『전경』에 나타난 입문의례에 관한 연구 (A Study on the Entrance Rituals seen in the 『Jeon-Gyeong』)

  • The Reordering of the Universe(天地公事) pursuing the Latter world(後天)'s ideal world while denying the Former world(先天) is composed of enormous rituals. The Dosu(度數) is formed through these rituals and the world is transformed according to the Dosu. The people who follow the Sangje(上帝), the subject of this universe reordering and also participate in the Reordering of the Universe are called as the followers. The follower group can be said as a ritual group in the aspect that they participate in the ritual for the Reordering of the Universe. They not only observed the rituals but also actively participated in them, so took certain roles in forming the Dosu. That is, they performed certain, given roles in developing the rituals, or actively proposed their ideas under the Sangje's leadership, and participated in the process realizing the Dosu. Therefore it can be said that they were a group initiatively participating in the process overcoming the Former world's Sangguk(相克) world, and making the latter world's ideal world. It seemed that the followers at that time might have gone through a certain entrance ritual process in order to join in such a follower group. The 『Jeon-Gyeong』 recorded the entrance rituals of a man called as Cha Gyeong Seok among tremendous followers relatively in detail. According to the 『Jeon-Gyeong』, he first had to get a unique test in the entrance process, and the test was proceeded in several stages: the wisdom test reflecting the Sangje's unusual intelligence, the patience test to endure physical, psychological pains for the great ethic, and the test to evaluate the testee's ability to give up past oneself and to follow the Sangje with a new body & mind. In the process separating himself from the past his appearance, Gyeong-Seok, the candidate to enter, faced a liminal situation, and then performed the incorporation rite. In this process, the purification rite going him out of the past relationship of benefits & grudges was performed, and he was given the regulations to comply as a member of the follower group. Through such serial processes, his entrance in the follower group was allowed. What requested to the candidate in this entrance process was the severance from one's past. For that, the candidate was needed to go out of his past life habits, to free from the relationship of benefits and grudges, and to sever him from his past faults. Such severance was the precondition for him to go out of the Former world's negative reality and to break from the Sanggeuk habits. Another thing requesting to the candidate as well as the severance from his past was to establish a new ideal. The new ideal should be matched with the ideal of the Reordering of the Universe whose main ideology was the Haewon-Sangsaeng(解冤相生). Such ideal can be said as the driving force to proceed toward the new ideal world of Latter World. And the candidate was requested to purify his mind and to participate in the Universe Fair Judgement (天地公庭). That can be said as an important condition for the new member directly to participate in the ritual of the Reordering of the Universe dramatically transforming the world. Finally, the candidate was given the regulations for his ascetic practice(修道) as well as his participation in the Reordering, and was requested to comply them. After becoming a member of this follower group, one had to practice his asceticism through the compliance with such regulations and the training of mantras(呪文) in order to accomplish the goal called as Dotong(道通). By fulfilling these requirements, the newly entered member could have the qualification to perform a certain role in the ritual of the Reordering of the Universe, and could accomplish his religious ideal.

새로운 간호윤리학 방법론;통합된 사례방법론 (An integrated Method of New Casuistry and Specified Principlism as Nursing Ethics Methodology)

  • The purpose of the study was to introduce an integrated approach of new Casuistry and specified principlism in resolving ethical problems and studying nursing ethics. In studying clinical ethics and nursing ethics, there is no systematic research method. While nurses often experience ethical dilemmas in practice, much of previous research on nursing ethics has focused merely on describing the existing problems. In addition, ethists presented theoretical analysis and critics rather than providing the specific problems solving strategies. There is a need in clinical situations for an integrated method which can provide the objective description for existing problem situations as well as specific problem solving methods. We inherit two distinct ways of discussing ethical issues. One of these frames these issues in terms of principles, rules, and other general ideas; the other focuses on the specific features of particular kinds of moral cases. In the first way general ethical rules relate to specific moral cases in a theoretical manner, with universal rules serving as "axioms" from which particular moral judgments are deduced as theorems. In the seconds, this relation is frankly practical. with general moral rules serving as "maxims", which can be fully understood only in terms of the paradigmatic cases that define their meaning and force. Theoretical arguments are structured in ways that free them from any dependence on the circumstances of their presentation and ensure them a validity of a kind that is not affected by the practical context of use. In formal arguments particular conclusions are deduced from("entailed by") the initial axioms or universal principles that are the apex of the argument. So the truth or certainty that attaches to those axioms flows downward to the specific instances to be "proved". In the language of formal logic, the axioms are major premises, the facts that specify the present instance are minor premises, and the conclusion to be "proved" is deduced (follows necessarily) from the initial presises. Practical arguments, by contrast, involve a wider range of factors than formal deductions and are read with an eye to their occasion of use. Instead of aiming at strict entailments, they draw on the outcomes of previous experience, carrying over the procedures used to resolve earlier problems and reapply them in new problmatic situations. Practical arguments depend for their power on how closely the present circumstances resemble those of the earlier precedent cases for which this particular type of argument was originally devised. So. in practical arguments, the truths and certitudes established in the precedent cases pass sideways, so as to provide "resolutions" of later problems. In the language of rational analysis, the facts of the present case define the gounds on which any resolution must be based; the general considerations that carried wight in similar situations provide warrants that help settle future cases. So the resolution of any problem holds good presumptively; its strengh depends on the similarities between the present case and the prededents; and its soundness can be challenged (or rebutted) in situations that are recognized ans exceptional. Jonsen & Toulmin (1988), and Jonsen (1991) introduce New Casuistry as a practical method. The oxford English Dictionary defines casuistry quite accurately as "that part of ethics which resolves cases of conscience, applying the general rules of religion and morality to particular instances in which circumstances alter cases or in which there appears to be a conflict of duties." They modified the casuistry of the medieval ages to use in clinical situations which is characterized by "the typology of cases and the analogy as an inference method". A case is the unit of analysis. The structure of case was made with interaction of situation and moral rules. The situation is what surrounds or stands around. The moral rule is the essence of case. The analogy can be objective because "the grounds, the warrants, the theoretical backing, the modal qualifiers" are identified in the cases. The specified principlism was the method that Degrazia (1992) integrated the principlism and the specification introduced by Richardson (1990). In this method, the principle is specified by adding information about limitations of the scope and restricting the range of the principle. This should be substantive qualifications. The integrated method is an combination of the New Casuistry and the specified principlism. For example, the study was "Ethical problems experienced by nurses in the care of terminally ill patients"(Um, 1994). A semi-structured in-depth interview was conducted for fifteen nurses who mainly took care of terminally ill patients. The first stage, twenty one cases were identified as relevant to the topic, and then were classified to four types of problems. For instance, one of these types was the patient's refusal of care. The second stage, the ethical problems in the case were defined, and then the case was analyzed. This was to analyze the reasons, the ethical values, and the related ethical principles in the cases. Then the interpretation was synthetically done by integration of the result of analysis and the situation. The third stage was the ordering phase of the cases, which was done according to the result of the interpretation and the common principles in the cases. The first two stages describe the methodology of new casuistry, and the final stage was for the methodology of the specified principlism. The common principles were the principle of autonomy and the principle of caring. The principle of autonomy was specified; when competent patients refused care, nurse should discontinue the care to respect for the patients' decision. The principle of caring was also specified; when the competent patients refused care, nurses should continue to provide the care in spite of the patients' refusal to preserve their life. These specification may lead the opposite behavior, which emphasizes the importance of nurse's will and intentions to make their decision in the clinical situations.

흰쥐 폐동맥의 내피세포의존성 혈관이완과 급성 저산소성 폐동맥수축에서 산화질소의 역할 (A Study of Endothelium-dependent Pulmonary Arterial Relaxation and the Role of Nitric oxide on Acute Hypoxic Pulmonary Vasoconstriction in Rats)

  • 연구배경: 저산소증에 의한 폐동맥수축의 기전은 저산소증 자체가 폐혈관 평활근에 직접 작용하여 수축을 유발한다는 것과, 저산소증에 의해 조직으로 부터 여러 매개물질이 유리되어 혈관평활근을 수축시킨다는 설이 제시되고 있지만 정확히 밝혀져있지 않다. 최근에는 저산소증이 EDRF의 생성을 억제하여 혈관수축을 유발시킨다고하여 관심이 되고 있다. 본 연구에서는 흰쥐 폐동맥에서 내피세포 의존형 혈관이완을 조사하고, 저산소증에 의한 폐동맥수축에 EDRF의 작용을 조사하였다. 방법 : 300~350g의 수컷 흰쥐(Sprague Dawley)의 폐동맥을 박리하여 길이가 2mm되는 폐동맥고리를 Krebs용액으로 채워져 있으며, 95% $O_2$/5% $CO_2$(산소상태)와 95% $N_2$/5% $CO_2$(저산소상태)가 각각 공급되는 magnus관에서 가는 stainless 갈고리로 고정한 다음 Gilson사의 polygraph에 부착된 isometric transducer(FT.03 Grass, Quincy, USA)에 의해 등장성 수축곡선을 그리도록 장치하였다. 결과: 1) 내피세포가 있는 폐동맥에서 PE($10^{-6}M$)에 의한 혈관수축은 Ach($10^{-9}-10^{-5}M$) 및 SN($10^{-9}-10^{-5}M$)의 농도에 비례해서 이완되어 거의 기초장력까지 이완되었으나, 내피세포를 제거한 폐동맥에서는 Ach($10^{-9}-10^{-5}M$)에 의한 혈관이완은 거의 상실되었다. 2) L-NMMA($10^{-4}M$)으로 전처치한 경우 Ach($10^{-9}-10^{-5}M$)에 의한 혈관이완은 전처치하지 않은 경우보다 의미있게 감소하였다. 3) L-arginine($10^{-4}M$)과 L-NMMA($10^{-4}M$)을 전처치 하였을 경우 Ach($10^{-9}-10^{-5}M$)에 의한 혈관이완은 L-NMMA에 의해 거의 영향을 받지 않았다. 4) PE($10^{-6}M$)에 의한 폐동맥 수축은 산소상태보다 저산소 상태에서 훨씬 강했으며, Ach($10^{-9}-10^{-5}M$)에 의한 혈관이완은 산소상태보다 저산소상태에서 의미있게 감소하였다. 5) L-arginine($10^{-4}M$)을 전처치 하였을 경우 저산소상태에서의 Ach($10^{-9}-10^{-5}M$)에 의한 혈관이완은 산소상태에서의 Ach 에 의한 혈관이완 정도로 회복되었다. 결론: 흰쥐 폐동맥에서 내피세포의존성 혈관이완은 NO가 관여하며, 저산소증에 의한 폐동맥 수축은 내피세포내의 EDRF 생성의 저하와 관련이 있을 것으로 사료된다.

  • The wall shear stress in the vicinity of end-to end anastomoses under steady flow conditions was measured using a flush-mounted hot-film anemometer(FMHFA) probe. The experimental measurements were in good agreement with numerical results except in flow with low Reynolds numbers. The wall shear stress increased proximal to the anastomosis in flow from the Penrose tubing (simulating an artery) to the PTFE: graft. In flow from the PTFE graft to the Penrose tubing, low wall shear stress was observed distal to the anastomosis. Abnormal distributions of wall shear stress in the vicinity of the anastomosis, resulting from the compliance mismatch between the graft and the host artery, might be an important factor of ANFH formation and the graft failure. The present study suggests a correlation between regions of the low wall shear stress and the development of anastomotic neointimal fibrous hyperplasia(ANPH) in end-to-end anastomoses. 30523 T00401030523 ^x Air pressure decay(APD) rate and ultrafiltration rate(UFR) tests were performed on new and saline rinsed dialyzers as well as those roused in patients several times. C-DAK 4000 (Cordis Dow) and CF IS-11 (Baxter Travenol) reused dialyzers obtained from the dialysis clinic were used in the present study. The new dialyzers exhibited a relatively flat APD, whereas saline rinsed and reused dialyzers showed considerable amount of decay. C-DAH dialyzers had a larger APD(11.70$\pm$1.32mmHg/min)compared to CF dialyzers(4.32$\pm$0.55mmHg/min)(p<0.05). However, there was no observable difference in the UFR between the two dialyzers. Neither APD nor UFR showed any significant increase with an increasing number of reuses for up to more than 20reuses. A substantial number of failures observed in APD(larger than 20mmHe/min)on the reused dialyzers(2 out of 40 CP and S out 26 C-DAK) were attributed to the Possible damage on the fibers. The CF 15-11 HFDs which failed APD test did not show changes in the UFR compared to normal dialyzers indicating that APD is a more sensitive test than UFR test to evaluate the integrity of the fibers. 30527 T00401030527 ^x For quantitative measurement of reflected light from a clinical diagnostic strip, a prototype old reflectance photometer was designed. The strip loader and cassette were made to obtain more accurate reflectance parameters. The strip was illuminated at 45˚c through optical fiber and the intensity of reflected light was determined at rectanguLat angle using a photodiode. The kubelka-munk coefficient and reflection optical density were determined ar four different wavelengths(500, 550, 570 and 610nm) for blood glucose strip. For higher concentration than 300mg/41 about glucose, a saturation state of abforbance was observed at 500, 550 and 570nm. The mice were divided into two groups. One group was injected with Photofrin II, intravenously (2.5mg/kg body weight). The other group received no Photofrin II. Mice from both groups were irradialed for approximately 15 minutes at 100, 300, or 500 mW/cm2 with the argon (488nm/514.5 nm), dye(628nm) and gold vapor (pulsed 628 nm) laser light. A photosensitizer behaved as an added absorber. Under our experimental conditions, the presence of Photolfrin II increased surface temperature by at least 40% and the temperature rise due to 300 mW/cm2 irradiation exceeded values for hyperthermia. Light and temperature distributions with depth were estimated by a computer model. The model demonstrated the influence of wavelength on the thermal process and proved to be a valuable tool to investigate internal temperature rise. 30536 T00401030536 ^x We investigated the structural geometry of thirty-eight Korean femurs. The purpose of this study is to identify major geometrical differences between Korean femurs 3nd others that we believe belong to Caucasians so that we would be able to get insights into the femoral component design that fits Asians including Koreans. We utilized computerized tomography (CT) images of femurs extracted from cadavers. The CT images were transformed into bitmap data by using a film scanner, and then analyzed by using a commercially available software called Image v.1.0 and a Macintosh IIci computer.The resulting data were compared with already published data. The major results show that the geometry of the Korean femurs is significantly different from that of Caucasians: (1) the anteversion angle and the canal flare index are greater by the amount of approximately 8˚ and 0.5, respectively, (2) the shape of the isthmus cross section is more round, and (3) the distance between the teaser trochanter and the proximal border of the isthmus is shelter by about 15 mm. The results suggested that the femoral component suitable for Asians should be different from the currently-used components designed and manufactured mostly by European or American companies. 30537 T00401030537 ^x It is well known that nonlinear propagation characteristics of the wave in the tissue may give very useful information for the medical diagnoisis. In this paper, a new method to detect nonlinear propagation characteristics of the internal vibration in the tissue for the low frequency mechanical vibration by using bispectral analysis is proposed. In the method, low frequency vibration of f0( = 100Hz) is applied on the surface of the object, and the waveform of the internal vibration x (t) is measured from Doppler frequency modulation of silmultaneously transmitted probing ultrasonic waves. Then, the bispectra of the signal x (t) at the frequencies (f0, f0) and (f0, 2f0) are calculated to estimate the nonlinear propagation characteristics as their magnitude ratio, w here since bispectrum is free from the gaussian additive noise we can get the value with high S/N. Basic experimental system is constructed by using 3.0 MHz probing ultrasonic waves and the several experiments are carried out for some phantoms. Our department has developed an information system for routine hematology using down-sized computer system. We have used an IBM 486 compatible PC with 16MB main memory, 210 MB hard disk drive, 9 RS-232C port and 24 pin dot printer. The operating system and database management system were SCO UNIX and SCO foxbase, respectively. For program development, we used Xbase language provided by SCO foxbase. The C language was used for interface purpose. To make the system use friendly, pull-down menu was used. The system connected to our hospital information system via application program interface (API), so the information related to patient and request details is automatically transmitted to our computer. Our system interfaced with fwd complete blood count analyzers(Sysmex NE-8000 and Coulter STKS) for unidirectional data tansmission from analyzer to computer. The frame and leaflet of the polymer valve were made from polyurethane, To evaluate the hemodynamic performance of the polymer valve a comparative study of flow dynamics past a polymer valve and a St. Jude Medical prosthetic valve under physiological pulsatile flow conditions in vitro was made. Comparisons between the valves were made on the transvalvular pressure drop, regurgitation volume and maximum valve opening area. The polymer valve showed smaller regurgitation volume and transvalvular pressure drop compared to the mechanical valve at higher heart rate. Because the point of maximun temperature of laser-irradiated gelatin exists below the surface due to surface cooling, evaporation at the boiling temperature is made explosively from below the surface. The important parameters of this process are the conduction loss to laser power absorption (defined as the conduction-to-laser power parameter, Nk), the convection heat transfer at the surface to conduction loss (defined as Bi), dimensionless extinction coefficient (defined as Br.), and dimensionless irradiation time (defined as Fo). Dependence of Fo on Nk and Bi has been observed by experiment, and the results have been compared with the numerical results obtained by solving a 2-dimensional conduction equation. Fo and explosion depth (from the surface to the point of maximun temperature) are increased when Nk and Bi are increased.To find out the minimum laser power for explosive evaporative removal process, steady state analysis has been also made. The limit of Nk to induce evaporative removal, which is proportional to the inverse of the laser power, has been obtained. 30622 T00401030622 ^x N1 and N2 gross neural action potentials were measured from the round window of the guinea pig cochlea at the onset of the acoustic stimuli.   • The wall shear stress in the vicinity of end-to end anastomoses under steady flow conditions was measured using a flush-mounted hot-film anemometer(FMHFA) probe. The experimental measurements were in good agreement with numerical results except in flow with low Reynolds numbers. The wall shear stress increased proximal to the anastomosis in flow from the Penrose tubing (simulating an artery) to the PTFE: graft. In flow from the PTFE graft to the Penrose tubing, low wall shear stress was observed distal to the anastomosis. Abnormal distributions of wall shear stress in the vicinity of the anastomosis, resulting from the compliance mismatch between the graft and the host artery, might be an important factor of ANFH formation and the graft failure. The present study suggests a correlation between regions of the low wall shear stress and the development of anastomotic neointimal fibrous hyperplasia(ANPH) in end-to-end anastomoses. 30523 T00401030523 ^x Air pressure decay(APD) rate and ultrafiltration rate(UFR) tests were performed on new and saline rinsed dialyzers as well as those roused in patients several times. C-DAK 4000 (Cordis Dow) and CF IS-11 (Baxter Travenol) reused dialyzers obtained from the dialysis clinic were used in the present study. The new dialyzers exhibited a relatively flat APD, whereas saline rinsed and reused dialyzers showed considerable amount of decay. C-DAH dialyzers had a larger APD(11.70${\pm}$1.32mmHg/min)compared to CF dialyzers(4.32${\pm}$0.55mmHg/min)(p<0.05). However, there was no observable difference in the UFR between the two dialyzers. Neither APD nor UFR showed any significant increase with an increasing number of reuses for up to more than 20reuses. A substantial number of failures observed in APD(larger than 20mmHe/min)on the reused dialyzers(2 out of 40 CP and S out 26 C-DAK) were attributed to the Possible damage on the fibers. The purpose of this study is to identify major geometrical differences between Korean femurs 3nd others that we believe belong to Caucasians so that we would be able to get insights into the femoral component design that fits Asians including Koreans. We utilized computerized tomography (CT) images of femurs extracted from cadavers. The CT images were transformed into bitmap data by using a film scanner, and then analyzed by using a commercially available software called Image v.1.0 and a Macintosh IIci computer.The resulting data were compared with already published data. The major results show that the geometry of the Korean femurs is significantly different from that of Caucasians: (1) the anteversion angle and the canal flare index are greater by the amount of approximately 8˚ and 0.5, respectively, (2) the shape of the isthmus cross section is more round, and (3) the distance between the teaser trochanter and the proximal border of the isthmus is shelter by about 15 mm. Then, the bispectra of the signal x (t) at the frequencies (f0, f0) and (f0, 2f0) are calculated to estimate the nonlinear propagation characteristics as their magnitude ratio, w here since bispectrum is free from the gaussian additive noise we can get the value with high S/N. Dependence of Fo on Nk and Bi has been observed by experiment, and the results have been compared with the numerical results obtained by solving a 2-dimensional conduction equation. The main unit includes a 12.1" TFT color LCD, a main CPU board, and peripherals such as a module controller, Ethernet LAN card, video card, rotate/push button controller, etc. The main unit can connect at maximum three module cases each of which can accommodate up to 7 parameter modules. They include the modules for electrocardiograph, respiration, invasive blood pressure, noninvasive blood pressure, temperature, and SpO2 with Plethysmograph.

제사과정 전후에서의 견사세리신의 물리화학적 성질변화에 관한 연구 (Studies on the Physical and Chemical Denatures of Cocoon Bave Sericin throughout Silk Filature Processes)

  • 본 연구는 fibroin을 피복하여 견섬유의 경막적 성질을 지배하는 sericin에 대한 일연의 연구를 수행하여 다음과 같은 결론을 얻었다. I. Sericin Fraction의 물리화학적 특성에 관한 실험 1) 난용성 sericin은 역용성 sericin에 비하여 polar side chain을 가진 amino산(Tyr, Ser)은 적은 반면 alanine과 leucine 등의 수화성이 적은 amino산이 측정되었다. 2) 수화성의 amine산은 견사의 외층부에서, 그리고 수화성이 적은 amino산은 fibroin에 가까운 부위에 많이 존재하였다. 3) 용수에 대한 sericin의 팽윤, 용해성은 alnino산 조성만으로 해석하기는 곤란하며 sericin의 결정구조나 이차구조와의 복합구조로 변화한다고 생각된다. 4) 견사의 간섭은 환상에 가까우나 정연처리로서 소멸하였다. 5) 작잠견 sericin은 가잠견 sericin과 차이가 있었는데 자오선상에 강한 환상 Ring이 많았다. 6) Mosher 법으로 분별한 A와 B fraction 사이의 amino산 조성에는 차이가 없었다. 7) Sericin I, II, III의 X-선도에 있어서는 큰 차이는 인정되지 않으나 측쇄간격에 해당 하는 Ring에서 차이가 인정되었다. 8) 분자량 150이상의 amino산(Cys, Tyr, Phe, His,Arg)은 6N-HCl, 60분의 가수분해로서 정양되지 않았다. 9) 4.6$\AA$의 X-선 간섭은 습열과 ether 및 alcohol로 처리하므로서 소멸하는 경향이었다. 10) sericin의 가수분해물(6N-HCl)은 자오선상에 간섭 Ring(2$\AA$)을 출현시켰다. 11) 가수분해 sericin 잔사는 어느 특정한 amino산의 peptide로 추정된다. 12) Seriein III의 분해온도는 Sericin I과 II보다 높았다. 13) 견층 부위별 sericin의 D.T.A 곡선에 었어서, 내층의 sercin은 15$0^{\circ}C$와 245$^{\circ}C$에서 흡열 peak가 나타나고 외, 중층의 것보다 고온측에 이동하였다. 14) IR-spectrum에 의한 sericin fraction(Sericin I, II, III, 외층, 중층 및 내층의 sercin)의 적외선흡수 결과는 일치하였다. II. 제사공정에서의 Sericin의 팽윤, 용해특성에 관한 실험 1) 3,000 R.P.M으로 침지처리된 견층의 자유성수분은 15분간으로 탈수가 가능하고 이 경우의 원심력은 13$\times$$10^4$dyne/g 이었다. 2) sericin에 대한 Folin시약의 발색에 필요한 시간은 실온에서 30분이었다. 3) 가시광선중 측정가능파장은 500~750m$\mu$이다. 4) 실제 비색정량의 경우 정도가 높은 측정치를 얻기 위해서는, 저농도(10$\mu\textrm{g}$/$m\ell$)인 때는 650m$\mu$에서 그 이상의 농도에서늘 500m$\mu$으로 측정해야 했다. 5) sericin과 egg albumin의 파장별 흡광도곡선형은 일치하나 흡광도는 sericin이 높았다. 6) 비색분석법에 의하여 측정된 sericin의 량은 Kjeldahl 법에 비해 적은 값을 나타냈다. 7) 견층의 팽윤, 용해도에 영향하는 처리조건으로서는 온도와 시간으로서 시간보다도 온도의 방과가 켰다. 8) 팽윤, 용해도를 촉진하는 처리온도와 시간과의 관계는 저온(7$0^{\circ}C$)에서는 시간의 증가에 따라서 팽윤, 용해도는 서서히 증대하나 고온에 있어서는 단시간의 처리로 현저히 증대했다. 9) 생견의 건조온도가 높아지면 견층의 팽윤, 용해도는 반대로 감소했다. 10) 견층의 두께가 크게 되면 일정시간에 있어서의 팽윤, 용해성은 저하하였다. 11) 견층부위별 팽윤, 용해성은 외>중>내층의 순이고 품종에 따라서는 견층부위별로 차이가 있었다. 12) 견층의 납물질제거처리를 하게 되면 sericin의 팽윤, 용해성은 대조구에 비해 감소하였다. 13) 음 ion 활성제는(pH 6.0 부근) sericin의 팽윤, 용해도를 촉진시켰다. 14) 양 ion 활성제는 위와 같은 조건에서 sericin 의 흡착현상을 나타내었다. 15) 경도성분(Ca, Mg)의 농도가 증가하면, 용수의 pH는 발성방향으로 이동하였다. 16) 용수중의 경도성분과 sericin과는 서로 완충작용을 나타내었다. 17) Ca와 Mg의 경도성분이 sericin의 팽윤, 용해에 미치는 영향을 비교하면 Ca 성분이 팽윤, 용해를 억제하였 다. 18) 용수중의 경도성분의 용존은 전기전도도를 증가시켰다.

우주조약의 국제법적 의미에 관한 연구 (A Study on the Meaning of Outer Space Treaty in International Law)

  • 필자는 우주조약의 국제법적 의미에 관하여 첫째, 우주활동의 법원칙선언조항, 둘째, 세부조약으로 발전한 조항 그리고 마지막으로 우주조약의 보완사항에 관한 최근 동향으로 분류하여 설명하였다. 1963년 12월 13일 UN총회의 '우주법선언'을 반영한 우주조약은 그 세부조약으로 1968년 구조협정, 1972년 책임협약, 1975년 등록협약을 제정하였다. 2013년 5월 기준으로 102개국이 가입하고 27개국이 서명한 우주조약은 그야말로 우주법의 '마그나 카르타'(Magna Carta) 내지는 우주의 헌법이라고 불릴 정도로 우주법의 가장 기본이 되는 원칙을 담고 있고, 특히 달과 다른 천체를 포함한 우주를 비전유원칙인 '국제공역'(res extra commercium)으로 선언함으로서 우주에 대한 영유권 문제를 종식시켰다는 점에서 큰 의미를 찾을 수 있다. 우주조약이 제정된지 반세기가 되어가는 시점에서 우주조약에서 규정하고 있는 조항 중 우주활동은 모든 국가들의 이익을 위한다는 원칙(제1조), 외기권 우주의 자유로운 탐사와 이용(제1조), 전유화금지(제2조)와 타국의 권리존중(제9조)은 조약법은 물론 모든 국가들을 구속하는 국제관습법과 '강행규범'(jus cogens)으로까지 발전된 조항이라고 할 수 있다. 특히 우주조약은 투명성과 개방성을 규범적으로 요구하고 있다. 이것은 우주활동이 '전세계적 공공 이익'(global public interest)과 관련되어 있음을 시사하고 있다. 이러한 우주에서의 '전세계적 공공이익'에 대한 원리는 국제공동체에게 '대세적 의무'(obligation erga omnes)를 부과하고 있는데, 우주를 모든 인류의 영역이라고 선언한 점, 우주에서의 협력의 의무, 우주비행사를 인류의 사절이라고 한 점, 우주활동에서 해로운 오염을 피하라고 한 점, 우주활동을 국가, 사적 실체 그리고 정부간 조직체(IGOs)로 제한한 점, 우주활동으로 인한 손해배상에 대한 절대책임원칙, 우주에서의 핵무기 및 대량파괴무기 배치 금지, 우주활동의 공개성과 투명성 그리고 국제우주제도의 보편적 적용 등이 이를 뒷받침 해주고 있다. 현재 우주조약의 해석을 두고 많은 논란이 있는 조항들이 있고 제정당시 예상 못했던 우주기술의 발달과 상업화로 인해 보충해야 할 주제도 많이 생겨나서 현재 COPUOS 내에서 1979년 달조약을 포함한 현행 우주관련 5개 조약의 지위검토를 법률소위원회에 의제로 포함시킬 것을 제의하여 1998년 제37차 법률소위원회부터 정식으로 승인받아 현재까지 논의되고 있다. 그러나 필자는 '우주법선언'의 내용들이 이미 국제관습법으로 굳어 졌으며, 이를 거의 반영한 우주조약의 상당부분 조항들이 이제는 국제관습법화 되었고, 심지어는 강행규범(jus cogens)이 된 조항들도 있다는 면에서 우주조약의 성과는 국제법상 매우 큰 의미를 지녔다고 평가하고 싶다. 앞으로 우주조약 이외에 우주관련세부조약들로도 해결하지 못하는 분야들은 COPUOS나 UN을 통하여 보완적인 결의와 선언들로 계속 반영되어야 할 것이며 만일 별도의 조약제정이 불가능하다면 적당한 시기에 우주조약을 포함하여 세부조약의 개정을 통하여 또는 추가의정서를 만들어 보완하면 좋을 것이라고 생각한다. 우주조약은 그 개념들의 모호성 때문에 수많은 학자들로부터 비난을 받아왔지만 그럼에도 불구하고 계속 존속해 왔다는 사실을 간과해서는 안 될 것이다. 현재 우주폐기물과 관련하여 "IADC 우주폐기물 경감 가이드라인", COPUOS의 "우주폐기물감축 가이드라인", 세계국제법협회(ILA)의 "우주폐기물로 인한 피해로부터 환경을 보호하기 위한 국제협약 초안" 등이 우주조약을 보완하고 있고, 분쟁해결에 관하여 세계국제법협회(ILA)가 1998년 타이페이(Taipei) 회의에서 채택한 "우주법분쟁해결에 관한 협약안"을 제시한 바 있고, 2011년 중재재판소(PCA)가 "우주활동관련 분쟁의 중재재판에 관한 선택규칙"을 제정하고, 2012년 우주활동관련 분쟁의 중재재판관을 새롭게 임명하였다는 점은 우주법이 계속 발전되어 가고 있다는 모습을 보여주고 있다. 한편 UNIDROIT(국제사법통일기구)에서는 우주자산의 구입 및 조달에 필요한 담보금 거래시 국제적으로 통일된 담보거래 규칙을 위한 "이동장비국제담보권협약에 대한 우주자산의정서"는 우주조약이 해결하지 못하고 있는 분야는 별도의 조약체결을 통하여도 보완되고 있다는 가능성을 보여주고 있는 것이다.
