A Study on the Advancement of the Legal System for Small Fishing Vessels to Ensure Marine Safety (해양안전 확보를 위한 소형어선 법제도 개선에 관한 연구)

  • The Government of the Republic of Korea has been continuously improving its legal system to ensure marine safety as a precaution against marine accidents. However, despite the ongoing improvement of the legal system, the number of maritime accidents has been increasing steadily, suggesting that the efficacy of the legal system is insufficient. As for recent marine accidents, small fishing vessels (less than 10 tons) account for 44.9 % of marine accidents over 5 years ('13_'17). Therefore, this study investigated the improvement status of the Korean government's legal system for small fishing vessels and the characteristics of related overseas legal systems in order to find a way to further improve marine safety for small fishing vessels. Following the results, the Korean government's laws related to small fishing vessels show a hybrid phenomenon due to the history of merging ('97) and separation ('09) of legal systems for fishing and non-fishing vessels, and it has been concluded that only improvements to construct additional facilities are being performed, and those in a fragmentary manner. In addition, overseas legal systems for small fishing vessels were confirmed to have requirements strengthening the responsibility of owners and operators of fishing vessels and introduced a self-inspection program. Based on these results, a plan is suggested to improve the efficacy of the legal system to ensuree marine safety for small Korean fishing vessels.

A Study for Stability Criteria of Small Fishing Vessel (소형어선 복원성 판정 기준에 관한 연구)

  • The majority of fishing vessels(under 20 tonnages) in Korea have a high casualty accident of the flood and capsizing occurred by lack of stability. Actually, it is so difficult to make out the data of inclining and stability tests of small fishing vessels after building, because most of them were built on experiences of manufacturer. According to above reasons, the aim of this study is an attempt to propose a stability criteria of small fishing vessels as follows: Firstly, it is examined that the stability is driven from a transverse metacenter height of actual ships, which is able to obtain a basic drawing and stability data. Secondly, it is examined the heeling at high-speed turning, and the period of rolling according to B/D(breadth/depth). Finally, it is suggested the stability criteria by using a dynamic state which is applied in passenger boat and fishing vessels over 24 meters.

  • The use of Japanese stylish terms in the Korean fishing vessels has been overdoing. It becomes a reason of preventing the communications between crews who have been working for many years and the beginners who newly work for the ships. Also the experienced crews cannot easily understand the contents of the texts and manuals for marine ship's machinery because the terms explained in the books are very different from those they always speak in the ships. It is reasonable to expel Japanese stylish terms from the vessel if possible to enable free communications to each other. I inspected and examined about 122 Japanese stylish terms that is spoken in the engineering part of the fishing vessels. So, I expect this paper is a basic research for the eradication of the Japanese stylish terms in the Korean fishing vessels.

  • As far as fishing vessels are concerned, there are two aspects to be noted: One is the stability which is the greatest concern for the safety of fishing vessels, as the corresponding number of casualty is overwhelming compared with those of other types of vessels. To flake it worse, the feature of casualty is rather catastrophic, accompanying major fatalities. The other aspect is related to the needs of improvement of resistance performance along with the hull form development. In particular, small fishing vessels, such as under 24m in length, which is dominant size in the type, need further scrutiny to enhance the qualities mentioned above, as relevant standards/criteria on the issues are not shown clearly and, therefore, implemented for the design or assessment.

  • The injury accidents in fishing vessels account for $67.2\%$ of all marine injury casualties$(1997\~2001)$ and is on an increasing trend every year. Also, it is remarkable for the injury accidents to be basically caused by human errors. This study aims to investigate the human error of injury accidents in fishing vessels and presents the injury preventing program in them. Human errors were analysed by the methods such as SHELL & Reason Hybrid Model, GEMS Model adopted by International Maritime Organization(IMO). Based on the analysis, the following propositions were made to reduce the fishing vessels accidents by human errors : improvement of hazard awareness and quality of personnel, establishment of safety management system, and enforcement of vessels inspection.

A Study on the Correlation between Effective Impact Speed and the Severity of Collision Accidents with Fishing Vessels (유효충돌속도에 따른 어선 충돌사고 피해 상관성에 관한 연구)

  • In maritime accidents, collisions involving fishing vessels are more frequent and severe than those involving other types of vessels. Previous cases of collision accidents caused by fishing vessels causing serious damage implied that fishing vessels maintained high speeds until just before the collision and that they collided with much larger vessels. This study investigated the correlation between the severity of ship damage resulting from fishing vessel collisions and the vessel's speed. The effective impact speed commonly used in the road transport sector was utilized to analyze ship collision accidents. The study collected collision data between fishing vessels and between fishing vessels and non-fishing vessels from accident investigation reports from 2016 to 2022. The effective impact speed was calculated for a total of 617 vessels. After using binary and multinomial logistic regression methodology, the analysis was carried out with effective impact speed as the independent variable and severity of accident as the dependent variable. The analysis revealed a statistically significant correlation between the effective impact speed and the severity of ship damage, indicating that the severity of ship damage is influenced not only by the effective impact speed but also by the tonnage of the vessel.

  • Engaged in trawling in limited fishing grounds with a number of fish schools could cause collisions between fishing vessels. Therefore, providing accurate maneuver information according to the situation could be regarded as essential for improving seafarers safety and fishing efficiency as well as safety of navigation. It is difficult to obtain all maneuver information through sea trial tests only, so a method through empirical formula is necessary. Since most empirical formulas are developed for merchant ship types, especially the characteristics of hull shape parameter like CbB/L and dCb/B etc. are clearly different between fishing vessels and merchant ships, this could occur estimation errors. Therefore, in this study, the authors have selected target fishing vessels and merchant ships and analyzed the characteristics of hull shape parameter according to the ship types. Based on this analysis, the empirical formula developed for the merchant ship type has applied to the target fishing vessels; it has verified through the turning motion simulation that the estimation error could be generated. In conclusion, it is necessary to include the characteristics of the hull shape parameter of fishing vessels in the empirical formula in order to apply the empirical formula has developed for merchant ship types to fishing vessel types.

A Study on the Lights and Shapes for the Small Fishing Vessel and the Vessels Towing and Being Towed (소형어선 및 예인선단의 등화 및 형상물에 관한 고찰)

  • This study aims at reviewing first the cases of marine accidents of small fishing vessels and vessels towing and being towed and, the problems concerning such lights and shapes that could be misunderstood for those in concerned Rules, or that could impair their distinctive characteristics or obstruct to keep a proper look-out. And then I wish to make a suggestion of the necessity of amending the National Laws which stipulate the rules for the ship's lights and shapes as follows; Firstly, by amending the "Standard of Construction and Equipment for the Less Than 10 Gross Tonnage of Small Fishing Vessels" small fishing vessel must be equipped with the lights and shapes that are the same as those of "vessel engaged in fishing" prescribed by Rule 26 of the "COLREG 1972" and Rule 84 of the "Maritime Safety Law Act". Secondly, "Standard of Fishing Vessels Equipment" which stipulate the rules concerning the exception of the running lights and radar reflector for the small fishing vessels must be amended to meet the requirement of Rule 20 of the "Maritime Safety Act". Thirdly, the definition of "Length of the tow" which prescribed by Rule 2 of the "Maritime Safety Act" must be amended to meet the Rule 24 of the "COLREG 1972". And also I wish to adhere to the importance of displaying the adequate vessel lights and shapes by every mariner for preventing marine accidents.

A Study on the Measurement of Fishing Capacity and the Determination of Its Reduction Levels (어획능력(Fishing Capacity)의 측정과 감축수준 결정에 관한 연구 -기선권현망어업을 중심으로-)

  • This study was aimed at measuring the fishing capacity of Powered Anchovy Drag Net Fisheries (PADNF) in Korea using Peak-to-Peak(PTP) and Data Envelopment Analysis(DEA) methods recommended by FAO. In the analysis, both fishing capacities of total PADNF and individual PADNF vessels were measured with time series data and cross sectional data, respectively. In addition, the results of the DEA measurement were analyzed in order to determine reduction levels of fishing capacity. In case of total PADNF, the results by rn and DEA methods showed a similar rate of capacity utilization (79%), indicating the capacity was not utilized enough. In addition, the sensitivity analysis suggested that the number of vessels should be reduced by 20%, and the gross tonnage and the horse power should be reduced by 20% and 21%, respectively if the current catch is to stay at the 2004 level. The DEA results on individual PADNF vessels indicated the capacity utilization was 75% on average, showing some differences in capacity utilization among vessels (31%-100%). The results of the study would be useful for measuring production efficiency in PADNF. They would also provide good policy information for efficient use of resources and capacity reduction levels, which are useful far vessel buyback programs of coastal and offshore fisheries.

Risk assessment for fisher's safety in coastal composite fishing vessels (연안복합 어선원의 안전 위험도 평가)

  • The coastal composite fishery has the highest rate of around 30.0% in registered fishing vessels of Korea for the last three years. The risk analysis for the fisher's safety of coastal composite fishing vessels was conducted to serve as a basic data for improving the healthy and safe working environment of fisher using fisher's occupational accidents of the national federation of fisheries cooperatives (NFFC) from 2016 to 2018 (n = 1,105). As a result, the occupational accident occurrence rate of coastal composite fishery was 3.76% in all industries, 7.8 times the rate of that. In addition, death and missing rate was found to have a serious level management to 10.10‱. Among the accidents, 76.0% occurred at sea. The slipping, others and contact with machinery or fishing gear occurred more frequently in order in the frequency of accident occurrence pattern. In the risk assessment using frequency and severity, slipping, contact with machinery and others showed high risk during fishing. The results are expected to contribute to identification and assessment of safety hazard occurred in coastal composite fishing vessels.
