Legal approach on uniliteral changing membership in the airlines' frequent flyer program (항공사의 상용고객우대제도 변경에 관한 법적 고찰 - 미국 연방대법원의 Northwest, Inc. v. Ginsberg사례를 중심으로 -)

  • Since American Airlines launched AAdvantage which was the first Frequent Flyer Program in 1981, many people has accumulated mileage credits, and now, frequent flyer program(FFP) is the universal marketing tool to the airlines. These days, airlines establish a strategic alliance with domestic and foreign companies of various fields ; other airlines, travel agencies, car hire firms, hotels, department stores, even credit card companies. However, more people want to use their mileage credits, more airlines reject to approve that or change frequent flyer program against their customers. Last year, Northwest, Inc. v. Ginsberg, the United State Supreme Court made a decision that the preemption provision of Airlines Deregulation Act(ADA) preempts state laws related to rates, routes and services for air carriers including implied covenant of good faith and fare dealing. Thus, the claim of Ginsberg was canceled, it means that Northwest Inc. could terminated one-sidedly his membership in the frequent flyer program. In the contrast, Korea does not have the statute like ADA. If customers file a claim on FFP like Ginsberg, the courts of Korea judge whether the clauses of standard form contract are unfair or not. Therefore, in this article, Ginsberg would be checked on legal issues and be compared briefly with the courts' ruling in Korea.

Optimization of Contaminated Land Investigation based on Different Fitness-for-Purpose Criteria (조사목적별 기준에 부합하는 오염부지 조사방법의 최적화 방안에 관한 연구)

  • Investigations on the contaminated lands due to heavy metals from mining activities or hydrocarbons from oil spillage for example, should be planned based on specific fitness-for-purpose criteria(FFP criteria). A FFP criterion is site specific or varies with situation, based on which not only the data quality but also the decision quality can be determined. The limiting factors on the qualities can be, for example, the total budget for the investigation, regulatory guidance or expert's subjective fitness-for-purpose criterion. This paper deals with planning of investigation methods that can satisfy each suggested FFP criterion based on economic factors and the data quality. To this aim, a probabilistic loss function was applied to derive the cost effective investigation method that balances the measurement uncertainty, which estimates the degree of the data quality, with the decision quality. In addition, investigation planning methods when the objectives of investigations do not lie in the classification of the land but simply in producing the estimation of the mean concentration of the contaminant at the site(e.g. for the use in risk assessment), were also suggested. Furthermore, the efficient allocation of resources between sampling and analysis was also devised. These methods were applied to the two contaminated sites in the UK to test the validity of each method.

MILD HEMOPHILIA A DETECTED BY DELAYED BLEEDING: A CASE REPORT (지연된 출혈로 밝혀진 경증 혈우병 A에 대한 증례 보고)

  • Hemophilia A is an X-linked disorder resulting from a deficiency in factor VIII. Hemophilia A is classified into severe, moderate, and mild forms. A 12-month old boy visited for uncontrolled bleeding on the upper labial frenum area. Spontaneous bleeding occurred about 13 days ago. We sutured the wound. However, the patient returned after 6 days with large hematoma formation. Consultation to the hematologist and laboratory examination were carried out. Activated PTT was elongated and factor VIII was only 6%. He was diagnosed as mild hemophilia A. Fresh frozen plasma (FFP) was provided and hemostasis was achieved. At 5-day check-up, no more bleeding was observed. For the management of prolonged bleeding in hemophilia A patient, not only local hemostatic measures, but factor VIII replacement therapy, antifibrinolytics, and Desmopressin are also available. Mild hemophilia A often occurs without either familial or medical history. It is often first detected by dental trauma.

A Study on Characteristics of Chinese Civil Aviation Market (중국 항공운송시장특성에 관한 연구)

  • Recently, China has expanded enormously its economic trade exchange bilaterally with other nations and developed as the second largest aviation market in the world. While open skies bilateral agreements were signed between China and other countries, the agreement processes influenced the aviation market structure and market sharing heavily. This paper analyzed the Chinese aviation market by such three angles as market scale, competitive situation, and market concentration. It is concluded that the Chinese aviation market is the oligopolistic market structure tested by the Herfindahl-Hirschman Index. Finally, suggestions are given to the airlines operating in China such as joining the air alliance, paying attention to a different frequent flyer program (FFP) etc.

Do Various Respirator Models Fit the Workers in the Norwegian Smelting Industry?

  • Background: Respirator fit testing is a method to assess if the respirator provides an adequate face seal for the worker. Methods: Workers from four Norwegian smelters were invited to participate in the study, and 701 respirator fit tests were performed on 127 workers. Fourteen respirator models were included: one FFABE1P3 and 11 FFP3 respirator models produced in one size and two silicone half masks with P3 filters available in three sizes. The workers performed a quantitative fit test according to Health and Safety Executive 282/28 with 5-6 different respirator models, and they rated the respirators based on comfort. Predictors of overall fit factors were explored. Results: The pass rate for all fit tests was 62%, 56% for women, and 63% for men. The silicone respirators had the highest percentage of passed tests (92-100%). The pass rate for the FFP3 models varied from 19-89%, whereas the FFABE1P3 respirator had a pass rate of 36%. Five workers did not pass with any respirators, and 14 passed with all the respirators tested. Only 63% passed the test with the respirator they normally used. The mean comfort score on the scale from 1 to 5 was 3.2. The respirator model was the strongest predictor of the overall fit factor. The other predictors (age, sex, and comfort score) did not improve the fit of the model. Conclusion: There were large differences in how well the different respirator models fitted the Norwegian smelter workers. The results can be useful when choosing which respirators to include in respirator fit testing programs in similar populations.

Analysis of Massive Transfusion Blood Product Use in a Tertiary Care Hospital (일개 3차 의료기관의 대량수혈 혈액 사용 분석)

  • Background: A massive blood transfusion (MT) requires significant efforts by the Blood Bank. This study examined blood product use in MT and emergency O Rh Positive red cells (O RBCs) available directly for emergency patients from the Trauma Center in Ajou University Hospital. Methods: MT was defined as a transfusion of 10 or more RBCs within 24 hours. The extracted data for the total RBCs, fresh frozen plasma (FFP), platelets (PLTs, single donor platelets (SDP) and random platelet concentrates (PC)) issued from Blood Bank between March 2016 and November 2017 from Hospital Information System were reviewed. SDP was considered equivalent to 6 units of PC. Results: A total of 345 MTs, and 6233/53268 (11.7%) RBCs, 4717/19376 (24.3%) FFP, and 4473/94166 (4.8%) PLTs were used in MT (P<0.001). For the RBC products in MT and non-MT transfusions, 28.0% and 34.1% were group A; 27.1% and 26.0% were group B; 37.3% and 29.7% were group O, and 7.5% and 10.2% were group AB (P<0.001). The ratios of RBC:FFP:PLT use were 1:0.76:0.72 in MT and 1:0.31:1.91 in non-MT (P<0.001). A total of 461 O RBCs were used in 36.2% (125/345) of MT cases and the number of O RBCs transfused per patient ranged from 1 to 18. Conclusion: RBCs with the O blood group are most used for MT. Ongoing education of clinicians to minimize the overuse of emergency O RBCs in MT is required. A procedure to have thawed plasma readily available in MT appears to be of importance because FFP was used frequently in MT.

A Study of the Influencing Factors for Decision Making on Construction Contract Types : Focused on DoD Construction Acquisitions with Firm Fixed Price and Cost Reimbursable in FAR (건설공사 대가지급방식의 의사결정 영향요인에 관한 연구 - 미국 연방조달규정에 따른 미국 국방성의 정액계약과 실비정산계약을 중심으로 -)

  • This study analyzed the correlation between each of the 12 influencing factors in FAR 16.04 and the decision-making process for construction contract types, using data from a total of 2,406 DoD Construction Acquisitions spanning from 2008 to 2022. The study considered 12 independent variables, grouped into 4 Characteristics with 3 factors each. Meanwhile, all other contract types were categorized into two types: Firm-Fixed-Price (FFP) and Cost-Reimbursement Contract (CRC), which served as the dependent variables. The findings revealed that FFP contracts significantly dominated in terms of acquisition volume. In line with prevailing beliefs, logistic data analysis and Analytical Hierarchy Process (AHP) analysis of Relative Weights from Experts' Survey demonstrated that independent variables like Uncertainty of the Scope of Work and Complexity found out to be increasing the likelihood of selecting CRC. The number of contractors in the market does indeed influence the possibilities of contract decision-making between CRC and FFP. Meanwhile, the p-values of the top 3 influencing factors on CRC from the AHP analysis-namely, Appropriateness of CAS, Project Urgency, and Cost Analysis-exceeded 0.05 in the binominal regression results, rendering it inconclusive whether they significantly influenced the construction contract type decision, particularly with respect to payment methods. This outcome partly results from the fact that a majority of respondents possessed specific experiences related to the USFK relocation project. Furthermore, influencing factors in construction projects behave differently than common beliefs suggest. As a result, it is imperative to consider the 12 influencing factors categorized into 4 Characteristics areas before establishing acquisition strategies for targeted construction projects.

Development of an Integrity Evaluation Program for Corroded City Gas Pipelines

  • Pipelines have the highest capacity and are the safest and the least environmentally disruptive means for transmitting gas or oil. Recently, failures due to corrosion defects have become a major concern in maintaining pipeline integrity. A number of solutions have been developed for the assessment of remaining strength of corroded pipelines. In this paper, a Fitness-For-Purpose(FFP) type limit load solution for corroded city gas pipelines is proposed. For this purpose, a series of burst tests with various types of machined defects were performed. Finite element simulations were carried out to derive an appropriate failure criterion. Based on such solution along with existing solutions, an integrity evaluation program for corroded city gas pipeline, COPAP-CITY, has been developed.

Construction of High-Speed Wavelength Swept Mode-Locked Laser Based on Oscillation Characteristics of Fiber Fabry-Perot Tunable Filter (광섬유 패브리-페로 파장가변 필터의 공진특성에 기반한 고속 파장가변 모드잠김 레이저의 제작)

  • A high-speed wavelength swept laser, which is based on oscillation characteristics of a fiber Fabry-Perot tunable filter, is described. The laser is constructed by using a semiconductor optical amplifier, a fiber Fabry-Perot tunable filter, and 3.348 km fiber ring cavity. The wavelength sweeps are repeatatively generated with the repetition period of 61 kHz which is the first parallel oscillation frequency of the Fabry-Perot tunable filter for the low power consumption. Mode-locking is implemented by 3.348 km fiber ring cavity for matching the fundamental of cavity roundtrip time to the sweep period. The wavelength tuning range of the laser is 87 nm(FWHM) and the average output power is 1.284 mW.

Development of Wavelength Swept Laser by using the two SOAs parallel configuration (SOA 2개의 병렬연결을 통한 파장 가변 레이저 개발)

  • In this paper, we have developed wavelength swept laser system for the swept source optical coherence tomography(SS-OCT). A laser is constructed by using the two SOAs parallel configuration, fiber Fabry-Perot tunable filter(FFP-TF). The wavelength sweeps are repetitively generated with the repetition period of 50Hz. The wavelength tuning range of the laser is more than FWHM of 80nm centered at the wavelength of 1310nm and the line-width of the source is 0.12 nm.
