the basis of OSLO manual and prior studies, the research categorizes their status. R&D capability, technology accumulation capability and technological innovation system are categorized into technological innovation capability; product development capability, manufacturing capability and marketing capability into technology commercialization capability; and increase in product competitiveness and merits for new technology and/or product development into business performance. Then the effect of each component on business performance is substantially analyzed. In addition, the mediation effect of technological innovation and technology commercialization capability on business performance is observed by the use of the market information orientation as a parameter. The following hypotheses are proposed. H1 : Technology innovation capability will positively influence business performance. H1-1 : R&D capability will positively influence product competitiveness. H1-2 : R&D capability will positively influence merits for new technology and/or product development into business performance. H1-3 : Technology accumulation capability will positively influence product competitiveness. H1-4 : Technology accumulation capability will positively influence merits for new technology and/or product development into business performance. H1-5 : Technological innovation system will positively influence product competitiveness. H1-6 : Technological innovation system will positively influence merits for new technology and/or product development into business performance. H2 : Technology commercializing capability will positively influence business performance. H2-1 : Product development capability will positively influence product competitiveness. H2-2 : Product development capability will positively influence merits for new technology and/or product development into business performance. H2-3 : Manufacturing capability will positively influence product competitiveness. H2-4 : Manufacturing capability will positively influence merits for new technology and/or product development into business performance. H2-5 : Marketing capability will positively influence product competitiveness. The followings are the research results : First, as for the effect of technological innovation on business performance, the technology accumulation capability and technological innovating system have a positive effect on increase in product competitiveness and merits for new technology and/or product development, while R&D capability has little effect on business performance. Second, as for the effect of technology commercialization capability on business performance, the effect of manufacturing capability is relatively greater than that of merits for new technology and/or product development. Third, the mediation effect of market information orientation is identified to exist partially in information generation, information diffusion and information response. Judging from these results, the following analysis can be made : On Increase in product competitiveness, directly related to successful technology commercialization of technology, management capability including technological innovation system, manufacturing capability and marketing capability has a relatively strong effect. On merits for new technology and/or product development, on the other hand, capability in technological aspect including R&D capability, technology accumulation capability and product development capability has relatively strong effect. Besides, in the cast of market information orientation, the level of information diffusion within an organization plays and important role in new technology and/or product development. Also, for commercial success like increase in product competitiveness, the level of information response is primarily required. Accordingly, the following policies are suggested : First, as the effect of technological innovation capability and technology commercialization capability on business performance differs among SMEs; in order for SMEs to secure competitiveness, the government has to establish microscopic policies for SMEs which meet their needs and characteristics. Especially, the SMEs lacking in capital and labor are required to map out management strategies of focusing their resources primarily on their strengths. And the government needs to set up policies for SMEs, not from its macro-scaled standpoint, but from the selective and concentrative one that meets the needs and characteristics of respective SMEs. Second, systematic infrastructures are urgently required which lead technological success to commercial success. Namely, as technological merits at respective SME levels do not always guarantee commercial success, the government should make and effort to build systematic infrastructures including encouragement of M&A or technology trade, systematic support for protecting intellectual property, furtherance of business incubating and industrial clusters for strengthening academic-industrial network, and revitalization of technology financing, in order to make successful commercialization from technological success. Finally, the effort to innovate technology, R&D, for example, is essential to future national competitiveness, but its result is often prolonged. So the government needs continuous concern and funding for basic science, in order to maximize technological innovation capability. Indeed the government needs to examine continuously whether technological innovation capability or technological success leads satisfactorily to commercial success in market economic system. It is because, when the transition fails, it should be left to the government.

Improvement of Information Security Management System Evaluation Model Considering the Characteristics of Small and Medium-Sized Enterprises (중소기업의 특성을 고려한 정보보호 관리체계 평가 모델 개선)

  • Although more than 99% of all Korean companies are small and medium-sized enterprises (SMEs), which accounts for a large part of the national economy, they are having difficulties in securing information protection capabilities due to problems such as budget and manpower. On the other hand, as 97% of cyber incidents are concentrated in SMEs, it is urgent to strengthen the information protection management and response capabilities of SMEs. Although the government is promoting company-wide information security consulting for SMEs, the need for supplementing it's procedures and consulting items is being raised. Based on the results of information security consulting supported by the government in 2020, this study attempted to derive improvement plans by interviewing SME workers, information security consultants, and system operators. Through the research results, it is expected to create a basis for SMEs to autonomously check the information security management system and contribute to the reference of related policies.

A Study on Assessing Disaster Response Capacity for Coastal Residents (연안거주민에 대한 재해대응능력 평가 연구)

  • Recently the frequency of coastal disasters caused by global warming is increasing and the damage is becoming greater. Therefore, the Korean government is establishing various policies and measures to minimize damage. For disaster prevention, this study will evaluate the disaster response capacity of each local resident(Eup/Myeun/Dong) in coastal areas through the survey. The purpose of this study is to quantitatively understand the disaster response capacity and analyze spatial autocorrelation between hot spots(vulnerable area) and cold spots. Thus this study was conducted a survey of 311 towns(Eup/Myeun/Dong) about the disaster response capacity of coastal residents. As a result, Namhae has the highest average score(4.9). On the contrary, Hampyeong has the lowest(1.6). Coastal residents in Namhae seem to have better understanding of first aid and preventive maintenance. But coastal residents in Hampyeong seem to not have these characteristics. Afterwards, this study builds a database of disaster response capacity, and analyzes it using the spatial autocorrelation method. Finally, the area of hot spots and cold spots for disaster response capacity was quantitatively detected.

Trend of Reduction and Direction of Management Response in the Large Purse Seine Fishery (대형선망어업의 축소 동향과 경영대응 방향)

  • This paper examines the trend of restructuring and direction of management response in the Large Purse Seine Fishery. The large-scale fishing industry is one of the most popular fishing areas in the coastal area, and it has been developed by providing exclusive supplies of many types of catchy fish, such as mackerel and horse mackerel through physical productivity in fleet operations. However, the Large Purse Seine Fishery has been declining in profitability due to the deterioration of the business environment since 2000. It is at a crossroads whether it will disappear or regenerate as it is. The Large Purse Seine Fishery's current problems are: firstly, the continued deterioration of the fishery business balance and worsening labor problems, secondly, insufficient freshness management and quality control after landing, and thirdly, import competition. The fourth is the intensification of the market competition, which is the evolution of fishing variability and the increase in the proportion of small fish. The fifth is the reduction of the operating fishing ground due to the suspension of mutual fishing in Korea and Japan. To address these problems and suggest management response directions for the survival of large-scale fishing businesses is as follows. First, a sustainable production system should be established through strengthening resource management and promoting international fisheries cooperation. Second, the profitability of fishing management should be improved by introducing a low-cost supplier system and securing a stable labor force. Third, we should improve the leading and quality control of catch, improve the high value-added value of catch through brand development, and secure competitive advantage with imported produce. Finally, the government should establish a cooperative system among private sector, government, and research institutes to push ahead with these tasks and strengthen the competitiveness of the front and rear industries.

A Study on the Network of Civilian, Enterprise, School and Government Sectors for Disaster Management (재난관리를 위한 민관산학네트워크 구축에 관한 연구)

  • As disasters in the modem era become a large scale and complexity, no single entity can manage them. Instead collective cooperation between civilian, enterprise, school and government sectors is significantly needed, along with a well prepared mechanism. Thus, I attempt to construct the applicable network of civilian, enterprise, school and government sectors for disaster management through exemplary case studies of established countries as well as Korea's current operations and its drawbacks, based upon a networking design of disaster management organizations as belows: Firstly, it is cooperation and coordination among relevant organizations that are required essentially in the new era, in view of formative condition of necessary environment for civil participation. The cooperation and coordination can be made only through the network of civilian, enterprise, school and government sectors. Secondly, in order to build up the network, major roles and tasks which should be done by civilian, enterprise, school and government sectors respectively are listed based upon a stage of disaster management. Thirdly, operation models of a safety monitoring unit, a disaster prevention unit, a emergency response unit, and a rehabilitation unit are proposed in line with the network of civilian, enterprise, school and government sectors in regional base.

  • Life-cycle performance and maintaining cost predictions are required for the effective management for bridges. In Korea, the importance of management of bridges has been recognized over the past two decades, resulting in the development of databases and various bridge management support tools by both government and private sectors. However, none of these tools has truly included the expected features of the bridge management system (EMS) for the next generation such as the quantification of the effects of maintenance interventions on bridge condition and safety. In this paper, a novel quantification process to simulate the life-cycle performance of steel box bridges has been developed. The process is based on the Response Surface method. Various performance-related variables aloe investigated to identify a set of significant design variables to construct the response surfaces.

Coexisting with the Coronavirus, How to Prepare for It (위드코로나 시대, 어떻게 준비할 것인가?)

  • With the increase in vaccinations worldwide, the world is facing the era of coexisting with coronavirus disease 2019 (COVID-19). The government announced that it will change its focus of public health emergency response system, gradually toward daily recovery from November. Hence, this article reviews an overview of policy tasks to prepare for the era of coexistence with COVID-19. The three key policies that should be considered are as follow: (1) vaccination should be administered promptly to improve the immunity of the target population; (2) the government should advance the medical capability for critically ill patients and reorganize the patient delivery system; and (3) epidemiological surveillance system should be reformed in a direction to raise the social capacity.
