The Economic Cost of the Fair Online Platform Intermediary Transactions Act: A Comparative Case Study (디지털 플랫폼 규제의 경제적 비용: '온라인 플랫폼 공정화법(안)' 사례 연구)

  • On September 28, 2020, the Korea Fair Trade Commission introduced a proposed bill entitled the "Fair Online Platform Intermediary Transactions Act." We quantify the impact of this proposed act on Naver, Korea's major digital platform. Finding a proper control unit is not an easy task in social science studies. We overcome this caveat by constructing a synthetic version of Naver using Abadie & Gardeazabal's (2003) synthetic control method. It appears that the economic cost of the proposed act is not negligible at all. Naver's opportunity loss amounted to 16.18% of its market capitalization (approximately 8.5 trillion won in comparison with its pre-regulation market capitalization). Any regulation-based approaches to resolving digital platform issues have both promises and pitfalls. The results highlight that regulatory bodies should carefully gauge the impact of such regulations, as we have seen with Naver's case.

  • In recent years, greenhouse gas (GHG) reduction has become high priority issue in international aviation. GHG emissions from the aviation sector only accounts for approximately 2 percent of total GHG emissions in the world. However, as with GHG gases in other sectors, it has been pointed out as a contributing factor to global warming and there is an ongoing conversation in the aviation community to establish international framework for emissions reductions. In the case of international aviation, effects of aviation activities of a State go beyond the airports and airspace of that State. This makes compiling of GHG emissions data very difficult. There are also other legal and technical issues, namely the principle of “Common but Differentiated Responsibility (CBDR)” under the United Nations Framework Convention on Climate Change (UNFCCC) and “Fair Opportunity” principle of the Chicago Convention. For all these reason, it is expected that it will not be an easy job to establish an internationally agreed mechanism for reducing emissions in spite of continuing collaboration among States. UN adopted the UNFCCC in 1990 and the Kyoto Protocol in 1997 to impose common but differentiated responsibility on emissions reductions. In international aviation, ICAO has been taking the lead in measures for the aviation sector. In this role, ICAO held the High-level Meeting on International Aviation and Climate Change on 7 to 9 October 2009 at its Headquarters in Montreal and endorsed recommendations on reducing GHG from international aviation which will also be reported to the 15th Meeting of the Conference of the Parties (COP15). Key items include basic principle in global aviation emissions reduction: aspirational goals and implementation options: strategies and measures to achieve goals: means to measure and monitor the implementation; and financial and human resources. It is very likely that the Republic of Korea will be included among the Parties subject to mandatory limitation or reduction of GHG emissions after 2013. Therefore, it is necessary for Korea to thoroughly analyze ICAO measures to develop comprehensive measures for reducing aviation emissions and to take proactive actions to prepare for future discussions on critical issues after COP15.

Design of MAC Algorithm Supporting Adaptive Transmission Rate on VANET (VANET에서 적정 전송속도를 지원하는 MAC 설계)

  • VANET(Vehicular Ad-hoc Network), standardization of IEEE 802.11p specification is in process. 802.11 MAC protocol grants all nodes equal opportunity to acquire channel without regard to their bit-rates, making it possible for lower bit-rate nodes to occupy communication channel for a fair amount of time thus keeping the higher bit-rate nodes from acquiring connection channel which downward-equalize the overall network performance. Also with the 802.11p MAC protocol, the probability of collision occurring increases as the number of nodes grow. The proposed algorithm is a new MAC protocol that guarantees nodes with acquired channel a firm priority over other nodes for a fixed amount of time with TXOP concept added to 'packet burst' according to the current transmitting speed. This newly designed algorithm allows the construction of wireless network with enhanced network throughput, decreased probability of collisions as well as providing the means to grant each node a fair chance of acquiring connection according to their channel conditions. The algorithm sets the CW's (Contention Window) width wider than the standard's and modulates the continuous transmitting threshold value depending on channel acquired time, thus improving the overall performance of the network.

  • Currently, the beauty of Korean traditional furniture has been changed irregularly and even the traditional character has been distorted. The purpose of the study is to examine the current situations of traditional bedroom-furnitures that are reproduced and sold at the markets in Korea. The eight companies were selected as a research sample. All those companies also participated at the "Living-design Fair 2003 and 2004" The traditional bedroom-furnitures were the limited products as a research target. As a method of the research, the content analysis such as names, dimensions and types was used. The results of research were as follows: 1) Using the confused names for a same item, 2) Changes of dimensions, 3) Diversification of the types, 4) Mixing with Japanese style furniture in the Korean traditional furniture market. On the basis of the results, selected eight companies were divided into three types: First, representation of traditions near to the prototype, second, reforming to be suitable to the contemporary life-style, and the last, mixing of Japanese style furniture. This research will make us be concerned about reproduced Korean traditional furniture and established the position to seek for Koreanity. This research expected to be a reference to develope Korean traditional furniture industry, opportunity of verification for reproduced Korean traditional furniture companies and find out the change of life-style through a comparison analysis of the original traditional furniture.furniture.

  • Uplink overflow in WMSN (Wireless Multimedia Sensor Networks) aggravates the resource consumption, delay, and traffic congestion. This paper proposes a new traffic congestion control mechanism using popularity. The proposed mechanism controls congestions by dispersing the media traffic, and it control fairly packets according to priority. This paper proposes PQS (Packet Queue Scheduler) to control fairly packets, and the proposed mechanism provides a fair opportunity to all sensor nodes without a specific location. The simulation results show that the proposed mechanism achieves improved performance in throughput, delay ratio, link quality, and buffer queue control ratio compared with those of other existing methods.

A Social Responsibility of Landscape Architecture as a Green Infrastructure for Environmental Justice Realization

  • The main task of landscape architecture is to create a higher quality of the environment by utilizing resources or to provide effective stewardship for the preserved environment. These outcomes enhance the correlation between humans and the environment. Landscape architect deals with direct use of market economic goods in private property resources such as capital, land, plant, structure. But it also has indirect use of non-market economic goods in public resources like scenic view from the forest, sea, urbanscape, and refreshing atmosphere. At this point, landscaping products should have a role of public goods, and even these attribute to individuals or certain group. From the results of neo-liberalism regime in modern era such as guarantee of private property, deregulation for free market, and reduction of social welfare, minority has getting less opportunity to enjoy the quality life in ecotop and social welfare. With all future, landscape architecture should have the role of social infrastructure through planning concept that ensures public interests first. The virtuous functions of Green Infrastructure is a proper tool in realizing environmental justice in that it efficiently protects environment, and distributes fair benefits to all people.

U.S. Courts' Review of Article V(1)(b) under the New York Convention for the Enforcement of Foreign Arbitral Awards

  • In light of increasing international trade in recent years, international arbitration has been more widely used by international parties to resolve their conflicts. Thus, the need for reliable and effective enforcement of foreign arbitral awards has amplified. To facilitate the enforcement of foreign arbitral awards, the New York Convention lists grounds for the refusal of recognition and enforcement in Article V. This paper examines prominent U.S. case law on Article V(1)(b), which is put in place to ensure that arbitration proceedings are conducted properly in accordance with due process requirements: proper notice to parties and an opportunity to a fundamentally fair hearing. This examination of case law conveys that U.S. courts refuse to enforce foreign arbitral awards pursuant to Article V(1)(b) only when due process rights of the party against whom the award is to be enforced are clearly violated by the arbitral tribunal. This paper also reveals that U.S. courts mainly defer to arbitral tribunals' discretion, especially as to evidentiary matters. Therefore, it is predicted that U.S. courts will likely continue to narrowly construe the grounds in Article V to facilitate reliable and effective enforcement of foreign arbitral awards in the U.S.

Approximate Analysis of MAC Protocol with Multiple Self-tokens in a Slotted Ring

  • Ring networks are very commonly exploited among local area and metropolitan area networks (LAN/MAN), whereas cells or small fixed-size packets are widely used in synchronized ring networks. In this paper, we present an analytical method for evaluating the delay-throughput performance of a MAC protocol with multiple self-tokens in a slotted ring network under uniform traffic. In our analysis, we introduce the stationary probability, which indicates the number of packets in a node. Also, it is assumed that each node has a sufficiently large amount of self-tokens, and a slotted ring has the symmetry. The analytical results with respect to delay-throughput performance have similar values to computer simulated ones. Furthermore, in order to achieve fair access under non-uniform traffic, we propose an adaptive MAC protocol, where the number of self-tokens in a node dynamically varies, based on the number of packets transmitted within a specified period. In the proposed protocol, when the number of packets transmitted by a node within a specified period is larger than a specified threshold, the node decreases the number of self-tokens in a per-node distributed method. That results in creating free slots in the ring, thus all nodes can obtain an equal opportunity to transmit into the ring. Performance results obtained by computer simulation show that our proposed protocol can maintain throughput fairness under non-uniform traffic.

Analysis on the Problems of U.S.-Korea Air Services Agreement and Recommend Action for its Improvement- (한.미항공협정(韓.美航空協定)의 문제점(問題點)과 개선방향(改善方向))

  • This paper is examine the problems of U.S.-Korea Air Service Agreement and recommend some directions for its improvement under the rapidly changing circumstance and growing importance of Korean penisula. Since the provisional agreement of 1949, U.S. -Korea Air Service Agreement has consistently been favorable to U.S. side. Fair and equal opportunity is the principle and basis of the bilateral air agreement. Notwithstanding such principle, it is only the U.S. carriers who can freely enter into any market, under the discretion of business strategy, while Korean carrier can serve only three points including Honolulu. In an effort to recitify such serious imbalance, Korea continuousely requested additional rights and has given utmost efforts to accommodate requests made by U.S. carries without much success. When we review aviation market between Korea and U.S. under the present agreement, Korea is fully open to U.S. carries as they can connect from any or all points in the U.S. via any or all points in Korea and all points beyond Korea. Increased number of U.S. carriers are enjoying greater utilization of the opportunity accorded them. Four(4) U.S. carries now operate to Korea using thirteen(13) gateway points and about one hundred fifty(150) on-line points in the U.S. such imbalance can be well understood when we review the exchange of traffic rights between the U.S. and the Pacific rim countries. During the yeras following the 1978 agreement with Korea, the U.S. proceeded to sign liberal agreements with Thailand, Taiwan, Singapore and the Phillipines. In exchange, the U.S. granted the four Pacific rim countries substantially greater rights than were granted to Korea, although Korea was the first Asian nation to sign a pro-competitive aviation agreement which granted U.S. carriers unrestricted market access and pricing flexibility. Moreover, Korea ranks the 2nd trading and tourist partner to the U.S. among the Pacific rim countries (Japan is the largest partner to the U.S. in terms of both trade and tourist market). In this paper such problems in the Korea-U.S. Air Services Agreement are analyzed in terms of historical perspective, U.S. Aviation policy, imbalance status in detail cases, discrimination to Korea comparing to other Asian countries, and theoretical application. And further it discusses current aviation issues between Korea and U.S. such as the ratification of 1980 MOU and various doing business issues of U.S. carriers in Korea. Finally, this paper concludes the analysis and suggests some directions to improve and rectify the problems and imbalance of U.S.-Korea Air Services Agreement in question.

A Study on the Characteristics of Heavy Rainfalls in Chungcheong Province using Radar Reflectivity (레이더 자료를 이용한 충청지역 집중호우 사례 특성 분석)

  • This paper describes the detailed characteristics of heavy rainfall events occurred in Chungcheong province on 15 and 16 April and from 6 to 8 August 2002 based on the analysis of raingauge rainfall rate and radar reflectivity from the METRI's X-band Weather Radar located in Cheongju. A synoptic analysis of the case is carried out, first, and then the analysis is devoted to seeing how the radar observes the case and how much information we obtain. The highly resolved radar reflectivity of horizontal and vertical resolutions of 1 km and 500 m, respectively shows a three-dimensional structure of the precipitating system, in a similar sequence with the ground rainfall rate. The radar echo classification algorithm for convective/stratiform cloud is applied. In the convectively-classified area, the radar reflectivity pattern shows a fair agreement with that of the surface rainfall rate. This kind of classification using radar reflectivity is considered to be useful for the precipitation forecasting. Another noteworthy aspect of the case includes the effect of topography on the precipitating system, following the analysis of the surface rainfall rate, topography, and precipitating system. The results from this case study offer a unique opportunity of the usefulness of weather radar for better understanding of structural and variable characteristics of flash flood-producing heavy rainfall events, in particular for their improved forecasting.
