해양사고에 따른 해원(海員)의 과실책임에 대한 형사실무적 고찰 (A Study on Seaman's Criminal Responsibility of Marine Accidents)

  • 해양사고가 발생하게 되면 총론적으로는 해원의 형사책임은 자기부죄의 원칙상 해원이 직접 부담하지 아니할 수 없다. 그러므로 해원의 형사책임에 대한 대책은 형사상의 절차(영장실질심사제도, 구속적부심제도 등)를 최대한 이용하여 자신의 형사책임을 줄이는 방법 밖에는 없을 것이다. 기존법률의 개정을 통해 형벌을 낮추는 것도 하나의 방법이 될 것이다. 각론적으로 벌금 관련한 예로서 현행 해양오염방지법상의 과실로 인한 기름유출사고의 벌금인 3천만원은 유출량에 관계없이 최고액수가 벌금으로 나오는 경향이 있으므로 이를 유출량에 따라 차등화 시키는 것도 고려해볼 가치가 있을 것으로 판단된다. P&I의 벌금납부는 일반의 인식과는 달리 P&I가 법적의무를 부담하거나 P&I납부를 인정하는 경우에만 전보가 가능하다. 이러한 문제를 해결하기 위해서는 새로운 집단적 보험이나 공제제도를 신설하는 것도 하나의 대안이 될 것이다. 또한 해원들은 법률적인 문제에 대하여 전문가가 아니므로 법률적인 문제에 연루되게 되면 변호사 등 법률전문가의 조력을 체계적으로 받을 수 있도록 선주협회나 해기사협회 등에서 대안을 마련할 필요가 있다. (예 농어민무료법률구조지원사업 등). 끝으로 별도의 법률을 제정하든지 그렇지 않으면 기존의 교통사고처리특례법을 개정하여 해양사고부분을 삽입하는 것도 대안일 수 있을 것이다.

Comparison of catches and species composition for flounders caught using gillnets, gillnets with supporting lines, and trammel nets

  • To compare the catches made using gillnets, trammel nets, and gillnets with supporting lines, several experiments were conducted with commercial vessels near Uljin and Pohang in Eastern Korea between July 2010 and May 2011. Two sets of 13 different nets were used, including 5 panels of gillnets and trammel nets each with stretched mesh sizes of 7.6, 9.1, 10.6, 12.1, and 13.6 cm and 3 panels of gillnets with a mesh size of 9.1 cm with supporting lines with different line spacing. The outer (stretched) mesh size of the trammel nets measured 51.5 cm. The target fishes of the fishing nets were various types of flounders. The catch rate of flounders was 50.7% of the total catch in weight. The total catch for all nets was 443.8 kg. The predominant species was pointhead flounder (Cleisthenes pinetorum). The total catch by trammel nets was 1.4 times that of the comparable gillnets. But more pointhead flounder were caught by gillnets than by trammel nets, though there was no significant difference. Fishermen catching the pointhead flounder in Korea said that there was no need to use trammel net to catch it; this was an unexpected finding compared to the findings of other flounder fisheries. The amounts of roughscale sole, brown sole, and blackfin flounder caught by trammel nets were greater than those caught by gillnets. The mean lengths (standard deviation) of blackfin flounder, pointhead flounder, brown sole, and roughscale sole were 21.0 (4.57), 22.9 (3.40), 24.7 (4.90), and 28.3 (5.43) cm, respectively; there were significant differences in mean length (p < 0.00001). Therefore, in order to catch flounder efficiently, the fishing nets and mesh size should be chosen according to the target species. One advantage of using supporting lines is that it prevents breakage by strengthening the material especially when utilized on a rough bottom. Catch by using gillnet with supporting lines was not greater than that by using trammel net for the conservation of fisheries resources.

새만금 논쟁과 과학기술의 역할 (Environmental Controversy and the Role of Science - The Case of Saemangeum Reclamation Project in Korea)

  • 이 글은 환경논쟁에서 과학기술이 종종 중요한 구실을 하고 있지만 쟁점을 과학적 합리성의 문제로 틀 지움으로써 환경문제가 지닌 사회적, 문화적, 정치적 함의를 놓치게 할 수 있음을 새만금 간척사업을 사례로 논의하였다. 정부가 새만금 사업 재개를 결정하는데 분수령이 된 새만금 환경영향 민관공동조사단의 구성은 환경단체가 정부와 동등한 위치에서 사업을 재검토할 수 있는 기회를 제공했으나 이에 못지 않게 환경논쟁을 좁은 과학논쟁으로 한정시키는 데 기여했다. 논쟁의 양쪽 당사자가 전략적으로 비중을 둔 새만금 담수호의 장래 수질오염 논쟁은 불확실하고 가치와 관련된 갯벌보전 논란을 구체적이고 객관적으로 검증이 가능한 수질문제로 환원시켰다. 나아가 이런 논쟁의 성격변화는 수질관련 데이터와 정책을 생산하는 정부에게 유리한 조건을 제공했다. 민관공동조사단 활동 이후의 정부부처 협의과정은 수질 예측 모델링을 통해 미래의 수질을 더욱 정확하게 예측하려는 환경예측과학의 사회적 구성과정이기도 했지만, 기본적으로 정부의 정치적인 논리가 과학적인 예측을 좌우한 것으로 보인다. 결국 민관공동조사단 방식의 환경갈등 해결책은 환경운동단체의 의도와는 달리 논쟁의 폭을 좁히고 지역주민보다는 과학기술 전문가를 논쟁의 주요 당사자로 만듦으로써 운동의 제도화를 초래했다. 정부가 새만금 사업의 재개를 결정한 뒤 환경운동 내부에 성찰성과 현장성, 헌신성을 강조하는 삼보일배 등 생명평화운동이 대두한 배경에는 이처럼 환경단체가 과학적 합리성을 무비판적으로 받아들였기 때문으로 추정된다.

연평어장에서 생분해성 꽃게 삼중자망의 어획성능 (Catching efficiency of biodegradable trammel net for swimming crab (Portunus trituberculatus) in the Yeonpyeong fishing ground of Korea)

  • To study the catching efficiency of biodegradable trammel net for swimming crab (Portunus trituberculatus), three types (biodegradable, monofilament and multifilament) of trammel nets were used in the field test, and the tests were carried out 16 times with two different mesh sizes (105mm and 160mm) in the Yeonpyeong fishing ground of Korea, 2009~2011. The catching efficiency of three type nets was analyzed by catch in number, catch in weight and average weight per individual of small and large size swimming crab by net types and mesh sizes. Statistical T-test was also carried out to verify the efficiency between the three types of nets. The results are as follows. The catch in number of swimming crab was 24,667 and formed about 81.0% of total catch. Of all swimming crab catch, small swimming crabs with less than 64mm in carapace length which is a prohibited landing size by law formed 48.1%, larger swimming crabs with more than 64mm in carapace length which is a landing size formed 51.9%. In 105mm mesh size trammel net test, the catch share in number of small size swimming crab by biodegradable trammel net was 47.5% in comparison with multifilament trammel net and 74.2% in comparison with monofilament trammel net, so biodegradable trammel net has more protective effects on small size swimming crab than other types of trammel nets. The protective effects for small size swimming crab by biodegradable trammel net was 25.8~52.5% in comparison with other types of trammel nets. The catch share in weight of large size swimming crab by biodegradable trammel net was 98.3% in comparison with multifilament trammel net and 92.3% in comparison with monofilament trammel net, so biodegradable trammel net has a similar catch efficiency to multifilament trammel net. The results of 160mm mesh size trammel net test have shown similar results of 105mm mesh size trammel net test. This study shows that biodegradable trammel net is a more useful fishing gear than multifilament and monofilament trammel net because biodegradable trammel net has lower catch rate than other types of nets in small size swimming crab and similar catch rate than multifilament trammel net which is a well used net by fishermen.

천리안 위성영상을 이용한 경상남도 남해안해역 적조이동 패턴 분석 (Analysis of Red Tide Movement in the South Sea of Gyeongnam Province Using the GOCI Images of COMS)

  • 여름철이 되면 매년 남해안에서 발생되고 있는 적조현상은 양식장을 운영하는 어민들에 막대한 피해를 주고 있으며 이를 방재하기 위한 노력이 다각도로 진행되고 있다. 특히 위성영상을 이용한 적조 모니터링은 발생해역 전반에 걸친 적조발생자료를 취득할 수 있어서 방재 계획수립에 중요한 정보를 제공하여 줄 수 있다. 따라서 본 연구에서는 천리안 GOCI영상을 이용하여 하루 중 적조의 확산과 감소를 모니터링할 수 있는 결과를 제시하기 위하여 경상남도 남해안 지역을 선정하고 2013년(8월 12일), 2014년(9월 11일) GOCI영상자료를 분석한 결과 다음과 같은 결론을 얻었다. 남해안 해역의 적조발생 패턴은 오전에 거제도 남부해역에서 출현하여 점점 더 확산되다가 오후 1시에 최대가 되고 그 후 서서히 감소되는 경향을 보여주었다. 또한 하루 중 적조의 중심 이동은 거제시 남부해역에서 적조가 시작하여 서쪽으로 이동하다가 정오를 기하여 다시 동쪽으로 이동하는 경향을 보여주었다. 향후 적조 생물의 특성과 해수유동, 태양 일조량, 그리고 해수온도 등 많은 요인에 대한 추가적인 연구가 필요하다고 판단되지만, GOCI 영상을 이용한 적조이동 모니터링은 적조의 확산과 이동을 예측하여 방재하고 관리하는데 매우 중요한 정보가 될 것으로 생각된다.

동해안 참굴 양식에 관한 연구 (Studies on the Culture of Oyster, Crassostrea gigas (Thunberg) in Eastern Coast of Korean)

  • 동해안에서 고품질의 굴 양식 생산과 어업인의 안정적인 소득 향상을 도모하고저 경남 하동에서 채묘한 굴을 강원도 주문진 연안에 연승수하식으로 이식한 후 1994년 8월부터 1995년 7월까지 어장환경과 수층별 성장시험을 실시하였다. 환경요인 조사결과 수온은 8.33-$25.62^{\circ}C,\;염분\;32.84-34.28\textperthousand,\;영양염류인\;인산염은\;0.09-0.40\mug$-at/l, 용존성 무기질소(DIN)는 0.32-3.12$\mu$g-at/l로 나타났다. 굴의 성장은 상층이 각고 88.7 mm, 중층 84.9 mm, 하층 78.0 mm로 하층에 비해 상층의 성장이 더 빨랐다. 수층별 각고(SH)에 대한 각장(SL)의 상대성장식은 상층 SL=0.5403 SH+8.5486 (r=0.9959), 중층 SL=0.5813 SH+3.7775 (r=0.9869), 하층 SL=0.5159 SH+6.8736 (r=0.9961) 이였다. 육질은 상층 13.24 g, 중층 12.68 g, 하층 10.96 g으로 상층에서 높게 나타났으며, 수층별 전중량(TW)에 대한 육중량(MW)의 상대성장식은 상층 MW=0.1933 TW+0.1051 (r=0.9973), 중층 MW=0.1915 TW+0.1894 (r=0.9984), 하층 MW=0.1650 TW+0.0558 (r=0.9983)으로 나타났다.

일본에 있어서 어류양식업의 경영과 어협의 역할;(방어양식경영을 중심으로) (The Management of Fish Culture Industry and the Role of Fisheries Cooperatives in Japan;- Focused on Yellowtail Cultural industry -)

  • The Purpose of this research is to analyze and discuss the development of yellowtail aquaculture industry in Japan and its management structure. The research includes the following : (a) It confirms the industrial conditions of yellowtail aqaculture which has a national technical and mass production system that has been developed at great speed. (b) It analyzes yellowtail aqaculture development from a family - oriented management to a large scale production. (c) It examines how the fisheries cooperatives harmonized their role with the object of individual aqaculture management and aqaculture fishing ground management. The reasons for this study focusing on the yellowtail aqaculture industry of Japan are : (a) The yellowtail aqaculture is regared as a typical field in aqaculture because it reflects the general aqaculture history, quantity of fisheries aqaculture product, the number of fishermen involved in this industry, technology , and the live and fish market formation in Japan. (b) The aqaculture has the most powerful entrepreneurial in financial and management style. The aqaculture industry also has a most individual management style which includes planned production and shipping strategy. This research has attempted to study the industrial processes of fisheries aqaculture industry and its management development, and focused on the yellowtail aqaculture industry of Japan. This work also includes data about the aqaculture management of fisheries cooperatives and case by case analysis of aqaculture production. The following results were obtained from this study : First, even though ocean, weather conditions, and widespread propagation of places suitable for aqaculture in Japan were crucial factors in aqaculture development, it must be pointed out that fisheries policy in Japan changed from "catching" in the 1960s to "cultivating". Second, the widespread course of fisheries cultivating technology in Japan has had two characteristics. One is that early aqaculture technology spread to the southern part of Japan and the other is that the metal nets were widely used in the northern part in the 1970s. Japan's yellowtail aqaculture industry's overproduction was due to metal nets. However, the use of mwtal nets also contributed to the improvement of aqaculture and the strategic aspects of aqaculture management. In addition, it should be stressed that Kagoshima prefecture as the pioneer of metal nets contributed to fisheries aqaculture development in japan. Third, as aqaculture technology developed, entrepreneurial qualities of aqaculture management also developed this field into a large scale business. Even though it is not clear, large scale management of yellowtail aqaculture shows evidence of superiority over small andmedium - size management of yellowtail aqaculture. Fourth, yellowtail aqaculture management in Japan hascontributed to the production system and aqaculture strategy to meet consumers' needs and market demands from weather - oriented trational fisheries industry, which overcame their overproduction structure. Fifth, Japanese fisheries cooperative played very important roles in the prevention of fishing grounds production from destruction and in promoting suitable aqaculture facilities so that aqaculture could grow continually.ld grow continually.

ITQ 어업관리의 기본이론과 경제적 효과분석 - 붉은대게어업을 중심으로 - (Analysis of Economic Effects and Basic Theoretical Frameworks of ITQ Fishery Management - Focusing on the Red Crab Trap Fishery -)

  • The purpose of this paper is to provide information that will help both fishing industry and fisheries authority understand the principals of individual transferable quota(ITQ) fishery management. Theoretical frameworks and primary features of ITQ fishery managemenet are the assignment of exclusive property rights for harvest of common - property fisheries resources. An ITQ fishery management is fundamentally different from the conventional fishery management and it gives an individual fisherman the right to catch a specified quantity of fish, his quota. With ITQ, fisherman's quotas are transferable, in whole or in part. An ITQ is a property with certain rights of use, namely, the right to catch a given quantity and species of fish in a specific location during a specific period of time. The right is exclusive in the sense that no one else has the right to use the quota without the owner's permission. The property may be assigned, traded, and exchanged; i.e., the owner has the right to transfer an ownership to others. An ITQ fishery management leads to both economic efficiency and resource conservation. Motivations to overexploit stocks and to overcapitalize should be lessened because fishermen no longer have to compete for limited resources. There are significant positive net benefits and advantages with ITQ fishery management than without. The potential benefits and advantages of ITQ fishery management include increased profits, economic stability, improved product quality, safer working conditions, less gear conflict, elimination of the race - to - fish phenomenon, less by - catch, less gear loss, improved investment climate, mitigation of market gluts, waste reduction, addition to fisherman's wealth, and compensation for fisherman exiting the fishery. As an independent observe to Red Crab Trap Fishery some of the benefits, problems, and effects, an ITQ fishery management in Red Crab Trap Fishery is still far from to be implemented. Many different and difficult aspects (biological, socioeconomics, administrative) are involved considering the implementation of ITQ fishery management in Red Crab Trap Fishery. Among other fishery management tools, the implementation of ITQ fishery management in Red Crab Trap Fishery is considered to be the best in achieving the better conservation of fisheries resources and their more economic and rational exploitation. Korean fisheries authority should pay great attention to the experience of the economic effects of the ITQ fishery management in Red Crab Trap Fishery in the hope of being able to implement at least some of those experiences into the Korean fishery management.

푸른바다거북 보전의 공익적 가치 추정 (Measurement of the Public Value of Conserving Green Turtles)

  • 본 논문에서는 푸른바다거북의 구조 치료를 통한 보전의 공익적 가치를 경제학적 방법론에 근거하여 평가하고자 조건부 가치측정법을 적용하였다. 자료의 수집은 여론조사전문기관이 무작위 추출한 전국 1,000 가구를 대상으로 일대일 개별면접조사를 통해 이루어졌다. 지불의사 유도방법으로 1.5경계 모형을 적용하되 지불수단으로는 가구당 소득세를 활용하였다. 지불의사액 분석모형으로는 효용격차모형에 근거한 스파이크 모형을 적용하였다. 분석결과, 응답가구는 중앙정부가 푸른바다거북 구조, 치료, 방류를 시행하기 위해 2016년말 기준 향후 10년 동안 매년 평균적으로 2,570원을 부담하고자 하였으며 이 값은 유의수준 1%에서 통계적으로 유의하였다. 이 값을 전국으로 확장하면 푸른바다거북 보전의 공익적 가치가 연간 487억원임을 알 수 있다. 따라서 중앙정부 차원에서 어업활동 중의 부수어획, 어선과 충돌, 폐그물에 걸려 죽거나, 부상당한 푸른바다거북에 대해 구조, 치료, 방류를 추진하는 것의 공익적 가치는 작지 않다.

각국 제안서에 따른 WTO/DDA 수산보조금 대응 방안 (Proposal's analysis of major fishing countries and Countermeasures under WTO/DDA)

  • The WTO/DDA Negotiation on the Fisheries Subsidies started by DDA(Doha Development Agenda : 2001.11)at early 2002 has been held about 20 times until the fist half of 2005. The Negotiation will be terminated until the end of 2005 but now, it is impossible to predict the exact conclusion of the Negotiation. There is a sharp conflict of opinion on the WTO/DDA Negotiation on the Fisheries Subsidies between FFG(Fish Friends Groups : USA, New Zealand etc) and Anti-FFG(Rep. Korea, Japan etc). The Fisheries Subsidies is regulated by the WTO/DDA Negotiation that regulates on the subsidies of industrial products, fisheries products, forest products. Considering the progress of the WTO/DDA Negotiation on the Fisheries Subsidies, Guidelines for the Fisheries Subsidies Negotiation were established in Doha Ministerial Declaration at 2001 and a necessity of a special regulation on the Fisheries Subsidies has been discussed from 2002 to 2004. After june, 2004, the Negotiation was proceeding as Rep. Korea, Japan and Taiwan agreed with discussing a special regulation on the Fisheries Subsidies and At 1st, August, 2004, they reached an agreement on a necessity of a special regulation on the Fisheries Subsidies. At Feb, 2005, discussion was suspended because of presenting the joint proposal from 3 countries(Rep. Korea, Japan and Taiwan) and now discussion on the Fisheries Subsidies is giving the first consideration to classification of prohibited/non-actionable subsidies, S&D of a developing countries, small fisheries, problems of farming, grace period etc. From now on, Considering the 18th~the 20th negotiations, it is expected that discussion of fisheries subsidies regulation including property and range of prohibited/non-actionable subsidies, S&D of a developing countries, a definition of small fisheries is accelerated. In this point of view, this paper analyzed and arranged every country's proposals holding our own position and took a survey to fishermen and fisheries experts about prohibited/non-actionable subsidies. In addition, this paper intends to suggest the way of future-negotiation and provides essential data to help government's policy making through analyzing prohibited/ non-actionable subsidies, farming subsidies, S&D of a developing countries, small scale fisheries.
