공해조업선(公海操業船)에 대한 관할권문제(管轄權問題)와 기국(旗國)의 책임(責任) (A Study on the Jurisdictional Problems for Fishing Vessels Engaging High Sea Fishery and the Responsibility of Flag States)

  • In accordance with the establishment of 200 nautical miles EEZ regime as a customary international law since the mid - 1980s, the area of global high seas became reduced relatively. On the other hand, the importance of high seas fishing ground became serious for the distant-water fishing states like Korea. But it can be expected that international dispute on the jurisdictional problem of the fishing vessels engaging high sea fishery will occur frequently owing to institutional inertia of the UNLOS Convention on this matter. "The Draft Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas" as an international code of conduct for responsible fishing which was adopted by FAO in 1993 is providing the more consolidating and definiting rules for jurisdictional responsibility of flag states to make completion the loophole of the UNLOS Convention. As a precondition for the effective control and enforcement of activities of the fishing vessels engaging high sea fishery, the Draft Agreement is providing some articles allowing the flag states to hold the rights of granting nationality, fishery permission, fishery supervision and control with punishment for the fishing vessels entitled to fly their own flag. Accordingly it can be evaluated that this Draft Agreement does not deviate on the whole from the traditional practice and the basic legal principle of the UNLOS Convention.

FRP 어선 보수에 적용되는 겔코트의 해수 침투 방지 효과 (The Prevention Effect of Seawater Penetration of Gel Coat Applied in Repair of FRP Fishing Vessel)

  • Ships may collide with reefs or other objects during operation, when arriving or departing ports. The hull plate may be damaged due to the contact with other ships. The total number of domestic powered fishing vessels has decreased, but that of FRP fishing vessels has increased by 0.7% and the ratio of FRP fishing vessels to the total fishing vessels increased to 96%. Recently, fishing vessels has been used as fishing boats for income of non-fishermen as well as fishermen. Therefore, safety management for repair and maintenance is necessary. The penetration of moisture and moisture in the composite material such as FRP may deteriorate the mechanical properties and the salt (NaCl) component of the damaged portion may cause a relatively high deterioration in material strength. The gel coat painting is the final stage of repairs ans maintenance of FRP fishing vessels. The thickness criteria in the domestic and foreign gel coat is 0.3~0.762 mm. The joint specimens, which was immersed in seawater for 120 days, were compared with those without seawater immersion. As a result, the tensile strength was 83 ~ 121.8% and the flexural strength was 83 ~ 113% compared with the specimens without seawater immersion. According to the previous study the tensile strength decreased by more than 29% and the flexural strength decreased by more than 50% when the composite material was immersed in seawater for 1,083 hours without coating. As a result, it was found that the gel coat with 0.5 mm thickness is very effective in preventing the strength decrease of the composite material.

어선 기관사고 저감을 위한 연구 (A Study for a Reduction of Machinery Damage on Fishing Vessels)

  • The aim of this study is to supply the basic field data and precautionary measures that was obtained from analys of troubles and failures in the main engine and its accessories of fishing vessels. In this paper, we analyzed the accidents of main engines and their accessories in fishing vessels for five years from 2000 to 2004, according to engine system, type of fishing vessels and engine power. Finally, we propose the methods to reduces the accidents of main engines and rheir accessories in fishing vessels.

소형어선 검사제도 현실과 개선방안 (Improvement Policy about Inspection systems of Small fishing Vessels)

  • 소형어선 검사제도와 관련하여 최근에 정부에서는 선박검사대상에 제외되었던 선외기등 총톤수 2톤 미만의 선박(이하 소형어선)에 대하여 선박안전법 적용대상으로 확대하여 어민들의 안정적인 조업활동을 지원하여야 한다는 근거하에 선박안전법 개정(제3조)에 관한 입법이 추진중에 있다. 소형어선의 검사여부 문제에 대해 어선의 안전확보 차원에서 검사를 해야 된다는 측면과 영세민과 노년층으로 현행 검사비 및 검사수수료의 비용 부담 및 어선검사를 받는데 소요되는 많은 시간 등의 문제로 종전과 같이 검사대상에서 제외되어야 한다고 주장하고 있다. 이러한 상반된 의견에 대한 대안으로 영세어민의 생업에 사용하거나 소형어선에 대한 검사는 원칙적으로 선박의 소유 또는 사용자가 자발적으로 수행하여야 하며 행정적인 규제는 이러한 목적 달성을 위한 최소한의 정책수단으로 제한되는 것이 바람직한 것으로 나타났다. 또한, 주요 수산국들 처럼 우리나라도 소형어선 검사를 위한 다양한 프로그램개발이 필요하다. 특히, 소형어선에 대한 검사를 실시하는 경우, 어선검사료 정부 지원, 최소한의 안전확보 검사, 어선건조시 검사, 검사기간을 연장하는 방안을 고려하여 정책을 추진할 필요가 있는 것으로 파악되었다.

소형어선의 해양사고를 줄이기 위한 방안 (Reduction plan of marine casualty for small fishing vessels)

  • Marine casualties of small fishing vessels (SFV) of less than 20 tons are frequent in Korea. The analysis was conducted to identify the cause and then prepared reduction plan using the marine casualty statistics of fishing vessels for the last five years from 2012 to 2016 by the Korean Maritime Safety Tribunal to reduce the marine casualties of SFV. According to the analysis of the type of whole vessels occurring marine casualty, fishing vessels accounted for an average 68.0 %; moreover, except for 2014 when M/V SEWOL ferry capsizing occurred, the rate of death and missing due to marine casualties occurred from 68.3 % to 91.2 % in fishing vessels, and an average 79.5 % was found to be urgent need of a measure. Marine casualties occurrence depending on the gross tonnage of fishing vessel was found that the most occurred at less than 5 tons, followed by the order of 5 to 10 tons or less. However, crews who boarded on SFV do not have any training program for them, except for the fishing safety training of fisher who carry out fishing for shipowners and crew of the coastal and offshore fishing vessel in accordance with the safety regulations for fishing vessels in the Fisheries Cooperative Association. Therefore, it is necessary to revise the training program so as to improve the preventive action and then emergency response including the fishing safety compliance with each fishery, safe navigation, machinery inspection and emergency response. Also, an SFV of less than 5 tons of 56,000 vessels is boarded by unqualified fishers. It would also be possible to consider subdividing small boat operator's certificate to enhance their qualifications. It is expected that marine casualties of SFV will be reduced if active efforts are made to improve the safety consciousness of fisher and shipowners as well as the reorganization of fishing safety training and the small boat operator's certificate system.

어선 종사자에 대한 안전교육 적정성에 관한 연구 (A Study on the Adequacy of Maritime Safety Training for Fisheries Seafarers)

  • In order to prevent the maritime accident, all seafarers who work on fishing vessels over G/T 20 tons are required to undergo the basic safety training by the Seafarer's Act. 45% of domestic crews have boarded on the fishing vessels. However, the fishermen have been trained in accordance with the STCW(International convention on standards of training certification and watch-keeping for seafarers) Convention. But safety training courses for seaman do not reflect on the safety equipment and the limitation of the fishing vessel in the training contents which is organized in accordance with the merchant ship by STCW convention and code. Most of the fishing vessels are small fishing boat of less than G/T 80 tons. Small fishing vessels are operating with only a minimum of safety equipment that has been defined by the fishing vessel safety equipment standard. Due to the safety training that does not fit the situation of the fishing boat, the level of satisfaction by the crews onboard is low for the training. Furthermore, there is a difficulty in achieving the goal of safety education. In order to carry out the safety training that is suitable for fishermen, it is required to provide appropriate standards for the safety education of workers of small fishing boat, by understanding the current state of the domestic fishing vessels. The purpose of this study is to define the aforementioned problems and to provide the standard for the safety education of fishermen. In order to complete the purpose, the research team has conducted a analyzation for registered domestic fishing vessel and safety equipment standard.

국내어선 타면적비 설계현황 분석연구 (Analysis of the Design of Rudder Area Ratio for Domestic Fishing Vessel)

  • 우리나라에 등록 된 선박은 2019년 기준 전체 97,623척이다. 그 중 어선이 차지하는 비율은 약 67 %로 65,835척이 등록되어 있다. 어선의 비율만큼이나 해양사고의 빈도수도 높다. 2020년 기준 전체 사고 3,535건 중 2,331건이 어선에서 발생했다. 즉 국내어선의 안전성 향상을 위한 여러 제도적 마련이 필요한 실정이다. 본 연구에서는 어선의 안전향상을 위한 다양한 부분 중에서 어선과 관련된 국내외 조종성능에 대한 국내외 평가 규정을 살펴보았다. 또한 상선에 비하여 설계 기준이 명확히 정립되지 않은 어선의 타면적 설계 현황을 살펴보기 위하여 국내 조업 중인 153척의 어선 타면적 비율를 조사하였다. 그 결과 대다수의 어선이 국제적 기준에 미달하여 타면적을 설계하고 있음을 통계적으로 확인하였다. 향후 이러한 분석 결과는 국내 어선의 조종성능 향상을 위한 타면적 설계 기준마련을 위한 기초 자료로 활용하고자 한다.

어획노력이 어획량에 미치는 영향분석 (The Analysis of Fishing Efforts and Catch in Korea)

  • This paper examines the efficacy of the vessel buy - back program implemented by the Korean government between 1994 and 2005. At the descriptive level, it is found that various factors of fishing efforts including power of vessels, fishing days and the number of employees increased during the program. The statistical analysis over the period 1981 to 2005 shows that the amount of weight and power of vessels tend to have a positive impact on the amount of catch with the number of vessels controlled. In particular, 1% increase in weight and power leads to $0.5%{\sim}1.4%$ and $1.0%{\sim}2.0%$ increase in catch, respectively. Therefore, the results suggest that the vessel buy - back program in Korea had contributed to reducing the catch but only as far as it reduced the weight and power of the vessels. As is consistent with the previous literature, it is indicated that the efficacy of vessel buy - back program may be limited by the fishermen's effots to increase the fishing efforts in terms of power of vessels, fishing days or number of employees.

어선에 종사하는 초급 해기사의 직업 지향에 관한 연구 (A Study on the Occupational Orientation of the Junior Ship Officer in Fishing Vessel)

  • In contemporary society, many fishery industries face a serious problem of having an insufficient number of junior ship officers and engineers. Even though many fishery high schools in Korea made significant effort to produce many talented junior officers and engineers, but after graduation, the students are reluctant to get a job on the fishing vessels. Furthermore, Korean government also invested a large amount of money to train students for ocean-going and costal & near-ocean fishing vessels. However, despite the government's great effort on the training program and education, only a few students wish to work on the fishing vessels. In this article, the author tried to find answers for various questions such as what are the factors that the student prefer, where the student to want to get a job in fishery industries, and how student feel about working at fishing vessels. Furthermore, the author also analyzed the differences between high school student group and Korea Institute of Maritime and Fisheries Technology(KIMFT) student group about occupational orientation by utilizing SPSS statistical program. Additionally, the author surveyed the current onboard status of job position of the high school and KIMFT alumni. This study's results and data will be used for aiding further stimulation and advertisement of job position in fishing vessels and continued daily lives on board.
