  • In this study, using the governing equation for thermohydrodyamic lubrication involving the homogeneous mixture of incompressible fluid derived by based on the principle of continuum mechanics, it is discussed the effects of water within turbine oil on the performance of high speed journal bearing of a steam turbine shipping engine. The governing equation is the general equation being able to be applied on the mixture of Newtonian fluid and non-Newtonian fluid. Here, the fluid viscosity index, n of power-law non-Newtonian fluid is supposed to be 1 for the application of the journal bearing in a steam turbine shipping engine lubricated with the mixture of two Newtonian fluid, for example, water within turbine oil. The results related with the bearing performance are showed.

  • The thermo-mechanical vibration behavior of two dimensional functionally graded (2D-FG) porous nanobeam is reported in this paper. The material properties of the nanobeam are variable along thickness and length of the nanobeam according to the power law function. The nanobeam is modeled within the framework of Timoshenko beam theory. Eringen's nonlocal elasticity theory is used to develop the governing equations. Using the generalized differential quadrature method (GDQM) the governing equations are solved. The effect of porosity, temperature distribution, nonlocal value, L/h, FG power indexes along thickness and length and are investigated using parametric studies.

Thermal buckling of functionally graded plates using a n-order four variable refined theory

  • This paper presents a simple n-order four variable refined theory for buckling analysis of functionally graded plates. By dividing the transverse displacement into bending and shear parts, the number of unknowns and governing equations of the present theory is reduced, and hence, makes it simple to use. The present theory is variationally consistent, uses the n-order polynomial term to represent the displacement field, does not require shear correction factor, and eliminates the shear stresses at the top and bottom surfaces. A power law distribution is used to describe the variation of volume fraction of material compositions. Equilibrium and stability equations are derived based on the present n-order refined theory. The non-linear governing equations are solved for plates subjected to simply supported boundary conditions. The thermal loads are assumed to be uniform, linear and non-linear distribution through-the-thickness. The effects of aspect and thickness ratios, gradient index, on the critical buckling are all discussed.

  • This study is carried out in order to evaluate the performances of the Reynolds stress turbulence models such as SSG and GL models in the calculation of separated flow over backward-facing stepp.In addition, two slow return-to-isotropy models, YA and Rotta models combined with rapid part of SSG model are also tested. The finite volume method is used to discretize the governing differential equations, and the power-law scheme is used to approximate the convection terms. The SIMPLE algorithm is used for pressure correction in the governing equations. The results show that SSG model gives the better prediction near the reattachment point than GL model. In cases that the rapid term of SSG model is combined with Rotta and YA slow models, the results show the better predictions of stress components in recirculation zone, but indicate inaccuracy in the predictions of mean velocity.

  • The performance of a mixed $H_{\infty}/H_2$ design with pole placement constraints based on robust vibration control for a piezo/beam system is investigated. The governing equation of motion for the piezo/beam system is derived by Hamilton's principle. The assumed mode method is used to discretize the governing equation into a set of ordinary differential equation. A robust controller is designed by $H_{\infty}/H_2$ feedback control law that satisfies additional constraints on the closed-loop pole location in the face of model uncertainties, which are derived for a general class of convex regions of the complex plane. These constraints are expressed in terms of linear matrix inequalities (LMIs) approach for the multiobjective synthesis. The validity and applicability of this approach for vibration suppressions of SMART structural systems are discussed by damping out the multiple vibrational modes of the piezo/beam system.

Arbitration Clause Prohibiting Class Action in Consumer Contracts

  • For recent years, several disputes between Korean consumers and multinational companies have arisen. Since the disputes were big and material that children's safety was at issue, a question started if Korean law properly has protected consumers' rights against multinational companies. While the Korean legal society tried to legislate punitive compensation with this concern, the U.S. Supreme Court reached an interesting case law regarding consumer contracts. A recent trend on consumer contracts in the United States shows that general terms have arbitration clause with class action waiver. As much as international arbitration has worked as the most effective resolution in international commercial disputes, the concept is still foreign and the experts are not approachable to lay individual consumers. However, class action in arbitration can hugely help for lay individual consumers to bring a case before arbitration tribunal. California courts consistently showed the analysis that the practical impact of prohibiting class action in arbitration clause is to ban lay individual consumers from fighting for their rights. However, the Supreme Court held that the arbitration clause shall be enforced as parties agree even if consumers practically cannot fight for their rights in the end. Even though consumer contracts are a typical example of lack of parity and of adhesive contract, the Supreme Court still applies liberalism that parties are equal in power and free to agree. This case law has a crucial implication since Korean consumers buy goods and services from the U.S. and other countries in everyday life. Accordingly, they are deemed to agree on the dispute resolution clauses, which might violate their constitutional right to bring their cases before the adjudication tribunal. This issue could be more important than adopting punitive compensation because consumers' rights are not necessarily governed by Korean law but by the governing law of the general terms and conditions chosen and written by the multinational companies. Thus this paper studies and analyzes the practical reality of international arbitration and influence of arbitration clause with class action waiver with the U.S. Supreme Court and California case laws.

  • Since 2009, Morocco has had a law governing the processing of personal data, the law 09-08, and a supervisory authority, the CNDP (National Commission for the Protection of Personal Data). Since May 2018, the European General Regulation on the Protection of Personal Data (GDPR) entered into force, which applies outside the EU in certain cases and therefore to certain Moroccan companies. The question of the protection of personal data is primarily addressed to the customer. The latter may not only be a victim of crime linked to ICT, but also have to face risks linked to the collection and abusive processing of his personal data by the private and public sectors. Often the customer does not really know how their data is stored, nor for how long and for what purpose. This fact raises the question of satisfying customer requirements, in particular for organizations that have adopted a quality approach based on ISO 9001 standard.In order to master these constraints, Moroccan companies have to adopt strategies based on modern quality management techniques, especially the adoption of principles issued from the international standard ISO 9001 while being confirmed by the law 09-08. It is through ISO 9001 and the law 09-08 that these companies can refer to recognized approaches in terms of quality and compliance. The major challenge for these companies is to have a Quality approach that allows the coexistence between the law 09-08 and ISO 9001 standard and this article deals within this specific context.

의료보장을 위한 지방정부의 사회보험료 지원 자치법규에 관한 고찰 (A Study on the Local Governments' Autonomous Laws Regulating Social Insurance Premium for Medical Security)

  • 지방자치단체는 의료보장을 위해 2006년부터 국민건강보험제도 등 의료보장과 관련한 사회보험료를 지원하는 정책이 매월마다 시행되고 있다. 본 연구는 지방정부에서 노인세대 또는 저소득대가구 등의 국민건강보험료 등 공적 보험료를 지원하는 자치법규가 어떠한 내용으로 법규화되어 있는가의 특성 등에 대해 고찰하는 데 목적이 있다. 본 연구의 수행을 위한 방법으로서 국가법령정보센터의 웹사이트에 공표된 자치법규에서 조례와 조례규칙을 '건강보험료'의 검색어를 통해 검색한 결과를 통해 이루어졌다. 2019년5월 현재 제정된 조례는 201건이었는데, 광역지방자치단체는 17개 중에서 8개의 시도에서, 기초지방자치단체는 226개 중에서 193개의 시군구에서 제정되어 있으며, 조례 시행규칙은 전체 37건이 제정된 것으로 조사되었다. 이 중 조례의 경우 목적, 조례 제정시기, 사회보험료의 종류, 사회보험료의 지원 대상, 사회보험료 지원의 금액, 사회보험료 지원의 방법과 과정, 사회보험료 지원의 시기, 사회보험료의 재원 등으로 구성되어 있고, 이러한 조문 내용에 대해 분석하였다. 그리고 이러한 내용을 통해 정책적, 법적인 측면에서 논쟁이 될 수 있는 사안은 무엇인지에 대한 논의와 함께 개선 방향을 제시하였다.

국회의원 투표 행태 분석: 지방교육자치 관련 법안을 중심으로 (An Analysis on Congressional Voting Behaviors based on the Whole Reform Bill on the Law of Local Educational Self-Governing)

  • 본 연구는 지방교육자치에 관한 법률 전부개정법률안(대안)에 대한 국회의 표결에 있어 국회의원에 영향을 미친 요인은 무엇인지 알아보는 것을 목적으로 한다. 지방교육자치에 관한 법률 전부개정법률안(대안)이 관심을 끄는 것은 교육감과 교육위원에 대한 직접 선거 및 교육위원회 시·도의회 상임위원회 전환 등을 주요 내용으로 하고 있기 때문이다. 또한 이 법안은 위원회 이름으로 발의된 법안이며 특정 정당 및 지역의 반대가 있었던 법안이 아님에도 이에 대한 수정안이 제출되었고, 국회에서 통과된 다른 법안과 달리 반대표가 상대적으로 많았기 때문이다. 이러한 이유로 의원들의 투표는 무엇에 영향을 받았는지 분석을 시도하였다. 투표행태 분석을 통해 법안의 통과에 있어 중요한 것은 교섭단체 간 합의며, 특히 국회 다수당의 선택이 매우 중요하다는 점을 알 수 있었다. 또한 분석을 통해 의정경험이 많은 의원과 비례대표 의원들은 교섭단체 간 합의된 법안에 좀 더 순응하고 있음을 알 수 있었다. 본 연구는 전자투표제 실시 이후 학자들의 관심을 끌고 있는 의원들의 투표행태를 좀 더 구체적으로 이해할 수 있는 기회를 제공했다는 점에 의미가 있다고 하겠다.
