외식 프랜차이지의 가맹 계약 법률 인식에 관한 연구 (Franchisee's Cognition on Franchise-contract in Foodservice Industry)

  • This study researched unequal trades and analyzed the difference of legal relation control between the franchisor and the franchisee in foodservice industry. The purpose of this study was the preparatory process for basic data to establish a statute law for the franchisee in foodservice industry. We made up a questionnaire for 53 franchisees in March 2004 and analysed spss 10.0. This result was as follows. First, the special office was needed for publicity activities of law related franchise and the investigation of a right in the written contract for a franchisee. Second, there should be the conformation and objective criteria of monopolistic goodwill in legal proceedings. Third, the larger the scale of franchisees was, the less efficiently the conflicts between franchisors and franchisees were controlled.

프랜차이즈 모기업 핵심역량 자원이 가맹점 관계결속과 재계약의도에 미치는 영향 (Effects of Core Competence and Resource Sharing on the Relational Bond among Franchisees and on Re-contract Intention in the Franchising Parent Companies)

  • Purpose - The domestic franchise industry has made significant contributions to industry such as investment, employment, and community economy development, facilitating growth potential. The franchise industry provides management knowhow transfer between parent companies and franchisees as per contracts addressing use of business signs, franchisees' independent position, franchisor support, and royalties to be paid to the franchisors. However, many franchisors lack management knowhow and provide insufficient support because of poor control of franchisees and not having a systematic approach to support. This results in dissatisfied franchisees and failure to establish long-term relationships. Few studies have examined relational commitment and/or re-contract intention by support resources between franchisors and franchisees, despite a considerable output of theories and studies of the growth of the franchise industry. The purpose of this study, therefore, was to examine the effects of the ability to provide resources on relational commitments and re-contract intention, and to suggest causal relationships and implications. Research design, data, and methodology - The subject was domestic franchisors registered with the Association of Franchise with more than 50 franchisees. Franchisees under contract for 2 years and considering re-contract of their franchise 2 years later were used. The subjects totaled 300 franchisees in Seoul. A questionnaire survey was used to investigate the subject of franchisees' concessions during the 10 days from November 21, 2013 to November 30, 2013. After excluding 16 surveys with poor answers, 284 responses were finally used. Four areas and 44 questions were used. A nominal scale was used for four common characteristics questions including gender, ages, educational background, and franchise managing time. Questions regarding ability, relational commitment, and re-contract intention made use of a Likert 5-point scale. Data coding and data cleaning were used. SPSS 18.0 was used as follows. First, frequency analysis was done to investigate demographic characteristics. Second, exploratory factor analysis was done to verify validity of testing tools, and Cronbach's α coefficient was used to verify reliability. Third, correlation analysis and multiple regression analysis were done. An exploratory factor analysis was done to verify validity of concepts. A correlation analysis was done to test relationships between the variables, and multiple regression analysis was done to verify franchisor's ability, franchisees' relational commitment, and re-contract intention. Results - The following were the outcomes. First, store operation management, finance operation management, and human resource management affected the calculated bond. Second, store operation management and finance operation management affected the emotional bond. Third, store operation management, finance operation management, human resource management, and marketing management affected the prescriptive bond. Fourth, calculated bond and prescriptive bond had an effect on re-contract intention. Conclusions - As stated above, in franchise management, parent companies' offer and instruction of core competence to their franchisees as an information resource could improve the relational bond by helping them grow together through the resource sharing. Consequently, core competence factors were promoting factors that could improve franchisees' re-contract intention for a long time.

프랜차이즈 기업의 전사적 계약관리 (ECM) 모델 도입을 위한 IT 프로그램 개발에 관한 연구 (A Study on the Development of IT Program for the Introduction of Enterprise Contract Management Model by Franchise Enterprise)

  • 본 연구는 프랜차이즈 산업에 있어 가맹본부의 효율적인 가맹점 관리 시스템 도입을 위한 새로운 실무적 관점의 연구이다. 프랜차이즈 가맹본부와 가맹점사업자 간의 계약에 의해 관계가 형성되고 이후 지속적으로 계약에 의해 규정받게 된다. 따라서 가맹본부는 다수의 가맹점사업자를 효과적으로 통제하고 관리하기 위해서 계약의 체계적인 관리가 필요하고, 외부적으로는 정부의 규제정책에 합법적이고 능동적으로 대처할 필요가 있다. 이를 위하여 프랜차이즈 기업의 "전사적 계약관리(ECM : Enetrprise Contract Management)"라는 개념을 정립하여 가맹점 관리의 시스템화를 촉진시키고자 하였다. 이를 실무적 차원에서 효과적으로 도입하기 위하여 프랜차이즈 전문 IT프로그램인 ECM 기반의 "프랜차이즈 계약관리·슈퍼바이징 시스템(Franchise Contract Management·Supervising System) - TruFCM"을 개발하였다. 이 프로그램을 통해 프랜차이즈 기업의 지속가능경영의 실현과 프랜차이즈 산업의 질적인 발전에 기여하고 하는 데 본 연구의 의의가 있다 하겠다.

LDA 알고리즘을 이용한 프랜차이즈 연구 동향에 대한 토픽모델링 분석 (Topic Modeling Analysis of Franchise Research Trends Using LDA Algorithm)

  • Purpose: This study aimed to derive clues for the franchise industry to overcome difficulties such as various legal regulations and social responsibility demands and to continuously develop by analyzing the research trends related to franchises published in Korea. Research design, data and methodology: As a result of searching for 'franchise' in ScienceON, abstracts were collected from papers published in domestic academic journals from 1994 to June 2021. Keywords were extracted from the abstracts of 1,110 valid papers, and after preprocessing, keyword analysis, TF-IDF analysis, and topic modeling using LDA algorithm, along with trend analysis of the top 20 words in TF-IDF by year group was carried out using the R-package. Results: As a result of keyword analysis, it was found that businesses and brands were the subjects of research related to franchises, and interest in service and satisfaction was considerable, and food and coffee were prominently studied as industries. As a result of TF-IDF calculation, it was found that brand, satisfaction, franchisor, and coffee were ranked at the top. As a result of LDA-based topic modeling, a total of 12 topics including "growth strategy" were derived and visualized with LDAvis. On the other hand, the areas of Topic 1 (growth strategy) and Topic 9 (organizational culture), Topic 4 (consumption experience) and Topic 6 (contribution and loyalty), Topic 7 (brand image) and Topic 10 (commercial area) overlap significantly. Finally, the trend analysis results for the top 20 keywords with high TF-IDF showed that 10 keywords such as quality, brand, food, and trust would be more utilized overall. Conclusions: Through the results of this study, the direction of interest in the franchise industry was confirmed, and it was found that it was necessary to find a clue for continuous growth through research in more diverse fields. And it was also considered an important finding to suggest a technique that can supplement the problems of topic trend analysis. Therefore, the results of this study show that researchers will gain significant insights from the perspectives related to the selection of research topics, and practitioners from the perspectives related to future franchise changes.

머신러닝 기반 외식업 프랜차이즈 가맹점 성패 예측 (Prediction of Food Franchise Success and Failure Based on Machine Learning)

  • 외식업은 소비자의 수요가 많고 진입장벽이 낮아 창업이 활발하게 일어난다. 하지만 외식업은 폐업률이 높고, 프랜차이즈의 경우 동일 브랜드 내에서도 매출 편차가 크게 나타난다. 따라서 외식업 프랜차이즈의 폐업을 방지하기 위한 연구가 필요하다. 이를 위해, 본 연구에서는 프랜차이즈 가맹점 매출에 영향을 미치는 요인들을 살펴보고, 도출된 요인들에 머신러닝 기법을 활용하여 프랜차이즈의 성패를 예측하고자 한다. 강남구 프랜차이즈 매장의 PoS(Point of Sale) 데이터와 공공데이터를 활용하여 가맹점 매출에 영향을 미치는 여러 요인들을 추출하고, VIF(Variance Inflation Factor)를 활용하여 다중공산성을 제거하여 타당성 있는 변수 선택을 진행한 뒤, 머신러닝 기법 중 분류모델을 활용하여 프랜차이즈 매장의 성패 예측을 진행한다. 이를 통해 최고 정확도 0.92를 가진 프랜차이즈 성패 예측 모델을 제안한다.

영국 프랜차이즈 사업 환경과 진출 전략에 관한 연구 (A Study on the Franchise Business Environment and its Strategy in United Kingdom)

  • 프랜차이즈 시스템은 제2차 세계대전 이후 유통경로의 중요한 한 분야로서 미국을 시작으로 급속한 성장세를 보여 왔다. 미국과 일본을 거쳐 국내에는 1979년에 도입되어 비약적인 성장과 발전을 이루었다. 현재 한국의 프랜차이즈 시스템은 미국적 계약문화에 의한 지적재산권으로 정착되기 보다는 한국문화에 맞는 사업경쟁력 강화시스템으로 변형, 발전 되었는데 한국의 프랜차이즈 시스템은 가맹본부가 가맹점으로부터 로열티를 받는 대신 대량구매와 공동물류, 마케팅을 활용한 경쟁력을 높여 이에 따른 이익을 발생시키는 독특한 시스템으로 정착되었다. 이러한 한국적 프랜차이즈 시스템의 국내 성공에 힘입어 최근 국내의 많은 프랜차이즈 업체들이 한국적 프랜차이즈 시스템에 의한 국제경쟁력을 갖추고 해외 진출을 본격적으로 전개하고 있다. 이런 한국의 프랜차이즈 기업의 해외진출은 한국 내에서 지역을 넓혀가는 것에 비해 훨씬 많은 시간과 조사, 노력, 자금이 필요하고 이에 따르는 위험도도 높다. 즉 진출하고자 하는 국가의 문화, 관습, 생활수준 및 관련 법규에 대하여 충분한 조사를 행한 후에야 진출 여부에 대한 의사 결정을 내릴 수가 있다. 최근 카페베네가 미국 뉴욕 맨해튼에 진출하고 번 전문업체도 미국 현지에서 성공적으로 안착하는 등 국내 토종 프랜차이즈 기업들도 해외 진출을 통하여 사업을 확대하고 있는 추세다. 그러나 영국시장에서 우리나라 프랜차이즈 진출은 전무한 상태다. 영국의 경우는 개인 서비스 영역의 프랜차이즈의 성장세가 높아지고 있고 웰빙 열풍으로 동양의 식음료에 대한 정보도 유입되고 있는 상황이다. 또한 유럽국가 중에서도 인터넷 보급률이 높으며 2012년 런던올림픽 이후 IT 산업 육성 등 홍보나 마케팅 정보의 유입이 예전에 비해 좀 더 쉽게 다가갈 수 있게 되었다. 이러한 상황에서 영국 시장에 프랜차이즈 진출을 위하여 사업 환경은 어떠한지 어떠한 업종으로 진출할 것인지의 전략수립을 통하여 세밀하게 성공 요인을 분석하고 벤치마킹함으로써 한국의 프랜차이즈 기업이 영국 시장 진출에 큰 시사점을 얻을 수 있는데 그 목적이 있다.

가맹사업거래 계약과 분쟁해결 (Franchise Transaction Contracts and Resolution of the Related Disputes)

  • Recently in Korea, franchise system has been specially used in the distribution industry. However, it also brought up many problems caused by various issues between franchisor and franchisee. The purpose of this article is to review recent trend of the franchise transaction contracts and resolution of the disputes in Korea. And to expand to use of ADR(Alternative Dispute Resolution) system as a practical dispute settlement procedure including mediation and arbitration. Arbitration means a procedure to settle any dispute in private laws, not by the adjudication of a court, but by the award of an arbitrator or arbitrators, as agreed by the parties. Arbitration agreement is a prerequisite for either party to a dispute to commence arbitral proceeding and may be in the form of a separate agreement or in the form of an arbitration clause in a contract and shall be in writing.

캐주얼웨어 대리점의 경영성과에 영향을 미치는 요인 (Factors Affecting Performance of Casual Wear Franchise Stores)

  • The main purpose of this study was to investigate factors affecting performance of casual wear franchise stores including franchiser support and social network between owners/managers. The study included the franchise stores of 55 casual wear brands located in Seoul, Incheon and Gyeonggi-do. In each store, one manager, owner or staff member with management responsibility was asked to fill out a questionnaire. A total of 184 questionnaires were collected with 165 used in the final analysis. The results showed that franchiser support consisted of educational support, marketing support and customer support. Path analysis indicated that only the educational support had a significant influence on the franchiser-franchise relationship, and in turn, the franchiser-franchise relationship positively influenced customer performance. Marketing support did not have a significant influence on the franchiser-franchise relationship, but did demonstrate a direct influence on customer performance. Social networks positively influenced customer performance, and there was significant a correlation between regions and social networks on customer performance. Sales performance was significantly influenced by customer performance.

프랜차이즈 외식업체 종사자의 감정노동과 조직몰입 관계에서 사회적지지의 매개효과 분석 (The Mediating Effects of Social Support on the Relation between Emotional Labor and Organizational Commitment of Franchise Food Service Industry Employees)

  • 본 연구는 프랜차이즈 외식업체 종사자를 대상으로 감정노동, 사회적지지, 조직몰입 간의 관계를 분석하고 감정노동과 조직몰입 관계에서 동료 및 상사의 사회적지지의 매개효과를 분석하는데 목적을 둔 실증적 조사연구이다. 본 연구의 목적과 문제를 해결하기 위해 서울 지역 J구에 소재한 패스트푸드, 치킨, 커피 등의 프랜차이즈 외식업체에 종사하고 있는 268명의 종사자들을 연구 대상으로 선정하여 설문조사를 수행하였다. 수집된 설문 자료는 SPSS 프로그램을 이용하여 빈도분석과 기술통계, 신뢰도 분석, 상관관계 및 다중회귀분석을 실시하였다. 분석을 통해 나타난 본 연구의 결론을 제시하면 다음과 같다. 첫째, 감정노동의 표면행위는 조직몰입에 부정적인 영향을 미치고, 감정노동의 내면행위는 조직몰입에 긍정적인 영향을 미치는 것으로 나타났고, 동료 및 상사의 사회적지지는 조직몰입에 긍정적인 영향을 미치는 것으로 나타났다. 둘째, 감정노동과 조직몰입 관계에서 동료 및 상사의 사회적지지는 부분매개효과가 있는 것으로 나타났다. 외식업체 프랜차이즈 종사자의 조직몰입 증진을 위해 종사자의 감정노동과 동료 및 상사의 사회적지지는 중요한 역할을 하고 있어 종사자의 내면적 및 표면적 감정행위를 조절하고 동료 및 상사의 사회 심리적 지원 체계를 구축해야 함을 시사하고 있다.

외식 기업의 CSR 활동이 고객충성도에 미치는 영향 : 한식 뷔페 프랜차이즈 기업 중심으로 (The Effect of Corporate Social Responsibility Activities on Consumer Loyalty in the Foodservice Industry: Focusing on Korean-Style Buffet Franchise)

  • Purpose - This study examined the effect of perceived corporate social responsibility (CSR) on cognitive trust, emotional trust, and loyalty among using Korean food buffet franchises. The result of this study is expected to provide practical implication to industry practitioners in expanding their understanding of the CSR effect in the marketing perspective. Research design, data, and methodology - The data was collected from a panel of online research companies who are over 20 years old and dined in at Korean style buffet franchise outlets more than five times. A total of 370 samples were used after eliminating outliers and missing data. the data were analyzed SEM with SPSS and AMOS. Result - The result of this study showed that: 1) social CSR activities have an effect only on emotional trust; 2) food-related CSR activities influence both cognitive trust and emotional trust; and 3) both cognitive trust and emotional trust have a significant impact on customer loyalty in Korean style buffet franchises. However, it is important to note that this study found no significant causal impact from environmental CSR activities. Furthermore, this study found that food-related CSR activities have the greater influence on the cognitive trust, and cognitive trust is more influential on the customer loyalty than the emotional trust. Conclusions - Based on the findings, this study provides practical implications to industry practitioners. First, that CSR has a significant impact on customer trust suggests that Korean style buffet franchises should focus on CSR activities to improve customer trust. Second, that food-related CSR activities have the greater influence on the cognitive trust implies that industry practitioners should reinforce food-related CSR activities as a marketing tool to enhance emotional trust and the overall credibility of their franchise. Third, we need to find CSR measures at the social level that can secure emotional trust so that customer loyalty can be formed. Fourth, Korean food buffet franchise food service companies should concentrate their efforts on CSR activities at food and social level among the three dimensions suggested by researchers in order to form customer loyalty. For next study, perceived concept of CSR on individual customer should be examined.
